Abstract

The sale and purchase of land represent a legally binding relationship as stipulated in Article 1233 of the Indonesian Civil Code, formed through mutual agreement between the seller and the buyer. Despite the existence of clear legal provisions, informal or underhanded land sale practices remain prevalent, particularly in rural regions. These unregistered transactions often lead to complications in the transfer of land ownership, especially when the original landowner is no longer traceable. This study aims to explore the legal mechanisms for transferring land ownership certificates to buyers acting in good faith and to assess the legal protection available in the absence of registered land sale agreements. The research employs a normative juridical method, grounded in legal theories from Satjipto Rahardjo on legal protection and Subekti on agreements. The study analyzes secondary data through statutory, case, and conceptual approaches, supported by legal document identification and inventory techniques. The findings indicate that buyers in good faith must pursue court rulings to validate ownership rights when faced with informal land transactions. Such rulings serve as a legal basis to register the land transfer at the local Land Office. This approach upholds the principle of legal certainty and provides protective mechanisms for individuals affected by non-notarial land transactions, encouraging future land dealings to adhere to formal registration processes to protect ownership rights.

Abstract

A lease agreement executed in the form of a notarial deed, as regulated under Article 1548 of the Indonesian Civil Code, may be rescinded due to default as stipulated in Article 1243 of the Civil Code, with legal consequences pursuant to Articles 1266 and 1267 thereof, which in principle require formal recognition through a court decision. The issues examined in this study concern the legal consequences of the annulment of a deed by the court in relation to default committed by the lessee, and the legal certainty of such judicial annulment arising from the lessee’s default. The theoretical framework applied in this research consists of the theory of legal certainty as formulated by Jan Michiel Otto and the theory of legal consequences as developed by Soeroso. The research method used is normative juridical research, namely legal research based on library materials or secondary data, consisting of primary, secondary, and tertiary legal materials. The research approaches employed include the statutory approach, case approach, analytical approach, and conceptual approach. The collection of legal materials is carried out by identifying and inventorying positive legal norms, book literature, journals, and other legal sources. The analysis of legal materials is conducted through legal interpretation, namely grammatical interpretation and systematic interpretation, as well as methods of legal construction, including analogical construction and legal refinement. The findings of this research showed that the judicial annulment of a lease agreement due to the lessee’s default not only terminates the contractual relationship, but also gives rise to new legal consequences in the form of changes in the legal status of the parties, the affirmation of post-contractual rights and obligations, and the imposition of enforceable civil sanctions, such that legal certainty is genuinely achieved when the provisions of the Civil Code are applied consistently and judicial decisions are implemented concretely in accordance with the concept of realistic legal certainty

Abstract

PPJB is made as a preliminary agreement made by the seller and buyer in the sale and purchase of land rights because there are conditions that have not been fulfilled by one of the parties, so the sale and purchase before the PPAT cannot be carried out, so the prospective buyer seller first makes a PPJB before a Notary as a Public Official. The problem formulations in this research are: 1) What is the legal effect of the Sale and Purchase Binding Agreement on land acquired by the buyer and resold by the developer?; 2). How is the legal protection of the buyer of the land based on the Sale and Purchase Binding Agreement (PPJB) of the land that has been paid in full and resold by the developer? By using the theory of legal protection according to Satjipto Rahardjo and the theory of legal consequences according to R. Soeroso, it can be concluded that the legal consequences of the Sale and Purchase Binding Agreement on the land obtained by the buyer and resold by the developer are very detrimental to the buyer who has done the PPJB before, and as promised can be said to have broken the promise (default) as stipulated in Article 1238 of the Civil Code.2) The legal protection obtained by the parties in terms of the transfer of land rights in the sale and purchase binding agreement is very strong because the proof of the sale and purchase binding agreement is made before an authorized public official in this case is a Notary, by signing the deed in front of a Notary or PPAT and then explaining its contents to the parties who make a sale and purchase binding agreement then signing before a Notary, the deed has valid and strong evidence as other authentic deeds.

Abstract

Pejabat Pembuat Akta Tanah memiliki kewenangan untuk membuat akta hibah sebagai dasar peralihan hak atas tanah yang sah. Namun, dalam praktiknya, pembuatan akta hibah harus memperhatikan asas kehati-hatian, khususnya terkait perlindungan hak mutlak ahli waris sebagaimana dikenal dalam konsep legitieme portie. Penelitian ini bertujuan untuk menganalisis akibat hukum akta hibah yang melanggar legitieme portie serta bentuk perlindungan hukum bagi ahli waris yang dirugikan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, kasus, konseptual, dan analitis. Data diperoleh melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier, kemudian dianalisis menggunakan penafsiran hukum secara gramatikal dan sistematis serta metode konstruksi hukum. Hasil penelitian menunjukkan bahwa akta hibah tanah yang dibuat oleh Pejabat Pembuat Akta Tanah yang melanggar ketentuan legitieme portie sebagaimana diatur dalam Pasal 913 KUHPerdata berpotensi menimbulkan sengketa antar ahli waris. Abstract

A Deed of Sale and Purchase is an authentic deed drawn up by a Land Deed Making Official (Pejabat Pembuat Akta Tanah – PPAT) and serves as a legal product required as evidence of the transfer of land rights. The provisions regarding Temporary PPATs are regulated in Government Regulation No. 24 of 2016 and Regulation of the Head of the National Land Agency No. 23 of 2009. According to Article 5 paragraph (3) of Government Regulation No. 24 of 2016, in order to serve the community in the preparation of PPAT deeds in areas where there are insufficient PPATs, or to serve specific community groups in the preparation of certain PPAT deeds, the Minister may appoint a Sub-District Head (Camat) or a Village Head (Kepala Desa) to provide deed-making services in areas lacking adequate PPATs. The method used in this research is juridical-normative, namely library-based legal research utilizing primary, secondary, and tertiary legal sources. The research approaches employed include the statutory approach, case approach, analytical approach, and conceptual approach. Legal materials were collected by identifying and reviewing book literature, journals, and other sources of legal materials. Legal material analysis was conducted using: 1) grammatical interpretation, 2) systematic interpretation, and legal construction methods, with data analyzed qualitatively.

Abstract

This study analyzes the legal consequences of a Deed of Sale and Purchase arising from the seller’s bad faith and the legal protection afforded to buyers in land rights transfers. It employs normative juridical research using statutory, case, and analytical approaches, supported by primary, secondary, and tertiary legal materials. The analysis examines the Civil Code, the Basic Agrarian Law, Government Regulation Number 24 of 1997, Supreme Court Circular Letter Number 4 of 2016, and three sets of court decisions. The findings show that a seller’s bad faith does not automatically invalidate a Deed of Sale and Purchase. Its legal consequences depend on whether such conduct affects the validity requirements of the agreement; violations of subjective requirements may render the agreement voidable, while violations of objective requirements may make it null and void. Where the sale is proven valid, the buyer’s rights remain protected. Protection is reinforced through registration, counterclaims, recognition of ownership, confirmation of transfer validity, eviction, and compensation. Evidence remains decisive in assessing authority, payment, documentation, registration, and conduct.
