Abstract

Pre-trial has been set in the Criminal Procedure Code reap a lot of criticism from legal practitioners. In practice, it turns out pre-trial failed to give justice to those seeking justice in particular suspects in criminal proceedings. Government and Parliament have made a Draft Law on the Code of Criminal Procedure (Draft Criminal Code) which one to replace it with a Justice Pre Preliminary Examining Judge. The main problem in implementing this research include: What is the reason for that is the basis for the reconstruction policy settings Preliminary Examining Judge in Criminal Procedure Bill 2015. Results of this study are: the reason on which to base the reconstruction policy settings Preliminary Examining Judge is to better protect human rights guarantees in particular for seeking justice in the criminal justice process.

Abstract

This writing is oriented to find out how the legal aspects of evidence on cybercrime in the national criminal law system and law enforcement policies against cybercrime. The method uses is normatif legal research. Based on the results of the study it can be seen that the legal aspects of proving cybercrime have been strictly regulated in several laws and regulations in positive law in Indonesia. Provisions regarding Cybercrime are also regulated in international regulations without reducing the opportunity for each individual to continue to develop creativity in developing information technology. Law enforcement policies against cybercrime are carried out with a penal and non-penal approach. Seen from the point of view of criminal policy, efforts to overcome cybercrime certainly cannot be done partially with criminal law (penal), but must also be taken with an integral/systemic approach as well as a preventive approach (non-penal). Abstract

Pada dasarnya keberadaan Dewan Perwakilan Daerah melalui amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dilatarbelakangi akan adanya faktor demokratisasi dan upaya mengakomodasi daerah dalam pengambilan kebijakan nasional, secara teoritis keberadaan Dewan Perewakilan Daerah dimasudkan untuk menerapkan prinsip cheks and balances antar lembaga negara, yaitu adanya proses saling mengawasi dan mengimbangi antar lembaga Negara. Hal tersebut dilakukan untuk memperkuat hubungan pusat dan daerah demi menjaga keutuhan dan kesatuan Negara kesatuan republik Indonesia. Bila ditinjau dari perubahan sistem ketatanegaraan NKRI setelah reformasi 1998, kemunculan Dewan Perwakilan Daerah sebagai lembaga tinggi negara, pada hakikatnya merupakan respons atas penolakan sistem pemerintahan otoritarian-oligarkhis-sentralistik yang dilaksanakan oleh rezim orde baru. Oleh sebab itu secara sistemik keberadaan DPD ini tidak mungkin dapat dilepaskan  dari perjalanan panjang yang terjadi dalam perdebatan Perubahan UUD 1945 dalam rangka mewujudkan sistem pemerintahan yang demokratis-desentralistik sebagai tuntutan utama gerakan reformasi 1998. Ditinjau dari perjalanan demokrasi DPD dimaksudkan untuk mendorong percepatan demokrasi, pembangunan dan kemajuan daerah-daerah secara serasi dan seimbang untuk mewujudkan kesejahteraan rakyat. Sementara dasar pertimbangan teoritis dibentuknya DPD antara lain adalah untuk membangun mekanisme kontrol dan keseimbangan (check and balances) antar cabang kekuasaan negara danantar lembaga legislatif sendiri

Abstract

The problem in this study is how the implementation of the conception of Crime Prevention Through Social Development (CPTSD) by Bhabinkamtibmas in combating criminal acts of terrorism and why there are obstacles to the implementation of the conception of CPTSD by Bhabinkamtibmas in combating criminal acts of terrorism. The research method specifically uses this type of qualitative research with a normative juridical approach to the problem and an empirical approach. The types of data used are primary data and secondary data. Primary data were obtained from interviews with resource persons and secondary data from literature studies. The results of the study indicate that the CPTSD model policy by Bhabinkamtibmas in overcoming criminal acts of terrorism is carried out through preventive, preemptive, and repressive efforts. Preventive efforts are supervision of chemicals that can be processed into explosives. Preemptive efforts are holding tabligh akbar and re-instilling Pancasila values ​​in society. The repressive effort is the establishment of the Anti-Terror Task Force. The obstacle in implementing the CPTSD model policy by Bhabinkamtibmas in overcoming criminal acts of terrorism is that Bhabinkamtibmas still lacks resources both in terms of quantity of members and in the field of facilities and infrastructure which includes the number of vehicles and task tools used to carry out Anjau Glare and binluh to the community. The Binmas Pioneer program through the CPTSD by Bhabinkamtibmas has not yet reached the target, so it has not been maximal in raising public awareness and preventing crime.

Abstract

Examination of corruption cases in the absence of the defendant at trial still has many obstacles. The elucidation of Law Number 31 of 1999 as amended in Law Number 20 of 2001 concerning eradicating criminal acts of corruption, especially in Article 38, provides an opening for the judiciary in absentia as an orientation to save state assets. What is the importance of the judiciary in absentia as an effort to recover assets, how is the implementation of justice in absentia to recover assets? What is the basis for the judges' legal considerations on the implementation of the trial? Then this study uses a normative research method with a normative juridical approach, while this type of research is descriptive. Based on the discussion in the study that the importance of the in absentia judiciary as an effort to recover assets carried out by the defendant legally and appropriately summoned to eradicate the crime of corruption and recover state losses can still be implemented, the assets and all assets of the defendant based on the verdict are proven to be related to corruption. A criminal act of corruption can then be executed. The implementation of the judiciary in absentia is an effort to recover assets through a legal process by taking into account the defendant's rights. The judiciary without the presence of the defendant is guided by Law Number 31 of 1999 as amended in Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in Article 38 paragraph (1). The basis for the Judge's legal considerations regarding the trial examination in the defendant's absence is to ensure legal certainty so that the prosecutor as the executor can save the country's assets with considerations of exceptionality, return, and rescue of state assets.

Abstract

Lampung Province is a province located at the tip of the island of Sumatra which is the gateway between the islands of Java and Sumatra. Lampung is a province that has a variety of tourist destinations, especially coastal and island tourism which has beautiful panoramas and a wide variety of interesting marine habitats for tourists to visit, both local, national and international. One of the island's tourist destinations that is interesting and has good potential, namely the tourist village on Pahawang Island, apart from offering beautiful beaches and interesting marine habitats to visit, the people of Pahawang Tourism Village have potential in the field of MSME Business, especially PKK women and Karang Taruna youth like making Dodol. For this reason, it is hoped that the participation of universities to provide a legal basis for MSMEs is contained in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises (UU.UMKM).

Abstract

Abstrak Vonis yang dijatuhkan berdasarkan dalam Perkara Nomor : 299/Pid.B/2017/PN.Tjk menjadi kajian penting karena berhubungan erat dengan asas legalitas dan kepastian hukum yang diwujudkan dalam penegakan hukum. Permasalahan dalam penelitian ini meliputi: a. Bagaimana pertimbangan Hakim Pengadilan Negeri terhadap pelaku tindak pidana perzinahan dalam Perkara Nomor :299/Pid.B/2017/PN.Tjk, b. Apa yang menjadi dasar pertimbangan Hakim judex factie terhadap putusan bebas pelaku tindak pidana perzinahan dalam Perkara Nomor: 89/Pid /2017/PT.Tjk. Pendekatan masalah yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dan yuridis empiris. Data dalam penelitian ini bersumber dari data kepustakaan (library research) dan data lapangan (field research). Hasil pembahasan menunjukkan bahwa pertimbangan Hakim Pengadilan Negeri terhadap pelaku tindak pidana perzinahan dalam Perkara Nomor :299/Pid.B/2017/PN.Tjk adalah dakwaan jaksa keterangan terdakwa, keterangan saksi, barang bukti, hal-hal yang meringankan dan memberatkan. Pertimbangan Pasal 182 ayat (6) KUHAP. Unsur materiil ketentuan Pasal 284 ayat (1) ke-2 a KUHP, serta teori pemidanaan. Dasar pertimbangan Hakim judex factie terhadap putusan bebas pelaku tindak pidana perzinahan dalam Perkara Nomor: 89/Pid /2017/PT.Tjk yakni Hakim tingkat pertama yang memutus perkara a quo dengan menggunakan Pasal yang tidak sesuai dengan Surat dakwaan tunggal yang diajukan oleh Jaksa Penuntut Umum, telah tidak cermat dan keliru dalam mengutip Pasal yang dijadikan dasar pemutusan perkara ini yaitu Pasal Pasal 284 ayat (2) huruf a KUHP, karena tidak ada Pasal 284 ayat (2) huruf a KUHP tetapi yang ada adalah Pasal 284 ayat (2) KUHP saja yang mengatur tentang delik aduan dan tenggang waktu pengaduan dalam pasal ini, sedangkan yang dimaksud oleh Hakim tingkat pertama adalah Pasal 284 ayat (1) ke-2 a KUHP, pertimbangan Hakim cenderung tidak menjatuhkan pidana maksimum sesuai Pasal 182 ayat (6) KUHAP serta pertimbangan dalam kepastian hukum, kemanfaatan dan keadilan hukum. Kata Kunci:         Pertimbangan Hakim, Judex Factie, Putusan Bebas, Perzinahan

Abstract

Abstrak Upaya penegakan hukum dalam tindak pidana korupsi salah satunya adalah dengan melakukan kegiatan pengawal dan pengaman pemerintah dan pembangunan daerah tentang aksi pencegahan dan pemberantasan korupsi di wilayah hukum Kejaksaan Tinggi Lampung. Permasalahan dalam penelitian ini meliputi: a. Bagaimana eksistensi tim pengawal dan pengaman pemerintah dan pembangunan daerah, b. Apa hambatan tim pengawal dan pengaman pemerintah dan pembangunan daerah dalam pencegahan dan pemberantasan korupsi. eksistensi tim pengawal dan pengaman pemerintah dan pembangunan daerah yakni mengawal, mengamankan dan mendukung keberhasilan jalannya pemerintahan dan pembangunan melalui upaya-upaya pencegahan/ preventif dan persuasif, memberikan penerangan hukum dilingkungan Instansi pemerintah, BUMN, BUMD dan pihak terkait materi tentang perencanaan, pelelangan, pelaksanaan pekerjaan, perijinan, pengadaan barang dan jasa, tertib administrasi dan tertib pengelolaan keuangan Negara, memberikan pendampingan hukum dalam setiap tahapan program pembangunan dari awal sampai akhir, melakukan koordinasi dengan aparat pengawasan intern pemerintah untuk mencegah terjadinya penyimpangan yang berpotensi menghambat, menggagalkan dan menimbulkan kerugian bagi keuangan Negara. Hambatan tim pengawal dan pengaman pemerintah dan pembangunan daerah yaitu ketidaktahuan pemahaman tentang TP4D di lingkungan birokrat Pemerintah Daerah Lampung Utara sehingga menimbulakan keragu-raguan dalam pelaksanaan pemabngunan daerah dan khawatir akan adanya TP4D sehingga lebih banyak menutup informasi. Kata Kunci:         Eksistensi, Tim Pengawal, Pengaman, Pemerintah, Pembangunan, Korupsi

Abstract

Currently, the rate of narcotics crime cases among students has increased every year. Because there are many new methods used by narcotics traffickers to sell and distribute illegal drugs to teenagers and students. Starting from inviting and teaching students who are originally users to participate in selling these illegal drugs in the student environment and creating a sales network for narcotics and illegal drugs between students and also even creating WhatsApp groups and other social media that are used for transactions of these illicit goods. . There have been many efforts and actions taken by the police and the National Narcotics Agency (BNN) to follow up and deal with this matter, starting from preventive or prevention efforts and repressive efforts or actions in accordance with applicable legal regulations. Prevention or prevention efforts have been carried out through outreach efforts about the dangers of narcotics and illegal drugs to students in the school environment and the community. And repressive efforts were carried out by taking firm legal action through arresting narcotics dealers and raids at entertainment venues and in fact there were several minors or students of student age who were caught carrying narcotics and illegal drugs. The problem in this research is what are the efforts of law enforcement officials in tackling criminal acts of narcotics and illegal drug abuse among students, and what are the inhibiting factors in tackling narcotics crimes among these students. It is hoped that this research can become reference material and literature in following up and tackling criminal acts of narcotics trafficking among students in Bandar Lampung which is increasingly worrying.
