Abstract

The principle of freedom of contract is a principle that gives freedom to the parties to: (1) make or not make an agreement; (2) entering into agreements with anyone; (3) determine the contents of the agreement, implementation, and terms; and (4) determine the form of an agreement that is written or oral. The purpose of this study is to find out whether the work agreement between directors and employees at the Hospital of Menggala based on the principle of freedom of contract is in accordance with Article 1320 of the Civil Code, knowing the inhibiting factors in the implementation of the principle of freedom contracting to an employment agreement at the District Hospital ofalaala, and the efforts made in overcoming any obstacles that occur in the implementation of the principle of freedom of contracting with an employment contract at the District Hospital.The results of the analysis carried out that the work agreement of the Cooperative Hospital meets the principle of freedom of contract. The principle of freedom of contract is a principle that gives freedom to the parties to make or not make an agreement, enter into an agreement with anyone, determine the contents of the agreement, its implementation, requirements, determine the form of the agreement, written or oral, in making the work agreement of both the Directors and workers there is no influence or pressure from the other party, both parties give freedom to the other party to express their opinions or proposals regarding the agreement material, then the work agreement of the Shepala Regional Hospital is in accordance with the principle of freedom of contract as contained in Article 1320 of the Civil Code. In carrying out the principle of freedom of contract beer to work agreements the Cooperative Hospital experienced obstacles. Constraints faced include: (1) the absence of trade unions in fighting for workers' rights (2) Low Worker Resources. The efforts of the Penggala District Hospital in facing obstacles in implementing the principle of freedom of contract to work agreements are immediately possible to form trade unions that can bridge workers and hospital directors and hold various trainings to improve the professionalism and abilities of their employees.

Abstract

Currently Child Trafficking in Bandar Lampung has become a problem that needs to be taken seriously, marked by the increasing number of cases that have arisen, particularly child trafficking through sexual exploitation, with a different modus operandi of crime. There are various forms of modus operandi that are used by actors in carrying out their actions, ranging from persuasion, fraud, or threats with violence. From this description, I am interested in researching about, What is the modus operandi of child trafficking in Bandar Lampung, how is the handling of child trafficking in Bandar Lampung? What are the barriers to handling child trafficking in Bandar Lampung? The research method used is normative legal research law that uses literature or empirical material that is sourced from interviews with several sources. The results showed that the form of modus operandi for cases of trafficking in persons / children in Bandar Lampung, namely Fraud by Fraud Employees Against Child Labor, Child Labor Similar to Modern Slavery, Prostitution Crimes through Social Media, Child Trafficking through Illegal Adoption, Kidnapping of Children Suspected By Organ Trafficking Syndicate. Furthermore, the number of cases in the city of Bandar Lampung increased in number from year to year, therefore the need for response to these cases. Crime prevention consists of three main parts, namely Pre-Emictive, Non-Penal Efforts that are Preventive, Penal Efforts that are Repressive. Then the Barriers to the Elimination of the Criminal Act of Child Trafficking in the City of Bandar Lampung, namely the legal substance aspects, legal structure aspects.

Abstract

The problem in this study is how the implementation of the conception of Crime Prevention Through Social Development (CPTSD) by Bhabinkamtibmas in combating criminal acts of terrorism and why there are obstacles to the implementation of the conception of CPTSD by Bhabinkamtibmas in combating criminal acts of terrorism. The research method specifically uses this type of qualitative research with a normative juridical approach to the problem and an empirical approach. The types of data used are primary data and secondary data. Primary data were obtained from interviews with resource persons and secondary data from literature studies. The results of the study indicate that the CPTSD model policy by Bhabinkamtibmas in overcoming criminal acts of terrorism is carried out through preventive, preemptive, and repressive efforts. Preventive efforts are supervision of chemicals that can be processed into explosives. Preemptive efforts are holding tabligh akbar and re-instilling Pancasila values ​​in society. The repressive effort is the establishment of the Anti-Terror Task Force. The obstacle in implementing the CPTSD model policy by Bhabinkamtibmas in overcoming criminal acts of terrorism is that Bhabinkamtibmas still lacks resources both in terms of quantity of members and in the field of facilities and infrastructure which includes the number of vehicles and task tools used to carry out Anjau Glare and binluh to the community. The Binmas Pioneer program through the CPTSD by Bhabinkamtibmas has not yet reached the target, so it has not been maximal in raising public awareness and preventing crime.

Abstract

Fasilitas antar jemput dan pembelian makanan kini dibantu melalui pemesanan pada smartphone oleh konsumen. Penelitian ini difokuskan terhadap perjanjian pemesanan makanan melalui ojek online yang dinamai go-food. Terdapat beberapa konsumen yang mengeluhkan kerugian yang dialami terhadap perjanjian yang dilakukan pada pembelian pengantaran makanan melalui go-food. Melalui penelitian yuridis normatif ini, diketahui bahwa adanya kerugian yang dialami oleh salah satu konsumen driver go-food membuktikan bahwa perjanjian yang dilakukan tidak memenuhi unsur hak dan kewajiban, bertentangan dengan Pasal 4 UU No. 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

The need for clean water is increasing with the rapid population growth, however.Its availability has decreased due to environmental destruction or pollution, one of which is rivers.Damage or pollution to rivers is caused by domestic, industrial and agricultural activities.Damage or pollution to rivers will have a negative impact on health and cause imbalance in the river ecosystem.The problems raised are why administrative sanctions are used as an instrument in controlling river destruction in Tulang Bawang Regency, and what are the legal consequences of administrative sanctions on perpetrators of river destruction in Tulang Bawang Regency.The problem approach in this study is a normative approach, this study uses quantitative dataanalysis. The results of the research and discussion show that administrative sanctions are an instrument in river pollution due to restoration of conditions, repair of damage, or in other words aimed at actions committed by business actors or activities that pollute rivers, and are one of the efforts to enforce laws against activities related to licensing requirements, environmental quality standards, environmental management plans and so on through administrative sanctions, as well as enforcement of administrative sanctions aiming at actions that violate the law or do not meet the permitted requirements to stop or return to their original state,namely before the occurrence of pollution or destruction.to.Local government policies that do not take sides with the environment have in the occurrence of various natural disasters or events that continue to occur invariousregions, especially in Bawang BawangRegency.Keywords: Administrative Sanctions, Perpetrators, River Destruction.

Abstract

Pelaksanaan perjanjian jual beli sering terjadi suatu permasalahan, salah satu permasalahan yang sering terjadi yaitu perjanjian jual beli dalam keluarga. Perjanjian jual beli dalam keluarga sangat jarang terjadi, karena biasanya dalam keluarga yang terjadi adalah hibah. Putusan hakim Nomor : 104/Pdt.G/2019/PN.Tjk terjadi proses jual beli harta warisan dalam keluarga dan terdapat suatu permasalahan pada penelitian ini yaitu bagaimana kedudukan hukum jual beli dalam keluarga terhadap harta warisan menurut hukum perdata di Indonesia, bagaimana dasar pertimbangan hakim dalam perkara Nomor : 104/Pdt.G/2019/PN.Tjk, dan apa akibat hukum dari putusan Nomor : 104/Pdt.G/2019/PN.Tjk bagi para pihak dan objek sengketa. Kedudukan hukum jual dalam kelurga terhadap harta warisan ini secara hukum perdata sah karena telah memenuhi syarat-syarat sah jual beli pasal 1320 KUHPerdata, adapun jual beli dalam keluarga yang tidak diperbolehkan oleh perdata yaitu jual beli antara suami dan istri, kecuali dalam 3 hal yang terdapat dalam pasal 1467 KUHPerdata. Dalam pertimbangan hakim, hakim mengabulkan eksepsi tergugat yang pada pokoknya gugatan penggugat cacat formil, tidak jelas dasar hukum atau dasar peristiwa gugatan pada posita gugatan serta ketidaksesuaian antara posita dan petitum, sehingga gugatan tidak dapat diterima. Mengenai akibat hukum, Secara yuridis, putusan tersebut memenangkan pihak tergugat, karena gugatan penggugat cacat formil. Dari hasil putusan Nomor 104/Pdt.G/2019/PN.Tjk ini penggugat kalah dan tergugat menguasai objek dalam perkara ini. akibat hukum yang timbul terhadap objek sengketa akibat putusan Nomor 104/Pdt.G/2019/PN.Tjk ini ialah objek tersebut dikuasai oleh pihak tergugat. Akibat putusan NO (Niet Onvankelijk Verklaard) penggugat bisa mengajukan ulang gugatan dengan gugatan baru dan tidak Ne Bis In Idem.

Abstract

ABSTRAK Penyalahgunaan atau dampak negatif dari kemajuan teknologi informasi melalui sistem komputerisasi dan jaringan internet dikenal dengan istilah  Cybercrime atau kejahatan siber. Salah satu perbuatan tindak pidana siber yang sering terjadi di dalam masyarakat kita saat ini adalah kejahatan di bidang kesusilaan yaitu kejahatan pornografi siber  (cyberpornography). Cyber Pornography sendiri barangkali dapat diartikan sebagai penyebaran muatan pornografi melalui internet Persebaran tindak pidana pornografi siber yang marak terjadi saat ini banyak dilakukan melalui internet, khususnya menggunakan media sosial. Abstract

Pembaharuan dan perkembangan hukum perdata timbul sebab hukum bersifat dinamis, hal ini juga dipengaruhi juga oleh adanya ilmu filsafat hukum yang berusaha mencari kebenaran secara metodis, sistematis, rasional, dan radikal melampaui kebenaran dan pertanggungjawaban yang semata-mata empiris. Permasalahan dalam penulisan ini adalah bagaimana peranan filsafat hukum dalam pembaharuan hukum keperdataan, Penelitian ini menggunakan pendekatan metode penulisan yuridis normatif. Analisis data dilakukan dengan analisis kualitatif. Filsafat hukum lebih menitik beratkan pada substansi atau materi hukum, hukum harus dibentuk sesuai dengan prosedur atau memenuhi tuntutan formal tertentu agar diakui sebagai hukum (legitimasi yuridis). Akan tetapi, pemenuhan aspek formal-prosedural saja tidaklah mencukupi. Masih diperlukan tuntutan lain supaya hukum pantas disebut hukum, yakni aspek substansinya atau isi, yang menjamin agar hukum perdata tidak boleh bertentangan dengan tuntutan keadilan.

Abstract

Penelitian ini di dalamnya mengkaji serta menjawab permasalahan tentang akta partij di hadapan notaris dan kepastian dari hukum partij akta yang dilaksanakan ataupun dinyatakan di depan notaris. Penelitian juga masuk pada kelompok penelitian yuridis empiris yang bersifat normatif. Bahan yang telah diperoleh melalui penelitian pada kantor Notaris Cindy Larasaty, S.H., M.Kn. dan pembahasan yang sudah dilakukan adalah partij akta menurut Undang-Undang No 2 Tahun 2014 merupakan akta pihak-pihak yang dilaksanakan di depan notaris untuk kemudia di autentikan dengan tandatangan notaris. Perbedaan partij akta dan akta yang tidak resmi merupakan proses pembuatannya, partij akta di nyatakan serta dilaksanakan di depan  notaris kemudian diparaf dengan notaris sedangkan akta di bawah tangan cuma atas kedua pihak, sifat-sifat yang memenuhi unsur akta partij merupakan : akta musti dilaksanakan dari pihak-pihak langsung di depan notaris, akta musti dilaksanakan bertara kepada bentuk yang dimuat oleh Undang-undang, akta yang dilaksanakan terhadap ataupun didepan pejabat publik yang berkompeten dalam kausa itu serta tempat akta tersebut dilaksanakan.  memenuhi bagian-bagian pada Pasal 1320 KUHPerdata. Notaris pun harus memasukan akta yang dibuat ke dalam buku besar notaris kemudian nantinya akan dievaluasi setiap tahunnya. Untuk dipastikan kebenarannya,  notaris harus menjaga kerahasiaan dari pihak-pihak yang menghadap. Hal yang sering dilanggar baik oleh para pihak maupun notaris seperti notaris yang kurang teliti, notaris mendokumentasikan akta kemudian disebar dimedia sosial, kurangnya pemahaman bahasa asing. Sedangkan dari para pihak klien pihak- pihaknya tidak datang bersamaan, para pihak tidak memahami dampak dari kesepakatan. Solusi yang dapat diberikan kepada notaris yaitu dengan cara lebih memfokuskan pada syarat pembuktian formil akta.

Abstract

The curator must be independent and not have a conflict of interest because the curator has such great authority over bankruptcy assets. The research used in this research is normative legal research. This is because researchers use library materials as data to analyze cases in the preparation of this study. provisions regarding the principle of independence are emphasized in the Code of Ethics of the Indonesian Curator and Administrator Association (AKPI) which states that in every appointment received, members of the Indonesian Curator and Administrator Association (hereinafter referred to as "members") must be independent and free from anyone's influence. Independence in bankruptcy law can be interpreted that the curator may not and cannot be intervened by anything, either by debtors, creditors, or other individuals within the bankruptcy institution or outside the bankruptcy institution. Independent also reflects the integrity of a curator which contains values including having a noble character, being trustworthy in carrying out his position, being able to act wisely and prudently in dealing with a plural reality between the interests of debtors and creditors, being consistent between his words and the responsibilities he carries, obeying the values and Norms, both written and unwritten, and no less important, are always oriented to the best interests of the bankruptcy estate.
