Abstract

Tulisan ini mengkaji tentang konsep warga negara serta hak dan kewajiban warga negara non muslim di negara Islam menurut Al-Maududi. Tujuan dari artikiel ini adalah untuk mengetahui dan menjelaskan pandangan Al-Maududi tentang konsep warga negara serta hak dan kewajiban warga negara non muslim di negara-negara Islam.Permasalahan yang dibahas dalam artikel ini adalah  bagaimana pandangan tokoh Islam Al Maududi terhadap suatu negara Islam yang terdiri dari masyarakat yang yang berbeda dari segi agama?, bagaimana posisi hak dan kewajiban dalam bernegara?. Metode yang digunakan adalah metode kualitatif dengan pendekatan penelitian kepustakaan (library research), dengan temuan bahwa dalam Negara Islam menurut Al Maududi tidak adanya diskriminasi terhadap non muslim yang berada di Negara Islam, baik itu berupa perlindungan terhadap hidupnya, hartanya,dan kehormatannya, perlindungan terhadap kebebasan pribadi, kebebasan menyatakan pendapat dan berkeyakinan, serta terjamin kebutuhan pokok hidupnya dan hak-hak lainnya.

Abstract

Studi ini mengkaji tentang efektivitas sidang keliling dalam menangani perkara itsbat nikah di Pengadilan Agama Sawahlunto Kelas II. Permasalahan pada skripsi ini adalah bagaimana pelaksanaan sidang keliling itsbat nikah di Pengadilan Agama Sawahlunto Kelas II dan bagaimana efektivitas pelaksanaan sidang keliling itsbat nikahdi Pengadilan Agama Sawahlunto Kelas II. Penelitian ini merupakan penelitian lapangan (field research), data diperoleh melalui wawancara dan dokumentas. Setelah data terkumkumpul diolah dengan cara deskriptif kualitatif dan kemudian diuraikan serta melakukan klasifikasi terhadap aspek masalah tertentu dan memaparkan melalui kalimat efektif. Penelitian ini menemukan hasil sidang keliling itsbat nikah di Pengadilan Agama Sawahlunto Kelas II meliputi tiga hal yaitu; sosialisasi pelaksanaan sidang keliling itsbat nikah, proses pelaksanaan sidang keliling itsbat nikah dan realisasi anggaran dana. Sedangkan efektivitas pelaksanaan sidang keliling itsbat nikah di Pengadilan Agama Sawahlunto Kelas II, dilihat dari standar efektivitas sudah terlaksana dengan baik pada tiga hal, yaitu: efektifitas sosialisasi sidang keliling itsbat nikah, efektifitas proses pelaksanaan sidang keliling itsbat nikah dan efektivitas anggaran dana.

Abstract

This paper aims to reveal and explain Al-Mawardi's legal thoughts about the form of the State and the formation of the State. This type of research is library research with a qualitative approach. The technique of collecting materials used is to find and record materials that are relevant to the problem under study. this study finds that, in the concept of Negara al-Mawardi, the position of religion is very important. Al-Mawardi argues that religion and the state need each other so as not to become a secular state. With the state, religion can develop, because the state and religion have a reciprocal relationship. Religion needs the State as a means of preserving religion and developing religion, and vice versa, the State also needs religion, because religion also helps the State in fostering the moral and spiritual ethics of its citizens. On the other hand, the State needs religion, because with religion the State can develop in ethical and moral development. The form of the state according to Al-Mawardi is the caliphate. Al-Mawardi lived in the caliphate government system that was in effect at that time. This can be seen from the appointment of a caliph or imam, the criteria or conditions for becoming a caliph, and the procedure for selecting it. Al-Mawardi argues that the state is formed because of the weakness of the people who cannot meet their own needs, therefore a state is needed. According to Al-Mawardi, the formation of the state must fulfill six points, namely guiding religion as self-control, having an authoritative ruler who will bring change and achieve its goals, justice for oneself and others, universal security in order to achieve good development, and good soil fertility. Sustainability can support the economy, finally the hope of survival, because the progress of a country is also seen through the dimensions of human development. If one of the elements of the formation of the state is not fulfilled then it cannot achieve its objectives.

Abstract

This study discusses the review of Islamic Constitutional Law on presidential government systems in Indonesia. This type of research is library research in which materials are collected through books, laws and journals related to research. The method used is a normative legal research method. Theories used are power theory, authority theory, trias politica theory and tanfidziyyah sulthah theory. From the results of the research conducted by the author, it can be concluded that based on the Indonesian constitution namely the 1945 Constitution in Article 4 paragraph (1) the power of the President includes executive, legislative and judicial powers. In a presidential government system the President is not only the head of state but also the head of government. Based on the Sulfah tanfidziyyah review of the power of the head of state in the presidential system in Indonesia, namely the power of the head of state in the presidential government system does not conflict with Islamic governance and Islamic law because in the Fiqh Siyasah Dusturiyah or the Khalifah Islamic State Constitutional Law covers all power, both as head of state, head of state government, legislature, judiciary and head of religion. It's just that presidential power in the Presidential system does not include as head of religion.

Abstract

The purpose of this study was to explain the comparison of financing processes, asset acquisition, and transfer of home ownership financing with Musyarakah Mutanaqisah and Ijarah muntahiyah Bitamlik. The research object was at Bank Muamalat Indonesia, Solok Branch Office and at Bank Rakyat Indonesia Syariah Padang Branch. The type of research used is qualitative comparative research. The data collection technique used is through interviews and documentation. Data processing is done by qualitative comparative analysis techniques. The results of the study are: First, the process of financing home ownership with musyarakah mutanaqisah is longer than ijarah muntahiyah bitamlik. Second, the procurement of assets with musyrakah mutanaqisah is clearer than ijarah muntahiyah bitamlik. Third, the transfer of ownership in the financing of home ownership with Musyarakah Mutanaqisah process is certain, while the transfer of home ownership with Ijarah Muntahiyah Bitamlik the process is uncertain. Fourth, financing using the Musharaka Mutanaqisah agreement is superior to the Ijarah muntahiya bitamlik both in terms of procurement, certainty of ownership transfer and in terms of legality to collateral. Although in terms of the process it is faster on Ijarah Muntahiya Bittamlik.

Abstract

Studi ini mengkaji tentang Implementasi akad Murabahah bil Wakalah di PT. Bank Syariah Indonesia KCP Bukittinggi tinjauan fatwa DSN MUI No: 10/DSN-MUI/IV/2000 dan PBI Nomor 7/46/PBI/2005. Permasalahannya adalah praktek akad Murabahah bil Wakalah di PT. Bank Syariah Indonesia KCP Bukittinggi melakukan akad Murabahah bil Wakalah secara bersamaan. Penelitian ini bertujuan melihat Implementasi akad Murabahah bil Wakalah di PT. Bank Syariah Indonesia KCP Bukittinggi tinjauan fatwa DSN MUI No: 10/DSN-MUI/IV/2000 dan PBI Nomor 07/46/PBI/2005. Penelitian ini menggunakan data primer maupun data sekunder. Metode analisis yang digunakan adalah metode deskriptif. Berdasarkan hasil survey yang diberikan Jadid Ardiansyah dan karyawan menunjukkan bahwa pelaksanaan akad keuangan, Murabahah bil Wakalah apabila permohonan pembiayaan nasabah telah disetujui maka dilakukan proses akad. Dalam proses membuat kesepakatan, klien dan bank menandatangani kontrak Murabahah dan Wakalah pada saat yang bersamaan. Setelah proses kontrak selesai, klien sebagai perwakilan bank menerima uang untuk pembelian barang sesuai dengan kebutuhannya, yang merupakan tanda terima atau faktur yang diserahkan oleh klien kepada bank tinjauan Fatwa DSN-MUI No. 04/DSN-MUI/IV/2000 tentang Murabahah No. 9 dan PBI No. 07/46/PBI/2005 Murabahah bil Wakalah di PT. Bank Syariah Indonesia KCP Bukittinggi tidak memenuhi Fatwa DSN-MUI No. 04/DSN-MUI/IV/2000 tentang Murabahah No. 9 dan PBI No. 07/46/PBI/2005 tentang akad penghimpunan dan penyaluran dana bagi bank yang melakukan kegiatan usaha berdasarkan prinsip syariah.

Abstract

This study aims to review sharia economic law on muzara'ah cooperation in the management of agricultural land in Jorong Sungai Tarab, Tanah District. This research is a qualitative descriptive research. The data used in this research are primary data in the form of direct interviews with 6 informants. The data analysis method used is the Miles and Huberman model which consists of the data analysis process, data reduction, data selection and data validity. This study examines the implementation of muzara'ah in the management of agricultural land in Jorong Sungai Tarab, Tanah Datar Regency. The results of this study explain that in general the implementation of muzara'ah cooperation on agricultural land in Jorong Sungai Tarab, Tanah Datar Regency is already in accordance with sharia economic law, this can be seen from the fulfillment of the pillars and conditions of cooperation starting from land owners, land cultivators, land to be worked on and sighat contract

Abstract

This study examines the distribution of inheritance in rotation. The problem is that the inheritance is not distributed individually to the heirs, but the heirs only take the proceeds from the inheritance, and if the male heir dies, the right of turn is removed, but if the female heir dies, the right of turn is continued by his son. From these problems, questions arise about how the process of implementing the rotation of inheritance in Nagari Taram is and how to review Islamic aristocratic law on the implementation of rotation of inheritance. This research is a field research. The data were obtained through interviews with respondents and documents of inheritance, then the data were narrated descriptively. The results are discussed with the proposed theories. This study found that the rotation of inheritance is a community tradition that has been going on for quite a long time, the types of assets that are rotated are rice fields, gardens, and livestock (cows). Based on Islamic inheritance law, rotating inheritance in Nagari Taram is not in accordance with the provisions of Islamic inheritance contained in Surah An-Nisa 'verse 11-12 and the principles in Islamic inheritance law. This verse explains that inheritance must be distributed according to the share of each heir, while the tradition of rotating inheritance in Nagari Taram the heirs do not know how much each heir is entitled to receive. And children of heirs who have died are not entitled to a turn, because grandchildren are veiled by children.

Abstract

This study examines the review of the integration of fiqh and social towards the phenomenon of apostasy in Indonesia. The problem is that the phenomenon of apostasy in Indonesia is increasing, while religious doctrine, especially Islam, does not tolerate such apostate behavior. From these problems, research questions arise: 1) How does society react to apostates? 2) What are the implications of apostasy in social life? This research is a field research using a qualitative approach. Data was collected through interviews with 20 informants, tracking online media and print media such as social media, Google, news on online sites, and Youtube to collect information relevant to apostates in a review of fiqh and social integration. The data collected was analyzed using descriptive analysis techniques which will be presented in order to answer the problems. Based on the results of the study it was found that in the problem of apostasy there is a significant integration of fiqh and social. This can be seen from the impact/implications arising from the act of apostasy in a fiqh and social review, namely being the cause of a person's apostasy through a study of fiqh and social facts, apostasy being the cause of rifts in the family, being a hindrance to child custody, and being the cause of a couple's divorce. husband and wife, as well as the reaction of an indigenous community that advises apostates to return to Islam is also taught in fiqh and social matters.

Abstract

Studi ini mengkaji tentang Kontradiksi Peraturan Pemerintah  Nomor 34 Tahun 2021 tentang Penggunaan Tenaga Kerja Asing ditinjau dari siyasah dusturiyah . Permasalahannya adalah dalam Peraturan Pemerintah Nomor 34 Tahun 2021 terdapat beberapa pasal yang kontradiktif dengan Peraturan yang berada diatasnya sehingga mempermudah TKA bekerja di Indonesia sementara Tenaga Kerja Indonesia masih banyak yang membutuhkan pekerjaan . Penelitian ini menggunakan penelitian hukum normatif atau penelitian kepustakaan (Library Research) bahan diperoleh melalui penelitian setelah bahan yang terkumpul diolah dengan cara deduktif dan dianalisi dengan kualitatif. Hasil yang dicapai adalah beberapa pasal dalam Peraturan Pemerintah Nomor 34 tahun 2021 yang menimbulkan Kontradiktif dengan peraturan yang berada diatasnya, diantaranya: (a) Pasal 5 ayat (1) tentang bekerja rangkap jabatan bagi TKA  kontradiktif dengan pasal 26 Undang-Undang Nomor 5 tahun 1999 tentang Praktek Monopoli Dagang. (b) Pasal 6 tentang Penghapusan Izin Menggunakan Tenaga Kerja Asing (IMTA)  kontradiktif dengan Pasal 43 ayat (1) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. dan (c)  Pasal 19 tentang dispensasi Rencana Menggunakan Tenaga Kerja Asing (RPTKA) kontradiktif dengan Pasal 43 ayat (3) Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan.  Berbagai kelonggaran tersebut mempermudah Tenaga Kerja Asing bekerja di Indonesia sehingga mengakibatkan berkurangnya kesempatan kerja bagi tenaga kerja dalam negeri. Secara keseluruhan kelonggaran bagi TKA bekerja di Indonesia juga menimbulkan kontradiktif dengan UUD 1945 Pasal 27 ayat (2) yang menjamin setiap hak warga negara atas pekerjaan dan penghidupan yang layak. Peraturan ini juga tidak sejalan dengan teori tujuan hukum yakni teori keadilan, teori kebermanfaatan dan teori kepastian hukum. Menurut perspektif Fikih Siyasah Dusturiyah bahwa Peraturan Pemerintah perihal Penggunaan Tenaga Kerja Asing di Indonesia belum memenuhi kriteria dalam pembentukan peraturan perundang-undangan dalam siyasah Sar’iyyah, yakni : (1) bertentangan dengan tujuan syaiat yang mana kebijakan seorang pemimpin terhadap rakyatnya bergantung kepada kemaslahatan, namun dengan adanya kelonggaran dalam peraturan ini tidaklah menciptakan kemaslahatan melainkan kemudharatan yakni semakin berpeluang menambah pengangguran karena lapangan pekerjaan diambil oleh TKA.  (2) tidak meletakan persamaan kedudukan manusia didepan hukum dimana Peraturan Pemerintah Nomor 34 Tahun 2021 dibuat hanya untuk kepentingan-kepentingan golongan tertentu. (3) Akan memberatkan masyarakat terutama yang sedang mencari pekerjaan. (4) Tidak tercapainya keadilan dalam masyarakat karena haknya sebagai warga negara tidak terpenuhi yakni hak untuk mendapatkan pekejaan yang layak.
