Abstract

Baby blues syndrome is a psychological problem often experienced by postpartum mothers, characterized by anxiety, mood swings, and emotional stress. From an Islamic perspective, the hadith of the Prophet Muhammad SAW offers guidance on calmness, patience, and social support that can help mothers face these emotional challenges. This study aims to explore the effectiveness of the hadith approach in overcoming baby blues syndrome using a mixed methods method, namely a combination of qualitative and quantitative approaches. Data were collected through in-depth interviews, quantitative questionnaires using the Edinburgh Postnatal Depression Scale (EPDS), and participant observation of postpartum mothers at the Madina Pratama Clinic, Medan. The results showed that mothers who had a better understanding of the hadith on calmness and patience tended to have lower levels of anxiety. In addition, worship practices such as dhikr, prayer, and reading the Qur'an play a role in improving maternal emotional well-being. However, several inhibiting factors in the application of the hadith approach include lack of access to relevant Islamic education, limited time for worship due to being busy taking care of babies, and lack of social support from the surrounding environment. This study provides insight that a hadith-based approach can be an effective method in dealing with baby blues syndrome if supported by more inclusive religious education and a strong social support system. Therefore, the integration of Islamic teachings and modern psychological approaches in postpartum maternal health services needs to be further developed to improve maternal mental well-being.

Abstract

This study aims to comprehensively examine the interpretation of lafaz bi 'abdihi in QS. al-Isra' [17]:1 through cross-tafsir analysis, namely al-Munir, Tafsir al-Qur'an al-'Adzhim by Ibn Katsir, and al-Mishbah by M. Quraish Shihab. The focus of this research is to uncover the meaning of ubudiyyah as the core of the spirituality of the Prophet Muhammad ﷺ as well as its relevance for the lives of contemporary Muslims. The method used is qualitative research with descriptive-analytical, comparative, and semantic approaches, while the data collection technique is done through library research on tafsir texts and supporting literature. The results showed that the three mufasirs have similarities in emphasizing that the glory of the Prophet lies in the identity of servanthood, not merely apostolic status. However, each tafsir has a different style: al-Munir emphasizes the fiqh-theological dimension, Ibn Katsir focuses on history, while al-Mishbah emphasizes spiritual context and social relevance. The synthesis of the three emphasizes that bi 'abdihi contains universal messages of humility, spiritual value-based leadership, and resistance to the challenges of modernity such as materialism and individualism. This research contributes to the strengthening of comparative tafsir studies while opening space for the integration of classical and contemporary tafsir with the needs of modern Muslims. The theoretical implications enrich the paradigm of ubudiyyah-based tafsir, while the practical implications are relevant for character education, social ethics, and Islamic leadership. Further research is suggested to link the study of tafsir with an interdisciplinary approach in order to expand the scientific horizon.

Abstract

Ilmu ushul fikih memiliki posisi sentral dalam konstruksi hukum Islam sebagai fondasi metodologis dalam proses istinbath al-ahkam dari Alqur’an dan Sunnah. Dalam khazanah keilmuan Islam, ushul fikih diyakini telah berkembang sejak masa Rasulullah dan para sahabat, meskipun belum dibukukan secara sistematis. Namun, sebagian orientalis seperti Joseph Schacht dan Patricia Crone meragukan asal-usul normatif ushul fikih dan menilai bahwa ia merupakan produk konstruksi sosial-politik abad ke-2 H, bukan warisan langsung Nabi. Tulisan ini bertujuan mengkaji diskursus antara pandangan orientalis dan ulama Muslim tentang asal-usul dan perkembangan ushul fikih secara historis dan epistemologis. Penelitian ini menggunakan pendekatan kualitatif-deskriptif dengan metode studi pustaka. Data dikumpulkan dari literatur primer dan sekunder, baik dari tokoh orientalis seperti Schacht, Crone, dan Hallaq, maupun ulama Muslim seperti al-Syafi’i, al-Ghazali, Wahbah al-Zuhaili, dan Mustafa al-Azami. Analisis dilakukan secara kritis dan komparatif untuk mengidentifikasi perbedaan pendekatan epistemologis serta kontribusinya terhadap pemahaman kontemporer ushul fikih. Hasil penelitian menunjukkan bahwa ushul fikih merupakan sintesis antara wahyu, realitas sosial, dan refleksi intelektual umat Islam, bukan sekadar produk rekayasa historis. Meskipun kritik orientalis membuka ruang diskursus baru, banyak argumen mereka bersifat reduksionistik dan mengabaikan aspek internal tradisi keilmuan Islam seperti sistem sanad dan otoritas kolektif ulama. Oleh karena itu, pemahaman integratif yang menggabungkan pendekatan historis dan nilai-nilai normatif Islam diperlukan untuk memperkuat metodologi ushul fikih dalam konteks kekinian.

Abstract

This study focuses on exploring the views of the dayah scholars in Aceh and the dynamics behind their different views on cash waqf which are becoming popular in Indonesian society. Designed in the form of a qualitative research, research data were collected through in-depth interviews with 8 prominent dayah scholars in Aceh, who were selected purposively. The eight scholars who were used as key informants for this research were charismatic scholars who were always used by the people of Aceh as the mecca of legal fatwas. Data were also collected through repeated observations to research sites and document studies related to the topic being researched. The results of the study show that the dayah scholars in Aceh have different views in executing the law allowing cash waqf. This difference occurs because each scholar has a different perspective in understanding the source of waqf law, both in terms of text and context. In the end, this study argues that the view of the dayah scholars regarding cash waqf which has been very textual in nature, must be shifted to contextual, so that the implementation of cash waqf is carried out properly as an effort to improve the welfare of the Acehnese people.

Abstract

Conflict resolution of heritage is a problem that often occurs in Indonesian society. This conflict usually occurs due to disagreements in dividing inherited property between family members. In West Sumatra, Minangkabau women are essential in resolving inheritance conflicts. This article will explain the factors that support the position and role of Minangkabau women in resolving heritage conflicts in West Sumatra. This research is empirical legal research or (socio-legal research) with socio-empirical studies with qualitative research. The approach method used in this study is part of legal pluralism (mix or mix), including philosophical, sociological, phenomenological, and legal anthropological approaches. This article aims to provide an understanding of the role and position of Minangkabau women in resolving heritage conflicts in West Sumatra. The factors that support their role are Economic, Educational, Psychological, and Social factors. It is hoped that this article can provide a better insight into the importance of the role of women in resolving inheritance conflicts, as well as provide proper recognition for Minangkabau women for their contributions to society

Abstract

Artikel ini mengkaji konsep wakalah dalam perspektif tafsir dan hadis a?k?m, dan berangkat dari asumsi bahwa wakalah bukan sekadar konstruksi fiqh praktis, melainkan memiliki landasan normatif yang kuat dalam al-Qur’an dan Sunnah Metode yang digunakan adalah penelitian kepustakaan (library research) dengan pendekatan tafsir a?k?m dan hadis a?k?m, disertai analisis ushul fiqh terhadap ayat-ayat dan hadis-hadis yang merepresentasikan praktik perwakilan. Hasil kajian menunjukkan bahwa meskipun al-Qur’an tidak secara eksplisit menggunakan istilah wakalah dalam seluruh ayat yang relevan, ayat-ayat seperti QS. an-Nis?’ [4]: 35, al-Kahf [18]: 19, dan Y?suf [12]: 55 serta [12]: 93 mengandung prinsip-prinsip delegasi, pengutusan, dan penyerahan mandat yang secara substansial menjadi basis normatif wakalah. Penafsiran para mufassir terhadap ayat-ayat tersebut menegaskan bahwa wakalah berorientasi pada maslahat, amanah, dan kompetensi wakil. Temuan ini diperkuat oleh hadis-hadis a?k?m tentang wakalah dalam jual beli, pelunasan utang, dan akad nikah yang secara eksplisit menunjukkan legitimasi syar‘i praktik perwakilan, sekaligus menetapkan batas kewenangan dan tanggung jawab wakil. Secara kritis, artikel ini menegaskan bahwa wakalah tidak dapat dipahami secara reduktif sebagai akad teknis semata, melainkan sebagai mekanisme hukum yang sarat nilai etis dan maq??id?, terutama dalam menjaga harta (?if? al-m?l), mewujudkan kemudahan (tays?r), dan menjamin keadilan dalam relasi sosial. Dengan demikian, wakalah memiliki relevansi normatif yang kuat untuk dikontekstualisasikan dalam praktik mu??malah kontemporer, termasuk ekonomi dan perbankan syariah, selama prinsip amanah, kejelasan mandat, dan tanggung jawab hukum tetap dijaga.

Abstract

Mudharabah merupakan salah satu akad kerja sama dalam ekonomi Islam yang memiliki peran penting dalam praktik muamalah, baik pada masa klasik maupun dalam konteks ekonomi dan keuangan syariah modern. Keabsahan dan penerapan akad mudharabah tidak terlepas dari landasan syar‘i yang bersumber dari Al-Qur’an dan Sunnah. Artikel ini bertujuan untuk mengkaji secara komprehensif tafsir ayat-ayat Al-Qur’an dan hadis-hadis ahkam yang menjadi dasar hukum akad mudharabah. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif-analitis dan normatif, dengan menelaah ayat-ayat terkait aktivitas usaha, kerja sama, dan perdagangan, serta hadis-hadis Nabi SAW yang relevan dengan praktik mudharabah. Analisis dilakukan dengan memperhatikan asb?bun nuz?l, asb?bul wur?d, serta pandangan para ulama tafsir dan muhaddits dalam memahami dalil-dalil tersebut. Hasil kajian menunjukkan bahwa meskipun mudharabah tidak disebutkan secara eksplisit dalam Al-Qur’an, prinsip-prinsip dasarnya memiliki legitimasi kuat melalui ayat-ayat umum tentang muamalah dan diperkuat oleh praktik Nabi SAW serta ijma‘ ulama. Kajian ini diharapkan dapat memperkaya khazanah keilmuan hukum Islam dan memberikan kontribusi teoritis dalam penguatan landasan syar‘i akad mudharabah, khususnya dalam pengembangan ekonomi dan keuangan syariah kontemporer.

Abstract

Buying and selling activities are one aspect of muamalah which is very important in human life and receives great attention in the Qur'an and hadith. The principles of justice and honesty are the main foundation in every transaction, as illustrated in the verses which emphasize the importance of correct measures and scales, as in the words of Allah SWT: "Make measures and scales fairly, and do not harm people in their rights" (QS. Al-A'raf [7]: 85). This verse not only emphasizes the need to uphold justice in measurable transactions, but also raises the issue of interpretation regarding the status of transactions that do not use formal measures or scales, such as buying and selling jizāf. In community practice, buying and selling jizāf—that is, buying and selling goods based on estimates without measuring or weighing—has been known since the time of the Prophet Muhammad. A number of hadiths narrate the permissibility of this form of transaction in certain contexts, such as buying and selling foodstuffs or harvests that can be measured in a general sense without causing gharar (unclarity). However, differences in socio-economic contexts and modern trading systems raise a new question: to what extent can the sharia principle, which emphasizes fairness in measurement, be applied to sales without a fixed measure? From an exegetical perspective, classical commentators such as Al-Qurtubi, Ibn Kathir, and Al-Razi have differing emphases in their understanding of verses concerning measures and weights. Some emphasize moral aspects and universal justice, while others emphasize strict legal aspects regarding sales practices. Meanwhile, in the hadith literature, differences in wording and context of the narrations regarding jizāf have given rise to debates about the validity and scope of its permissibility. The hermeneutic tension between the texts of verses that demand precise measurements and the hadith that permit jizāf is an important area of ​​research.

Abstract

Syuf'ah is a legal institution in transactions aimed at protecting joint owners from potential losses resulting from the transfer of rights to third parties. This article examines the views of Islamic jurisprudence schools regarding the subject, object, and conditions for implementing syuf'ah, and analyzes the similarities and differences in the opinions of scholars. This research uses a juridical-normative method through a literature review of hadith evidence and the opinions of jurists. The study results show that all schools of thought agree on the validity of syuf'ah based on authentic hadith. This similarity of opinion is evident in the basic requirements of syuf'ah, namely joint ownership, an undivided object, immediate demand, and payment at the same price. Differences of opinion arise in determining the subject and object of syuf'ah, particularly regarding the extension of rights to neighbors and the scope of property, which are influenced by differences in istinbath methods, particularly the use of qiyas. This study confirms that the differences between schools of thought are methodological and do not eliminate the main objective of syuf'ah as an instrument to maintain public welfare, legal certainty, and justice in joint ownership.

Abstract

Islam sebagai agama yang komprehensif menetapkan prinsip-prinsip muamalah untuk mewujudkan keadilan, transparansi, dan perlindungan terhadap pihak yang rentan dalam aktivitas ekonomi, salah satunya melalui larangan riba dan gharar. Penelitian ini bertujuan menganalisis konsep, dasar normatif, dan implikasi larangan riba dan gharar dalam perspektif Al-Qur'an dan Maqasid Al-Syariah serta relevansinya dalam praktik ekonomi modern. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kepustakaan, melalui penelaahan tafsir Al-Qur'an, hadis, kitab fikih muamalah, karya ulama klasik dan kontemporer, serta literatur ekonomi syariah. Hasil penelitian menunjukkan bahwa riba diharamkan secara mutlak karena mengandung unsur eksploitasi, ketidakadilan, dan perolehan keuntungan tanpa risiko produktif, yang bertentangan dengan prinsip perlindungan harta (hifz al-mal) dan keadilan sosial. Gharar dilarang karena mengandung ketidakpastian dan spekulasi yang merugikan, meskipun gharar ringan (yasir) ditoleransi karena sulit dihindari dan tidak berdampak signifikan terhadap keadilan akad. Dalam konteks ekonomi modern, prinsip larangan riba dan gharar diimplementasikan melalui instrumen keuangan syariah berbasis bagi hasil, juaal beli, dan sewa, serta mitigasi risiko dalam transaksi digital. Dari perspektif maqāṣid al-syarī‘ah larangan riba dan gharar berfungsi menjaga harta, jiwa, akal, dan keadilan sosial, sehingga selaras dengan tujuan syariat dalam mewujudkan kemaslahatan umat secara menyeluruh.
