Abstract

Penelitian ini bertujuan untuk menguraikan lebih lanjut tentang pemberlakuan parliamentary threshold dalam sistem Pemilu, serta pertentangannya dengan konsep kedaulatan rakyat. pendekatan normatif, yang dimana bukan hanya mengkaji hukum dalam arti peraturan perundang-undangan semata, akan tetapi meliputi aspek yang lebih luas, yaitu sesuatu yang dapat ditelusuri melalui bahan kepustakaan. Teknis analisis yang digunakan dalam penelitian ini adalah metode analisis hermeneutik dan interpretasi. Hasil penelitian menunjukkan bahwa pemberlakuan parliamentary threshold dalam sistem Pemilu di Indonesia bertentangan dengan konsep kedaulatan rakyat. Adapun penerapan sistem khususnya pada Pemilu 2024, patut mempertimbangkan sistem Campuran sebagai alternatif dari sistem Representasi Proporsional yang selama ini diterapkan pada Pemilu di Indonesia. Selanjutnya, dibutuhkan formulasi khusus dimana Partai Politik Peserta Pemilu yang dinyatakan tidak memenuhi ambang batas dapat menempuh jalur koalisi untuk mencapai ambang batas, bahkan sampai pada pilihan untuk meniadakan parliamentary threshold (ambang batas perolehan suara 0%). Hal ini akan menjadi jalan tengah atas kebutuhan pencapaian proporsionalitas sistem Pemilu, sebagai bentuk akomodasi suara pemilih serta kepastian hukum atas kedaulatan rakyat, serta kebutuhan menciptakan sistem Presidensialisme yang semakin efektif di masa yang akan datang

Abstract

Based on data from the Ministry of Communication and Information, recorded there were 1,028 fake news or hoaxes about health information spread since 2020 on social media platforms. Data shows that 73.7% of the 27 4.9 million people in Indonesia are internet users This condition makes it difficult to control the infodemic in Indonesia. Digital Data 2021 states that around 170 million people are active users of social media. Health literacy socialization is an effort to build awareness among teenagers in filtering the right health information.

Abstract

Tujuan penelitian menganalisis pemenuhan hak narapidana Anak di Lembaga Pembinaan Khusus Anak (LPKA) Kelas II Maros dan Faktor yang mempengaruhi. Penelitian ini menggunakan data Data Primer. Hasil penelitian ini menunjukkan bahwa: (1) Pemenuhan Hak-hak Narapidana Anak di Lembaga Pembinaan Khusus Anak (LPKA) Kelas II Maros menurut Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak sudah terpenuhi tetapi kurang efektif karena masih belum terpenuhi sarana dan prasarana serta kurangnya tenaga petugas yang profesional dalam pemenuhan pembinaan di LPKA Maros. (2) Faktor-faktor yang mempengaruhi pemenuhan hak Anak di Lembaga Pembinaan Khusus Anak (LPKA) Kelas II Maros, yaitu: faktor sarana dan prasarana pada pelaksanan pendidikan formal LPKA Maros belum memiliki tenaga pendidik dan ruang kelas untuk belajar secara formal dan berdekatannya jarak antara blok narapidana Anak dan blok narapidana dewasa, faktor kurangnya tenaga SDM di LPKA Kelas II Maros jumlah petugas masih kurang di bandingkan jumlah narapidana yang terdapat di LPKA Maros, dan faktor Kurangnya Suplai Anggaran dalam pemenuhan sarana dan prasarana serta penyediaan tenaga pendidik. The research objective to analyze the fulfillment of the rights of child prisoners at the Class II Maros Special Child Development Institute (LPKA) and the influencing factors. This study uses primary data data. The results of this study indicate that: (1) Fulfillment of the Rights of Child Convicts in the Class II Maros Special Child Development Institute (LPKA) according to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System has been fulfilled but is less effective because the facilities and infrastructure are not yet fulfilled. infrastructure and the lack of professional staff in fulfilling the guidance at LPKA Maros. (2) The factors that influence the fulfillment of children's rights in the Class II Maros Special Child Development Institute (LPKA), namely: the factors of facilities and infrastructure in the implementation of formal education LPKA Maros does not yet have educators and classrooms for formal learning and the close distance between Child convict block and adult convict block, the factor of lack of human resources in LPKA Class II Maros the number of officers is still less compared to the number of prisoners in LPKA Maros, and the factor of Lack of Budget Supply in fulfilling facilities and infrastructure as well as providing educators.

Abstract

The emergence of the COVID-19 pandemic has hampered the conduct of general elections in a number of countries. In the previous simultaneous regional elections in 2020, there was an increase in positive cases of COVID-19, which resulted in fatalities. This study seeks to examine the possibility of electronic voting (E-Voting) as an alternative policy to ensure safe elections during a pandemic, by examining the aspects of constitutionality, advantages, and challenges of its implementation.. This research employs a normative research methodology with a conceptual, constitutional, and comparative approach. The result shows that, from a constitutional standpoint, the protocol for implementing E-Voting is consistent with the principles of direct, general, free, confidential, honest, and fair elections mandated in the Republic of Indonesia's 1945 Constitution, and thus can be used as an alternative election policy in the future. E-voting also offer potential benefits for the democratic, efficient, and secure electoral system that can be used in the current pandemic situation. However, there are a number of obstacles to its implementation in Indonesia due to systemic flaws in e-voting, such as its security and validity, as well as the condition of voters and insufficient infrastructure in the Indonesian context.

Abstract

The debate about the authority of the Supreme Court to examine the  Statutes and bylaws of Political Parties against the Law has become a problem in the practice of law in Indonesia. This study aims to analyze the nature of the Supreme Court's authority to examine the Statutes and bylaws of political parties against the law. This research is a normative legal research. The data collection technique used in this research is literature study. The analytical technique used in this research is hermeneutic analysis method and interpretation. The results of this study indicate that political parties as public legal entities are present in all aspects of government and have an important contribution in determining the direction of constitutional development in Indonesia. Ratification of the Articles of association and by-laws of Political Parties based on a Ministerial Decree and announced in the State Gazette of the Republic of Indonesia. In this case, the Statutes and bylaws of a political party are statutory regulations under laws and Ministerial Decrees. The Supreme Court must carry out its supervisory function, including testing the Statutes and bylaws of political parties that are in conflict with the Law on Political Parties. This study concludes that the Supreme Court exercises broad powers as judge made law, especially in dealing with complex cases, such as the Statutes and bylaws issues of political parties.

Abstract

The primary issue addressed in this study is how the Supreme Court's authority is autonomous in hiring judges with the status of state officials for judicial organizations within its jurisdiction. Because the legislation was the primary source of information, this study took a normative juridical approach. The study's findings indicate that the current legal framework is not yet fully capable of accurately regulating, thoroughly implementing, and enforcing the judicial system and pattern and judges' status as state officials. The current system and pattern of judicial recruitment continue to demonstrate the lack of transparency and uncertainty regarding the legal rules governing the recruitment pattern of judges with state official status. The existing rules retain a tenuous legitimacy because they are not governed by the Constitution, which establishes an independent Judicial Authority charged with enforcing law and justice. As a result, it will be required to enact new rules and regulations governing the system and pattern of recruitment of judges in accordance with the characteristics of judges' positions as state officials in the future to ensure the implementation and accountability of judicial responsibilities.

Abstract

Tujuan penelitian menganalisis pencegahan tindak pidana korupsi pada bagian pengadaan barang dan jasa oleh pejabat pelaksa teknis kegiatan pemerintah kota makassar. Metode yang digunakan dalam penelitian ini adalah penelitian empiris dan dilakukan di Kota Makassar dan tempatnya di Bagian Barang dan Jasa Pemerintah Kota Makassar serta respondennya adalah Kepala Bagian dan orang-orang yang terkait dengan pengadaan. Hasil Penelitian ini menunjukkan bahwa: (1) Pencegahan Tindak Pidana Korupsi Pada Bagian Pengadaan Barang dan Jasa oleh Pejabat Pelaksana Teknis Kegiatan Kota Makassar Belum Efektif diterapkan (2) Faktor-Faktor Yang Mempengaruhi Pencegahan Tindak Pidana Korupsi Bagian Barang dan Jasa oleh Pejabat Pelaksana Teknis Kegiatan di Kota Makassar Yaitu Faktor Yuridis, Faktor Struktur, Faktor Budaya. The research objective is to analyze the prevention of corruption in the procurement of goods and services by the Makassar city government's technical implementation officials. The method used in this study is empirical research and was conducted in Makassar City and place is in the Goods and Services Section of the Makassar City Government and the respondents are Heads of Sections and people related to procurement. The results of this study indicate that: (1) Prevention of Corruption Crimes in the Procurement of Goods and Services Section by Technical Implementation Officers for Activities in the City of Makassar has not been effectively implemented (2) Factors that Influence the Prevention of Corruption Crimes in the Goods and Services Section by Technical Implementation Officers for Activities in Makassar City, namely Juridical Factors, Structural Factors, Cultural Factors.

Abstract

This study aims to analyze the legal standing and interest of the MRP as an embodiment of asymmetrical decentralization policies and the ratio decidendi of the Constitutional Court in Decision Number 47/PUU-XIX/2021. This normative legal study uses the statute and case approaches and collects data through a literature study technique. Results showed that asymmetrical decentralization policy prioritizes the specificity, uniqueness, diversity of regions, and unity of society through indigenous law and traditional rights. The granting of special autonomy to Papua aims to reduce disparities and improve living standards for the indigenous people. The MRP, established as a cultural representation with specific authority in protecting the rights of the indigenous people of Papua, evaluated that some provisions in Law Number 21 of 2001 and Law Number 2 of 2021 contradict the 1945 Constitution. In contrast, MRP’s request does not contain constitutional issues, and some are in line with the interests of the Local Government. In Decision 47/PUU-XIX/2021, the Constitutional Court stated that part of the complainant’s request could not be accepted and rejected the complainant’s request other than and the rest. Therefore, it is recommended that the MRP collaborate with the Local Government to promote the interests of the indigenous people of Papua. The Government must also continuously monitor the progress and evaluate the asymmetrical decentralization policy in reducing disparities and improving the standard of living for the indigenous people of Papua. Furthermore, the Government should ensure that the rights of the indigenous people of Papua remain protected and respected.

Abstract

Holding simultaneous local elections in 2024 will result in vacancies in the positions of regional heads in some regions. To overcome this impact, the government appointed and authorized active TNI to become PJ Regents, even though the provisions stated that filling the position of the regional head was the position of Pratama high leadership, who came from the State Civil Apparatus group. In this study, the authors utilized normative juridical research methods with a statutory approach, also called the approach, the approach, and a conceptual approach, also called the conceptual approach. That the appointment and appointment of the TNI to be active in filling the position of regional head violates the laws and is contrary to the principles of good governance. The active presence of the TNI in civilian jobs has damaged civilian supremacy, which has been fought for during the reform period to abolish the Dwifungsi ABRI doctrine.
