Abstract

This study aims to examine and analyze the constitutionality of the electoral system to the relevance of the philosophische grondslag and staatsfundamentalnorm of Pancasila and to investigate the constitutional ideological degree of the electoral system in Indonesia. This study uses normative legal research with a statute, historical, and comparative approaches. The collection of legal materials is carried out using a literature study technique. The collected legal material is then qualitatively analyzed to describe the problem and answer study purposes. The results show that the constitutionality of the PR system in Indonesian state governance is an effort to create an inclusive and democratic government. However, since the Reform Era and the post-amendment of the 1945 Constitution, the moral values of Pancasila are embedded in the preamble of the 1945 Constitution as philosophische grondslag and staatsfundamentalnorm, its implementation has not been realized in every subject matter. Additionally, Pancasila should be the standard measure of the ideological degree of the electoral system in Indonesia. Therefore, it is recommended that the Government and the House of Representatives prioritize implementing Pancasila’s moral values in the electoral system by amending the 1945 Constitution and Law Number 7 of 2017. Implementing Pancasila’s values must be concretely realized in each main subject regulated in the body of the 1945 Constitution and the norms of Law Number 7 of 2017. Furthermore, systematic evaluations of Indonesia’s electoral system should be carried out periodically to ensure alignment between the electoral system and Pancasila as the country’s ideological foundation. Thus, the design of the electoral system will become an ideological means for realizing national goals based on Pancasila ideology in the future.

Abstract

Constitutional Court, through Decision No. 91/PUU-XVIII/2020, states that the Job Creation Law is conditionally unconstitutional, so the Government is asked to amend the Job Creation Law within the last two years. The Government did not implement the Job Creation Law as mandated by the Constitutional Court Decision. Instead, the Government stipulated the Job Creation Perppu as a substitute for the Job Creation Law, which had been declared formally flawed by the Constitutional Court. Problems arising from the stipulation of the Job Creation Perppu include the stipulation of the Work Creation Perppu; and the implication of the enactment of Perppu by the Government after the Constitutional Court Decision No. 91/PUU-XVIII/2020. This study aims to find out the various polemics and implications of the enactment of Perppu by the Government after the Constitutional Court Decision No. 91/PUU-XVIII/2020. The research method used is normative legal research in the form of library research. The data collection technique used in this study was a literature study which was then analyzed qualitatively. The research results obtained are that the Job Creation Perppu is not in line with the Constitutional Court decision No. 91/PUU-XVIII/2020, reasons for urgency that force cannot be assumptive and calculative, basic principles and juridical parameters in constructing a nature and precarious situation that compels constitutional limits have been formulated by the Constitutional Court in Decision Number 138/PUU-VII/2009.AbstrakMahkamah Konstitusi melalui Putusan No. 91/PUU-XVIII/2020 menyatakan bahwa UU Cipta Kerja inkonstitusional bersyarat, sehingga pemerintah diminta untuk memperbaiki UU Cipta Kerja dalam dua tahun ini. Atas hal tersebut pemerintah tidak melaksanakan sebagaimana amanat Putusan Mahkamah Konstitusi, namun  menetapkan Perppu Cipta Kerja sebagai pengganti UU Cipta Kerja yang telah dinyatakan cacat formil oleh Mahkamah Konstitusi. Permasalahan yang timbul dari penetapan Perppu Cipta Kerja, antara lain: penetapan Perppu Cipta Kerja; dan implikasi ditetapkanya Perppu oleh pemerintah pasca Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Tujuan dari penelitian ini yaitu untuk mengetahui berbagai polemik dan implikasi ditetapkanya Perppu oleh pemerintah pasca Putusan Mahkamah Konstitusi No. 91/PUU-XVIII/2020. Metode penelitian yang digunakan yaitu penelitian hukum normatif berupa penelitian kepustakaan (library research). Teknik pengumpulan data yang dilakukan dalam penelitian ini adalah studi kepustakaan yang kemudian dianalisis secara kualitatif. Hasil Penelitian yang diperoleh yaitu Perppu Cipta Kerja tidak sejalan dengan putusan Mahkamah konstitusi No. 91/PUU-XVIII/2020, alasan kegentingan yang memaksa tidak boleh asumtif serta kalkulatif, prinsip dasar dan parameter yuridis dalam mengkonstruksikan suatu sifat dan keadaan kegentingan yang memaksa telah dirumuskan batasan konstitusionalnya oleh Mahkamah Konstitusi dalam Putusan Nomor 138/PUU-VII/2009.

Abstract

Tujuan penelitian menganalisis penyebab kurang Efektifnya perlindungan hukum bagi tenaga kesehatan dalam melakukan tindakan medis di Kabupaten Gowa dan Masalah akibat hukum bagi Tenaga Medis yang lalai dalam menjalankan tindakan medis pada pelayanan kesehatan. Penelitian ini menggunakan data primer yang diperoleh dari penelitian lapangan. Hasil Penelitian ini menunjukkan Bahwa: (1) Efektivitas Perlindungan Hukum di Rumah Sakit Syekh Yusuf dan Puskemas Kampili secara Prosedur Sudah Efektif Namum Masih ada Beberapa Hal yang menyebabkan tidak Efektifnya Perlindungan Hukum Bagi tenaga Kesehatan yang di sebabkan Beberapa hal di antaranya adalah Kurangnya pemahaman Mengenai beberapa Undang-undang Kesehatan yang dibuat untuk melindungi tenaga Kesehatan itu Sendiri dan besarnya harapan pasien terhadap tenaga kesehatan untuk mendapatkan kesembuhan (2) Permasalahan Hukum Yang terjadi di Ruang Lingkup Rumah Sakit dan Puskemas di Kab. Gowa antara Tenaga Kesehatan dengan Pasien semuanya bisa terselesaikan dengan Jalur Mediasi setelah Melalui beberapa Prosedur yang ada di Rumah Sakit dan Puskemas sebagaimana diatur dalam undang-undang No. 17 tahun 2023 tentang kesehatan, Pasal 310 Dalam hal Tenaga Medis atau Tenaga Kesehatan diduga melakukan kesalahan dalam menjalankan profesinya yang menyebabkan kerugian kepada Pasien, perselisihan yang timbul akibat kesalahan tersebut diselesaikan terlebih dahulu melalui alternatif penyelesaian sengketa di luar pengadilan. The research objective is to analyze the causes of the lack of effective legal protection for health workers in carrying out medical procedures in the Gowa Regency and the problem of legal consequences for medical personnel who are negligent in carrying out medical procedures in health services. This research uses primary data obtained from field research. The results of this research show that: (1) The effectiveness of legal protection at Syekh Yusuf Hospital and Kampili Community Health Center is procedurally effective, but there are still several things that cause ineffective legal protection for health workers, some of which a lack of understanding regarding several The Health Law was created to protect the health workers themselves and the high hopes that patients have for health workers to get healing (2) Legal problems that occur within the scope of hospitals and health centres in the district. Gowa between Health Workers and Patients can all be resolved through Mediation after going through several procedures in Hospitals and Community Health Centers as regulated in Law no. 17 of 2023 concerning health, Article 310 If a Medical Personnel or Health Personnel is suspected of making a mistake in carrying out their profession which causes harm to the Patient, the dispute that arises as a result of the mistake is resolved first through alternative dispute resolution outside of court.

Abstract

Tujuan penelitian menganalisis Kedudukan Majelis Kehormatan Mahkamah Konstitusi Ri Menurut UUD 1945. Tipe penelitian dalam penulisan hukum ini adalah penelitian hukum normatif atau penelitian hukum kepustakaan. Hasil penelitian menyatakan Urgensi kedudukan Majelis Kehormatan Mahkamah Konstitusi sebagai Lembaga penegak kode etik hakim berperan sangat penting dalam memantau dan memeriksa Tindakan hakim konstitusi yang diduga melanggar kode etik. Ruang lingkup penegakan kode etik oleh Majelis Kehormatan Mahkamah Konstitusi adalah pelanggaran berat sesuai dengan Peraturan Mahkamah Konstitusi Nomor 02/PMK/2003 pada pasal 4 ayat huruf cmenjelaskan bahwa Majelis kehormatan berhak memeriksa dan memutuskan Tindakan yang akan direkomendasikan kepada pimpinan mahkamah konstitusi. Bentuk pengawasan yang dilakukan Dewan Etik dan Majelis Kehormatan Mahkamah Konstitusi belum efektif dalam mengawasi kinerja hakim yang mana dewan etik sebagai Lembaga pengawas harian yang anggotanya bersifat tetap, karena Dewan Etik tidak menyebutkan secara spesifik bentuk pengawasannya terhadap hakim konstitusi. Dalam pengawasannya Dewan Etik hanya melakukan pengumpulan, mengolah dan menelaah jika ada laporan pelanggaran kode etik terhadap hakim konstitusi yang diduga bermasalah. The research objective is to analyze the position of the Honorary Council of the Indonesian Constitutional Court according to the 1945 Constitution. This type of research in legal writing is normative legal research or library legal research. The research results state the urgency of the position of the Honorary Council of the Constitutional Court as an institution that enforces the code of ethics for judges. It plays a very important role in monitoring and examining the actions of constitutional judges who are suspected of violating the code of ethics. The scope of enforcement of the code of ethics by the Honorary Council of the Constitutional Court is a serious violation of Constitutional Court Regulation Number 02/PMK/2003 in Article 4 paragraph letter c explaining that the Honorary Council has the right to examine and decide on actions that will be recommended to the leadership of the constitutional court. The form of supervision carried out by the Ethics Council and the Honorary Council of the Constitutional Court has not been effective in supervising the performance of judges, where the ethics council is a daily supervisory institution whose members are permanent, because the Ethics Council does not specifically mention the form of supervision of constitutional judges. In its supervision, the Ethics Council only collects, processes and reviews reports of violations of the code of ethics against constitutional judges who are suspected of having problems.

Abstract

Tujuan penelitian menganalisis pencabutan gugatan dalam praktik peradilan umum menurut hukum acara perdata dan akibat hukum pencabutan gugatan dalam praktik peradilan menurut hukum acara perdata. Metode penelitian yang digunakan adalah penelitian yuridis Normaitf. Hasil penelitian bahwa Pencabutan gugatan dapat dilakukan saat pemeriksaan belum berlangsung selama tergugat belum menyampaikan jawaban. Hal ini hukum memberi hak penuh kepada penggugat mencabut gugatan tanpa persetujuan pihak tergugat. Namun penggugat selaku pihak yang mencabut gugatan harus memberitahukan kepada pihak lawan dengan akta sederhana atau surat bahwa gugatan itu dicabut. Akibat hukum atas pencabutan gugatan pada perkara No. 359/Pdt.G/2022/PN. Mks, yang pada dasarnya telah dicabut oleh penggugat, namun dalam pencabutan tersebut telah masuk dalam pokok perkara atau tergugat telah mengajukan jawaban atas gugatan tersebut. Setelah pencabutan gugatan tersebut Penggugat mendaftarkan kembali gugatanya dengan Perkara No. 336/Pdt.G/2022/PN. Mks. Berdasarkan ketentuan Pasal 271 Rv, maka gugatan tersebut seharusnya ditolak oleh majelis hakim untuk diperksa, karena gugatan tersebut bersiat final dan tidak dapat diajukan kembali. The research objective is to analyze the withdrawal of lawsuits in general judicial practice according to civil procedural law and the legal consequences of withdrawing lawsuits in judicial practice according to civil procedural law. The research method used is normative juridical research. The research results show that a lawsuit can be withdrawn when the examination has not yet taken place as long as the defendant has not submitted an answer. This law gives the plaintiff full rights to withdraw the lawsuit without the defendant's consent. However, the plaintiff as the party who withdraws the lawsuit must notify the opposing party with a simple deed or letter that the lawsuit is withdrawn. The legal consequences of withdrawing the lawsuit in case no. 359/Pdt.G/2022/PN. Mks, which has been revoked by the plaintiff, but in this revocation, it has been included in the main case or the defendant has filed an answer to the lawsuit. After withdrawing the lawsuit, the Plaintiff re-registered the lawsuit with Case No. 336/Pdt.G/2022/PN. Max. Based on the provisions of Article 271 Rv, the lawsuit should have been rejected by the panel of judges for examination, because the lawsuit is final and cannot be resubmitted.

Abstract

The purpose of the research is to analyze the legal implications of Jakarta State Court Judgment No. 757/Pdt.G/2022/PN Jkt.Pst. The PRIMA Party, as one of the future political party candidates for the 2024 elections, filed a lawsuit with the Jakarta Central State Court over the issue of the KPU Decision regarding the establishment of the political party of the Election Participants 2024, thus giving rise to Judgement No. The research method used is normative legal research with a case-approach approach. The results of his research showed that Judgment No. 757/Pdt.G/2022/PN Jkt.Pst. is beyond authority (ultra vires) and is considered void by law (van rechtswege nietig/null end void). If the decision of the Central Government of Jakarta is implemented, it could potentially lead to state chaos. Nevertheless, the 2024 elections can only be postponed, either constitutionally or unconstitutionally. Constitutionally, the 2024 elections can only be postponed if articles 7 and 22E of the 1945 NRI Rules are passed, and the option for such amendments is wide open with reference to Article 37 of the 1945. It is unconstitutional to issue a presidential decree or to hold a state convention. However, his tendency led to a change in the 1945 NRI UUD. (konstitusi). That is, the ruling of the Central Court of Jakarta cannot affect the course of the 2024 elections or, in other words, cannot postpone the way of the elections of 2024. Tujuan penelitian ini untuk menganalisis implikasi hukum dari putusan Pengadilan Negeri Jakarta Pusat Nomor 757/Pdt.G/2022/PN Jkt.Pst. Partai PRIMA sebagai salah satu partai politik bakal calon peserta Pemilu 2024 mengajukan gugatan ke Pengadilan Negeri Jakarta Pusat atas terbitnya Keputusan KPU terkait Penetapan Partai Politik Peserta Pemilu 2024, sehingga melahirkan putusan Nomor 757/Pdt.G/2022/PN Jkt.Pst, yang seharusnya diajukan ke Pengadilan TUN yang secara substansi berkaitan dengan Penundaan Pemilu Tahun 2024. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan penelitian pendekatan kasus (case approach). Hasil Penelitiannya menunjukan bahwa Putusan Nomor 757/Pdt.G/2022/PN Jkt.Pst., bersifat melampaui kewenangan (ultra vires) sehingga dianggap batal demi hukum (van rechtswege nietig/null end void). Jika Putusan PN Jakarta Pusat tersebut diterapkan maka berpotensi menyebabkan terjadi kekacauan ketatanegaraan. Meskipun demikian, Pemilu 2024 dapatlah saja ditunda, baik secara konstitusional ataupun nonkonstitusional. Secara konstitusional, Pemilu 2024 hanya dapat ditunda jika Pasal 7 dan Pasal 22E UUD NRI 1945 diamandemen, dan opsi amandemen tersebut terbuka lebar dengan mengacu pada Pasal 37 UUD NRI 1945. Secara nonkonstitusional adalah dengan mengeluarkan dekrit Presiden atau membuat suatu konvensi ketatanegaraan. Namun, kecendrungannya mengarah pada perubahan UUD NRI 1945 (konstitusi). Artinya, Putusan Pengadilan Jakarta Pusat tidak dapat memengaruhi jalannya tahapan Pemilu 2024 atau dengan kata lain tidak dapat menunda jalan Pemilu 2024.

Abstract

The primary issue addressed in this study is how the Supreme Court's authority is autonomous in hiring judges with the status of state officials for judicial organizations within its jurisdiction. Because the legislation was the primary source of information, this study took a normative juridical approach. The study's findings indicate that the current legal framework is not yet fully capable of accurately regulating, thoroughly implementing, and enforcing the judicial system and pattern and judges' status as state officials. The current system and pattern of judicial recruitment continue to demonstrate the lack of transparency and uncertainty regarding the legal rules governing the recruitment pattern of judges with state official status. The existing rules retain a tenuous legitimacy because they are not governed by the Constitution, which establishes an independent Judicial Authority charged with enforcing law and justice. As a result, it will be required to enact new rules and regulations governing the system and pattern of recruitment of judges in accordance with the characteristics of judges' positions as state officials in the future to ensure the implementation and accountability of judicial responsibilities.

Abstract

Abstract: This study aims to explain and analyze the forms of regulation of freedom of opinion and expression in social media that apply in indonesia and explain and analyze whether the regulation of freedom of opinion and expression in social media is appropriate and in line with the principles of human rights protection. This study uses normative methods. The results showed that people's freedom of expression to express their opinions is the right and responsibility of the Democratic state. The application of the ITE Law in relation to the basic rights of every citizen in terms of freedom of opinion and expression cannot be reduced or limited by anyone and by anything, even the state. Because the state here is a party that assumes responsibility in terms of respecting and protecting these human rights through the provisions of legislation. Criticism of the government is not a violation of the law, freedom of opinion and expression is guaranteed in the Indonesian constitution. The restriction in freedom of expression and opinion is intended to create a security and welfare among fellow citizens so as not to violate other human rights. Abstrak: Penelitian ini bertujuan untuk menjelaskan dan menganalisis bentuk pengaturan kebebasan berpendapat dan berekspresi di media social yang berlaku di indonesia serta menjelaskan dan menganalisis apakah pengaturan kebebasan berpendapat dan berekspresi di media sosial sudah sesuai dan sejalan dengan prinsip-prinsip perlindungan hak asasi manusia. Penelitian ini menggunakan metode normatif. Hasil penelitian menunjukkan bahwa kebebasan masyarakat dalam berekspresi untuk mengemukakan pendapatnya merupakan hak dan tanggung jawab dari negara demokrasi. Penerapan UU ITE dalam kaitannya dengan hak dasar setiap warga negara dalam hal kebebasan berpendapat dan berekspresi tidak dapat dikurangi atau dibatasi oleh siapapun dan oleh apapun, bahkan negara sekalipun. Sebab negara disini merupakan pihak yang mengemban tanggung jawab dalam hal menghormati dan melindungi hak-hak asasi manusia tersebut melalui ketentuan perundang-undangan. Kritikan kepada pemerintah bukan merupakan pelanggaran hukum, kebebasan dalam berpendapat dan berekspresi dijamin dalam konstitusi Indonesia. Adapun pembatasan dalam kebebasan berekspresi dan berpendapat ditujukan agar terciptanya suatu kemanan dan kesejahteraan antar sesama warga negara sehingga tidak melanggar hak asasi manusia lain.

Abstract

To carry out the profession of an advocate, a person must go through various stages regulated in the Law on advocates, including the process of education and appointment through oaths. However, the publication of the Letter of the Chief Justice of the Supreme Court of the Republic of Indonesia regarding the oath of advocates has created a polemic among law enforcement. This study aims to examine two main issues: first, the substance and position of the Letter of the Chief Justice of the Supreme Court of the Republic of Indonesia regarding advocate oaths; and second, the substance and position of the Advocate Organization's Constitutional Court Decision. As doctrinal legal research, this study uses statutory and contextual approaches to secondary data in the form of primary and secondary legal materials. The results of the analysis conclude that the Letter of Chief Justice of the Supreme Court is recognized as a product of laws and regulations in Indonesia, so it must comply with the principles regarding statutory regulations. However, it is considered that this policy cannot become a binding legal product because it is considered contradictory to the law on advocacy organizations. This was justified by the Constitutional Court's decision, which considered that there was an error in the substance of the letter. The Court, in its legal considerations, then determined the Indonesian Advocates Association (PERADI) as the only advocate organization that was given eight authorities, including carrying out Advocate Profession Special Education (PKPA), Advocate Professional Examination, and carrying out the oath of attorney candidates

Jenis penelitian yang dipakai yaitu penelitian hukum yuridis normatif. Teknik pengumpulan data dilakukan dengan cara studi kepustakaan. Data yang terkumpul kemudian dianalisis dengan metode kualitatif yaitu pemaparan fakta berdasarkan hasil penelitian. Hasil penelitian ini menunjukkan: 1.) Masa jabatan pimpinan organisasi advokat yaitu 5 (lima) tahun dan setelahnya hanya dapat dipilih lagi untuk 1 (satu) periode masa jabatan, dengan memakai cara berfikir seperti ini dapat meniadakan dan menghalangi kemungkinan penyalahgunaan kekuasaan dalam tubuh organisasi advokat. 2) Dengan telah dinyatakannya Pasal 28 ayat (3) UU Advokat inkonstitusional secara bersyarat, pimpinan organisasi advokat yang sedang memegang jabatan yang sama lebih dari 2 (dua) periode sebelum Putusan Nomor: 91/PUU-XX-2022, maka untuk alasan kepastian hukum dan tidak mengakibatkan permasalah di dalam organisasi advokat, pimpinan organisasi advokat yang berkaitan tetap melaksanakan tugasnya sampai akhir masa jabatan dan setelahnya pengisian masa jabatan pimpinan organisasi advokat didasarkan pada pemaknaan baru terhadap norma Pasal 28 ayat (3) UU Advokat sebagaimana putusan Putusan Nomor: 91/PUU-XX-2022.
