Abstract

The purpose of this research is to provide knowledge about the security of cryptocurrency and the laws that protect it in Indonesia. In addition, it is also an insight to be aware of fraud. This research takes a normative and statutory juridical method approach through some literature related to the problem of this research by understanding the laws that have been collected. Tokocrypto is a trading and investment platform where the process is based on agreements and regulations submitted by Tokocrypto. Regarding safety issues and customer protection, it has been explained in BAPPETI No. 11 of 2022 (Determination of the Crypto Asset Trading List on the Crypto Asset Physical Market), Regulations, Bappebti Regulation No. 2 of 2019 concerning the Implementation of the Commodity Physical Market on the Futures Exchange, Bappebti Regulation No. 5 of 2019 concerning Technical Provisions for the Implementation of the Crypto Asset Physical Market on the Futures Exchange. Tokocrypto assets are officially processed by parties who work and cooperate with Treasury with the permission of BAPPETI No. 001/BAPPEBTI/CP-AK/11/2019 dated November 18.

Abstract

Seiring majunya waktu, muncul berbagai inovasi, termasuk Rokok Elektrik. Rokok jenis ini mengandalkan daya listrik dari baterai dan menggunakan Liquid sebagai substansi untuk menghasilkan uap. Pada dasarnya, Rokok Elektrik dirancang sebagai alternatif untuk mengurangi konsumsi Rokok konvensional yang tinggi kandungan nikotinnya. Namun, banyak Liquid Rokok Elektrik yang masuk ke Indonesia tidak mengikuti prosedur yang sesuai, dan jika dikonsumsi, dapat menjadi lebih berbahaya daripada rokok konvensional. Penelitian ini menggunakan pendekatan filosofi yuridis normatif, yang menyimpulkan bahwa perlindungan hukum bagi konsumen yang terkait dengan Rokok Elektrik dapat dievaluasi dengan merujuk pada Undang-Undang Nomor 8 Tahun 1999 tentang Proteksi Pelanggan dan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Terdapat juga tanggung jawab terhadap konsumen yang mengalami kerugian akibat konsumsi Liquid Vape. Pihak distributor atau industri yang memproduksi dapat dikenakan sanksi hukum dalam bentuk ganjaran administratif. Jenis ganjaran ini mungkin melibatkan peringatan lisan, peringatan tertulis, pencabutan produk dari peredaran, saran untuk menghentikan produksi, atau pun saran untuk menaikkan standar keamanan sesuai dengan ketentuan dalam Peraturan Perundang-undangan.

Abstract

Collateral and insurance agreements are usually included with credit agreements. Banks can use this insurance agreement to transfer risk, especially life insurance if the debtor dies. If the debtor dies before paying off the remaining credit, the credit can also fall to his heirs. The purpose of this article is to study the legal consequences of a Bank Credit Agreement if the Debtor Dies and the Insurance Party's responsibilities regarding the Bank Credit Agreement if the Debtor Dies. This normative research uses a statutory and conceptual approach. The research results show that if the debtor dies, the credit agreement law cancels the credit because of the life insurance or life insurance clause. In other words, the insurance company must be responsible for paying off the remaining debt of the deceased debtor in accordance with the terms and conditions stated in the policy. In conclusion, the parties must understand the contents of the credit agreement well so that they know how to pay the debtor's remaining debt if this risk occurs.

Abstract

The application of the non-discriminatory principle of the age limit for job seekers in Indonesia is an important issue in an effort to realize justice and equality of employment opportunities. The age limit on job vacancies is a provision made by some companies regarding the age range of job applicants to be able to apply for jobs. The practice of age restriction in the recruitment process is still widely found, even though it has been prohibited in article 5 of Law No. 13 of 2003 concerning Manpower and the Circular Letter of the Minister of Manpower No. M/6/HK.04/V/2025. This study aims to examine the application of the principle of non-discrimination in the labor recruitment process and sanctions if the principle is not applied. In this study, normative legal research methods are used using a statute approach, a comparative approach, and a conceptual approach. The results of this study show that the application of the principle of non-discrimination in the labor recruitment process in Indonesia has not been fully effective due to weak supervision. The application of the principle of non-discrimination must not conflict with Law No. 13 of 2003 concerning manpower and Law of the Republic of Indonesia Number 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection which, if violated, can result in sanctions. Therefore, there is a need to strengthen the role of supervisory institutions as an effort to create an objective, fair, inclusive labor recruitment process that focuses on the competencies or skills of applicants regardless of age limits.

Abstract

This study aims to analyze the application of the proportionality principle in formulating exit strategy clauses in franchise agreements and examine legal protections available to franchisees facing unilateral termination without proportional clauses. This study employs a normative legal approach examining legislation, academic literature, and franchise practices through conceptual, legislative, and case approaches. The novelty of this research lies in applying the proportionality principle specifically to exit strategy mechanisms, an aspect rarely explored in Indonesian franchise law literature, offering practical frameworks for balanced contract termination. The proportionality principle applies through three tests (suitability, necessity, and balancing). A proportional exit strategy clause must contain a clear termination mechanism with a cure period, fair compensation based on franchisee investment and contribution, and an adequate transition period for business cessation. Legal protection for franchisees includes preventive measures through notarial agreements and repressive measures through legal remedies based on the Civil Code, compensation claims, buyback mechanisms, protection during franchisor bankruptcy, and proportional non-competition clauses. This study emphasizes that applying proportionality principles in exit strategy clauses is crucial for ensuring balance between parties rights and obligations and preventing contractual power abuse.

Abstract

The rapid expansion of Indonesia's digital economy has introduced new contractual models that blur the legal distinction between employees and independent freelancers, creating uncertainty in the enforcement of rights and obligations. This study examines the legal construction of digital employment contracts between companies and digital marketing freelancers and analyzes the adequacy of legal protection mechanisms under Indonesian civil law. Employing a normative juridical approach with statutory and conceptual analysis, this research evaluates the Civil Code (particularly Article 1320), Law No. 11/2008 on Electronic Information and Transactions, Law No. 6/2023 on Job Creation, Law No. 27/2022 on Personal Data Protection, and Law No. 28/2014 on Copyright. The study finds that the validity and enforceability of digital employment contracts depend on compliance with Article 1320 of the Civil Code and Law No. 11/2008, supported by fair dispute resolution and data protection clauses. However, legal protection for digital marketing freelancers remains fragmented, lacking comprehensive integration of employment law, intellectual property rights, and social security provisions. This study contributes by integrating multiple legal dimensions of employment law, copyright, and data protection into a coherent analytical framework for freelancer protection, offering a foundation for developing adaptive Digital Labor Law in Indonesia's platform-based economy.

Abstract

Street vendors (PKL) constitute an essential component of the informal economic sector in Gresik Regency, yet their presence often generates issues related to urban order, cleanliness, and aesthetics. This study aims to: (1) analyze the effectiveness of implementing Gresik Regency Regional Regulation Number 7 of 2013 concerning the Arrangement and Empowerment of Street Vendors, and (2) identify the obstacles faced by the local government in carrying out the regulation. This research employs a socio-legal method with a normative-empirical approach, utilizing statutory analysis, field observation, interviews, and documentation. The findings indicate that the arrangement and empowerment of street vendors have been carried out through the designation of trading locations, regulation of operating hours and physical facilities, establishment of requirements for becoming street vendors, and the enforcement of rights, obligations, prohibitions, and sanctions. The Gresik Regency Government has also undertaken relocation initiatives to designated areas. However, the effectiveness of the regulation remains hindered by limited human resources, weak monitoring systems, and low compliance among some street vendors. Overall, the implementation of Regional Regulation Number 7 of 2013 has been conducted but has not yet achieved optimal outcomes in ensuring order and promoting the independence of street vendors. Strengthened coordination, enhanced guidance, and improved regulatory systems are needed to support the sustainability of the informal sector in Gresik Regency.

Abstract

This study aims to analyze the forms of legal protection for consumers who suffer losses due to the use of adulterated fuel and to examine the legal liability of business actors within the framework of consumer protection law in Indonesia. The research employs a normative legal research method using statutory, conceptual, and literature-based approaches. Primary legal materials include the Consumer Protection Law, the Oil and Gas Law, and relevant provisions of civil law. The analysis is conducted qualitatively through systematic interpretation of legal norms and doctrines. The findings indicate that legal protection for consumers is provided through preventive and repressive mechanisms. Adulterated fuel is classified as a defective product that gives rise to strict liability under the Consumer Protection Law as well as liability for unlawful acts under the Civil Code. However, law enforcement remains suboptimal due to weak supervision, limited institutional capacity, and evidentiary difficulties faced by consumers. This study recommends strengthening preventive supervision through random fuel quality testing, increasing the effectiveness of sanctions, enhancing the institutional capacity of the Consumer Dispute Resolution Agency (BPSK), and simplifying the burden of proof for consumers to ensure legal certainty and effective consumer protection.
