Abstract

This study compares the rights and obligations of foreign nationals (FNs) holding a Permanent Stay Permit (KITAP) in Indonesia and those holding a Green Card in the United States, with the problem on the legal implications for their family members. The research is based on increasing global mobility, which demands a clear and fair immigration system. Using a normative juridical method and comparative approach, the study analyzes immigration laws and relevant legal literature in both countries. The result and conclusion show that KITAP grants limited residency and work rights with strict administrative obligations, such as periodic reporting and tax compliance. In contrast, the U.S. Green Card offers permanent residency, employment rights, and a path to naturalization without routine reporting. Regarding families, KITAP holders may apply for residence visas and access public services under administrative requirements as regulated in Ministry Regulation No. 22 of 2023. These differences reflect each country’s immigration policy orientation in balancing sovereignty with legal protection for FNs.

Abstract

Indonesian Immigration is regulated by Law no. 6 of 2011 concerning Immigration, which is carried out by the Directorate General of Immigration in accordance with Article 1 paragraph (6). Problems: how did the violation of the use of fake immigration documents by Muhammad Habib a Bangladesh citizen occur and how was the supervision of foreigners who used fake documents in Indonesia, and was the District Court Decision Number: 172/Pid.B/2020/Pn.Tsm against Muhammad Habib is in accordance with the law on Immigration. This research is normative, descriptive in nature, uses secondary data, analyzed qualitatively, conclusions are drawn using a deductive method. Research results: Muhammad Habib made a mistake by submitting fake identity documents. Supervision of foreigners is carried out in accordance with a selective policy which aims to ensure that foreign nationals come to Indonesia to bring benefits to Indonesia.

Abstract

The Government of the Republic of Indonesia implemented the PPKM policy to limit Foreign Citizens to suppress the spread of COVID-19. In August 2021, 34 people originating from China entered Indonesian territory. The problem of this research is how did 34 foreign nationals from China violate PPKM restrictions against the provisions of PermenKumHam No. 27 of 2021 and what are the efforts made by the government in resolving the case of the entry of the 34 foreign nationals from China. This research is a juridical research that is analytical descriptive. Secondary data is data that is used with qualitative and deductive analysis as a method to draw a conclusion. The conclusion of this study is that the entry of 34 people originating from China entering Indonesian territory via Soekarno-Hatta International Airport does not violate the provisions in the Regulation of the Minister of Law and Human Rights Number 27 of 2021 which provides an exception for holders of Limited Stay Permits (ITAS). Completion efforts made by the government are to provide quarantine for 8 days and must show a complete vaccine dose certificate

Abstract

This research examines the principles, legal norms, and concepts within the Immigration Law in Indonesia. It focuses on the case of document forgery by a foreign national, MYAT THIT alias MUHAMMAD, a Myanmar citizen in Batam. The defendant was arrested at Pantai Stress, Batu Ampar, for not having a Myanmar passport and residence permit. The research problem formulation is: What is the role of the immigration office in supervising Foreign Nationals in Batam? And how is the law enforced against immigration offenses committed by Myanmar citizens? The research method used is normative juridical, drawing conclusions through deductive logic. The research results reveal that the concept and mechanism of supervision over foreign nationals (FN) in Batam are still unclear and cannot be implemented effectively.

Abstract

Immigration crime in the form of providing false information in terms of efforts to apply for the manufacture of travel documents of the Republic of Indonesia (Passport). The formulation of the problem is how the occurrence of immigration crimes committed by foreign nationals from Myanmar in making Indonesian passports, and whether the Immigration Law Enforcement of Myanmar foreign nationals contained in Decision Number 361/Pid.Sus/2022/PN.Dum is in accordance with Law Number 6 of 2011 concerning Immigration. The type of research used in answering these problems uses normative juridical legal research, descriptive in nature, the data used is secondary data, and primary data as secondary data support which is analyzed qualitatively and how to draw conclusions using deductive logic. The result is the investigation process by the Immigration PPNS, and is subject to criminal sanctions by the Dumai District Court as contained in Article 126 letter C of Law Number 6 of 2011 concerning Immigration for 5 months imprisonment, and a fine of Rp 100,000,000.00 in lieu of imprisonment for 2 months. In conclusion, the occurrence of Immigration Crimes in the form of providing false data information. the acts committed have the content of imprisonment sanctions, and fines.

Abstract

This study is based on previous work by the Governor of DKI Jakarta, who, in his 2021 Decree No. 1359, first decided on a minimum salary by looking at government regulations pertaining to salaries. Afterwards, Decree Number 1517 superseded it, disregarding the applicable government wage regulations. Examining whether or not Governor DKI Jakarta's Decision Number 1517 of 2021, which sets the minimum salary for 2022, conforms with legal requirements, and whether or not the Governor has the jurisdiction to decide minimum wage choices based on extant legislation are the problems that this study seeks to address. Using secondary data culled from a variety of sources, including main legal resources like statutes and secondary legal materials like books and journals, this study takes a descriptive-analytical method. Qualitative research and inference led to the conclusion that Law 23 of 2014 on Regional Governments grants the Governor of DKI Jakarta the authority to establish the provincial minimum salary for 2022. Unfortunately, this decision was not made in accordance with the processes laid forth in Law No. 12 of 2011 on the Formation of Legal standards.

Abstract

The increase in deportation cases indicates weak data integration, procedural differences, and limitations in the protection mechanisms for Indonesian citizens (WNI), which have resulted in delays in the repatriation and handling of deported WNI. Therefore, coordination between representatives of the Republic of Indonesia and the Directorate General of Immigration is needed in handling WNI who are deported from abroad. The research question in this study is: how is the coordination between representatives of the Republic of Indonesia and the Directorate General of Immigration coordinate in handling WNI who are deported from abroad? This study employs a normative legal method, is descriptive in nature, utilizes secondary data obtained through literature studies, analyzes the data qualitatively, and draws conclusions deductively. The results of the research and conclusions show that effective coordination requires data integration, clear communication channels, and standardised procedures, from notification to repatriation. Harmonisation of institutional roles is also important to ensure that the handling of deported Indonesian citizens can be carried out quickly, accurately, and in accordance with the principles of state protection.

Abstract

he monitoring and data collection of foreign nationals in Tangerang City is carried out by the Foreigners Monitoring Team (TIMPORA) as an inter-agency coordination forum. The high level of industrial and service activity in Tangerang City has led to increased mobility of foreign nationals, requiring effective and integrated monitoring. The research question is: What are the obstacles and challenges faced by TIMPORA in supervising and collecting data on foreign nationals in Tangerang City? This research uses a qualitative, descriptive method, using secondary data, which is analysed qualitatively, and conclusions are drawn deductively. The results of the discussion and conclusions show that TIMPORA has a strategic position in the regional immigration monitoring system, but its implementation has not been optimal due to weak inter-agency coordination, limited resources, and the lack of integration of the foreign national data collection system. In addition, the high mobility of foreign nationals and low community participation also pose challenges to supervision. Therefore, strengthening the role of TIMPORA requires increased institutional synergy, integration of cross-sector data collection systems, increased capacity of officials, and active involvement of local government and the community to realise effective and accountable supervision of foreign nationals in Tangerang City.

Abstract

Perkawinan antara Warga Negara Asing dengan Warga Negara Indonesia tidak serta-merta mengakibatkan perubahan status kewarganegaraan bagi Warga Negara Asing tersebut, kecuali dilakukan melalui mekanisme yang diatur dalam peraturan perundang-undangan. Permasalahan ini tercermin dalam Putusan Pengadilan Negeri Sumber Nomor 119/Pid.Sus/2023/PN Sbr, yang menimbulkan pertanyaan mengenai status kewarganegaraan serta akibat hukum bagi Warga Negara Asing yang menikah dengan Warga Negara Indonesia dan tinggal di Indonesia lebih dari lima tahun tanpa dokumen keimigrasian yang sah. Penelitian ini merupakan penelitian hukum normatif dengan sifat deskriptif yang menggunakan data sekunder melalui studi kepustakaan. Data dianalisis secara kualitatif dengan metode deduktif. Hasil penelitian menunjukkan bahwa perkawinan antara Warga Negara Asing dan Warga Negara Indonesia tidak mengubah status kewarganegaraan Warga Negara Asing menjadi Warga Negara Indonesia sepanjang yang bersangkutan tidak mengajukan permohonan naturalisasi sebagaimana diatur dalam Pasal 19 Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan Republik Indonesia. Dari perspektif hukum keimigrasian Indonesia, Mohd Rizal Bin Ilias terbukti melanggar ketentuan Pasal 8 ayat (2) juncto Pasal 119 ayat (1) Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian, sehingga dapat dikenai sanksi pidana berupa pidana penjara, denda, serta tindakan administratif berupa deportasi.
