Abstract

Setiap TKA yang ingin bekerja di Indonesia harus mempunyai izin kerjayang tertuang didalam visa kerja, tentang penggunaan TKA oleh undang–undang ketenagakerjaanpasal 43 ayat (4) ditentukan bahwa akan diaturlebih lanjut dalam keputusan menteri. Namun Penggunaan Tenaga kerjaasing diatur oleh peraturan Presiden No. 20 Tahun 2018. Dampak daridisahkan peraturan presiden menyebabkan masalah dari perspektif HukumKeimigrasian dan Hukum Ketenagakerjaan. Pokok permasalahan nyabagaimana permasalahan TKA yang terjadi setelah disahkan PeraturanPresiden No. 20 Tahun 2018, Apakah Peraturan Presiden No. 20 Tahun2018 sudah sesuai dengan teori materi muatan nya dalam Undang –Undang no. 12 Tahun 2011. Tentang Pembentukan Peraturan Perundang-Udangan.Penulisan dilakukan dengan metode penelitian yuridis normatifyang bersumber dari data sekunder. Analisis data dilakukan secarakualitatif dan pengambilan kesimpulan di lakukan dengan logika deduktif.Kesimpulan dari peneelitian ini permasalahan TKA terjadi setelah lahirnyaPerpres adalah permasalahan dibidang hukum keimigrasian dan hukumketenagakerjaan Apabila ditinjau dari teori materi muatan, PeraturanPresiden No. 20 Tahun 2018 tidak sesuai dengan materi muatan, karnamelanggar teori pelimpahan wewenang yaitu pendelegasian peraturanperundang-undangan karena undang-undang ketenagakerjaanmengamanahkan Penggunaan TKA diatur oleh Keputusan Menteri

Abstract

Dalam rangka mempererat dan memperkuat hubungan antara negara Republik Indonesia dengan negara lain pemerintah Republik Indonesia telah menerapkan kebijakan fasilitas bebas visa kepada negara lain. Permasalahannya adalah bagaimana pengaturan kebijakan bebas visa di Indonesia, dan bagaimana pemenuhan asas resiprokal (timbal balik) dan asas manfaat dalam kebijakan bebas visa dengan Peraturan Presiden Nomor 21 Tahun 2016 tentang Bebas Visa Kunjungan. Penelitian dilakukan dengan metode penelitian hukum normatif, menggunakan Data Sekunder dan analisis secara kualitatif, dengan penarikan kesimpulan menggunakan logika deduktif. Kesimpulan penelitian ini adalah bahwa pengaturan kebijakan bebas visa di Indonesia saat ini diatur dalam Peraturan Presiden Nomor 21 Tahun 2016 tentang Bebas Visa Kunjungan. Fasilitas bebas visa diberikan kepada 169 negara dengan 124 TPI sebagai pintu masuk dan keluar wilayah Indonesia. Asas resiprokal dalam penerbitan Peraturan Presiden Nomor 21 Tahun 2016 tentang Bebas Visa Kunjungan tidak terpenuhi karena hanya 27 negara dari 169 penerima fasilitas bebas visa kunjungan yang dapat memberikan timbal balik, dengan memberikan fasilitas bebas visa kepada WNI untuk dapat masuk ke negara tersebut, dan pemberian fasilitas bebas visa kunjungan ini memberikan manfaat dengan meningkatnya jumlah kunjungan wisatawan mancanegara ke Negara Indonesia.

Abstract

Keberadaan Mahkamah Kosntitusi dipahami sebagai bagian dari upaya mewujudkan mekanisme cheks and balances antar kekuasaan berdasarkan prinsip demokrasi untuk mewujudkan keadilan, kemanfaatan dan kepastian hukum. Permasalahannya adalah bagaimana kesesuian pertimbangan Mahkamah Konstitusi dalam Putusan Nomor 25/PUU-XIV/2016 dengan asas kepastian hukum sebagaimana diatur dalam Pasal 28D ayat (1) UUD NRI 1945 dan apakah akibat hukum dari berlakunya Putusan Mahkamah Konstitusi Nomor 25/PUU-XIV/2016 terhadap penanganan Tindak Pidana Korupsi di Indonesia. Penelitian dilakukan dengan metode penelitian hukum normatif, menggunakan Data Sekunder dan analisis secara kualitatif dengan penarikan kesimpulan metode deduktif. Kesimpulan penelitian ini adalah pertimbangan putusan Mahkamah konstitusi Nomor 25/PUU-XIV/2016 adalah tidak tepat karena dapat menghambat penanganan tindak Pidana Korupsi di Indonesia dan mengakibatkan ketidakpastian hukum serta mempersulit untuk membuktikan unsur kerugian keuangan negara.

Abstract

Pemberlakuan aturan bagi mantan terpidana untuk menyalonkan diri dirasa diskriminasi terhadap hak politik bagi mereka yang memiliki status mantan terpidana untuk menyalonkan diri sebagai kepala daerah maka dari itu diajukan Judicial Review ke Mahkamah Konstitusi. Selain itu masalah untuk mengungkapkan kepada publik dirasa masih menjadi perdebatan antara aturan KPU dengan UU KIP yang melindungi data pribadi. Pokok Permasalahan; (1) Apakah batasan keterbukaan informasi publik yang diwajibkan dalam pencalonan kepala daerah? (2)Apakah Putusan Mahkamah Konstitusi Nomor 56/PUU-XVII/2019 dapat menjamin hak politik bagi para mantan terpidana korupsi?dan (3)Apakah penyampaian status mantan terpidana korupsi kepada publik secara terbuka sudah sesuai dengan Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik? Untuk menjawab permasalahan tersebut dilakukan penelitian secara yuridis normatif yang menggunakan data sekunder sebagai data utamanya dan dianalisis secara kualitatif. Kesimpulan dalam penelitian ini adalah setelah diajukannya Judicial Review menghasilkan putusan Mahkamah Konstitusi Nomor 56/PUU-XVII/2019 menyatakan bahwa para mantan terpidana berhak menjadi kepala daerah dengan syarat-syarat tertentu, dan dilihat dari Peraturan Komisi Pemilihan Umum Nomor 1 Tahun 2020 Tentang Perubahan Ketiga Atas Peraturan Komisi Pemilihan Umum Nomor 3 Tahun 2007 Tentang Pencalonan Pemilhan Gubernur Dan Wakil Gubernur, Bupati Dan Wakil Bupati, Dan/Atau Walikota Dan Wakil Walikota mantan terpidana wajib mengumumkan statusnya kepada publik.

Abstract

The safety guarantee of the right to life for prisoners in correctional institutions (“lapas”) is often neglected, even though it is the responsibility of the state.  One of the cases that occurred was the alleged negligence of government officials in the management of facilities and infrastructure in prison, such as the fire that occurred in Correctional Institutions Class 1 Tangerang on September 8, 2021. The problems of this article are:  whether there is a violation of human rights in the case of fire in Correctional Institutions Class 1 Tangerang? This article is a normative legal research, descriptive in nature, using secondary data, and deductive inference. The Result and conclusion obtained is that there was a violation of human rights due to the negligence of several prison officers which then caused a fire and resulted in casualties. Related to the case, four prison officers were charged under Articles 359 and 188 of the Criminal Code with a prison sentence of up to five years. Improvement and revitalization of prisons are also needed so that the safety of prisoners in prison can be better guaranteed.

Abstract

National Police of the Republic of Indonesia is a State Instrument that carries out one of the functions of government, especially in the field of maintaining security and public order. This is regulated in Law No 2 of 2002 concerning the National Police of the Republic of Indonesia. As a guideline in carrying out Polri duties, it is regulated in National Police Chief Regulation No 1 of 2009 concerning the Use of Force in Police Actions which regulates Polri actions within its authority. The problem in this research is what are the duties and authorities of the Indonesian National Police in carrying out crowd control based on Law No 2 of 2002 and National Police Chief Regulation No. 1 of 2009? Are the actions of the Malang Police in dealing with the incident at Kanjuruhan Stadium in accordance with the Law? No 2 of 2002 and National Police Chief Regulation No 1 of 2009. This research is normative research, uses secondary data, is descriptive, qualitatively, and draws conclusions deductively. The duties and authority of the Republic of Indonesia Police in carrying out crowd control are regulated in Articles 13 and 14, while their authority is contained in Articles 15 and 16. And actions of the Malang Police in dealing with incidents are not in line with Article 18 of Law No 2 of 2002 by looking at the level of danger in the regulations. National Police Chief No 1 of 2009 there was no urgency for the police to fire tear gas.

Abstract

South Papua Province was established by Law No. 14 of 2022, enacted on July 25, 2022. This new province is a result of the division of Papua Province, which continues to generate public debate regarding the urgency of its expansion. This study examines the considerations of the central government and the House of Representatives in the formation of South Papua Province, and whether its creation complies with Law No. 23 of 2014 on Regional Government. The research uses a normative legal method based on secondary data, including primary and secondary legal materials. It is descriptive in nature, using qualitative analysis and deductive reasoning. The findings conclude that the government views the establishment of South Papua Province as a way to promote equitable development and improve service accessibility in Papua. However, administratively, the formation does not meet the basic and administrative requirements for a New Autonomous Region (DOB), such as having at least five regencies/cities and a three-year preparatory phase, as required by Law 23/2014. Despite this, the government proceeded with the expansion based on Law No. 2 of 2021, the Second Amendment to Law No. 21 of 2001 on Special Autonomy for Papua.

Abstract

This study proposed a reform of Indonesia’s legislative electoral system by implementing a closed proportional model to improve the quality and effectiveness of the House of Representatives (DPR). The open proportional system, standed since the 1998 Reform Era, has raised several serious issues, including the prevalence of money politics, high nomination costs, weakened party cohesion, and reduced accountability of elected representatives. Based on theoretical approaches encompassing popular sovereignty, political representation, and party systems which supported by empirical data, this study argues that a closed system aligns more closely with the principles of substantive democracy. The research proposed a closed-list system rooted in meritocracy and accountability, emphasizing objective candidate recruitment, independent oversight, a minimum 30 percent quota for women, and public monitoring of candidate lists. This reform is recommended to be implemented through a revision and integration of various electoral laws within an omnibus law framework. Conceptually, the findings contribute to the development of constitutional law and the strengthening of representative institutions that are professional, transparent, and people-oriented.

Abstract

The naturalization of foreign football players for the Indonesian national team presents legal challenges, particularly concerning the relationship between citizenship and immigration regulations. Players must fulfill administrative requirements such as limited stay visas (VITAS), limited stay permits (KITAS), and passports. The research questions in this study are, What are the legal issues in the naturalization process of Indonesian national football team players and How does immigration law analyze the required documents and the passport issuance procedures for naturalized players? This research applies a normative legal method with a statutory and case study approach. The findings show that the absence of a written guideline on the selective policy principle and weak inter-agency coordination hinder the efficiency of the naturalization process. Administrative issues involving ITAS, ITAP, and police clearance (SKCK), as well as biometric verification procedures, often delay passport issuance. Therefore, harmonization between Law No. 12 of 2006 on Citizenship and Law No. 6 of 2011 on Immigration is essential to ensure that the naturalization process is legally valid, efficient, and supports the players’ official participation in the national team.
