Abstract

Generasi muda saat ini tidak lepas dari hubungannya dengan teknologi. Adapun Perkembangan Teknologi yang terjadi saat ini adalah perkembangan terhadap telepon seluler (HP) dan internet. Generasi muda khususnya remaja sering menyalahgunakan media internet seperti mengakses video-video yang seharusnya tidak boleh ditonton oleh remaja, penggunaan media sosial facebook, twitter, whatsapp dan berbagai platfon sosial lainnya untuk menghina orang lain, mencemarkan nama baik orang lain, menyebarkan kebencian terhadap suku, agama, ras dan antar golongan atau bahkan dengan sengaja memperlihatkan foto-foto diri yang kurang pantas untuk diperlihatkan kepada orang banyak, yang mana hal tersebut telah melanggar Undang-Undang ITE Nomor 19 Tahun 2016 dan perbuatan tersebut memiliki resiko hukum. Maka dari itu penyuluhan ini dilakukan untuk meningkatkan kesadaran hukum terhadap pemanfaatan teknologi dikalangan generasi muda saat. Sehingga Generasi muda saat ini terutama para pelajar diharapakan lebih berhati-hati dalam menggunakan dan membagikan hal apa saja dimedia sosial dan harus menyaring segala informasi yang diperoleh melalui media sosial untuk dibagikan keorang lain agar terhindar dari penyalahgunaan media sosial dan dapat menciptakan generasi muda yang sadar hukum.

Abstract

Workers in Indonesia have the right to reject mutations, as stated in Article 32 paragraph (1) letter b of Labor Law No. 13 of 2003. This provision allows workers to refuse changes in employment conditions, including relocation, if these alterations violate employment agreements, company rules, or legal statutes. The research, following a normative approach and using secondary data sources, highlights that workers can refer to Articles 31 and 32 to assess the compatibility of mutations with existing regulations. Termination of employment, as defined in Article 1 Point 25 of the Labor Law, can occur due to specific events resulting in the cession of rights and obligations between workers and employers. Rejection of mutations may lead to termination, according to Article 161 of Law No. 13 of 2003, with a mandatory issuance of warning letters. Disputes can be resolved through the Industrial Relations Court or alternative mechanisms, including Bipartite, Tripartite, Mediation, Conciliation, and Arbitration. If out-of-court attempts fail, the Industrial Relations Court serves as the final resolution step, involving filing a lawsuit and examination procedures in the local court

Abstract

The cause of the child ng exploited to serve as the perpetrator of a crime is an internal factor. This internal factor is more directed to a family's situation factor which describes a situation within the individual and the family of a child who is exploited to be a beggar who encourages them to beg. These factors are individual and family poverty, age, formal education, parental permission, low skills and mental attitude. Criminal law policy against perpetrators who send children as beggars can be categorized as perpetrators of criminal acts so that the perpetrators may be subject to criminal or imprisonment sanctions or both at once. The threat of imprisonment is a maximum of 10 (ten) years, while a maximum fine of Rp. 200,000,000.00 (two hundred million rupiah). Criminal liability for the perpetrator who commits the child as a beggar is an act as regulated in the provisions of Article 301 of the Criminal Code and Article 76 I and Article 88 of Law Number 35 Year 2014 About Amendment to Law Number 23 Year 2002 on Child Protection regulates the subject of ordering the child begging the begging is a criminal act and to the perpetrator may be subject to criminal sanctions. Keywords: Children, Begging

Abstract

Fintech dapat dipahami sebagai pemanfaatan perkembangan teknologi informasi untuk meningkatkan layanan di sektor keuangan seperti perbankan dan startup. Khusus untuk peer- to-peer lending, Otoritas Jasa Keuangan telah memuatnya dalam Peraturan Otoritas Jasa Keuangan No. 77/POJK.01/2016 tentang Informasi Teknologi Layanan Berbasis Pinjaman (POJK LPUBTI). Otoritas Jasa Keuangan, sebagai bagian dari pengawasan peer-to-peer lending, telah menunjuk Asosiasi Fintech Pendanaan Umum Indonesia (AFPI) sebagai mitra strategis. Walaupun penggunaan debt collector diatur dalam kode etik, namun tetap tidak dapat menghilangkan masalah, yaitu masih adanya perbuatan debt collector yang tidak menyenangkan untuk menagih, seperti pada umumnya kira-kira , kepada suatu jabatan pribadi yang mengakibatkan kerugian material atau kerugian immateriil. Minimnya pengaturan mengenai penggunaan debt collector di lembaga jasa keuangan menimbulkan pertanyaan mengenai kepastian hukum dan perlindungan hukum dari discretionary debt collector dalam pembayaran kembali. Namun di sisi lain, meski fintech berkembang pesat, hal itu tetap diatur secara jelas dalam undang-undang fintech. Namun dalam hal perlindungan konsumen, data dan privasi konsumen belum terlindungi dengan baik. Meskipun perlindungan privasi dan keamanan data menjadi prioritas utama, banyak negara telah mengembangkan dan menetapkan regulasi terkait perlindungan hukum bagi fintech, namun Di Indonesia regulasi terkait fintech belum maksimal.

Abstract

Perlindungan ini meliputi berbagai aspek, mulai dari hak kreditur untuk memperoleh informasi yang akurat tentang kondisi keuangan debitur, hak untuk menuntut pembayaran utang melalui pengadilan, hingga hak untuk memperoleh bagian dari aset debitur dalam proses kepailitan. Tujuan dari penelitian Guna Mengetahui Kreditur Dan Debitur Dalam Sengketa Hutang Piutang Yang Berakhir Dengan Kepailitan Di Kota Medan, Guna Mengetahui Sanksi Hukum Bagi Debitur Dalam Sengketa Hutang Piutang Yang Berakhir Dengan Kepailitan Di Kota Medan dan Guna Mengetahui Perlindungan Hukum Bagi Kreditur Dalam Sengketa Hutang Piutang Yang Berakhir Dengan Kepailitan Menurut UndangUndang No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Metode Penelitian Desain penelitian ini adalah suatu usulan untuk memecahkan masalah dan merupakan rencana kegiatan yang dibuat peneliti untuk memecahkan masalah, sehingga akan diperoleh data yang valid sesuai dengan tujuan penelitian. Metode penelitian ini bersifat yuridis normatif yang akan menggali dari berbagai literatur sekunder terdiri dari perundang-undangan, peraturan-peraturan, buku-buku, jurnal dan makalah yang berkaitan dengan Paten. Metode pengumpulan data adalah teknik atau cara-cara yang dapat digunakan oleh peneliti untuk pengumpulan data. Teknik dalam menunjuk suatu kata yang abstrak dan tidak diwujudkan dalam benda, tetapi hanya dapat dilihat penggunaannya melalui: angket, wawancara, pengamatan, ujian (tes), dokumentasi, dan lain-lain. Berdasarkan hasil penelitian Penyelesaian utang debitur pailit terhadap para krediturnya melaui perdamaian (accoord) dapat terjadi apabila paling lambat 8 (delapan) hari sebelum rapat pencocokan piutang debitur pailit mengajukan rencana perdamaian dan diumumkan dengan jalan diletakkan di Kepaniteraan Pengadilan Niaga (Pasal 145 Undang-Undang Nomor 37 tahun 2004 tentang kepailitan dan Penundaan Kewajiban Pembayaran Utang). Rencana perdamaian tersebut wajib dibicarakan dan segera diambil keputusan setelah pencocokan piutang berakhir, apabila rencana perdamaian disetujui oleh kreditur menurut prosedur yang berlaku serta memperoleh pengesahan dari Pengadilan Niaga dan telah berkekuatan hukum tetap, maka kepailitan berakhir. Berdasarkan hasil kesimpulan bahwa ketentuan pasal di atas menunjukan bahwa baik debitur maupun kreditur mempunyai hak asasi manusia dimana hak ini melekat pada hakikat dan keberadaan manusia sebagai anugerah Tuhan Yang Maha Esa harus dilindungi oleh negara, pemerintah, dan hukum. Atas dasar ini maka Undangundang Kepailitan harus memberikan perlindungan seimbang bagi debitur dan kreditur sebagai perwujudan pemenuhan perlindungan hak asasi manusia.

Abstract

The correctional system is an important component in the framework of the integrated criminal justice system in Indonesia. This institution has strategic duties and responsibilities in enforcing the law and providing guidance to prisoners, correctional students, and correctional inmates at the pre-adjudication, adjudication, and post-adjudication stages. The implementation of the penitentiary system in Indonesia is based on the noble values ??of Pancasila and the state constitution, which upholds the principles of legal protection and respect for human rights. However, the implementation of the correctional system in many correctional institutions in Indonesia still faces various obstacles and problems. One of the crucial issues that often arises is the problem of overcrowding or excess housing capacity in correctional institutions. This condition not only gives rise to various technical and security problems but also hampers development and rehabilitation efforts for prisoners. This research aims to examine in depth three main aspects related to the penitentiary system in Indonesia. First, this research will analyze the legal basis and statutory regulations governing the correctional system, starting from constitutional norms to operational technical regulations. Second, this research will explore various efforts and strategies carried out by correctional institutions, especially the Medan Class I Correctional Institution, in overcoming the problem of overcrowding and optimizing the implementation of Law Number 22 of 2022 concerning Corrections. Third, this research will comprehensively analyze how the law is implemented in the practice of coaching and mentoring prisoners at the Medan Class I Penitentiary. The research method used in this study is an empirical juridical research method, which combines normative studies of statutory regulations with direct observation and interviews in the field. This research is descriptive-analytic, which means that the data and information obtained will be analyzed in depth concerning the applicable legal framework. The research results show that legal regulations regarding the penitentiary system in Indonesia are rooted in higher legal norms, namely Pancasila and the 1945 Constitution, which are then revealed in various statutory regulations, including Law Number 22 of 2022 concerning Corrections. To overcome the problem of overcrowding at the Medan Class I Correctional Institution, the institution has made various efforts, such as optimizing the social reintegration program, transferring prisoners to other correctional institutions that have more adequate capacity, and collaborating with various related parties. Implementation of Law Number 22 of 2022 concerning Corrections in Class I Medan Penitentiary covers various aspects, starting from fulfilling the rights and obligations of prisoners, implementing coaching and mentoring programs, as well as implementing a security system that is under applicable security standards. Even though there are still several obstacles in its implementation, the institution continues to strive to improve and improve the quality of the implementation of the correctional system to achieve the goals of law enforcement and justice.

Abstract

A brand is a logo or symbol representing a company's identity. Brands are highly influential in attracting customers and differentiating products from competitors. A brand is considered intellectual property, allowing differentiation between similar products and services, thereby maintaining quality. Trademark laws emphasize the exclusive rights of the brand owner to use it personally or to grant permission to others. Small and Medium Sized (SMEs) play a crucial role in the Indonesian economy by creating jobs and increasing community income. This highlights the importance of branding for SMEs, especially in Medan, where SMEs significantly contribute to economic growth and development. Trademark registration for SMEs actors involves a trademark renewal process that adds to the burden due to additional costs and periodic administrative requirements. All of this makes SMEs actors reluctant to register trademarks, even though this step is crucial for protecting and strengthening their business in the market

Abstract

Partnerships in Small and Medium Enterprises (SMEs) in Indonesia often encounter challenges in adhering to Islamic principles such as syirkah (partnership), justice, transparency, and social responsibility. Therefore, there needs to be a commitment from the government, financial institutions and business actors to encourage the implementation of Islamic law values ​​in business practices. This study aims to find solutions in implementing these principles in Small and Medium Enterprise partnerships in Indonesia. The methods employed include a qualitative approach, utilizing in-depth interviews and case studies to gain a deeper understanding of current practices and the challenges faced. The research results show that although Islamic legal principles have great potential to form fair and sustainable partnerships, their implementation is often not optimal. The principles of syirkah are often not applied fairly, justice in the distribution of profits is often hampered by power, transparency is often ignored, and social responsibility is often given little attention. The conclusion of this research is that to increase the application of Islamic legal principles in Small and Medium Enterprise partnerships, greater efforts are needed in regulatory reform, increased education, and support from sharia financial institutions. This approach aims to promote fairer and more sustainable business practices while ensuring that the principles of Islamic law are effectively implemented within the context of Small and Medium Enterprise partnerships.

Abstract

Introduction: The issue of the relationship between international law and national legal policies in developing countries, especially in the context of human rights (HAM), is increasingly relevant in contemporary international law studies. Developing countries often face significant challenges in integrating international human rights standards into their domestic legal systems.Purposes of the Research: This study aims to analyze the influence of international law on national legal policies in developing countries in the context of human rights.Methods of the Research: The method used in this study is the normative legal research method with a literature study approach, which includes an analysis of various national laws and international legal instruments related to human rights. In addition, this study also refers to the results of academic studies, reports from international human rights institutions, and official documents from organizations such as the United Nations (UN) and the National Human Rights Commission. This approach provides a more comprehensive picture of the implementation of international human rights standards in developing countries.Results Main Findings of the Research: The results main findings of the study show that although many developing countries have ratified various international instruments, such as the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, their implementation is often hampered by various domestic factors. Inconsistencies between international obligations and national conditions are major obstacles, exacerbated by political instability, weak state institutions, limited resources, and tensions between international norms and local cultures. In addition, political resistance to the implementation of international human rights policies is also a significant challenge, especially in countries that prioritize political or economic interests over commitment to global human rights standards.

Abstract

Notaries have important duties and responsibilities in providing social services, in accordance with Law No. 2/2014 on the amendment of Law No. 30/2004 on the Office of Notary. These duties are mainly related to making legal deeds and ensuring that legal actions are carried out in accordance with applicable rules. This study aims to examine the duties and responsibilities of notaries in social services as well as the impact of negligence in performing duties, including the legal sanctions that can be imposed. The analysis shows that notary negligence can harm the parties involved and undermine trust in the notary profession. Therefore, supervision of notary performance needs to be improved, and sanctions should be strictly applied to those who are negligent. Continuous education and training, as well as transparency in decision making, are important to reduce errors and improve the quality of legal services.
