Abstract

Hukum perdata mengenal jaminan yang bersifat hak kebendaan dan hak perorangan. Jaminan yang bersifat kebendaan merupakan jaminan hak mutlak atas suatu benda, yang mempunyai ciri hubungan langsung atas benda tertentu dari debitur, dapat dipertahankan terhadap siapapun, selalu mengikuti bendanya (droit de suit) dan dapat diperalihkan. Tujuan penelitian ini adalah untuk mengkaji kerangka bangunan gedung yang dijadikan objek jaminan hutang oleh debitur, status bangunan gedung dalam pranata hukum positif yang berdimensi privat dan karakter pengikatan jaminannya serta lembaga jaminan apakah yang tepat untuk pembebanan bangunan gedung yang dijadikan sebagai jaminan utang. Metode penelitian yang digunakan yaitu jenis penelitian yuridis normatif, dimana penelitian ini bersifat deskriptif analitis. Jaminan atas hak kebendaan sangat kental dengan penggolongan benda yang dikenal dalam sistem hukum perdata terutama penggolongan benda bergerak dan benda tidak bergerak. Karenanya juga dikenal adanya pembedaan jaminan atas benda bergerak dan jaminan atas benda tak bergerak. Atas dasar pembedaan benda tersebut menentukan jenis lembaga jaminan/ikatan kredit yang mana yang dapat dipasang untuk kredit yang akan diberikan. Jika benda jaminan itu berupa benda bergerak maka lembaga iamina yang dikenal dalam sistem hukum Indonesia adalah gadai dan fidusia, sedangkan jika benda jaminan itu berbentuk benda tetap tanah lembaga jaminan itu berbentuk hak  tanggungan.

Abstract

The world's market economic system influences the management behavior of State-Owned Enterprises which has been lulled by the monopolistic system. The market economic system requires the community as the main actor and the state as the facilitator. Competition occurs in companies as well as in State-Owned Enterprises. To increase efficiency and productivity, must make changes to the management system by making structural adjustments which have been known as restructuring. The government formulates the direction of targets and policies for the management and supervision of State-Owned Enterprises Law Number 19 of 2003 concerning  State-Owned Enterprises was made to fulfill the vision of future development; create a management and supervision system based on the principles of efficiency and productivity to improve performance and value in managing and confirming the role of government institutions and the position of government representatives as shareholders or capital owners to emphasize and clarify the relationship as an operator or business actor with a government institution as a regulator; to avoid acts of exploitation outside the corporate mechanism; to lay the foundations or principles of good corporate governance (Good Corporate Governance). The aim is to regulate operations, regulate restructuring, and privatization as a tool and method in State-Owned Enterprises.

Abstract

Public demands for the creation of good governance especially in the public service sector which is based on good governance and clean govenance produce Polri institutions as sub-systems in the field of public services are required to be responsible in carrying out their duties in a professional and accountable manner. The National Police in particular carries out functions in the field of Registration and Identification of Motorized Vehicles (Regident Ranmor) who have strived to improve themselves by taking steps to reform the police that are moral, professional, modren, and independent through e-government systems in public services, this study aims to analyze the role of the North Sumatra Regional Police traffic directorate in creating public service accountability and efforts in creating public service accountability by the North Sumatra regional police traffic directorate. The results of this study indicate that the regent then is one of the functions of the police in the field of traffic which has the task of being one of the functions of the police in the field of traffic which provides services to the public in the field of motor vehicle administration services, namely issuance (SIM STNK, STCK, BPKB), material training (SIM, STNK, BPKB, TNKB). Public services in the field of registration and identification of motor vehicles carried out by the Directorate of Traffic of the North Sumatra Regional Police based on community satisfaction, it is expected that a survey of the community is carried out periodically (at least once a year) to find out the hopes, desires of the community for the services provided in order to provide excellent service to the community

Abstract

Perlindungan konsumen menjadi isu yang sangat penting terkait dengan pasar bebas, dimana arus keluar masuk barang tidak boleh dihambat. Konsekuensi dari perdagangan bebas ini adalah adanya kompetisi yang fair di antara produsen dan keseimbangan antara kepentingan produsen dengan konsumen. Kualitas produk menjadi indikator utama bagi konsumen, sedangkan biaya produksi yang rendah menjadi kepentingan utama produsen. Namun keseimbangan demikian sangat rentan. Selain itu asuransi tanggung jawab produk merupakan isu penting yang perlu untuk dikaji dan dibahas secara mendalam untuk mendapatkan suatu solusi terhadap penggantian kerugian yang dialami konsumen akibat penggunaan suatu produk yang cacat. Oleh karena itu kehadiran asuransi tanggung jawab produk, di satu sisi dapat memberikan jaminan kepada konsumen untuk penggantian kerugian yang dialaminya. Di sisi yang lain, adanya asuransi tanggung jawab produk akan dapat membantu produsen atas penggantian kerugian konsumen, khususnya kerugian dalam jumlah besar. Penelitian ini menggunakan metode penelitian hukum normatif. Kesimpulan dari penelitian ini berdasarkan hasil analisis kualitatif. Bahwa Secara umum, perlindungan berarti mengayomi sesuatu dari hal-hal yang berbahaya, sesuatu itu bisa saja berupa kepentingan maupun benda atau barang.Selain itu perlindungan juga mengandung makna pengayoman yang diberikan oleh seseorang terhadap orang yang lebih lemah. Perlindungan hukum bagi setiap warga negara Indonesia tanpa terkecuali, dapat ditemukan dalam Undang-Undang Dasar Republik Indonesia Tahun 1945, untuk itu setiap produk yang dihasilkan legislatif harus senantiasa memberikan jamina perlindungan hukum bagi semua orang, bahkan harus mampu menangkap aspirasi-aspirasi hukum dan keadilan yang berkembang di masyarakat. Hal tersebut dapat dilihat dari ketentuan yang mengatur tentang adanya persamaan kedudukan hukum bagi setiap warga negara.Perlindungan hukum juga dapat diartikan sebagai tindakan suatu upaya untuk melindungi masyarakat dari perbuatan sewenang-wenang oleh penguasa yang tidak sesuai dengan aturan hukum, untuk mewujudkan ketertiban dan ketentraman sehingga memungkinkan manusia untuk menikmati martabatnya sebagi manusia. Bahwa Dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen diatur mengenai pertanggungjawaban produsen, yang disebut dengan pelaku usaha, pada Bab VI dengan judul Tanggung Jawab Pelaku Usaha Pasal 19 – 28. Pasal 19 menentukan Pelaku usaha bertanggung jawab memberikan ganti rugi atas kerusakan, pencemaran, dan/atau kerugian konsumen akibat mengonsumsi barang dan/atau jasa yang dihasilkan atau diperdagangkan, Ganti rugi sebagaimana dimaksud pada ayat (1) dapat berupa pengembalian uang atau penggantian barang dan/atau jasa sejenis atau setara nilainya, atau perawatan kesehatan dan atau pemberian santunan yang sesuai dengan peraturan perundang-undangan yang berlaku, Pemberian ganti rugi dilaksanakan dalam tenggang waktu 7 (tujuh) hari setelah tanggal transaksi dan Pemberian ganti rugi sebagaimana dimaksud pada ayat (1) dan ayat (2) tidak menghapuskan kemungkinan adanya tuntutan pidana berdasarkan pembuktian lebih lanjut mengenai adanya unsur kesalahan

Abstract

Money laundering is rampant in Indonesia with banks as a means. Weaknesses in the banking system provide a loophole for money launderers to carry out their actions so that the proceeds of crime obtained are safely stored in banks. This research is a normative legal research that is descriptive in nature, with a case appoach. The purpose of this paper is to analyze the role of banks in effors to prevent and eradicate money laundering crimes committed by customers in the perspective of banking laws and the mode of action committed by money laundering criminals in banks. The results of this study indicate that themode of conduct of money laundering in conducting money laundering in banks is through capital cooperation though credit collateral, overseas transfers, disguising domestic businessses, engineering foreign loans and the role of banks in preventing and eradicating money laundering and banking laws by recognizing prospective customers who will open accounts in banks and monitoring customer profiles and transactions carried out on an on going basis, including conformity between transaction profile, examining the similarity or similarity of names with names suspects/defendants published in the mass media or by the competent authority.

Abstract

Traffic violations have become a habit of the road user community, so that every time an orderly operation of the traffic on the road is carried out by the authorities, traffic violation cases are still occurring and these violations often cause traffic accidents. The research method used in this research is to use a normative and empirical approach. i.e. conducts library research by researching and collecting library materials that are specifically related to laws and regulations and books relating to law and traffic, as well as field research conducted by observing observations and direct interviews with related objects. The results showed that the forms of traffic violations that occurred were motorists breaking traffic signs, driving not using a complete safety system. Some acts and sanctions for violations which are categorized as traffic violations regulated by Law No. 22 of 2009. Factors handling obstacles to traffic violations in Siantar Traffic Police Station Siantar, namely the human factor (Human Error), the factor of inadequate road infrastructure and facilities causing traffic violations. Efforts to deal with traffic offenses at the Siantar Police Traffic Police Unit are preventive and repressive measures to take action by giving a letter of reprimand or verbally, taking action by giving a ticket.

Abstract

Tujuan penelitian ini adalah untuk mengkaji kerangka bangunan gedung yang dijadikan objek jaminan hutang oleh debitur, status bangunan gedung dalam pranata hukum positif yang berdimensi privat dan karakter pengikatan jaminannya serta lembaga jaminan apakah yang tepat untuk pembebanan bangunan gedung yang dijadikan sebagai jaminan utang. Metode penelitian yang digunakan yaitu jenis penelitian yuridis normatif, dimana penelitian ini bersifat deskriptif analitis. Jaminan atas hak kebendaan sangat kental dengan penggolongan benda yang dikenal dalam sistem hukum perdata terutama penggolongan benda bergerak dan benda tidak bergerak. Karenanya juga dikenal adanya pembedaan jaminan atas benda bergerak dan jaminan atas benda tak bergerak. Atas dasar pembedaan benda tersebut menentukan jenis lembaga jaminan/ikatan kredit yang mana yang dapat dipasang untuk kredit yang akan diberikan. Jika benda jaminan itu berupa benda bergerak maka lembaga iamina yang dikenal dalam sistem hukum Indonesia adalah gadai dan fidusia, sedangkan jika benda jaminan itu berbentuk benda tetap tanah lembaga jaminan itu berbentuk hak  tanggungan.

Abstract

In every country the existence of capital markets is fundamental in the development of the economy. Capital market, in addition to its function as a means to gather and allocate the public funds. Numerous companies attempted to fix up in order to get into a stock market and do the Initial Public Offering (IPO). But it is not an easy job, various preparations should be carried out and of course it takes some time and effort and considerable cost. In addition to stock market laws, the market is also governed by various regulations issued by the market authorities and stock exchanges as the SRO. In the U.S., the authority is the SEC and in Indonesia the capital market authority is the OJK. Stock exchanges such as the NYSE in the U.S. and Indonesian Stock Exchange (BEI) in Indonesia also issued various rules regulate all companies listed the shares in the stock exchanges. Internationalization means to bring something local to the international level. The Sarbanes-Oxley Act is supposed to applicable only in the U.S, it is not applicable in Indonesia. But the law is brought from the U.S brought to Indonesia to be applied to Indonesian companies that have the stocks listed with the U.S stock market. The application of the Act brought some problems to Indonesian companies that have to comply with all requirements stipulated in the Act.

Abstract

In the process of granting credit by the bank to the debtor, a careful analysis has been done, but in the implementation there are often many factors that can cause the debtor to become unable to repay the credit received. So as to guarantee repayment of credit given to the debtor, the bank asks for a guarantee from the debtor in the form of property or personal collateral. In accordance with the nature of the collateral, the collateral in the form of land and buildings is generally preferred by banks because the value tends to be stable in the long run. Thus, it is necessary to have a regulation governing the guarantee of assets in the form of land and buildings so that an ease and certainty is obtained for the bank in obtaining repayment of loans given to debtors if in the future the debtor is apparently unable to repay these obligations. It is necessary to create a strong guarantee institution and be able to provide legal certainty for all parties with an interest in providing credit by banks, the government has enacted and enforced it. to impose Mortgage Rights cannot be withdrawn or cannot be terminated by any reason except because it has been implemented or has expired. The provisions are intended so that the encumbrance of the Underwriting Right is actually implemented so as to provide legal certainty for the holder and the giver of the Underwriting Right.

Abstract

Actions to reduce the actual selling price included in the deed made before the Land Deed Officer are carried out by the parties in the sale and purchase deed as a form of avoidance of the value of buying and selling tax on land, by avoidance by reducing the actual sale price of land in the sale deed buying will certainly hurt the country's economy. There were also violations in the implementation of land sale and purchase contained in this decision, where it was supposed to be made in the form of land asset deed in the presence of a Land Deed Officer, namely in making an asset sale deed, or exchange of village land assets based on Law Number 6 of 2014 concerning Villages, and Article 32 of the Minister of Home Affairs Regulation Number 1 of 2016 concerning Management of Village Assets, but the parties and Officials of Land Deed in this case do not implement this provision. The problems raised in this study are how the provisions and legal rules for making village asset sale deeds in the form of land in the presence of Land Deed Officials, legal protection for buyers of village asset sale deeds in the form of land where there is a reduction in land sale value of village assets based on the object tax selling value, and the legal consequences of the village asset sale deed in the form of land in which there is a reduction in the land sale value of the village asset based on the selling value of the tax object
