Abstract

Pendaftaran tanah selamai ini dilakukan pada umumnya masih bersifat sporadik yang tentunya akan memerlukan waktu yang lama untuk menyelesaikan pendaftaran seluruh bidang tanah di wilayah Indonesia. Oleh sebab itu, pemerintah dalam hal ini Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional menerbitkan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 35 Tahun 2016 tentang Percepatan Pelaksanaan Pendaftaran Tanah Sistematis Lengkap yang telah diubah dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 1 Tahun 2017 dan kemudian disempurnakan dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 12 Tahun 2017 tentang Percepatan Pendaftaran Tanah Sistematis Lengkap. Berdasarkan hasil penelitian dapat disimpulkan bahwa dalam pelaksanaan PTSL di Kantor Pertanahan Kabupaten Simalungung telah melaksanakan program tersebut sesuai dengan ketentuan peraturan pemerintah.Kata kunci: faktor, penghambat, pendaftaran, tanah

Abstract

In carrying out his position serving the community, a notary certainly pays attention to the provisions of the applicable laws and regulations and other regulations. When a notary makes a deed for the benefit of the requester, of course the notary has paid attention to various signs that can cause the deed to be canceled or null and void. But it turns out that in subsequent developments in various court decisions other legal terminology was born which emphasized that if there is a violation for certain reasons, the deed can: Has no legal force, void, illegal according to law, illegal and null and void, no legal force, cancelled. by law, invalid and has no legal force, cancelled. The existence of the legal terminology with its own reasons for doing so makes it difficult for the Notary if there is a violation no longer in the legal terminology which can be canceled or null and void by law, but also uses terminology outside the law. Abuse of circumstances exists when a person knows or must be aware that the other party due to certain circumstances, such as an emergency, dependency, rush, abnormal mental state or lack of experience, is moved to take legal action, is provoked to take legal action, or at least knowing or having to realize that the other party should be kept away from that action.

Abstract

This study will look at the protection provided by the law for Indonesian workers who are threatened with the death sentence overseas and the steps taken by the administration to provide such protection. migrant workers from Indonesia or Indonesian Migrant Workers are parties who are very vulnerable to indecent treatment, physical and psychological violence, intimidation, discrimination, and injustice. Collecting data in research using normative study. Sexual violence experienced by female migrant workers or PMI is often the beginning of cases of murder committed by these workers in self-defence. In the end, cases like this in local courts sentence TKI or PMI with the death penalty. This study concludes that the concept of legal protection carried out by the government in recent years can reduce the number of TKI or PMI who are subject to capital punishment because the victims' families forgive them.

Abstract

Permen ATR BPN 1 tahun 2021 tentang Sertifikat Elektronik mendefinisikan bahwa Sistem Elektronik adalah serangkaian perangkat dan prosedur elektronik yang berfungsi mempersiapkan, mengumpulkan, mengolah, menganalisa, menyimpan, menampilkan, mengumumkan, mengirimkan, dan/atau menyebarkan informasi elektronik. Dokumen Elektronik adalah setiap informasi elektronik yang dibuat, diteruskan, dikirimkan, diterima, atau disimpan dalam bentuk analog, digital, elektromagnetik, optikal, atau sejenisnya, yang dapat dilihat, ditampilkan, dan/atau didengar melalui komputer atau Sistem Elektronik, termasuk tetapi tidak terbatas pada tulisan, suara, gambar, peta, rancangan, foto atau sejenisnya, huruf, tanda, angka, kode akses, simbol atau perforasi yang memiliki makna atau arti atau dapat dipahami oleh orang yang mampu memahaminya.dan merupakan terobosan baru dalam hal pendaftaran hak atas tanah secara elektronik, maka perlu adanya pembahasan lebih lanjut mengenai Perlindungan Hukum Terhadap Data Pendaftaran Tanah yang Dilakukan Secara Elektronik, dimana dalam Permen ATR/BPN tidak ada menjelaskan mengenai pelanggaran sanksi hukum dan lainnya, namun karena dilakukan secara elektronik maka harus dikaitkan dengan Undang-Undang Informasi dan Teknologi Nomor 19 tahun 2016 perubahan atas undang-undang informasi elektronik nomor 11 tahun 2008. Dimana data yang sudah terdaftar pada pangkalan data kementrian ATR/BPN atau kantor BPN wajib dan harus di simpan pada pangkalan data sebaik mungkin agar tidak dapat diretas atau di salah gunakan oleh pihak tertentu

Abstract

The Authority of the Election Supervisory Body in the Process of Resolving Administrative Violations of Elections has been regulated by Law Number 7 of 2017. The Election Supervisory Body has the authority to issue final decisions. With this authority, the role of the Election Supervisory Body is strengthened in the law enforcement framework for electoral justice. This research aims to determine how this authority is implemented, especially in the Province of Aceh. The selection of Aceh Province as the research object is due to the increased cases handled by the Election Supervisory Body in the 2019 Elections compared to 2014. The problem formulations for this journal are: How is the Authority of Election Supervisory Committee in Handling Administrative Violations of Elections? What is the Mechanism for Handling Administrative Violations of Elections? and What Factors Influence the Election Supervisory Committee in Resolving Administrative Violations of Elections in the 2019 Elections? This research is normative legal research accompanied by supporting data. Research data was collected through a literature study. The analysis was carried out using qualitative methods. Based on the research results, it is concluded that the institutional strengthening of election oversight has developed with each decade of electoral implementation, manifested through revisions of laws governing the authority of the Election Supervisory Body. Second, the Election Supervisory Body has issued Regulation Number 7 of 2017 concerning the Handling of Findings and Reports of Electoral Violations and Regulation Number 8 of 2018 concerning resolving administrative violations of elections. Third, factors influencing the Election Supervisory Committee in resolving administrative violations of elections include internal factors such as 1) Human Resource Issues, 2) Facilities and Infrastructure, and 3) Budget.Keywords: Election Supervisory Committee of Aceh, Administrative Election Violations

Abstract

Rights known as intellectual property (IPR) are rights that result from human thought and produce a product or process that is beneficial to human life. In Indonesia, there are various intellectual property rights that apply, including: As one of the countries that ratified the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs), Indonesia has a basic legal framework for these types of intellectual property rights. Each intellectual property right is governed by its own laws. Research cannot be said to be research if it does not have a research method. The research method is a process of collecting and analyzing data carried out systematically, to achieve certain goals. Data collection and analysis is carried out naturally, both quantitatively and qualitatively, experimentally and non-experimentally, interactively and non-interactively. The research method used is normative juridical research, namely legal research carried out by reviewing library materials or secondary data. In qualitative research, the process of obtaining data in accordance with the research objectives or problems is studied in depth and with a holistic approach. Indonesia is a country with many ethnicities, cultures and religions in addition to its legal status. The majority of people in Indonesia adhere to the Islamic religion. Islamic law covers everything from marriage to charity, and criminal behavior is based on the same principles as fasting and prayer. .According to the Islamic Fiqh Council, Islam is a religion and way of life that accepts everyone and can be practiced anytime and anywhere without separating religion from life.

Abstract

Peraturan perundang-undangan dalam bidang ketenagakerjaan telah membawa perubahan mendasar dalam hal menjadikan sifat hukum ketenagakerjaan menjadi ganda yaitu sifat privat dan publik. Sifat prifat melekat pada prinsip dasar adanya hubungan kerja yang ditandai dengan adanya hubungan perjanjian kerja antara pekerja dengan pemberi kerja, sedangkan sifat hukum publik dilihat dari adanya sanksi pidana, sanksi administratif bagi pelanggar ketentuan dibidang ketenagakerjaan dan ikut campur tangan pemerintah dalam menetapkan besarnya standar upah. Fenomena yang dialami oleh pekerja adalah upah yang diterima tidak sebanding dengan biaya hidup, tingginya biaya hidup membuat pekerja jauh dari kata sejahtera. Tuntutan kerja dinilai tidak sebanding dengan upah yang diterima. Sehingga jauh dari konsep keadilan. Metode yang digunakan dalam pemelitian ini menggunakan jenis penelitian normatif. Abstract

Pengawasan dibidang perikanan perlu dilakukan, sebab sumber daya perikanan yang potensial yang merupakan berkah dari tuhan yang maha esa dapat tetap terjaga dan lestari. Undang-Undang Nomor 45 Tahun 2009 tentang Perubahan Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan, memberikan tuntunan mengenai pengelolaan sektor perikanan yang berkelanjutan dan memberikan ancaman pidana bagi pelaku yang merusak sumber daya laut, namun tindak pidana dibidang perikanan masih terjadi. Tujuan dari penelitian ini adalah untuk memberikan solusi hukum dalam melakukan pengawasan tindak pidana perikanan melalui peran serta masyarakat. Kebijakan pengawasan dalam pengelolaan sumber daya perikanan salah satu sumber data dalam penelitian ini. Tahapan yang akan dilakukan adalah persiapan dan pelaksanaan penelitian dengan mengumpulkan data-data atau informasi lapangan melalui dokumen untuk dianalisis. Metode pada penelitian ini adalah yuridis normatif, yaitu mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan. Pengawasan tindak pidana perikanan selama ini dilakukan dengan cara normatif menggunakan hukum positif yaitu undang-undang perikanan dan kebijakan lainnya seperti peraturan daerah. Pengawasan telah dilakukan oleh pemerintah maupun masyarakat secara bersama maupun masing-masing. Kegiatan penyuluhan atau sosialisasi aturan dibidang perikanan dan bahkan sampai pada tindakan menghukum pelaku sudah dilakukan agar tindak pidana tersebut tidak terjadi lagi. Tetapi faktanya masih terjadi berbagai perbuatan yang dapat merusak sumber daya kelautan. Karena itu, perlu dilakukan peningkatan peran masyarakat dalam menjaga dan melestarikan laut agar sumber daya yang terkandung didalamnya dapat berkelanjutan

Abstract

Child convicts are separated from adult convicts so that they are placed in the Special Children's Development Institution (LPKA), where this is a place for child convicts, not as a place to administer punishment as we know in Correctional Institutions (Lapas) which contain adult convicts. The essence of diversion with a restorative justice approach is the "transfer" of the process of resolving criminal acts from inside to outside the court through the method of consensus deliberation by prioritizing "restoration", "improvement" of the original situation before the crime occurred and by meeting the needs of victims, perpetrators and the community. This is stated in Article 8 of the SPPA Law that diversion is carried out through deliberation involving many parties. The results of diversion are expressed in the form of a "diversion agreement" which generally takes the form of peace (with or without compensation), handover to parents/guardians, education/training at educational institutions or LPKS; or community services. Negative impacts arising from the decline of prison and detention center residents include burdening staff, deterioration of living conditions, lack of access to education, training and employment, quality of health and physical and mental comfort which triggers tension and violence, increasing the risk of disease transmission. , also has an impact on state finances, human rights issues, health issues, security and economic issues due to illegal levies, security for officers, and the effectiveness of coaching. Therefore, it is important to have policies to mitigate the impacts arising from the overcrowding that occurs in prisons and detention centers

Abstract

Procurement of goods and services is a very urgent need in a developing country, the need for goods and services certainly requires quite large funds to obtain them. Service Users (in this case the Government) certainly expect good quality goods and services with the smallest amount of capital, while Service Providers (in this case the Contractor) will expect large profits, these two interests will attract each other. other. Procurement of goods and services is increasingly chaotic due to the lack of legal regulations in the form of laws, while the legal regulations used so far are only at the level of Presidential Decrees (Kepres) and Presidential Regulations. When talking about Procurement of Goods and Services, it includes several legal provisions, namely Civil law, if it concerns contracts, of course the legal consequence is a Civil lawsuit, if it concerns administrative decisions then it will be resolved through the Administrative Court, then if there is an allegation of a criminal act of misappropriation of State finances it will be resolved through criminal law, however, the specific legal rules for criminal liability for perpetrators of procurement of goods and services still use the provisions of general criminal law and the Corruption Crime Law. The method used in this research uses normative research. Normative legal research methods are research that positions law as a building system of norms.
