Abstract

The purpose of this study was to determine the implementation of the Palm Oil Plantation Management Cooperation Agreement at PT Tepian Gayor Langkat classified into default, Legal Efforts of the Parties to the act of default in the palm oil plantation management cooperation agreement at PT Tepian Gayor Langkat and Legal Consequences of Default in the Implementation of the Palm Oil Plantation Management Cooperation Agreement at PT Tepian Gayor Langkat. This research uses a normative juridical approach which is literature and field research. The results showed that the implementation of cooperation in managing oil palm plantations at PT Tepian Gayor Langkat showed that the Civil Code had accommodated well, but ended in default. Efforts were made on the act of default by giving a reprimand, a written warning, or a subpoena, making criminal law efforts by making a complaint to the North Sumatra Regional Police, and filing a lawsuit to the Medan District Court. Legal Consequences of Default in the Implementation of the Cooperation Agreement for the Management of Oil Palm Plantations at PT Tepian Gayor Langkat, namely the cancellation of the cooperation agreement and providing compensation of Rp. 200,000.00 (Two Hundred Million Rupiah).

Abstract

This research aims to find out the consequences and impacts of forest destruction carried out by individuals and corporations, either directly or indirectly, as experienced by the people in the Batang Lubu Sutam District, Padang Lawan Regency, North Sumatra Province, who experienced direct impacts as a result. from forest destruction, namely flash floods accompanied by thousands of logs of wood and soil. This research is empirical legal research by testing laws and cases of forest destruction which have a direct impact on society in the form of flash floods using a statutory approach and a case approach, the data obtained is then processed and An in-depth analysis was carried out regarding rules, literature study, normative approach, concept testing and drawing conclusions. The data is then presented in a descriptive analysis related to criminal liability for forest destruction. The results of the research show that the form of criminal responsibility for perpetrators of forest destruction, whether carried out by individuals or corporations, must be strictly enforced, namely in the form of prison sentences and fines as a result of these actions, such as the flash flood accompanied by thousands of logs of wood and land that occurred in Batang District. Abstract

Abstrak: Penyalahgunaan narkotika di Indonesia banyak terjadi di kalangan remaja usia produktif, hal ini dikarenakan faktor lingkungan pergaulan di kalangan remaja. Undangundang No 35 tahun 2009 tentang Narkotika dibentuk untuk menekan angka penyalahgunaan narkotika dan peredaran gelap narkotika di Indonesia. Metode pelaksanaan terdiri dari dua tahap yaitu tahap persiapan serta tahap pelaksanaan sosialisasi. Keseluruhan rangkaian berjalan dengan baik dengan meningkatnya pemahaman masyarakat adalah guna mengetahui perlindungan hukum terhadap pecandu dan korban penyalahgunaan narkotika dan upaya mempertahankan diri agar tetap steril dari lingkungan narkoba terutama bagi masyarakan binaan di Panti Rehabilitasi Amelia Sumatera Utara. Lembaga rehabilitasi medis dan rehabilitasi sosial yang ditunjuk oleh pemerintah untuk mendapatkan pengobatan dan/atau perawatan melalui rehabilitasi medis, dan rehabilitasi sosial. Sifat wajib untuk rehabilitasi medis dan rehabilitasi sosial ini seharusnya menjadi landasan yang penting bagi hakim untuk mengambil tindakan dalam memutus perkara terhadap korban dan penyalahgunaan narkotika. Namun sifat wajib dari rehabilitasi ini Pasal 54 dengan pasal 127 UU Narkotika sangatlah berhubungan. Dapat dilihat dalam pasal 127 ayat (2) disebutkan bahwa hakim wajib memperhatikan ketentuan pasal 54, pasal 55, dan pasal 103 dalam menjatuhkan putusan. Namun meskipun bersifat wajib, dalam pelaksanaannya tetap bergantung pada penyidik dan penuntut umum. Efforts to Self-Sterilize Drug Users from the Drug Circle as a Form of Legal ProtectionAbstract: Abuse of narcotics in Indonesia occurs a lot among teenagers of productive age; this is due to environmental factors among adolescents. Law No. 35 of 2009 concerning narcotics was formed to reduce the number of narcotic abuses and illicit trafficking of narcotics in Indonesia. The implementation method consists of two stages, namely, the preparation stage and the implementation stage of socialization. The whole series went well with increasing public understanding about legal protection for people with addiction and victims of narcotics abuse and efforts to maintain themselves to remain sterile from the narcotics environment, especially for the people assisted at the Amelia Rehabilitation Center, North Sumatra. The government appoints medical rehabilitation and social rehabilitation institutions to receive treatment and care through medical rehabilitation and social rehabilitation. The mandatory nature of medical rehabilitation and social rehabilitation should be an essential basis for judges to take action in deciding cases against victims of narcotics abuse. However, the mandatory nature of this rehabilitation, Article 54 and Article 127 of the Narcotics Law, are closely related. It can be seen in Article 127 paragraph (2) that the judge must pay attention to the provisions of Article 54, Article 55, and Article 103 in making a decision. However, even though it is mandatory, its implementation still depends on investigators and public prosecutors.

Abstract

This study aims to obtain a comprehensive overview of the legal provisions related to the legal regulation of book copyright, forms of copyright infringement of books traded through e-commerce in Medan City, and the causes of copyright infringement of books traded through e-commerce. In line with the purpose of this study, the research method used is normative legal research, in order to get a full picture not only of the positive law that regulates it (law in a book), but also the consequences of its enforcement in society (law in action). The results of this study indicate that books are copyrighted works protected by Law Number 28 of 2014 concerning Copyright, so that the creator gets legal protection from all forms of infringement, both with respect to moral rights and economic rights. Forms of copyright infringement in the form of infringement of economic rights, where books traded through e-commerce in Medan is a book of the results of the copy without the right or permission of the creator or copyright holder; Copyright infringement of books traded through e-commerce can occur because of the weak copyright law system both in terms of substance, structure and culture of society itself.

Abstract

This study aims to analyze the implementation of the oil palm plantation management cooperation agreement at PT. The edge of Gayor Langkat, identifies the default that occurred, and evaluates legal remedies and legal consequences arising from the violation. This study uses a normative juridical approach with qualitative descriptive analysis based on literature studies and interviews. The data was analyzed to identify defaults, legal remedies, and consequences in the agreement of PT. The banks of Gayor Langkat. The results of the study show that the implementation of the cooperation agreement between PT. The banks of Gayor Langkat and Darmawan Armiadi were declared in default due to violations of Articles 3, 4, and 8 related to written approvals, financial statements, and profit sharing. The Second Party failed to fulfill its obligations, causing the First Party to lose Rp. 138,726,000. After legal remedies such as reprimands, summonses, and lawsuits, the court ruled on default, canceled the agreement, and sentenced the Second Party to pay damages of Rp200,000,000. This case emphasizes the importance of a strong agreement, strict supervision, and compliance to prevent losses and ensure fairness.

Abstract

LGBT behavior is a form of sexual deviance. Deviant sexual behavior in adolescents is caused by the way teenagers socialize freely and tends to be limitless, caused by the sexual urges that are developing in adolescents. Education about faith so far seems to have not been able to produce a generation that is steadfast, strong, and has high dedication to their religion. The method of implementing direct counseling is the method used in this community service activity. Counseling is carried out by visiting the location and providing materials related to Education on Preventing LGBT Acts in the Full Boarding Religious School Environment of Maahad Ahmadi Negeri Sembilan (SABP MANS) Malaysia. The results of the service show that the emergence of the LGBT phenomenon in schools is caused by various factors, such as lack of affection from parents, watching on social media, bad company, and having been a victim. Among the roles that the school can play include, first, providing socialization about LGBT. However, preventing LGBT students will not produce maximum results if it only relies on the school. Support and supervision from parents and the government are also very much needed, such as parental supervision of student viewing.

Abstract

Major corruption cases such as the Bank Century, e-KTP, Tambang and BLBI scandals are examples of how corruption can involve high-ranking officials and cost the state trillions of rupiah long marriage Agreement made by a husband and wife before or during marriage which regulates the Purpose of the Marriage Agreement Regulates separation or division of assets acquired during and before marriage. Abstract

This study analyzes judicial considerations in sentencing imprisonment and work training for a juvenile offender in a sexual intercourse case, using the Medan District Court Verdict No. 70/Pid.Sus-Anak/2024/PN Mdn as a case study. The research is grounded in the tension between retributive justice and the principle of restorative justice within Indonesia’s juvenile criminal justice system. A normative juridical method with a case study approach is employed, examining primary, secondary, and tertiary legal materials through literature review and descriptive-analytical analysis. The findings reveal that judicial considerations include legal aspects such as the Juvenile Criminal Justice System Act (UU SPPA) and the Criminal Code (KUHP), as well as non-legal aspects like the juvenile's age, social environment, and the psychological impact on the victim. The court’s decision combines retributive, restorative, substantive, and procedural justice, reflecting a holistic approach to child protection. The study concludes that achieving a balance between punishment and rehabilitation is essential for ensuring the rights of both juvenile offenders and victims, and for delivering justice that is fair and humane.

Abstract

This study analyzes the binding force of pre-contractual promises from the perspective of deontological law and ethics. In contract law, pre-contractual promises often raise debates about their validity and legal consequences. This study uses a normative legal approach with descriptive qualitative analysis, which focuses on the analysis of legal norms governing pre-contractual promises. From a deontological ethics perspective, the fulfillment of a promise is considered a moral obligation that must be honored regardless of the consequences, based on the principles of honesty and integrity. This study highlights that the combination of deontological law and ethics approaches can provide a stronger normative basis for assessing pre-contractual obligations, increase legal certainty, and strengthen the principle of trust in business relationships and contractual negotiations. Deontological studies of the binding force of pre-contractual promises confirm that promises made before a formal contract have interrelated legal and ethical dimensions. From a legal perspective, although not always legally binding, the principle of promissory estoppel in common law and the principle of good faith in civil law can provide protection for parties who suffer losses due to unfulfilled pre-contractual promises. Meanwhile, from a deontological ethical perspective, the obligation to fulfill promises is based on universal moral principles, such as honesty and good faith, which form the basis of trust in business and legal interactions.

Abstract

Introduction: Corporate Social Responsibility (CSR) has evolved over time, reflecting changes in corporate thinking and practices regarding their relationships with society and the environment.Purposes of the Research: This research aims to analyze the regulation and implementation of CSR in Indonesia to compare it with CSR regulations in other Southeast Asian countries, namely Malaysia and Thailand.Methods of the Research: This research is a normative legal study that emphasizes a conceptual and legislative approach.Results of the Research: The development of the concept of CSR began in the 18th century by Robert Owen, who provided facilities for employees. CSR rapidly evolved in the 20th century, with large companies in the US establishing social departments. Milton Friedman's thinking about profit as the primary goal of business and John Elkington's concept of the "triple bottom line" also influenced the development of CSR. CSR functions as the moral responsibility of companies towards society and the environment, implemented through transparency, ethics, and responsible business decisions. In Indonesia, CSR has been regulated by law since 2007, with the aim of improving the quality of life and supporting sustainable development. A comparison of CSR regulations in Indonesia, Malaysia, and Thailand shows that although their goals are similar, namely to encourage corporate contributions to social and environmental development, their approaches differ. Indonesia implements strict legal obligations, Malaysia combines voluntary elements with supportive regulations, while Thailand prioritizes a cultural and voluntary approach with government recognition. Thailand is recognized as the best example in the implementation of CSR in ASEAN, with a higher quality of implementation compared to other countries.
