Abstract

This study examines the state’s responsibility for identity errors in the issuance of land ownership certificates and their implications in judicial proof. The ideal framework of Indonesian land law, as stipulated in the 1960 Basic Agrarian Law (UUPA) and Government Regulation No. 24 of 1997, promises legal certainty through land certificates as strong evidence of ownership. In practice, however, administrative identity errors such as incorrect names, boundaries, or measurement data often weaken the evidentiary value of certificates in court. Using a normative juridical method based on doctrinal analysis, regulations, and court decisions, this study finds that defective certificates may be annulled even when held by good-faith owners. This highlights a research gap: the lack of systematic analysis on the state’s responsibility for administrative errors in certificates. The study concludes that the state must be accountable through preventive responsibility (error prevention), curative responsibility (administrative correction and compensation), and repressive responsibility (provision of damages). The study recommends integrating land registration with civil registry data, improving identity verification mechanisms, and strengthening legal protection to ensure land certificates effectively function as instruments of legal certainty.

Abstract

This study is motivated by the gap between the judicial ideal, which obliges judges to provide adequate legal reasoning (motiveringsplicht), and the reality in appellate courts that often produce onvoldoende gemotiveerd (insufficiently reasoned) decisions. Weak judicial reasoning not only increases the risk of annulment by the Supreme Court but also worsens the legal standing of local communities in land disputes over Hak Guna Usaha (HGU). The research gap lies in the lack of studies linking appellate court decisions to the legal status of community landholders on HGU plots. This research employs a normative juridical approach with doctrinal analysis supported by secondary data from court rulings and agrarian law literature. The findings reveal that onvoldoende gemotiveerd decisions undermine the legitimacy of district courts, prolong agrarian disputes, and intensify the dualism between formal law and social reality. This study highlights the urgency of reforming judicial reasoning so that the layered court system can deliver substantive justice while ensuring legal certainty for affected communities.

Abstract

The current environment has been exploited without consideration or regard for sustainability and ecological balance. Forests have been plundered and burned, natural resources have been depleted without any effort to replenish them, and development in many cities has ignored spatial planning. All of these actions have ultimately resulted in severe environmental degradation. The decline in the carrying capacity and capacity of the environment, pollution and destruction of the environment, climate change, deforestation, and damage to terrestrial and marine ecosystems have become serious threats to the survival of humans and other living creatures. The issue examined in this paper is how to revive public understanding and awareness (participation) of the law in preserving the function of the environment. This paper uses a philosophical and legal hermeneutic approach, which is to look at the fundamental side using the method of text criticism, which refers to how the grand discourse on environmental law is criticized through several main references. Through this approach and method, it is hoped that the Green Ecology Quitionent (GEQ) model concept can be developed based on cosmic religious environmental law. Cosmic religion is a fundamental concept of diverse local wisdom possessed by Indonesian society. This model concept is expected to become a reference or starting point for the development of environmental policy, environmental education, law enforcement, management, and preservation of environmental functions in Indonesia.

Abstract

Tanah adat Kei secara keseluruhan dikuasai dan dikelola bersama oleh masyarakat hukum adat dan terbagi menjadi hak kepemilikan perorangan, marga, dan desa. Namun dalam prakteknya tumpang tindih hak kepemilikan tanah adat. Dengan rumusan masalah yaitu bagaimana perlindungan hukum hak kepemilikan tanah adat Kei. Metode penelitian hukum empiris jenis pendekatan deskriptif analisis dengan observasi lapangan dan wawancara. Dengan tujuan memperoleh data dan informasi tentang perlindungan hukum hak kepemilikan tanah adat Kei; akibat hukum hak kepemilikan tanah adat Kei; dan upaya dari fungsionaris adat maupun pemerintah. Hasil penelitian berkaitan dengan perlindungan hukum hak kepemilikan tanah adat Kei masih belum maksimal karena belum adanya peraturan daerah khususnya Kabupaten Maluku Tenggara berkaitan hak kepemilikan tanah adat Kei. Akibat hukum hanya dilakukan dengan sanksi adat oleh tokoh-tokoh adat. Upaya hukum akan maksimal dengan peraturan daerah terkait perlindungan hukum hak kepemilikan tanah adat Kei.

Abstract

Terjadinya pandemic Covid-19 tidak terlepas dari persoalan kerusakan lingkungan hidup yang terjadi. Nampak nya ada persoalan paradigma dalam berelasi antara manusia dengan lingkungan hidupnya. Metode pendekatan yuridis sosiologis digunakan dalam penelitian ini dengan penggunaan data primer yang diperoleh melalui studi lapangan dan wawancara. Data yang diperoleh kemudian dianalisis secara yuridis kualitatif. Dari hasil penelitian diketahui bahwa perubahan paradigm diperlukan ketika manusia berelasi dengan lingkungan hidupnya. Kearifan lokal telah mengajarkan sebuah etika lingkungan hidup, saling menghormati dan selalu menjaga keseimbangan dan keharmonisan lingkungan hidup. Paradigma ini lah yang sebaiknya menjadi dasar dalam berelasi manusia dengan lingkungan hidupnya di masa covid-19 kini.

Abstract

Notaries are public officials (openbare ambtenaren) appointed by the Ministry of Law and Human Rights (KEMENKUMHAM) who have the authority to make authentic deeds. The notary deed clearly explains the rights and obligations of the parties so that the notary deed becomes the strongest and most complete means of evidence because it can prove the truth of its contents compared to a deed made privately. If a Notary as a public official is proven to have made a mistake in the deed they made, then as a result of their actions they can be held accountable both criminally and civilly if it causes a loss. In the case of the South Jakarta District Court decision number 782/PDT.G/2020/PN JKT.SEL a Notary in Tangerang was involved in a civil case of unlawful acts that resulted in the deed’s cancellation. A notary deed that is canceled by a court decision does not mean the result of a notary's mistake in making the deed, but can also be caused by an error or negligence on the part of the parties resulting in a lawsuit because the notary has made the deed in accordance with the regulations. The notary as a public official has the right to refuse not to notify the contents of the deed in accordance with the oath of office they uttered and taking the minutes of the deed and calling the notary must go through the approval of Notary Honorary Council as an institution that has the authority to carry out guidance and supervision of the notary and the existence of the right of refusal. become a form of legal protection for Notaries when carrying out their duties. This study uses normative legal research methods, by analyzing court decisions as the primary legal.

Abstract

Institution Banking is a financial institution that has strategic value in a country's economy. To achieve the specified goals, the company will use procedures that are most appropriate to the activities carried out by the company, especially in providing credit to its customers. In banking practice, we will know that there are sequences of activities or processes that occur starting from the credit applicant seeking information at the bank until the withdrawal of the loan can be realized. To obtain a clearer picture, these activities can be classified into three stages, namely: those interested in credit seeking information, obtaining information, and receiving forms (forms for submitting credit applications) from the bank, those interested in credit filling in and submitting forms to until the credit application is approved by the bank, the credit applicant applies for the realization of a credit withdrawal and the credit granting bank will realize it and to realize the credit a credit agreement is made first, where in banking the credit agreement can be made by notarial deed and private agreement

Abstract

Pencemaran air di sungai menjadi masalah serius di Indonesia, terutama di Sungai Brantas, Jawa Timur. Pencemaran ini disebabkan oleh limbah industri yang dibuang ke sungai, menyebabkan kematian massal ikan dan mengancam kesehatan masyarakat yang bergantung pada air sungai. Penelitian ini bertujuan untuk menganalisis tanggung jawab pemerintah daerah dalam mengelola dan mengawasi kualitas air sungai, terutama dalam konteks Putusan Pengadilan Negeri Surabaya Nomor 08/Pdt.G/2019/PN Sby. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan studi kasus. Sumber data primer adalah putusan pengadilan, sedangkan sumber data sekunder meliputi peraturan perundang-undangan, literatur, dan penelitian sebelumnya. Hasil penelitian menunjukkan bahwa pemerintah daerah memiliki kewenangan yang signifikan dalam pengelolaan dan pengawasan kualitas air sungai, namun dalam kasus Sungai Brantas, terdapat kelemahan dalam implementasi kewenangan tersebut. Putusan pengadilan mengkritik respons yang tidak memadai, pemantauan yang lemah, dan kurangnya koordinasi dari pemerintah daerah. Penelitian ini merekomendasikan penguatan koordinasi antara pemerintah pusat dan daerah, peningkatan kapasitas personel, penegakan hukum yang tegas, pemanfaatan teknologi, pelibatan masyarakat, serta penelitian dan pengembangan lebih lanjut untuk meningkatkan pengelolaan kualitas air sungai di Jawa Timur.

Abstract

Based on the Preamble to the 1945 Constitution of the Republic of Indonesia, the fourth paragraph refers to the ideals to be implemented within a single composition of the Republic of Indonesia. Article 28 C paragraph (1) of the 1945 Constitution of the Republic of Indonesia mandates that every person has the right to develop himself through meeting his basic needs, has the right to receive education and to benefit from science and technology, arts and culture, to improve for the quality of his life and for the welfare of humanity. This research aims to analyze legal politics in implementing the fulfillment of Minimum Service Standards (SPM) in Early Childhood Education (PAUD) in Indonesia. This research is normative legal research with a normative juridical approach. The research results show that the implementation of SPM in the PAUD sector is very important to ensure that every young child receives quality educational services. Article 11 of Government Regulation Number 2 of 2018 concerning Minimum Service Standards explains that local governments are obliged to implement SPM to fulfill the types of basic services and quality of basic services that every citizen has the right to receive. The implication is that the implementation of Minimum Service Standards (SPM) in Early Childhood Education (PAUD) is very important to ensure that every young child in Indonesia receives quality educational services, which ultimately contributes to improving the quality of life and human welfare.

Abstract

Penelantaran anak merupakan masalah yang disebabkan oleh berbagai faktor, dengan kemiskinan sebagai faktor utama. Penelitian ini bertujuan untuk mengkaji bagaimana peran negara dalam menangani persoalan kemiskinan serta menganalisis kebijakan dan langkah-langkah yang diambil oleh pemerintah melalui program-program yang telah dirancang.
