Abstract

One example of problems in environmental law that the author encountered is in the District Court Decision Number 591 / Pdt.G-LH / 2015 / PN.Jkt.Sel and the High Court Decision Number 540 / PDT / 2017 / PT.DKI which essentially contained fires forest that occurs in the Meranti Islands, which is an area belonging to PT National Sago Prima (PT NSP). In the legal considerations of the District Court judges, PT NSP was declared to have committed an illegal act which resulted in a forest fire because it was considered negligent in preventing and anticipating the forest fire. However, in the legal considerations of the High Court judges, the panel of judges has a different opinion, namely that the forest fire occurred not because of negligence by PT NSP but occurred because of a natural disaster. Then what is the basis for the judge's consideration in the limitation of enforcement of actions against the law and force majeure against environmental damage due to forest fires? Legal certainty has not been achieved due to differences in opinion regarding the status of forest fires because the Judges at the District Court and the High Court have different considerations. Apart from that, the permits required by PT NSP to run its business are also deemed non-existent, whereas in fact the permit is already owned, even though it is not yet under PT NSP's name.

Abstract

Notary is a public official who is guided by UUJN which thus gives the Notary full authority to make a Deed, along with the obligation to keep the contents of the Deed, as in the Notary’s commitment to his oath or promise. Thus the Deed made by the Notary is confidential and the entire process of maintaining it is a confidentiality legal protection effort. However, the fact that a Notary can be summoned to make inquiries and become a witness in a court permitted by law presents a dilemma in itself with the promise of Notary it should. To overcome this dilemma, the Notary is facilitated with a right called dissenters rights, which then gives the option for the Notary to deny his position as a witness in certain circumstances. Considering this, the author would like to see the implementation of the dissenters rights according to UUJN and also the limitations of the confidentiality of the Deed that the author will be conducted with normative juridical research using a statue approach, as well as using secondary data from books and scientific writings relevant to the dissenters rights of notary and confidentiality of the Deed. After conducting research, the authors identified that in the of dissenters rights of refusal of a Notary as an obligation stated in the law attached to his or her job duties, it has not been carried out clearly due the provision of Article 66 paragraph (1) UUJN which weakens the confidentiality of Deeds and dissenters rights.

Abstract

The existence of animal in this world is needed for human needs and often overused causes the extinction of these animals. One of the activities that occur in the extinction of animals is that trade is carried out not only for endangered animals nationally and internationally. Sulcata tortoise are listed at CITES and IUCN as endangered spesies, at 2018 TRAFFIC report for Indonesia there is still a lot of trade in these endangered species that means Sulcata tortoises can’t be trade without illegal and if want to trade their have to had some permission for trading Sulcata tortoise. The problem is Indonesia doesn’t legally protecting the trade of Sulcata tortoises. Endangered species, so that legally in Indonesia allow these endangered animals to be traded. With this, the question arises how are the legal protection of the Sulcata tortoise internationally and how it is adopted nationally. Internationally, the Sulcata tortoise is said to be an endangered species, so that trade is not permitted arbitrarily without the required documents, but nationally in Indonesia, the Sulcata tortoise is traded widely, causing the population of Sulcata tortoises to decrease. The laws and regulations in Indonesia are not fully regulated protected Sulcata tortoises because the ratification is carried out in the form of a presidential decree so that it is incomplete with the regulations that adhere to the ratification of the international treaty so that it is not only a complete legislation but also the legal structure and legal culture that affect the that matter.

Abstract

The male order in a family is very important and in terms of the division of inheritance men will get more inheritance than girls, this provides unbalance for women.  Thus, it gives a sense of injustice to girls because they do not get a role and also get a smaller share than men.  In the division of the estate each heir will get his share which the male will get a larger share than the female. This will cause an imbalance between the male and female parts so that it will cause disputes in terms of the division of inheritance.

Abstract

Holders of land in the form of Building Rights Title may be owned by Indonesian Citizens and legal entities established under Indonesian law and domiciled in Indonesia. The Term of Use of Building Rights Title is granted for the first time for 30 years and may extend to a maximum of 20 years. The extension of the Building Rights set forth in Art 27 paragraph (1) of Government Regulation Number 40 Year 1996 on the Right of Exploitation, the Right of Building and the Right of Use of Land/PP 40/1996 may be filed by the rights holder no later than 2 years before the expiry of the Building Rights Period and in Art 41 of Regulation of State Minister for Agrarian Affairs/Head of the National Land Affairs Agency Number 9 Year 1999 on Procedure for Granting and Nullifying Right to State Land and Management Right may be filed within a period of 2 years prior to the expiry of the Building Rights period. According to lex superior derogate the inferiori principle the application for extension of Building Rights should be made in accordance with Art 27 paragraph (1) of PP 40/1996. Type of research is empirical legal research with data collection techniques by literature study and interviews to the Land Office in Central Jakarta. The conclusion of this paper is that holders of Building Rights whenever can extend their rights and no consequences made to whom filed extensions over the time limit in Art 27 paragraph (1) PP 40/1996.

Abstract

  Land registration is regulated by the Basic Agrarian Law Article 29 (UUPA) also Government Regulation Number 24 of 1997 about land registration that has a purpose to give guarantee of legal certainty of land. Alongs with the use of Indonesia land increasingly to remote areas, the businessmen that need land as the business facility such as PT. Sinar Wijaya Plywood Industries did a request of Building Right to the land that was occupied by the community of Woriasi tribe. How the application procedure of the customary land Woriasi tribe relinquishment as the grants of Building Right to legal agency that is PT. Sinar Wijaya Plywood Industries already gives the legal certainty.The data collected from the field was analyzed descriptively qualitative where the primer and secondary data. The conclusion from the customary land Woriasi tribe relinquishment happened before between custom society with legal agency was agreed because discussion and fulfilment of the application of regulatory requirements Building Right. The state that holds the highest power could regulate the use of land also could be considered the aspects of the proposal that delivered and could be responsible by the applicant so appointed Decree of the Ministry of Agrarian and Spatial Planning / Head of the National Land Agency Number 34 / HGB / KEM / ATR / BPN / VI / 2019 is legality of the process of Building Right application.

Abstract

A notary is a public official authorized to do authentic deeds and has other authorities as referred to in this Law or based on other laws. This study aims to determine how a notary’s authority and responsibility as a deed maker is towards parties who do not recognize the deed. This type of research uses a doctrinal type because it is concerned about justice and good faith and aims to review the Notary Office Law. The literature study that will be worked on is legal documents such as the Law on the Position of Notary Public, Jurisprudence regarding related cases, and the decision of the West Jakarta District Court No.547/Pdt.G/2021/PN.Jkt.Brt. Based on the results of this study, it is the authority of the notary as the maker of the deed against parties who do not recognize the deed, stating that both parties have agreed and agreed to and at this moment, make a Sale and Purchase Agreement and Power of Attorney with the agreed terms and conditions. The responsibility of a Notary in doing a deed is the responsibility of a Notary in doing an authentic deed due to negligence in doing a deed. The negligence, in this case, is if a Notary has done a deed not by the applicable regulations.

Abstract

The State has obligation to maintain and utilize natural resources wisely and responsibly, besides, The State is also responsible for guaranteeing the right to a prosperous life born and inner, to reside, and to obtain a good and healthy living environment for its people, as stated in the 1945 Constitution of the Republic of Indonesia. Today, we still encounter environmental conditions that continue to experience destruction in almost all regions in Indonesia. Ministry of Environment and Forestry says, forest and land fires are still the biggest problem in environmental problems. However, one of the courts in Indonesia with Decision Number 233/Pid.B/LH/2020/Pn.Pbu has decided to acquit PT Kumai Sentosa for allegedly burning forest and land in Central Kalimantan. What was the judge’s reasoning on the case? Is the judge's decision in the case appropriate for the fulfillment of environmental protection efforts? The author examines the problem by using normative legal research methods. The research show that there’s an injustice in the decision, especially in the context of environmental protection efforts because the judge tends to be biased in deciding this case, as can be seen from the existence of several things that are ignored for consideration by the Panel of Judges. It is better if the court, which has an important role in fulfilling the environment, must be more careful in deciding cases related to the environment, because in this case the acquittal of PT Kumai Sentosa could set a bad precedent for environmental protection efforts in Indonesia’s future.

Abstract

This research discusses the relationship between green open space (RTH) and good environmental governance (good environmental governance). Good environmental governance is an extension of good government, which refers to the principles of good governance in the context of the environment. The government's role in providing green open space that can be enjoyed by the wider community is closely related to public policy making. This public policy involves a policy-making process that leads to certain goals and involves steps taken by the government. Green open space has various benefits, both ecologically, socio-culturally, and aesthetically. Green open space provides comfort, improves the microclimate, increases oxygen reserves, and serves as a means of recreation, social interaction and regional identity. The existence of green open space is also important in maintaining a balance between the natural environment and the built environment in urban areas. In managing green open space, it is important to apply the concept of good environmental governance by taking into account the sustainability of natural resources. Environmental governance understands environmental management through interactions between the state and its people. Green open space management also involves the process of planning, utilization and control which plays an important role in forming a planned urban spatial layout. This study focuses on Karawang Regency, where there is an imbalance between the amount of green open space with public facilities and private buildings. Even though there is still empty land that can be used as green open space, its utilization has not been optimal. In the Karawang Regency strategic plan, an analysis of land use and green open space needs is carried out based on the area and population. Good green open space management efforts in Karawang Regency can help achieve good environmental governance and improve the quality of the environment and the quality of life of its people.

Abstract

Burung cendrawasih merupakan burung endemic asli Papua yang sekarang memiliki status dilindungi dan berpotensi punah. Banyak hal yang dapat mengakibatkan terjadinya kepunahan terhadap burung cendrawasih seperti perburuan liar, rusaknya lingkungan hidup atau habitat asli burung cendrawasih dan juga terdapat faktor susah untuk berkembang biak. Dengan adanya hal – hal tersebut yang terus menerus terjadi dapat membuat terancamnya populasi burung cendrawasih bahkan dapat membuat jenis burung endemic asli papua ini menjadi terancam punah.
