Abstract

Abstract The emergence of tourism as a major industry is one of the most remarkable changes that have occurred in global economic activity. Over the last three decades, issues related to the environment and sustainable development related to tourism, especially in Bali, have developed from a marginal topic into a focus of consideration and research. The purpose of this research is to find a novelty in the use of the concept of green tourism as a method that is seen as capable of supporting sustainable tourism development based on local wisdom, especially in Bali. The research used is normative legal research on Law no. 10 of 200b concerning Tourism with a statutory and conceptual approach. This study found that various statutory regulations, including Law no. 10 of 2009 concerning Tourism, namely through sustainable tourism all resources can be managed so as to meet needs and maintain cultural integrity, ecological dimension biodiversity, and system life.Keywords: Bali; Green Tourism; Sustainable Tourism; Local Wisdom.

Abstract

Investment is one of the driving means of strengthening the country's economy. One of the expected ways to increase investment is through foreign investment. Various regulatory measures have been carried out by evaluating and analyzing regulations and policies related to the licensing process for foreign investment. A new legal breakthrough is in the form of the enactment of the Omnibus Law on the Job Creation Law that is being pursued by the government aims to make it easier for foreign investors to obtain a permit. The formulation of problems that can be studied include how the omnibus law applies to simplifying licensing in an effort to facilitate the licensing process related to foreign investment. This study aims to examine the urgency of the implementation the Omnibus Law to simplify the licensing process in an effort to facilitate foreign investment in Indonesia. This research is a normative legal research, which uses primary, secondary, and tertiary legal materials. The results of the study show that efforts to simplify the licensing process for foreign investment in Indonesia become a reference for the government with foreign investors in facilitating sustainable development efforts in the tourism sector which aims to increase large amounts of investment, the availability of jobs, and is expected to improve the country's economy. So in the application of the Omnibus Law, it is expected to be able to accommodate interests that aim to prosper the community.

Abstract

This study analyzes the effectiveness of regional government supervision over river water quality, focusing on the case of Brantas River pollution in East Java. Using normative juridical research methods with a case study approach, this research examines the role of regional government in monitoring and controlling river water quality through regulatory frameworks and institutional coordination. The study utilizes primary data from the Surabaya District Court Decision No. 08/Pdt.G/2019/PN.Sby and secondary data from relevant legislation and literature. The findings reveal significant weaknesses in inter-agency coordination and law enforcement mechanisms. The research concludes that regional government supervision effectiveness remains low due to limited human resources, weak institutional coordination, and insufficient political will. The study recommends strengthening inter-agency coordination, enhancing supervisory capacity, and implementing stricter sanctions to improve environmental protection.

Abstract

This research aims to examine how the protection given to notary employees in the event of making deeds that are legally defective is reviewed based on Law Number 13 of 2003 about employment and also regarding the responsibility of notary employees for deeds that are legally defective. This research journal uses a normative juridical research approach. Sourced data from laws and other literature data. The result of the research conducted is that the protection of notary employees has not been specifically regulated in the Notary Profession Law (Undang-Undang Jabatan Notaris), but from what has been described previously, it confirms that labor or worker is very necessary to get protection and has an important role that is needed as well as notary employees who are included as labor and also witnesses in carrying out various tasks are very necessary to get protection so that the welfare and justice for notary employees can be properly guaranteed. Therefore, the author is interested in writing a research with the title Protection of Notary Employees in Legal Defective Deed Making Agreements Reviewed from Law Number 13 of 2003 about employment.

Abstract

This article is entitled, Legality of Property Rights through Land Information issued by the Village Head, using a normative research type and using secondary data as analysis material. The results of the analysis are land ownership rights in the UUPA as proof of ownership, namely a certificate. However, the village head's SKT can be used as a historical guide in registering land to obtain a certificate at the land office, on the basis of physical and written evidence with coherent research on land ownership and supporting written evidence. This decision is based on Indonesia using a negative publication system that has a positive tendency. So the Village Head's Land Certificate can only be used as written evidence to register for labor, but the village head's SKT is not proof of recognized land ownership rights.

Abstract

Land rights, including cultivation rights, are an important aspect of a country's economic and social development. However, the complexity in implementing land rights is often a source of problems, especially related to overlapping land ownership and use status. Cultivation rights are a form of land right that has a primary nature. This means that this right gives permission to the holder to use the land in accordance with the specified purposes. The process of land registration and issuance of certificates by the National Land Agency (BPN) should provide clarity regarding ownership of land rights. However, in practice, there are still overlapping land ownership statuses which give rise to various problems. This problem involves land registration policies which are not yet fully capable of providing legal certainty for certificate holders. A land registration system that uses a negative approach, where land certificates are not an absolute means of proof, complicates the process of resolving land disputes. The impact is felt on people's lives, where land certificates become proof of ownership that has economic value. Concrete steps are needed to ensure clear land ownership and no overlap. This includes improving the land registration system, increasing coordination between relevant institutions, as well as outreach to the public about the importance of having a valid land certificate. The problem of overlapping land ownership is a serious challenge that needs to be addressed immediately. With cooperation between stakeholders and concrete steps, it is hoped that legal certainty in land ownership can be created, which will ultimately support sustainable development and community welfare.

Abstract

Forging a power of attorney deed has serious consequences, including: Legitimate property owners can lose their valuable assets without receiving compensation. It can also cause major financial losses to well-intentioned buyers. A power of attorney deed is a legal document that authorizes someone to sell property on behalf of the legal owner, and is usually made by a notary. Forgery of these documents can occur in various ways, such as forging signatures, using fake identities, collaborating with other parties to manipulate data, or involving corrupt notaries. Forgery of power of attorney deeds has serious impacts, both in the legal and economic realms. In the legal realm, legal owners can lose rights to their property without their knowledge, and the legal process for restoring rights is lengthy and complicated. To prevent forgery of power of attorney deeds to sell, several steps can be taken, including: Notaries must carry out strict verification of the identities and supporting documents of the parties involved in the transaction, including the use of biometric technology and digital verification systems. Increase training and awareness for notaries and their staff regarding document forgery techniques and how to detect them. Development of an integrated information system that allows notaries to check the validity of land certificates and related documents in real-time.

Abstract

The Indonesian Strategic Environmental Assessment (SEA) is governed by Law No. 32 of 2009 on Protection and Management of the Environment. However, the implementation of Strategic Environmental Assessment still faces significant challenges, especially in fulfilling the constitutional rights of citizens to a healthy and sustainable environment. The misalignment between Strategic Environmental Assessment (SEA) practices and constitutional principles, particularly regarding transparency, public participation, and environmental justice, has contributed to violations of environmental rights and the perpetuation of social injustice in the development processes. This study aims to analyze the constitutionality of SEA’s application in the context of sustainable development in Indonesia. This study uses a normative legal method with legislative, conceptual, and comparative approaches. The research results indicate that the implementation of SEA is still inconsistent with the Constitution, particularly in protecting environmental rights. Weakness of oversight and the lack of sanctions for violations of the Environmental Impact Assessment are the main obstacles to its implementation. This study has implications for the need for reforms in law enforcement, strengthening of oversight, and increasing community participation in the SEA process to ensure environmental protection and citizens’ constitutional rights.

Abstract

Artikel ini mengkaji kebutuhan integrasi pendekatan partisipatif, holistik, dan keadilan ekologis dalam pembangunan hukum lingkungan di Indonesia. Berdasarkan telaah literatur, ditemukan bahwa pendekatan hukum yang berlaku masih bersifat normatif, sektoral, dan minim pelibatan masyarakat. Pendekatan holistik dan prinsip keadilan ekologis belum terimplementasi secara efektif. Padahal, tantangan kerusakan lingkungan yang semakin kompleks menuntut adanya instrumen hukum yang tidak hanya menekankan kepatuhan formal, tetapi juga memperhatikan keterlibatan aktif masyarakat serta perlindungan ekosistem secara menyeluruh. Penelitian ini menekankan bahwa pembangunan sistem hukum lingkungan yang inklusif memerlukan paradigma baru dengan mengintegrasikan nilai partisipasi publik, pendekatan lintas disiplin, serta penerapan prinsip keadilan ekologis dalam setiap tahap perumusan maupun penegakan hukum. Dengan menggunakan analisis konseptual dan normatif, artikel ini mengusulkan kerangka hukum berbasis multilevel governance yang mendorong sinergi antara pemerintah pusat, pemerintah daerah, dan masyarakat sipil. Pendekatan ini diharapkan dapat menciptakan mekanisme hukum yang lebih adaptif, akuntabel, dan berkelanjutan dalam merespons dinamika permasalahan lingkungan hidup di Indonesia. Implikasi penelitian ini menunjukkan bahwa integrasi pendekatan tersebut tidak hanya akan memperkuat legitimasi hukum lingkungan, tetapi juga membangun kesadaran ekologis kolektif yang penting bagi keberlanjutan lingkungan di masa depan. Dengan demikian, hukum lingkungan di Indonesia dapat bertransformasi menjadi instrumen keadilan sosial dan ekologis yang sejalan dengan prinsip pembangunan berkelanjutan. Kata kunci: hukum lingkungan, partisipatif, holistik, keadilan ekologis.

Abstract

Padahal, tantangan kerusakan lingkungan yang semakin kompleks menuntut adanya instrumen hukum yang tidak hanya menekankan kepatuhan formal, tetapi juga memperhatikan keterlibatan aktif masyarakat serta perlindungan ekosistem secara menyeluruh. Penelitian ini menekankan bahwa pembangunan sistem hukum lingkungan yang inklusif memerlukan paradigma baru dengan mengintegrasikan nilai partisipasi publik, pendekatan lintas disiplin, serta penerapan prinsip keadilan ekologis dalam setiap tahap perumusan maupun penegakan hukum. Dengan menggunakan analisis konseptual dan normatif, artikel ini mengusulkan kerangka hukum berbasis multilevel governance yang mendorong sinergi antara pemerintah pusat, pemerintah daerah, dan masyarakat sipil. Pendekatan ini diharapkan dapat menciptakan mekanisme hukum yang lebih adaptif, akuntabel, dan berkelanjutan dalam merespons dinamika permasalahan lingkungan hidup di Indonesia. Implikasi penelitian ini menunjukkan bahwa integrasi pendekatan tersebut tidak hanya akan memperkuat legitimasi hukum lingkungan, tetapi juga membangun kesadaran ekologis kolektif yang penting bagi keberlanjutan lingkungan di masa depan. Dengan demikian, hukum lingkungan di Indonesia dapat bertransformasi menjadi instrumen keadilan sosial dan ekologis yang sejalan dengan prinsip pembangunan berkelanjutan. Kata kunci: hukum lingkungan, partisipatif, holistik, keadilan ekologis.
