Abstract

Perkawinan merupakan ikatan lahir batin antara seorang laki-laki dan seorang perempuan sebagai suami istri dengan tujuan membentuk keluarga atau rumah tangga yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perkawinan banyak dipengaruhi oleh bentuk, tradisi, kebudayaan, dijiwai oleh ajaran agama maka bagi masyarakat Hindu yang kawin beda agama terlebih dahulu harus disatukan agamanya melalui proses upacara Sudhi Wadani. Penelitian ini menggunakan pendekatan yuridis empiris. Dalam pengumpulan data dan bahan hukum, baik primer maupun sekunder, kasus yang dikumpulkan melalui wawancara dan pembelajaran dokumen-dokumen hukum, sedangkan teknik deskripsi analisis dilakukan secara kualitatif. Upacara Sudhi Wadani suatu upacara perkawinan di mana pihak laki-laki beragama Hindu sedangkan pihak perempuan menganut agama lain, tujuannya adalah agar status perempuan sama dengan pihak laki-laki dan sekaligus bertujuan agar pihak perempuan menjadi sah memeluk agama Hindu. Sehingga, upacara Sudhi Wadani adalah merupakan prasyarat mutlak dalam perkawinan yang berbeda agama. Filosofi yang terdapat upacara Sudhi Wadani akibat adanya perbedaan agama akan dapat menyatu secara utuh dalam sumpah melalui upacara untuk setia terhadap agama Hindu. Melalui pelaksanaan upacara Sudhi Wadani diharapkan dapat menumbuhkan sikap dan sifat yang harmonis dari sumpah tersebut, sebab sudah diketahui bahwa jika akhirnya sumpah itu dilanggar maka akan menimbulkan kehancuran dalam rumah tangganya.

Abstract

This study aims to analyze the challenges faced in the implementation of collateral seizure on land mortgages in Indonesia, particularly in the context of legal uncertainty and complicated execution procedures. Using a descriptive method and a juridical-normative approach, this study finds that the main issue in the execution of land collateral is the uncertainty regarding the ownership status of the land, often caused by unresolved land disputes or unregistered ownership. Additionally, the land execution process, which involves lengthy court procedures and the existence of land mafia, further worsens the efficiency of execution. Based on these findings, the study suggests several reforms, including improvements to the land registration system, more efficient judicial procedures, and enhanced legal protection for all parties involved. These reforms are expected to accelerate and simplify the process of executing land collateral as a legitimate and accountable form of credit guarantee.

Abstract

This study examines defaults in credit agreements secured by land collateral at PT BPR Gajah Mungkur, with particular emphasis on legal protection mechanisms available to creditors when debtors fail to meet their obligations. Although credit agreements are supported by a strong legal framework, incomplete registration of mortgage rights can undermine the creditor’s legal standing. The objective of this research is to address gaps in existing studies concerning creditor protection in mortgage enforcement and to analyze the implications of the Supreme Court Decision No. 469 K/Pdt/2024 on the practice of credit agreements in Indonesia. A normative juridical approach was employed, utilizing data sources such as court decisions, statutory regulations, and pertinent legal literature on credit agreements. The findings indicate that incomplete or delayed registration of mortgage rights significantly impedes creditors’ ability to execute collateral. The case study of PT BPR Gajah Mungkur demonstrates that, despite the formal validity of credit agreements, failure to register as a preferred creditor adversely affects the creditor’s right to debt repayment. This research contributes to legal theory by reinforcing the critical role of mortgage registration in enhancing creditor protection. Practically, it offers valuable insights for legal practitioners, emphasizing the necessity of properly completing the mortgage registration process to safeguard creditor interests in cases of debtor default.

Abstract

Amicus curiae comes from the Latin "amicus" which means "friend" and "curiae" which means "court". In English it is called "Friends Of Court" in Indonesian it is called Friends of Court. Amicus curiae is derived from Roman law, which was later developed and practiced in the common law system, which allows courts to invite third parties to provide information or legal facts relating to unfamiliar issues. Amicus curiae's opinion, when displayed in court, can increase the judge's confidence in the criminal evidence system. Regarding the Amicus curiae's opinion, there is no regulation in the provisions of the criminal procedural law so that the judge is still hesitant to use the Amicus curiae's opinion. The research method used is normative juridical. The results of the research in writing that because Amicus curiae does not yet have clear rules in the judiciary in Indonesia, it is difficult for judges to consider the opinion of Amicus curiae submitted in court and also difficult to relate to the evidence contained in Article 184 of the Criminal Procedure Code because The Amicus curiae does not yet have a clear form in the Indonesian judiciary

Abstract

Bentuk perilaku negatif yang terjadi dikalangan remaja adalah bullying, kasus bullying terus meningkat pada masa anak-anak hingga remaja. Konsep bullying diartikan sebagai suatu bentuk dari perilaku agresif yang dilakukan secara sengaja untuk menjahati atau membuat individu merasa kesusahan, terjadi berulang kali dari waktu ke waktu dan berlangsung dalam suatu hubungan yang tidak terdapat keseimbangan kekuasaan maupun kekuatan. Karakteristik bullying nampak pada tingkah laku agresif atau kejahatan disengaja, dilakukan berulangkali dalam waktu lama, dan dilakukan pada kondisi interpersonal yang tidak seimbang kekuatannya. Bullying dapat terjadi secara langsung maupun tidak langsung. bullying yang bersifat fisik yaitu melakukan agresi dengan kontak fisik, agresi verbal baik dengan kata-kata maupun tulisan.
