Abstract

The problems faced by the families of mualaf in Malaysia require serious handling and management by looking at the increasing number of mualaf every year. The National Board that has the responsibility to deal with this problem is the Council or State Department of Islamic Religion. Other non-governmental institutions are also involved in handling the problems of mualaf families such as The Islamic Welfare Organization Malaysia/ Pertubuhan Kebajikan Islam Malaysia (PERKIM) and Urusetia Saudara Kita (USK). This research will analyze the strategy of a governmental or non-governmental organization—the Islamic Welfare Organization Malaysia (PERKIM) in dealing with and managing the problems of converted families. This research is qualitative–empirical with a juridical-sociological approach. Primary data were collected from interviews with respondents located in Selampit Village, Malaysia. The results show that the PERKIM organization helps mualaf families in managing the conflicts they experience through cognitive empowerment strategies in handling and managing problems. Islamic preachers from PERKIM changed the speculations of mualaf parents who considered Islam immoral and troublesome religion by conveying da'wah bil-hikmah and da'wah fardiah through house-to-house visits and providing food, protection, education, financial and moral support. It can be concluded that the role of PERKIM in overcoming this conflict is good but not optimal, as can be seen from the activities, programs and policies in resolving the conflict.

Abstract

The urgency of proper inheritance distribution is greatly needed in society. Therefore, an appropriate concept and legal framework are necessary in practice to ensure that the essence of justice and the objectives of Islamic law in inheritance are not compromised. This is exemplified by the practice in Pagelaran village, where inheritance is distributed not according to Islamic law, even though the majority of the population is Muslim. They have a unique method of rotating the inheritance among heirs, taking turns. This practice presents an interesting subject for analysis using the theory of maqasid shari’ah to understand the essence of the objectives behind the enactment of inheritance law in Islam. This study is empirical, using a sociological and conceptual approach. The results can be summarized in two aspects: (1) The practice of rotating inheritance in Pagelaran village is carried out alternately among heirs based on mutual agreement, and in practice, this is driven by the limited land available for distribution. It also serves as a preliminary step toward permanent land division, with the proceeds from the rotation used to cover the costs of certifying the land for each heir; (2) The practice of rotating inheritance fulfills the purpose of maqasid shari’ah as outlined by Jasser Auda and aligns with the essence of the enactment of inheritance law, ensuring the fair distribution of inheritance. This is due to the mutual agreement among the heirs, while also considering the aspects of protection and resilience within the family.

Abstract

This research endeavours to critically examine the role of cultural mediation by Kyai and Imam in mitigating the incidence of divorce within coastal Muslim communities in Rembang and Melaka. It seeks to understand how these religious leaders influence social dynamics and foster community cohesion, stabilizing familial relationships in these regions. The research used a qualitative approach with interview methods with religious leaders, community members, and legal professionals to identify the social, religious, and legal roles of Kyai and Imam as mediators in family conflicts. The findings reveal that Kyai and Imam are crucial in guiding troubled couples through domestic conflict by integrating religious teachings and formal legal regulations. Kyai and Imams provide spiritual advice and authoritative figures capable of providing practical solutions to resolving family problems. However, challenges related to accessibility to formal mediation and the limitations of informal mediation point to the need for strengthened integration between religious patronage and the state legal system. The study concludes that Kyai and Imam patronage significantly reduces divorce rates. However, closer collaboration between the formal legal and faith-based mediation mechanisms is needed to increase effectiveness. This study offers a fresh perspective on the connections among religion, legal systems, and family mediation within Muslim communities.

Abstract

The high rate of child marriage in Indonesia following the marriage dispensation procedure demands an application to help judges decide the proposals accurately and effectively. This 4D development model research aims to create a standard reference in making decisions regarding the dispensation of marriage proposals using an application. The first stage is defining variables used at the application as measurement, the second stage is designing, namely the process of preparing a conceptual framework in the form of technological innovation, the third stage is developing technological innovation and the fourth stage is disseminating, namely the use of an application. At the defining stage, the variables to measure the level of urgency in granting the marriage dispensation include Social, Partnership Role, Financial, Spiritual, and Reproductive or Sexual Readiness. At the designing stage, the Dispen-Ku application is created using Kodular, a website that provides tools for creating Android applications using block programming. In the disseminating stage, the Dispen-ku application which has been uploaded to the Playstore page is distributed to research subjects, namely two judges in Religious Courts.

Abstract

Indonesian Government has made changes to the minimum age limit for marriage in the Marriage Law to prevent the practice of underage marriage and protect children's rights, which are part of human rights. This research aims to examine the sociological aspects of changes in the age limit for marriage in Indonesia, which basically uses the Universal Human Rights approach as the main instrument in revising the Marriage Law in Indonesia by using the view of human rights put forward by Mashood A. Baderin. This research is a normative juridical research that uses a historical and conceptual approach. The results of this research show that two sociological aspects underlie changes in the minimum age limit for marriage in Indonesia, namely the health and education aspects. Changes in the minimum age limit for marriage are intended to fight for children's rights, especially health and education. According to Mashood A. Baderin, the Al-Qur'an and Hadith have regulated children's rights. Changes in the minimum age limit for a marriage intended to fight for children's rights align with Mashood A. Baderin's views on children's rights in Islamic law.

Abstract

Abstrak: Childfree adalah sebuah pilihan hidup untuk tidak memiliki anak, setelah atau sebelum menikah, baik itu anak kandung, anak tiri, ataupun anak angkat. Artikel ini bertujuan untuk mendeskripsikan pandangan Abu Hamid al-Ghazali dan Nur Rofiah terhadap childfree, mengkaji persamaan dan perbedaan serta menganalisis dasar pemikiran keduanya. Artikel ini merupakan penelitian hukum normatif dengan metode komparasi. Hasil penelitian menunjukan bahwa menurut al-Ghazali keputusan childfree adalah meninggalkan keutamaan (tarku al-afdhal), apabila untuk bersenang-senang hukumnya makruh. Menurut Nur Rofiah childfree diperbolehkan (mubah) tetapi harus berdasarkan alasan bijak dan persetujuan pasangan. Nur Rofiah menekankan bahwa menjadi childfree tidak menghilangkan tanggung jawab sosial seseorang kepada anak terlantar. Kedua tokoh ini menjelaskan childfree bukanlah pilihan yang haram. Perbedaannya, al-Ghazali menyatakan tujuan pernikahan adalah memiliki keturunan, sedangkan menurut Nur Rofiah tujuan pernikahan adalah untuk menemukan ketenangan, kasih sayang dan rahmat. Al-Ghazali menjadikan hadits Rasulullah yang menyeru sahabat untuk menikah dan berketurunan serta memilih wanita yang pengasih dan subur sebagai dasar pentingnya keberadaan anak, berbeda dengan Nur Rofiah yang menyatakan bahwa tujuan pernikahan telah disampaikan dalam Q.S. Ar-Rum ayat 21. Selain untuk menciptakan ketenangan jiwa sebagai pasangan, pernikahan juga untuk berusaha bersama menciptakan dunia yang lebih baik sebagai khalifah fi al-ardh. Abstract: Childfree is a life decision of a person or couple for not having children, before or after marriage, be it biological children, stepchildren, or adopted children. This article aims to describe the perspective of Abu Hamid al-Ghazali and Nur Rofiah on childfree, examine the similarities and differences and analyze the basis of their thoughts. This article is normative legal research with a comparative approach. The results show that according to al-Ghazali, the decision to be childfree is leaving virtues (tarku al-afdhal), if it was chosen because of selfishness or for having fun, childfree is makruh. According to Nur Rofiah, being childfree is permissible (mubah), but it must be based on wise reason and be approved by both parties. She emphasizes that being childfree does not eliminate the social responsibilities of neglected children. Both al-Ghazali and Nur Rofiah agree childfree is not forbidden (haram). The difference is that al-Ghazali discusses the main purpose of marriage is to have children. In contrast, According to Nur Rofiah, the main purpose of marriage is to find tranquillity, affection and mercy. The basis of al-Ghazali’s perspective is the hadith of Rasulullah, which calls on his friends to get married and have children, and his recommendation to marry a loving and fertile woman. Unlike Nur Rofiah, she discusses that the main purpose of marriage is written in Q.S. Ar-Rum verse 21. Besides creating peace of mind as a couple, marriage is for making a better world together as Khalifah fi al-ardh.

Abstract

This study examines the legal consequences of Constitutional Court Decision No. 22/PUU-XV/2017 on the minimum marriage age and its relationship with the rising number of marriage dispensation cases before the Malang Religious Court. Using an empirical juridical (socio-legal) approach, primary data were collected through interviews with judges and court clerks, while secondary data comprised relevant statutes, the Constitutional Court decision, and selected court rulings. The findings indicate that the decision was accommodated through Law No. 16 of 2019, which equalized the minimum marriage age at 19; however, implementation has redirected practices toward the dispensation mechanism. SIPP data show a sharp increase in dispensation petitions in the Malang City Religious Court (83 in 2018; 183 in 2019; 260 in 2020; 261 in 2021). Key constraints include open-textured dispensation standards, weak operational guidance and cross-sector coordination, the voluntary nature of proceedings, and broad judicial discretion that normalizes dispensations. Policy recommendations include tightening “urgent reasons” criteria, issuing stricter judicial guidelines, and requiring health-psychological assessments and child-protection involvement.
