Abstract

Polygamy marriage has been an ongoing worldwide debate. The regulation of polygamy marriage in Turkey, Russia, and Jordan faces challenges in addressing the complexity of social issues. This article aims to explore and evaluate the polygamy marriage regulation in these three countries, from a social and fiqh (Islamic jurisprudence) priority perspective. The fiqh priority perspective emphasizes the common good and prioritizes long-term benefits. The article outlines diverse views on polygamy, including arguments supporting polygamy as a solution to specific social problems, as well as the complex social implications of polygamous practices. Furthermore, a comparative study of polygamous regulation in Turkey, Russia, and Jordan reveals differences in approaches to governing polygamy and how it affects societies within different social, cultural, and religious contexts. Through an analysis of social perspectives and fiqh priority, this article provides a deeper understanding of the regulation of polygamous marriage in Turkey, Russia, and Jordan, along with considerations that need to be taken into account in addressing this issue.

Abstract

BBerdasarkan hasil penelitian terkini, sebanyak 217 perempuan di desa Pandansari melakukan pernikahan di bawah usia 19 tahun yang berdampak pada putusnya jenjang pendidikan. Hal ini memicu permasalahan sosial seperti masalah kesehatan, penurunan tingkat pendidikan, dan dampak negatif terhadap sumber daya alam serta situs-situs kuno. Oleh karena itu, untuk mengatasi masalah sosial akibat pernikahan dini, perlu dilakukan upaya pengontrolan. Salah satu caranya adalah dengan menyelenggarakan kegiatan “sosialisasi pentingnya pendidikan dan dampak pernikahan dini”, yang dikhususkan pada siswa-siswi Madrasah Alyah Al-Hidayah sebagai kelas sosial yang berpotensi melakukan mobilitas sosial yang lebih tinggi melalui rekonstruksi pendidikan John Dewey. Yaitu memaparkan permasalahan sosial yang terjadi akibat pernikahan dini disekeliling peserta didik kemudian merangkai kembali atau membangun kembali berbagai pengalaman dan peristiwa yang dialami seseorang dalam kehidupan sosialnya sehingga setiap hal baru memiliki arah dan makna yang lebih jelas. Metode pelaksanaan dibagi menjadi tiga tahap yaitu tahap observasi, Penyampaian Materi dan Focus Group Discussion. Selanjutnya pengukuran perkembangan kognitif dan Sikap peserta didik melalui kuosioner. Hasilnya, ada peningkatan kognitif dan sikap peserta didik terhadap pentingnya pendidikan, dimana 100% peserta menolak pernikahan dini dan 88% berniat melanjutkan pendidikan hingga jenjang sarjana, serta 38% ingin bekerja sekaligus sarjana setelah mengikuti sosialisasi “Pentingnya pendidikan dan dampak pernikahan dini.

Abstract

Art 222 Law Number 7 year 2017 concerning General Elections, regulates the provisions of the threshold where the acquisition of seats in the DPR must be 20 percent or obtain valid votes nationally as much as 25 percent then political parties can nominate and nominate pairs of presidential and vice-presidential candidates. Setting the Presidential Threshold in the election of President and Vice President in Indonesia from a constitutional and human rights perspective brings its own problems in the Indonesian constitutional system. The Presidential Threshold system does give rise to privileges for certain parties. This is because only parties that meet the threshold can compete directly in the presidential election. It is for this reason that the privileges of these major parties have given birth to political cartels. What is bad for democracy is that it eliminates equal competition for all potential candidates to contest the Presidential election. The Presidential Threshold is not justified in eliminating or emasculating the meaning of democracy which provides rights and freedoms for citizens. Among the constitutional rights include the right to vote, the right to nominate (the right to be a candidate), and the right to nominate candidates, these are rights guaranteed by the 1945 Constitution of the Republic of Indonesia which everything is reduced because of this Presidential Threshold provision.

Abstract

In accordance with National Land Agency Regulation No. 1 of 2021, this study investigates the adoption of electronic land certificates. The need to enhance land services in Indonesia, especially in the fight against the land mafia and the settlement of intricate agrarian disputes, is what makes this research so urgent. Creating an electronic certificate system is essential to updating public services in light of the rise in fraud and land ownership disputes. Significant obstacles stand in the way of digital transformation in land management, nevertheless, such as the requirement for a strong legal framework and prepared infrastructure. The novel aspect of the study is its evaluation of infrastructure preparedness for electronic certificates, a topic that has received little attention in earlier studies. The responsive law theory of Philippe Nonet and Philip Selznick is used in this analysis to emphasize how crucial adaptable legal frameworks are for addressing societal shifts. The results indicate that increasing digital infrastructure and raising public understanding of land technology are essential to the success of electronic land certificates. This invention has the potential to improve confidence in the National Land Agency and expedite the settlement of land disputes. According to Indonesian law, both paper and electronic documents are legitimate; nevertheless, for long-term use, rules pertaining to data security, technology, and public education need to be strengthened. The digital revolution of land administration requires cross-sector cooperation.

Abstract

This research endeavours to critically examine the role of cultural mediation by Kyai and Imam in mitigating the incidence of divorce within coastal Muslim communities in Rembang and Melaka. It seeks to understand how these religious leaders influence social dynamics and foster community cohesion, stabilizing familial relationships in these regions. The research used a qualitative approach with interview methods with religious leaders, community members, and legal professionals to identify the social, religious, and legal roles of Kyai and Imam as mediators in family conflicts. The findings reveal that Kyai and Imam are crucial in guiding troubled couples through domestic conflict by integrating religious teachings and formal legal regulations. Kyai and Imams provide spiritual advice and authoritative figures capable of providing practical solutions to resolving family problems. However, challenges related to accessibility to formal mediation and the limitations of informal mediation point to the need for strengthened integration between religious patronage and the state legal system. The study concludes that Kyai and Imam patronage significantly reduces divorce rates. However, closer collaboration between the formal legal and faith-based mediation mechanisms is needed to increase effectiveness. This study offers a fresh perspective on the connections among religion, legal systems, and family mediation within Muslim communities.

Abstract

This article aims to delve deeply into the ratio legis of reformulating the legal status of interfaith inheritance from the perspective of fiqh minority, as articulated by the thoughts of Yusuf al-Qardhawi and Taha Jabir al-Alwani. The research method employed in this article is a library research approach, utilizing comparison and content analysis to identify similarities, differences, and potential points of convergence in their thinking. The research findings indicate that the legal status of interfaith inheritance, according to the fiqh minority of Qardhawi and Alwani, must be redefined from the classical textual fiqh formulations to a contextual division of interfaith inheritance. The growing Muslim population in various non-Muslim countries necessitates the urgent reformulation of interfaith inheritance distribution to fill the normative vacuum within minority Muslim communities. The ratio legis of reformulating the legal status of interfaith inheritance according to Qardhawi and Alwani is based on considerations of maslahat (public interest) and the values of Maqashid al-Shariah, which serve as guiding principles for redefining the contextual legal status of interfaith inheritance. Failure to understand Islam solely through a textual lens and an inability to address the issues faced by minority Muslims in non-Muslim countries could relegate Islamic law to a relic of civilization.

Abstract

The difference between Islamic law and Western law in viewing customary law is the core problem that forms the background of this research. This article aims to explore in-depth Customary Law from the perspectives of Hazairin and Cornelis Van Vollenhoven and its relevance to the future existence of Islamic law in Indonesia. This research is a literature study applying a qualitative Juridical-Normative approach. The primary sources for this research are the original works of Hazairin (Tujuh Serangkai tentang Hukum dan Hazairin, Hukum Kewarisan Bilateral Menurut al-Qur’an dan Hadith) and Van Vollenhoven (Het Adatrecht Van Nederlandsch-Indie and its translated version, Van Vollenhoven on Indonesian Adat Law). The secondary sources are all references relevant to the topic of the article. Comparative analysis is used in analyzing the data. The research findings explain that, according to Hazairin, customary law can be applied anywhere as long as it does not contradict Islamic law. In contrast, Van Vollenhoven argues that customary law does not need to consider religion because all humans have equal rights before God, thus rejecting or eliminating customs or traditions is considered undignified. The formation of national law due to culture and tradition is an important part of society. This research provides a conceptual historical-theoretical narrative related to customary law in Indonesia. Despite having different perspectives on customary law, both Hazairin and Van Vollenhoven share the vision that customary law should be made into positive law. Therefore, the existence of customary law needs to be considered by lawmakers to become national positive law.
