Abstract

Introduction: MSMEs made a significant contribution to the Indonesian economy at the beginning of 2018. However, since COVID-19 has become a global pandemic, micro, small, and medium-sized enterprises (MSMEs) have been heavily impacted, due to a series of social restriction policies enacted by the government. In order to resolve issues, the government must assist and empower the MSME sector so that it can survive the pandemic. However, not many studies have been carried out regarding the extent to which empowerment policies by local governments have been effective in the field. Purposes of the Research: This study aims to determine the effectiveness of the legal policies in empowering the micro and small enterprises (MSEs) during the pandemic based on the case of Gowa Regency, South Sulawesi.Methods of the Research: This is an empirical normative legal research that uses primary and secondary data with descriptive and qualitative analysis.Results of the Research: The results show that the empowerment policy in South Sulawesi has been regulated in Provincial Regulation Number 7 of 2019 concerning Cooperatives and Small Enterprises, where there are ten forms of facilitating MSE empowerment. Even though it has established the Cooperatives and MSMEs Office, the Gowa Regency Government does not yet issue spesific regulations on the empowerment of MSEs. Based on field data analysis, it was found that several forms of empowerment facilitation had been received by the respondents but were not evenly distributed. Empowerment received mostly focused on capital facilitation, while ignoring other form of facilitations. Thus, the existing policies have not been implemented effectively. This is influenced by several factors such as legal substance that do not provide legal certainty; legal structure factors, including the lack of apparatus and supporting facilities; and cultural factors, such as pragmatic behavior and low awareness of MSE actors.

Abstract

Pesantren as a traditional Islamic educational institution in Indonesia, plays a strategic role in shaping the character and intellectual development of its students (santri). However, the dynamics of globalization and advancements in digital technology demand that pesantren innovate their learning models to remain relevant to contemporary needs. The integration of digital technology in pesantren education has become an imperative to improve educational quality, broaden access to learning resources, and strengthen the integration between Islamic values and 21st-century skills. This study aims to explore the role of digital technology in enhancing the quality of learning in pesantren, which have long been known for their conventional teaching methods. The use of digital tools and platforms such as e-learning, educational apps, and social media has demonstrated significant potential in enriching students' learning experiences. This research employs a qualitative approach using case studies of several pesantren that have adopted digital technologies in their learning systems. Data were collected through in-depth interviews, participatory observations, and document analysis related to the learning process. Thematic analysis was used to identify patterns in technology utilization, supporting and inhibiting factors, and its impact on the learning process and outcomes. The findings indicate that digital technology integration enhances student engagement, facilitates access to learning materials, and enriches teaching methods. In conclusion, digitalization in pesantren education offers great potential to improve learning quality, provided it remains aligned with Islamic values and local cultural contexts.

Abstract

In the 2024 local head elections, voters in 37 regions face a growing trend of single candidates. While voters can express dissent, the blank box option is often viewed as a mere procedural formality, with current regulations failing to address the negative impact of single candidates. This paper examines the protest vote as a form of voter engagement and explores its potential institutionalization as a solution to the single-candidate issue in local head elections. Using a normative approach, the research combines conceptual and legislative analysis, along with a qualitative review of existing literature. The protest vote, viewed from a political participation perspective, should not be seen as anti-political, but rather as a way for voters to voice dissatisfaction with the system or political elites. Few countries officially recognize the protest vote, but this study argues for its institutionalization through four measures: 1) ensuring the right to protest votes in local head elections, 2) recognizing blank, null, or spoiled ballots as valid votes, 3) defining empty boxes as "None of The Above" (NOTA) and preventing unsuccessful single candidates from re-running, and 4) protecting and encouraging campaigns for protest votes.

Abstract

Peran kepala sekolah merupakan hal yang paling penting dalam mewujudkan visi dan misi lembaga pendidikan. Penelitian ini merupakan penelitian berdasarkan studi pustaka (kepustakaan) data-data yang diperoleh beserta referensi yang didapatkan dari perpustakaan, buku, ensiklopedia, jurnal, dokumen, media sosial, blog, artikel dan majalah. Penelitian ini bertujuan untuk membangun strategi kepala sekolah dalam meningkatkan kompetensi guru di MTs Darunnajah 02 Cipining Bogor. Strategi kepala sekolah sangat diperlukan dalam meningkatkan kompetensi guru, dengan adanya strategi kepala sekolah maka akan memudahkan kepala sekolah dalam mencapai tujuan yang telah direncanakan. Sehingga dengan adanya strategi serta kompetensi guru yang berkualitas akan memicu peserta didik berkompetensi, berkualitas, dan memiliki daya saing tinggi.

Abstract

Penelitian ini bertujuan untuk menganalisis bagaimana penerapan Akuntansi Entitas Tanpa Akuntabilitas Publik (ETAP) Pada Usaha Mikro, Kecil dan Menengah (UMKM) di Desa Sialang Kecamatan Bangun Purba. Jenis penelitian ini adalah deskriptif kualitatif dengan menggunakan teknik wawancara, observasi, dan dokumentasi sebagai teknik pengumpulan data. Hasil dari penelitian ini menunjukan belum terealisasinya Akuntansi Entitas Tanpa Akuntabilitas Publik (ETAP) Pada Usaha Mikro, Kecil dan Menengah (UMKM) di Desa Sialang Kecamatan Bangun Purba dengan standar yang telah ditulis pada Standar Akuntansi Keuangan Entitas Tanpa Akuntabilitas Publik (SAK ETAP). Penelitian ini juga menunjukan bagaimana bentuk penerapan akuntansi ETAP pada UMKM di Desa Sialang dengan pelaporan pencatatan keuangan dan laporan bisnis yang belum sesuai dengan SAK ETAP sebagai landasan utama. Peraturan pencatatan keuangan untuk UMKM telah di tetapkan oleh DSAK IAI (Dewan Standar Akuntansi Keuangan Ikatan Akuntan Indonesia) dan resmi diberlakukan pada Tahun 2011. Sementara masih rendahnya pengetahuan para pelaku usaha di Desa Sialang terhadap pencatatan keuangan dalam hal ini SAK ETAP sehingga para pelaku usaha belum menerapkan pencatatan keuangan yang sesuai dengan SAK ETAP pada usaha nya.

Abstract

Abstract This study aims to identify and analyze the Juridical Review of the Peace Deed Made Before a Notary in Resolving Civil Cases. Empirical research methods. This empirical legal researchmethod is basically a combination of normative legal approaches with the addition of various empirical elements. used as the strongest and most complete evidence. This peace deed guarantees the rights and obligations of the parties for the sake of certainty, order, and legal protection for interested parties in the civil dispute settlement process. Therefore, the peace deed is written evidence, the strongest and most complete and can make a real contribution to disputeresolution quickly and cheaply. A peace deed made before a notary has a legal legal standing against a court decision as a complete means of proof. In 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Positions (hereinafter referred to as the Notary Law) according to the Notary Law, a notary may not have a profession that interferes with his performance other than that he is prohibited from having a side job that can cause a conflict of interest (conflict interest). The mediation process carried out by a notary as a mediator is very possible considering that the notary understands the problems that occur between the disputingparties who are his clients. Another advantage if the notary acts as a mediator is that it will be easier to find a way out of the problem because the notary understands the direction of the settlement to be chosen, this is because the notary is the maker of the peace deed of the disputing parties, so he really understands the essence and context of the problems that are happening. Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis Tinjauan Yuridis Akta Perdamaian Yang Dibuat Di Hadapan Notaris Dalam Menyelesaikan Perkara Perdata. Metode penelitian empiris. Metode penelitian hukum empiris ini pada dasarnya ialah penggabungan antara pendekatan hukum normatif dengan adanya penambahan dari berbagai unsur-unsur empiris.Berdasarkan hasil penelitian ini adalah maka dapat ditarik kesimpulan Kedudukan hukum Akta Perdamaian yang dibuat dihadapan notaris adalah akta otentik, yang mempunyai kekuatan hukum yang dapat dijadikan sebagai alat bukti terkuat dan terpenuh. Akta perdamaian ini menjamin hak dan kewajiban para pihak demi kepastian, ketertiban, dan perlindungan hukum bagi para pihak yang berkepentingan dalam proses penyelesaian sengketa perdata. Oleh karena itu, akta perdamaian tersebut merupakan bukti tertulis, terkuat dan terpenuh serta dapat memberikan sumbangan nyata bagi penyelesaian sengketa secara cepat dan murah. Akta perdamaian yang dibuat di hadapan notaris memiliki kedudukan hukum yang sah terhadap putusan pengadilan sebagai alat pembuktian lengkap.Peran Notaris dalam membuat akta perdamaian sebagaimana kedudukannya sebagai pejabat umum yang berwenang membuat akta otentik, notaris juga berwenang menjadi mediator yang diatur dalam Undang-Undang Nomor 2Tahun 2014 Tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris (selanjutnya disebut UU Notaris) menurut UU Notaris, seorang notaris tidak bolehberprofesi yang mengganggu kinerjanya selain itu dilarang memiliki pekerjaan sampingan yang dapat menyebabkan terjadinya konflik kepentingan (conflict interesting). Proses mediasi yang dilakukan seorang notaris sebagai mediator sangat mungkin dilakukan mengingat notaris tersebut sangat memahami permasalahan yang terjadi antara pihak yang bersengketa yang merupakan kliennya. Keuntungan lainnya jika notaris berperan sebagai mediator adalah akan lebih mudah menemukan jalan keluar permasalahan karena notaris memahami arah penyelesaian yang akan dipilih, hal ini disebabkan karena notaris tersebut sebagai pembuat aktaperdamaian para pihak yang bersengketa, sehingga ia sangat memahami inti dan konteks permasalahan yang sedang terjadi.

Abstract

This study aims to determine and analyze the Effectiveness of Electronic Trial Implementation at the Makassar State Administrative Court and to determine and analyze the Factors that Influence the Effectiveness of Electronic Trial Implementation at the Makassar State Administrative Court. In this study, legal regulations and the reality in the field will be analyzed to provide answers to the questions raised. This study uses an empirical legal research method, with the research location in Makassar City and its location at the Makassar State Administrative Court. Data were collected through interview techniques and literature studies, which were then analyzed descriptively analytically. The results of the study indicate that the Effectiveness of the Implementation of Supreme Court Regulation Number 1 of 2019 Concerning Electronic Case Administration and Trials in Court (Case Study at the Makassar State Administrative Court) has not been fully effective because there are still many obstacles that hinder the implementation of electronic trials. Coupled with the settlement of cases from year to year experiencing fluctuating data. This is due to one of the factors that greatly influences, among others, the infrastructure factor, namely the network which still often experiences disruptions. As a recommendation, In order to improve the effectiveness of the implementation of electronic trials at the Makassar State Administrative Court in accordance with the Supreme Court Regulation with the intent and purpose of the government, it is necessary to add and update facilities and infrastructure, especially those related to the network. The government also needs to hold special training for judges and advocates so that law enforcers become more professional and the government needs to conduct socialization to the public about the importance of technology at this time. Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis Efektivitas Pelaksanaan Persidangan Secara Elektronik di Pengadilan Tata Usaha Negara Makasaar dan untuk mengetahui dan menganalisis Faktor-faktor yang memengaruhi Efektivitas Pelaksanaan Persidangan Secara Elektronik di Pengadilan Tata Usaha Negara Makassar. Di dalam penelitian ini peraturan hukum dan kenyataan di lapangan akan dianalisis untuk memberikan jawaban atas persoalan yang diajukan. Penelitian ini menggunakan metode penelitian hukum empiris, dengan lokasi penelitian di Kota Makassar dan tempatnya di Pengadilan Tata Usaha Negara Makassar. Data dikumpulkan melalui teknik wawancara dan studi Pustaka, yang kemudian dianalisis secara deskriptif analitis. Hasil penelitian menunjukkan bahwa Efektivitas Pelaksanaan Peraturan Mahkamah Agung Nomor 1 Tahun 2019 Tentang Administrasi Perkara Dan Persidangan Di Pengadilan Secara Elektronik (Studi Kasus Pada Pengadilan Tata Usaha Negara Makassar) belum sepenuhnya efektif di karenakan masih banyak kendala yang menghambat jalannya persidangan elektronik. Ditambah dengan penyelesaiaan perkara dari tahun ke tahun mengalami data yang fluktuatif. Hal ini disebabkan salah satu faktor yang sangat mempengaruhi antara lain faktor sarana prasarana yaitu jaringan yang masih sering mengalami gangguan. Sebagai rekomendasi, Dalam rangka meningkatkan efektivitas pelaksanaan persidangan elektronik di Pengadilan Tata Usaha Negara Makassar agar sesuai dengan Peraturan Mahkamah Agung dengan maksud dan tujuan pemerintah perlu menambah dan memperbaharui sarana dan prasarana tertutama yang berkaitan dengan jaringan. Pemerintah juga perlu mengadakan pelatihan khusus kepada hakim dan advokat agar penegak hukum menjadi lebih professional serta pemerintah perlu melakukan sosialisasi kepada masyarakat akan pentingnya teknologi pada saat ini.

Abstract

Limited face-to-face learning is a learning policy implemented by schools to prevent coronavirus transmission during the pandemic. Amidstface-to-face learning has become limited, so that it requires students to study more independently from home. Teachers are also required to maximize class time and are also required to be skilled in providing learning outside of student learning hours in class. This study aims to determine (1) the influence of student learning independence on learning outcomes, (2) the influence of teachers' teaching skills on learning outcomes, and (3) the influence of student learning independence and teacher teaching skills during limited face-to-face learning on student learning outcomes. The research method used is quantitative with a correlational approach. This research was conducted at SMK throughout Sleman Regency. Respondents were 26 schools with a total of 2209 students. The sample calculation used Slovin with 339 samples. Data collection using questionnaires and tests with the help of google forms. The data obtained were then analyzed with several techniques such as description analysis; normality, homogeneity, multicollinearity tests; and hypothesis tests consisting of simple regression tests and multiple regression tests. The study's results obtained 1.) Learning outcomes were positively and significantly influenced by student learning independence with a value of sig. 0.023 < 0.05; 2.) Learning outcomes are positively and significantly influenced by the teaching skills of teachers with sig grades. 0.000 < 0.05; and 3.) Learning outcomes are also positively and significantly influenced by student learning independence and teacher teaching skills with a value of sig. 0.000 < 0.05.

Abstract

keberadaan pedagang kaki (PKL) yang kini di nilai masyarakat, Semakin semerawut, Nampak sepanjang ruas jalan poros yang meliputi Desa Je’netallasa dan Kelurahan Mangalli Kecamatan Pallangga Kabuptaen Gowa Tipe penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris atau sosio-legal researchbahwa efektivitas penataan dan pembinaan PKL Kabupaten Gowa, sebagaimana yang telah diatur dalam Perda No. 5 Tahun 2009, dinilai belum efektif sebagaimana mestinya. Pemerintah Kabupaten Gowa yang memiliki peran utama dalam menertibkan dan menegakkan ketentuan yang belaku terkait PKL tidak sepenuhnya berjalan sesuai harapan masyarakat, khususnya warga Kelurahan Mangngalli Kabupaten Gowa. Pengaturan mengenai PKL telah diatur secara nasional oleh pemerintah pusat. Berpedoman dengan peraturan tersebut pemerintah Kabupaten Gowa sudah mengeluarkan peraturan yang khusus mengatur mengenai PKL yaitu Perda No. 5/2009. Faktor yang mempengaruhi pelaksanaan Perda No. 5/2009, sebagaimana yang disamapaikan oleh warga Kelurahan Mangngalli Kabupaten Gowa adalah pemerintah setempat tidak bertanggungjawab atas pembinaan dan penataan, seharusnya pemerintah yang berwenang melakukan penataan dan pembinaan; belum ada penyuluhan terkait penataan dan pembinaan PKL dan pemerintah belum benar-benar memberikan tempat yang layak guna menata dan membina PKL

Abstract

One of the authorities of the Regional Government is the field of tourism, this delegation of authority is emphasized in several laws and regulations. However, North Toraja Regency, which has tourism potential, does not yet have derivative regulations to empower and improve the economy of business actors. This article focuses on disclosing the basis for the formation of local regulations on the implementation of tourism and content specifically related to business actors. The method used is normative-empirical, focusing on examining primary data through open interviews, and examining secondary data, analyzed qualitatively. Referring to several laws and regulations, it is regulated that the local government has the authority and even emphasized several obligations to take care of tourism affairs, so that the North Toraja Regency government is seen as important to form regional regulations, while the content material related to business actors is realized by setting the norms of obligation for the government to conduct training for business actors, where the material is prepared on the basis of research so that business actors in the tourism and culinary management sector are able to increase the number of tourists, the income of business actors, as well as regional original income, the article contains standardization of the construction of identical infrastructure for each regions, and facilitating special partnerships with the need for appropriate technology for business actors, as well as facilitating access to capital with banks and investors.
