Abstract

There are still many practices of marginalization and subordination of women. An incomplete understanding of the Qur’an and hadith is the main reason. Women have the same position as men and are elevated in status in Islam. This article aims to explain Jasser Auda’s thoughts on women and their contribution to the reform of Islamic family law in Indonesia. This paper uses bibliographic research as the primary source of Jasser Auda’s works. This study concludes that Jasser Auda’s thinking which provides equal positions between men and women, aligns with maqāsid al-syarī’ah, which was developed and combined with systems theory. Women have an equal role and position with men in the mosque, become leaders, and are given rights in reproductive health. The authors argue that Jasser Auda’s views on women have inspired several reforms in Islamic family law in Indonesia that pay more attention to women’s rights and position on an equal footing with men rather than the practice of understanding Muslim societies, which are still patriarchal.

Abstract

This article analyzes Muhammad Syahrūr’s thoughts on the mustaḥiq zakah (zakat recipient) classification based on his interpretation of Qur’anic verse, QS. al-Taubah [9]: 60. Syahrūr’s perspective is unique because it challenges the classification of mustaḥiq zakah that Islamic jurists have widely accepted. The article uses a literature review with a Gadamer hermeneutic approach. Data was collected through text studies and analyzed using descriptive-analytical techniques. The study found that Syahrūr classified mustaḥiq zakah into four categories: fakīr (poor person), miskīn (needy person), ghārim (the debtor), and ibn sabīl (wayfarer). Using a scientific-historical approach, Syahrūr expanded the meaning of fakīr to include orphans, miskīn to include people with special needs, ghārim to include debts for paying diyah (blood money) for wrongful killing (al-qatl al-khaṭa’), and ibn sabīl, which refers to travelers. Syahrūr’s interpretation of QS. al-Taubah [9]: 60 is a product of his scientific-historical approach, which he developed while in Moscow under the influence of the prevailing logic of the time (episteme), the structuralism of Russian formalism, and his linguistic teacher, Ja’far Dak al-Bāb. Syahrūr’s approach required him to observe the contemporary object’s condition in understanding QS. al-Taubah [9]: 60. The poor conditions in Syria, both internal and external factors, influenced Syahrūr’s interpretation of QS. al-Taubah [9]: 60.

Abstract

Corporate zakat, or zakat levied on legal entities, is a contemporary phenomenon in the Muslim world. Although Indonesia is not an Islamic state, it has legalized corporate zakat for nearly three decades. Baitulmaal Munzalan Indonesia (BMI), a prominent zakat management institution in West Kalimantan, actively collects corporate zakat despite the absence of this concept in classical fiqh (Islamic jurisprudence). This study examines the Islamic legal understanding of the ‘āmils (zakat administrators) at BMI and their practices in collecting corporate zakat through the Zakat BMI application. Employing a qualitative approach, this research is based on in-depth interviews with five key informants, as well as observations of the Zakat BMI application, official website, and social media platforms. The findings reveal that the ‘āmils at BMI conceptualize corporate zakat through qiyās (analogical reasoning), equating it with trade zakat (zakāh al-tijārah), a subcategory of wealth zakat (zakāt al-māl). Although corporate zakat is not explicitly mentioned in classical fiqh literature, BMI legitimizes its implementation by referencing Qur’anic verses, hadith, contemporary Islamic scholarly opinions, fatwas, and national legal regulations. Furthermore, BMI adopts the concept of a legal entity (shakhṣiyyah i‘tibāriyyah) as a zakat-liable subject, as developed by contemporary Islamic scholars, and applies this concept through various zakat collection programs, including the Zakat BMI application. This study highlights the necessity of contextual interpretation of zakat norms within classical fiqh to expand the scope of Islamic legal implementation in addressing modern socio-economic challenges while underscoring the evolving perception of Islamic law among Muslim societies, particularly concerning zakat regulations. [Zakat korporasi, atau zakat yang dikenakan pada entitas hukum, merupakan fenomena kontemporer dalam dunia Muslim. Meskipun Indonesia bukan negara Islam, negara ini telah melegalkan zakat korporasi selama hampir tiga dekade. Baitulmaal Munzalan Indonesia (BMI), sebagai salah satu lembaga pengelola zakat terkemuka di Kalimantan Barat, secara aktif menghimpun zakat korporasi meskipun konsep ini tidak ditemukan dalam literatur fikih klasik. Studi ini menganalisis pemahaman hukum Islam yang dimiliki oleh para amil zakat di BMI serta praktik penghimpunan zakat korporasi yang dilakukan melalui aplikasi Zakat BMI. Dengan menggunakan pendekatan kualitatif, penelitian ini mengandalkan wawancara mendalam dengan lima informan kunci serta observasi terhadap aplikasi kalkulator zakat, situs web resmi, dan media sosial BMI. Temuan penelitian menunjukkan bahwa para amil zakat di BMI mengonseptualisasikan zakat korporasi melalui qiyās (analogi) dengan menyamakannya dengan zakat perdagangan, yang merupakan bagian dari zakat mal. Meskipun zakat korporasi tidak disebutkan secara eksplisit dalam literatur fikih klasik, BMI membangun legitimasi atas penerapannya dengan merujuk pada ayat-ayat Alquran, hadis, pendapat ulama kontemporer, fatwa, serta regulasi hukum nasional. Selain itu, BMI mengadopsi konsep badan hukum (shakhṣiyyah i‘tibāriyyah) sebagai subjek hukum dalam zakat, sebagaimana dikembangkan oleh para ulama kontemporer, dan menerapkannya dalam berbagai program penghimpunan zakat, termasuk aplikasi Zakat BMI. Abstract

This study aims to examine how Ma’had Aly Lirboyo implements epistemological decolonization in Islamic education through the preservation of pesantren traditions and their integration into the formal higher education system. The background of this research is rooted in the dominance of Western epistemology within national education systems, which often marginalize the Islamic intellectual heritage. This is a field research study using a qualitative approach, employing techniques such as direct observation, in-depth interviews with Ma’had Aly administrators and educators, and documentation analysis of institutional policies and curricula. The findings reveal that Ma’had Aly Lirboyo successfully preserves traditional pesantren methods—such as bandongan, sorogan, wetonan, and daurah ilmiah—while adapting them to a structured academic system through the Fiqh Kebangsaan curriculum. This strategy has enabled the development of an Islamic education model that not only maintains sanad (chains of knowledge transmission) and scholarly authority but also responds effectively to national and global challenges. Theoretically, these findings reinforce the discourse of knowledge decolonization by demonstrating that local systems of knowledge—rooted in tradition, spirituality, and social context—can form legitimate, autonomous, and globally relevant educational frameworks.

Abstract

This article is aimed to explain the implementation of the premarital course, the constraints, and the effectiveness of the Regulation of Director General Bimas Islam No. DJ. II/542 Years 2013 concerning the Guidelines on the Implementation of the Premarital Course in the KUA Southeast Pontianak Sub-District. That is because KUA Southeast Pontianak Sub-District did not implement this provision optimally. The type of research the author uses is empirical legal research with a sociological-juridical approach. There are three research results in this paper. First, the premarital course in the KUA Southeast Pontianak Sub-District is held once a week. The resource person delivered four materials with the lecture and answer method, namely reproductive health, reproductive health, marital law, fostering sakīnah families, and the resilience of families. These materials are submitted by the Officers of the Health Service, Head, and the Functional Headman (Penghulu) KUA Southeast Pontianak Sub-District. After attending a premarital course, the bride candidate received a certificate from BP4. Secondly, there are two obstacles experienced by the KUA Southeast Pontianak Sub-District that have not fully implemented the Regulation of Director General Bimas Islam No. DJ. II/542 Years 2013, namely the absence of fees for the Speaker’s honorarium and yet to be present and the management of the leadership related to the implementation. Third, the guidelines for administering prenuptial courses have not been effectively implemented at KUA Southeast Pontianak Sub-District, because there are no derivative rules from these regulations (substance), the unreadiness of officials and employees in implementing them (structure), and the public’s assumption that prenuptial courses are only a formality (legal culture).

Abstract

Artikel ini menelaah pandangan Djazimah Muqoddas terkait kedudukan hakim perempuan dalam sistem peradilan Islam melalui lensa teori perubahan hukum dan sosial. Penelitian ini mengidentifikasi celah dalam literatur mengenai penerimaan hakim perempuan di negara-negara Muslim dan menganalisis pandangan ulama klasik serta kontemporer terkait peran perempuan sebagai hakim. Dengan menggunakan metode kajian pustaka dan analisis kritis, artikel ini mengungkap bahwa Muqoddas mendukung penerimaan hakim perempuan dalam seluruh jenis perkara, berdasarkan prinsip teori perubahan hukum yang dikaitkan dengan konteks sosial dan politik. Temuan penelitian memberikan kontribusi signifikan dalam perdebatan hukum perempuan menjadi pemimpin, khususnya di lembaga peradilan.

Abstract

In communal societies, the celebration of traditional weddings often places a significant financial burden on host families, particularly in communities that uphold strong cultural values and social honor. This challenge is also faced by many lower- to middle-income families in Sambas Regency, West Kalimantan. This article analyzes the antar pakatan tradition practiced by the Sambas Malay community as a culturally embedded social strategy to mitigate the high costs associated with customary wedding ceremonies. Utilizing a qualitative field research methodology with a socio-legal approach, the study draws on in-depth interviews and non-participant observations conducted in Sepadu Village, Sambas Regency. The findings reveal that antar pakatan functions as an informal mechanism of economic redistribution, grounded in the values of mutual assistance and collective participation, which are realized through voluntary contributions from guests. This tradition effectively alleviates financial pressure without diminishing the symbolic significance of customary rituals, while reinforcing social solidarity through culturally institutionalized reciprocal relationships. This article argues that antar pakatan represents a customary institution capable of bridging the sustainability of tradition with the need to adapt to contemporary economic challenges. Furthermore, it contributes theoretically to the study of social exchange dynamics within value-based communal societies. [Dalam konteks masyarakat komunal, pelaksanaan pesta pernikahan adat sering kali menjadi beban ekonomi yang signifikan bagi keluarga penyelenggara, terutama dalam komunitas yang menjunjung tinggi nilai-nilai kultural dan kehormatan sosial. Hal serupa juga dialami oleh sebagian keluarga yang berpenghasilan menengah ke bawah di Kabupaten Sambas. Artikel ini bertujuan untuk menganalisis tradisi antar pakatan yang dipraktikkan oleh komunitas Melayu sebagai solusi sosial berbasis kearifan lokal dalam menghadapi tingginya biaya penyelenggaraan pernikahan adat. Penelitian ini menggunakan metode kualitatif lapangan dengan pendekatan sosio-legal, melalui wawancara mendalam dan observasi non-partisipan yang dilaksanakan di Desa Sepadu, Kabupaten Sambas. Hasil penelitian menunjukkan bahwa tradisi antar pakatan berfungsi sebagai mekanisme informal redistribusi ekonomi yang dilandasi nilai gotong-royong dan partisipasi kolektif, yang diwujudkan melalui kontribusi sukarela dari tamu undangan. Tradisi ini secara efektif mereduksi tekanan finansial tanpa menghilangkan makna simbolik dalam penyelenggaraan adat, sekaligus memperkuat solidaritas sosial melalui relasi timbal balik yang dilembagakan secara kultural. Artikel ini berargumen bahwa tradisi antar pakatan merepresentasikan pranata adat yang mampu menjembatani antara keberlanjutan tradisi dan adaptasi terhadap tantangan ekonomi kontemporer, serta memberikan kontribusi teoretis terhadap kajian mengenai dinamika pertukaran sosial dalam masyarakat berbasis nilai.]
