Abstract

Ijab and Kabul are the core elements in a marriage contract. Muhammad Arsyad Al-Banjari (17-18 AD), a Malay scholar from Banjar, wrote the ijab and kabul guidelines in the Kita>b al-Nika>h. Unlike many classical fiqh works, this book explains the guidelines for ijab and kabul clearly. This article discusses the construction of marriage contract (ijab kabul) in the book. Using a qualitative content analysis approach, this study found that the construction of ijab and kabul were written under the Banjar language with the Pegon script. The use of the local language aims to draw the broader attention of Banjar people. Description of ijab and kabul is presented with examples of marriage contracts that commonly exist in the community. This means that the construction of ijab and kabul in the book is practical—according to the needs of the Banjar people at that time. In addition to showing the practical character, Al-Banjari's fiqh on marriage contracts tends to reflect the Shafi'i School. Therefore, theoretically, it is safe to say that Al-Banjari is quite strict when it comes to following the Shafi'i school of jurisprudence.Ijab dan kabul merupakan elemen terpenting dalam akad pernikahan agar dapat dianggap sah secara hukum. Muhammad Arsyad Al-Banjari (17-18 M), seorang ulama Melayu asal Banjar, menulis tuntunan ijab dan kabul dalam Kita>b al-Nika>h. Tidak seperti kitab fikih klasik pada umumnya, kitab ini menjelaskan tuntunan ijab dan kabul secara gamblang. Artikel ini membahas kontruksi ijab dan kabul pernikahan dalam kitab tersebut. Dengan pendekatan analisis isi kualitatif, penelitian ini menemukan bahwa uraian-uraian ijab dan kabul ditulis menggunakan bahasa lokal dengan aksara Pegon. Hal ini ditujukan untuk memudahkan masyarakat Banjar memahami isi yang disampaikan. Tuntunan ijab dan kabul pernikahan juga disajikan dengan contoh akad perkawinan yang bi(a)sa terjadi dalam praktek keseharian sehingga mudah dipahami masyarakat Banjar. Artinya konstruksi ijab dan kabul dalam kitab tersebut bersifat praktis—sesuai dengan kebutuhan masyarakat Banjar pada masa itu. Selain menunjukkan karakter praktis, fikih Al-Banjari tentang akad nikah mencerminkan fikih-fikih berorientasi Mazhab Syafi’i. Oleh karena itu secara teoretis dapat dikatakan bahwa Al-Banjari cukup ketat dalam menerapkan fikih bermazhab Syafi’i.

Abstract

This paper aims to analyze two key variables between the policy of acknowledging marriages that have not been recorded by the Dukapil and the fatwa of the Muhammadiyah Tarjih Council through the perceptions of Muhammadiyah scholars in Palangkaraya City. The type of field research is that researchers conduct direct interviews with careful objects with a phenomenological approach. The results of this study indicate that several sources chose to look at different spaces for the case of unregistered marriage, there is a condition that non-sirri marriage is done intentionally. So it is not absolutely forbidden to marry siri. Regarding the Dukcapil policy, Muhammadiyah Ulama see the positive side with the intention to accommodate and provide administrative convenience to the perpetrators of unregistered marriages who may not know the obligation to register marriages. However, it is certain that the Dukcapil must pay attention to the provisions of the Marriage Law in order to create harmonization between policies. The Muhammadiyah cleric of Palangkaraya city has the principle of Maslahah in this case.

Abstract

The resolution of Islamic family civil disputes through mediation has been regulated in national regulations, particularly in Supreme Court Regulation (Perma) No. 1 of 2016. However, the implementation of this policy still faces various obstacles that hinder its effectiveness in peacefully resolving family disputes. This study aims to analyze the regulations governing mediation in the resolution of Islamic family disputes in Indonesia, evaluate the effectiveness of the applicable laws, and provide recommendations to enhance the role of mediation in the religious court system. Using a normative juridical method with a statute approach, this research examines how existing regulations have been implemented in practice and whether there is a need for revisions or improvements in the mediation system. The findings indicate that although mediation is mandatory in family dispute resolution, its success rate remains low due to limited public awareness, a shortage of certified mediators, and a lack of supervision and evaluation of its effectiveness.Therefore, strengthening the role of mediation is necessary by increasing mediator capacity, promoting the benefits of mediation to the public, and reinforcing regulations to ensure the optimal implementation of mediation. Thus, mediation is expected to become an effective solution in reducing the burden of cases in religious courts and achieving a more harmonious and fair resolution of family disputes.
