Abstract

Prinsip Mengenali Pengguna Jasa (PMPJ), diatur pada Pasal 18 Undang-Undang Nomor 8 Tahun 2010. Kemudian ditindak lanjuti dengan Peraturan Pemerintah Nomor 43 Tahun 2015, yang dilaksanakan dengan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 9 Tahun 2017. Berdasarkan peraturan perundang-undang tersebut di atas, Notaris merupakan salah satu Pihak Pelapor dalam pencegahan dan pemberantasan TPPU dan berkewajiban untuk menerapkan PMPJ bagi pengguna jasa Notaris. Penelitian ini akan mengkaji penerapan Prinsip Mengenali Pengguna Jasa oleh Notaris di Kabupaten Kampar dan tindak lanjut dari hasil audit kepatuhan oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Provinsi Riau terhadap penerapan Prinsip Mengenali Pengguna Jasa oleh Notaris di Kabupaten Kampar. Metode penelitian yang digunakan adalah yuridis empiris, dengan teknik purposive sampling. Hasil penelitian menunjukan bahwa Ppnerapan PMPJ oleh Notaris Kabupaten Kampar terhadap pengguna jasa belum terlaksana secara maksimal. Hal ini terlihat dari 119 jumlah Notaris Kabupaten Kampar, 15 orang Notaris terindikasi berisiko tinggi karena tidak menerapkan PMPJ sebagaimana yang telah ditetapkan dalam peraturan perundang-undangan, sehingga terhadap Notaris tersebut dilakukan audit kepatuhan langsung (on-site) oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia berkerjasam dengan Majelis Pengawas Daerah Notaris Kabupaten Kampar. Tindak lanjut hasil audit kepatuhan oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Provinsi Riau terhadap Penerapan PMPJ oleh Notaris di Kabupaten Kampar, yaitu Notaris Kabupaten Kampar harus melaksanakan komitmen untuk menerapkan PMPJ sebagaimana yang telah disepakati bersama. Selain itu, juga disampaikan informasi hasil pengawasan kepatuhan dan surat pembinaan kepada Notaris terkait serta informasi hasil pengawasan kepada PPATK, dan PPATK akan melakukan pemantauan terhadap Notaris terkait.

Abstract

Undang-undang telah mengatur bahwa Jaminan Pelaksanaan dalam Kontrak Kerja Konstruksi Pemerintah bersifat mudah dicairkan dan tanpa syarat (unconditional), namun dalam prakteknya, pencairan jaminan ini kerap menimbulkan permasalahan baru diantara para pihaknya, salah satunya karena tidak dicairkannya jaminan. Penelitian ini bertujuan untuk menganalisis kedudukan hukum Jaminan Pelaksanaan dalam Kontrak Kerja Konstruksi dan bentuk perlindungan hukum bagi Pengguna Jasa dalam penyelesaian pencairan Jaminan Pelaksanaan. Dari hasil penelitian menunjukan Jaminan Pelaksanaan merupakan perjanjian tambahan dari perjanjian pokok (Kontrak Kerja Konstruksi) yaitu perjanjian yang pemenuhannya dijamin dengan perjanjian jaminan. Adapun perlindungan hukum bagi Pengguna Jasa dalam penyelesaian pencairan Jaminan Pelaksanaan ada 2 (dua) yaitu: (1). Perlindungan Hukum Preventif sebagaimana diatur dalam peraturan perundang-undangan maupun dalam perjanjian dengan maksud untuk mencegah suatu pelanggaran serta memberikan rambu-rambu atau batasan dalam melakukan suatu kewajiban; dan (2). Perlindungan Hukum Represif melalui Non-Litigasi dengan memanfaatkan APS, Layanan Pengaduan OJK, dan LAPS SJK; serta melalui Litigasi berupa gugatan wanprestasi ke Pengadilan Negeri.

Abstract

This research was conducted in the Siberut Watershed, Mentawai Islands Regency, West Sumatra Province, with the aim of identifying the distribution of buildings, which are located on the boundaries of large rivers in the Siberut Watershed. The data processing method for identifying the distribution of buildings uses spatial analysis methods by digitizing high resolution satellite images using Arc Map 10.8 software and Microsoft Excel software to calculate the number and area of ??land. Based on research results, the border of a large river in the Siberut watershed was found to be 1,297.08 ha, the river passes through two sub-districts and six villages with the predominance of villages from the South Siberian sub-district which has five villages. Based on the results of remote sensing and digitization, there are 525 building points, with a total building area of ??4.62 ha with the largest building position in Muara Siberut Village, with a total of 236 buildings with a total area of ??2.33 ha.

Abstract

Mercury (Hg) is a metal element that is often used in technology development, especially in the beauty sector. Several brands of creams can be seen in the market, have no manufacturing or expiry date stated, labeling is incomplete, or contain levels of bleach which can only harm the skin itself. The creams may have up to 10,000 ingredients in them, common ones being steroids, arbutin, ascorbic acid, hydroquinone, and kojic acid, including high levels of toxic metals such as mercury. There are still many Indonesian women who lose that white and smooth skin is a symbol of beauty. This makes them do various ways to get white and smooth skin. Facial whitening creams that contain mercury metal in cosmetic ingredients are widely used. Cosmetic products containing mercury generally promise a white face in a short time, so many women are interested in using them. This is used by cosmetic manufacturers who sell face whitening creams containing hazardous ingredients, such as mercury. Public policies need to be regulated to prevent impacts on the skin health of users. This article is the result of a study from several sources, namely information that appears in the community and also through several articles.

Abstract

This study aims to optimize the use of cow dung as a natural dye in woven yarn. The experimental method was used with several variations of treatment on samples of cotton threads which were to be colored with cow dung. The variables observed included the type and amount of auxiliary solution. The results showed that optimizing the use of cow dung as a natural dye could be done by selecting a certain type of auxiliary solution and giving the yarn the proper soaking time so that it could penetrate completely into the fiber. Under optimum conditions, the resulting color is quite strong and long-lasting, although not as bright as the color of synthetic dyes. Thus, the potential for the use of organic waste such as cow manure as a natural dye in the weaving industry should be considered. Law No. 32/2009 concerning Environmental Protection regulates the importance of reducing organic waste to maintain a healthy and sustainable environment.

Abstract

This study focuses on traders' perceptions of the facility and infrastructure policy in the Lubuk Buaya traditional market. Based on the research questions, this type of research is qualitative descriptive research. The research informants were traders with the Snowball Sampling sampling technique and data were collected through observation and interviews. The results of the study showed that most traders did not know about Padang Mayor Regulation No. 7/2022. However, the use of facilities and infrastructure is up to government expectations even though there are some shortcomings. The effectiveness of the policy can be seen from the optimal utilization of facilities, but efficiency still needs to be improved, especially in terms of security and collection of levies. The adequacy of facilities is also adequate even though there are obstacles to trash bins. This policy is successful in terms of equality and government response to traders' needs. The accuracy of the policy can be seen from the positive impact of the maximum use of facilities.

Abstract

According to Article 3 letter f of Law Number 2 Year 2014 regarding Amendment to Law Number 30 Year 2004 about Notary Position a Notary candidate should take apprenticeship 24 consecutive months before allowed to practice as a notary. The problem is how the obligation conducted and how is the responsibility notary organization in holding the apprenticeship. The method taken in this research is empirical juridical. The juridical approach is used to analyse the various laws and regulations, while the empirical approach is used to view and analyse the law compare to its practice in society along with all its aspects. Because in this research examining people in relation of life in society, hence method of empirical law research can be regarded as research of sociological law which is branch of law of law (socio legal research in sociological jurisprudence) because legal research is taken from facts that exist in a society. The research was held in Notary organization known as Indonesian Notary Association in Padang . The research show that the Notary organization plays an important role in conducting apprenticeship for notary candidate, by permit their office chosen to hold apprenticeship. The each notary has also provided the notary candidate skill and knowledge that will be very useful for next practice. Each Notary candidate is required to attend the internship as one of the requirements to be able to follow the Notary Code of Ethics Examination which is preceded by Examination of Extraordinary Member in order to be appointed Notary

Abstract

Dalam hukum adat Minangkabau, ruang lingkup hak adat tidak dapat dipisahkan Antara tanah, air, dan sumber daya alam yang terkandung di dalamnya. Bukan hal yang aneh, ketika isu tanah komunal menjadi sumber perselisihan dan penyumbang terbesar kasus pada sistem hukum di Sumatera Barat. Di sisi lain menurut tanah publik adalah undang-undang kontrol masyarakat adat bawaan yang benar, sedangkan sisi lain dengan segala bentuk teknologi pembuatan kebijakan dan kebijakan yang dimiliki lahan/lahan masyarakat yang dikategorikan sebagai Hutan Lindung. Saat ini keberadaan lahan hutan dikuasai oleh masyarakat adat dari generasi ke generasi. Masalahnya adalah bagaimana status hak adat masyarakat hutan yang dikategorikan sebagai kawasan lindung. Kawasan lindung sering dieksploitasi dalam skala besar untuk keuntungan cepat tanpa memperhatikan prinsip-prinsip pembangunan berkelanjutan. Dapat disimpulkan bahwa warga masyarakat yang tidak menjadi warga hukum adat pada umumnya tidak boleh turut menggarap tanah yang merupakan wilayah kekuasaan perekutuan. Kemudian, pengelolaan kawasan lindung di Indonesia umumnya masih dalam konteks pengamanan hutan/kawasan lindung semata, sementara manajemen secara intensif belum berkembang, termasuk dalam hal pelibatan masyarakat lokal dalam pengelolaan dan sharing manfaatnya.

Abstract

Pada awal tahun 2020 wabah Virus Corona melanda Indonesia. Masyarakat yang menggunakan fasilitas kredit bank mengalami kemacetan. Pemerintah membuat program restrukturisasi kredit bagi pelaku Usaha Mikro Kecil dan Menengah yang terdampak covid-19 yaitu Peraturan Otoritas Jasa Keuangan Nomor 11/POJK.03/2020 Tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Countercyclical Dampak Penyebaran Coronavirus Disease 2019. Rumusan masalah yaitu Apakah pelaksanaan restrukturisasi kredit Usaha Mikro Kecil dn Menengah yang macet akibat Pandemi covid-19 telah sesuai Peraturan Otoritas Jasa Keuangan Nomor. 11/POJK.03/2020, Bagaimana pengawasan Otoritas Jasa Keuangan  dalam Restrukturisasi Kredit terdampak Pandemi Covid-19. Apa kendala yang dihadapi oleh pihak Bank dalam melaksanakan Restrukturisasi Kredit tersebut, sebagai pembanding digunakan Teori Kepastian Hukum dan Teori Perlindungan Hukum, metode pendekatan yuridis empiris yang disajikan secara deskriptif analisis. Hasil penelitian yaitu penanganan kredit macet akibat Pandemi Covid-19 dilaksanakan melalui program restrukturisasi dengan skema rescheduling. Nasabah yang layak mendapatkan restrukturisasi adalah nasabah yang masih memiliki prospek usaha yang baik dan mampu terus bertahan menjalankan usahanya pada masa pandemi covid-19. Selama masa program restrukturisasi berjalan pihak Bank Perkreditan Rakyat Cincin Permata Andalas Cabang Padang wajib melaporkan posisi akhir bulan laporan secara iuring kepada Otoritas Jasa Keuangan, laporan disampaikan paling lambat akhir bulan berikutnya setelah posisi bulan laporan. Sejalan dengan itu pengawasan yang dilakukan oleh Otoritas Jasa Keuangan yaitu pengawasan on site dan off site. pengawasan on site yaitu pengawasan pemeriksaan langsung kepada Jasa Industri Keuangan yang diawasi dengan ketentuan yang berlaku, pengawasan off site yaitu tindak lanjut analisis terhadap menitoring laporan rutin yang disampaikan oleh Industri Jasa Keuangan kepada Otoritas Jasa keuangan.

Abstract

Kampar Regency currently has the largest number of palm oil mills in Riau Province, which has led to an increase in environmental pollution due to the by-products of these industrial activities. The objective of this research is to identify the issues associated with waste management in palm oil mills. The research employs a descriptive-qualitative method to systematically, factually, and accurately represent the data contained in the news text. The results indicated that rubber and oil palm plantations (1.8 and 1.5 hectares) were inundated with waste. It is recommended that palm oil mills implement waste treatment in accordance with quality standards before disposal. Furthermore, the application of the law as the basis for sanctions from this waste must be accompanied by an appeal to the public to monitor the level of environmental pollution. In addition, the role of public policy actors in monitoring and determining legal sanctions for environmental pollution is of great importance.
