Abstract

The Industry 4.0 era, marked by advances in information technology and digitalization, has fundamentally transformed the patterns of industrial relations in Indonesia. One significantly affected aspect is the practice of strikes as a form of collective worker action to demand rights and justice. Whereas strikes were previously associated with physical actions carried out directly at the workplace, digital forms of strikes have now emerged such as mass logouts, deactivating work application accounts, and mobilizing protests through social media. This transformation presents new challenges in regulation, implementation, and legal protection. Existing legal instruments, such as Law Number 13 of 2003 on Manpower and its implementing regulations, have yet to fully accommodate the dynamics of digitally-based strikes. This gap creates the potential for a legal vacuum and uncertainty in the enforcement of both workers’ rights and employers’ obligations. This article aims to analyze the legal dynamics of strikes in the digital era, focusing on the adequacy of the current normative framework, identifying regulatory gaps, and proposing necessary legal reforms. Using a normative approach and case studies particularly regarding strikes by online motorcycle taxi drivers in Indonesia this paper recommends the formulation of more responsive and inclusive regulations for non-conventional strike forms. This study is expected to offer both academic and practical contributions toward creating a labor law system that is adaptive, fair, and capable of ensuring a balance of interests between workers and employers in the digital age.

Abstract

Submandibular–colli abscess accompanied by comorbidities such as diabetic ketoacidosis (DKA), airway obstruction, and chronic heart failure (CHF) presents a complex anesthetic challenge. Patients with maxillofacial abscesses and comorbidities such as impending airway obstruction, diabetic ketoacidosis (DKA), and chronic heart failure pose significant challenges to anesthetic management. Each comorbidity significantly influences perioperative management and increases the risk of morbidity and mortality. The goal of preoperative management is to stabilize the patient prior to surgery and reduce the risk of perioperative complications. Preoperative management includes ensuring adequate oxygenation, optimizing and monitoring hydration status, and controlling blood glucose levels. Objectives: To describe the perioperative anesthetic approach in a patient with a left submandibular abscess and multiple comorbidities, emphasizing the importance of a holistic strategy in managing complex surgical cases. Case Report: A 51-year-old female presented with progressive swelling of the left face and neck for two weeks. Examination revealed a submandibular abscess, DKA, and a known history of CHF. The patient reported trismus and odynophagia with marked hyperglycemia. Imaging showed tracheal deviation and abscess extension to the retropharyngeal space. Preoperative management focused on metabolic stabilization and cardiovascular optimization. Awake fiberoptic intubation (AFOI) with dexmedetomidine sedation was performed due to the anticipated difficult airway. Surgery proceeded uneventfully for 2 hours and 10 minutes, followed by intensive postoperative monitoring. Discussion: Anesthetic management in patients with deep neck abscesses and comorbid DKA and CHF requires comprehensive perioperative planning. Metabolic and hemodynamic stability must be achieved prior to induction. Careful airway planning, the use of cardiovascularly stable anesthetic agents, and vigilant glucose and fluid monitoring are essential to prevent complications. Conclusion: Successful anesthetic care in patients with submandibular abscess and complex comorbidities demands coordinated, individualized perioperative strategies to minimize risk and optimize outcomes.

Abstract

The development of the digital economy, including fintech, e-commerce, and Sharia-compliant digital assets, has created an urgent need for reform of Islamic law in regulating modern financial transactions. Although the basic principles of Islamic law, such as the prohibition of riba (usury), gharar (gharar), and maysir (risk of betting), as well as the provisions of Sharia contracts, serve as primary guidelines, practice demonstrates a gap between classical norms and the dynamics of the digital economy. The primary legal bases, namely the Qur'an (Qur'an, Surah Al-Baqarah: 275-279, Surah An-Nisa': 29) and the Hadith concerning buying and selling and contracts, are sometimes difficult to directly apply to digital instruments such as Sharia crowdfunding, digital tokens, and Sharia e-wallet services. Furthermore, fatwas issued by the National Sharia Council (DSN-MUI) and international standards such as AAOIFI and IFSB do not fully cover all financial technology innovations, creating legal uncertainty and challenges to Sharia compliance. Some digital transaction practices, such as the use of smart contracts, digital asset trading, and peer-to-peer lending, still require new interpretations to fulfill the principles of fairness, transparency, and equality in contracts. This research employs a normative juridical method with statutory regulations approach and Islamic legal concepts, utilizing secondary data from Islamic legal literature, national regulations, fatwas from the National Sharia Council (DSN-MUI), and AAOIFI and IFSB standards. The analysis aims to identify areas of Islamic law that must be updated or developed to accommodate innovations in the digital economy and the Islamic financial system. It also provides recommendations for regulators, academics, and practitioners in creating a digital financial ecosystem that is compliant with Islamic principles and legally secure.

Abstract

This study analyzes how Environmental, Social, and Governance (ESG) affects the value of companies listed on the Indonesia Stock Exchange (IDX). Researchers applied a purposive sampling method to select 86 companies that had a clear ESG score from Refinitiv and were listed on the IDX during the 2018–2022 period. It employs Ordinary Least Squares (OLS) for data analysis, to examine the relationships between the variables. Findings show that environmental and governance performance are negatively related to firm value, this tells that companies with high environmental and governance performance will has a higher spendings which will lower the company’s value, while social performance has a positive impact when considered alongside the other ESG components. A key limitation of this study is its exclusive focus on the Indonesian market, where distinctive regulatory frameworks, ESG disclosure practices, cultural factors, and investor preferences may shape the relationship between ESG performance and firm value in ways that differ from other countries, thereby limiting the extent to which the findings can be generalized to broader global contexts.

Abstract

This study aims to examine the characteristics of the West Monsoon wind based on convergence values at Sultan Hasanuddin International Airport, wind disturbance patterns over the Java Sea, the source and speed of air masses, regional-scale wind disturbances over Indonesia (Tropical Cyclones and Eddies), and wind flow patterns entering the study area under different rainfall categories during the period 2014 – 2023. The research employed a quantitative method by processing rainfall data and daily zonal (u) and meridional (v) wind component data during the peak rainy season (December – February). The analysis was conducted using the GrADS application to display streamline maps, data processing with Excel, and descriptive analysis. The results indicate that for the no-rain to light-rain categories, the characteristics of the West Monsoon wind are not clearly evident, except for wind disturbance patterns over the Java Sea and the speed and consistency of winds from the air-mass source toward the study area. In contrast, for moderate to very heavy or extreme rainfall categories, the characteristics of the West Monsoon wind are clearly observed. These conditions are characterized by air masses originating from the South China Sea, supported by strong and consistent wind speeds passing through the Karimata Strait and the Java Sea to Sultan Hasanuddin International Airport, as well as the presence of wind disturbances in the form of moderate to strong convergence over the Java Sea extending to the Makassar region. Therefore, the study concludes that the no-rain and light-rain categories exhibit nearly similar wind characteristics, while the main differences in the moderate to extreme rainfall categories lie in the consistency of wind speed and the intensity of convergence over the Java Sea.

Abstract

This study aims to analyze the legal position of contracts in civil agreement practices in Indonesia, with a focus on the normative basis in the Civil Code, relevant basic principles, and obstacles that arise in its application. Indonesian contract law relies on the Civil Code, but social, economic, and technological changes necessitate reform to address societal dynamics. The research method used is normative juridical with a doctrinal and conceptual approach. Data was obtained through a literature study of legislation, legal literature, and analysis of research results in legal journals. This approach was used to systematically examine the applicable legal rules, legal principles, and doctrines, as well as their implementation in civil contract practice. The results of the study show that fundamental principles, such as freedom of contract, consensualism, pacta sunt servanda, good faith, and the principle of personality, remain relevant as guidelines in the formation and execution of contracts. However, obstacles still arise from both normative and practical aspects, such as the ambiguity of electronic contract regulations, the use of standard contracts that are detrimental to certain parties, and the public's weak understanding of rights and obligations in contracts.
