Abstract

This study examines the process of acculturation between Islamic law and customary law in Betawi society from a historical perspective. Using qualitative research methods with secondary data analysis, this article traces the historical traces of the entry of Islam into Batavia/Betawi and its interaction with pre-existing local traditions. The analysis focuses on key domains such as family law (marriage and inheritance), life cycle rituals, and mechanisms of community governance and dispute resolution. It is found that acculturation is not a linear process, but rather a complex dynamic involving harmonization, syncretism, adaptation, negotiation, and sometimes conflict, especially evident in inheritance law practices. External factors such as Dutch colonial legal policies (e.g., theorie receptie) and the development of post-independence Indonesian national law (Marriage Law No. 1/1974, Compilation of Islamic Law) have also shaped the landscape of interaction between these two normative systems. This study concludes that Betawi society, with a strong Islamic identity, dynamically negotiates and integrates Islamic teachings with their customary heritage, resulting in unique and ever-evolving socio-legal practices.

Abstract

The development of artificial intelligence (AI) has had a major impact on various sectors, including the legal and judicial systems, which demand a transformation towards digitalization and efficiency. This research aims to analyze the contribution of AI in transforming conventional legal practices towards a more adaptive justice system, as well as examine the ethical, regulatory, and technological challenges that arise. This research uses a qualitative approach with literature studies as the main technique, reviewing literature, legal documents, and case studies of the application of AI in the judicial system in various countries. The findings show that AI is able to improve the efficiency and accuracy of legal processes, but its implementation still faces obstacles in terms of regulation, algorithm transparency, and institutional readiness. The transformation of the legal system through AI is inevitable, but it needs to be accompanied by regulatory reform, increased legal digital literacy, and the principle of prudence in its application in order to uphold substantive justice.

Abstract

The Industry 4.0 era, marked by advances in information technology and digitalization, has fundamentally transformed the patterns of industrial relations in Indonesia. One significantly affected aspect is the practice of strikes as a form of collective worker action to demand rights and justice. Whereas strikes were previously associated with physical actions carried out directly at the workplace, digital forms of strikes have now emerged such as mass logouts, deactivating work application accounts, and mobilizing protests through social media. This transformation presents new challenges in regulation, implementation, and legal protection. Existing legal instruments, such as Law Number 13 of 2003 on Manpower and its implementing regulations, have yet to fully accommodate the dynamics of digitally-based strikes. This gap creates the potential for a legal vacuum and uncertainty in the enforcement of both workers’ rights and employers’ obligations. This article aims to analyze the legal dynamics of strikes in the digital era, focusing on the adequacy of the current normative framework, identifying regulatory gaps, and proposing necessary legal reforms. Using a normative approach and case studies particularly regarding strikes by online motorcycle taxi drivers in Indonesia this paper recommends the formulation of more responsive and inclusive regulations for non-conventional strike forms. This study is expected to offer both academic and practical contributions toward creating a labor law system that is adaptive, fair, and capable of ensuring a balance of interests between workers and employers in the digital age.

Abstract

Legal protection for workers is a crucial aspect of employment law to ensure welfare and job security. However, in practice, there are still many invalid employment contracts that conflict with laws and regulations, such as the misuse of Fixed-Term Employment Agreements (PKWT) that exceed the specified time limit, fictitious contracts, and agreements that do not provide legal certainty for workers. This study aims to analyze the forms of employment contracts that conflict with employment law and the obstacles to legal protection for workers. This study uses a normative legal method with a statutory approach and an analytical approach focuses on the analysis of Law Number 6 of 2023 concerning Job Creation, Law Number 13 of 2003 concerning Manpower, and other related regulations. The results show that weak supervision, low understanding of workers' rights, and the difficulty of the dispute resolution process are the main factors that hinder legal protection for workers against invalid employment contracts. Therefore, it is necessary to optimize policies and enforce stricter laws so that workers' rights can be protected effectively.

Abstract

Abstract

The Prosecutor's Office plays a crucial role in the functioning of the legal system. However, in reality, the Corruption Court is still located in every provincial capital in Indonesia, which often results in high costs for resolving corruption cases which are sometimes disproportionate to the losses they cause to the state. The author of this research focuses on analyzing circular letters belonging to the Deputy Attorney General for Special Crimes by linking the theory of Legal Economic Analysis as a form of consideration and also explaining how the Prosecutional Office applies a restorative justice approach. The research contributes to the topic discussed by evaluating the policy's significance and the prosecutor-office's role in handling corruption cases through the application of restorive justice principles. This study also aims to provide an overview of the challenges and technical legal issues faced by the public prosecutor in carrying out their responsibility to recover funds and/or state assets.

Abstract

This study aims to examine the application of Indonesian contract law in bank loan agreements involving collateral rights and to evaluate its relevance to the development of modern mortgage contract law. Using an empirical juridical approach supported by both library research and field data, this research analyzes how the fundamental principles of contract law—such as freedom of contract, good faith, balance, and legal certainty—are implemented in banking practices. The findings indicate that contract law provides a legal foundation for regulating reciprocal obligations between creditors and debtors, primarily through instruments such as the Power of Attorney to Impose Security Rights (SKMHT) and the Deed of Grant of Security Rights (APHT). The enactment of Law No. 4 of 1996 on Mortgage Rights strengthens creditor protection by introducing a more enforceable and simplified collateral mechanism. However, several obstacles remain, including debtor default, administrative deficiencies, legal uncertainty in collateral execution, and imbalanced standard contracts that often disadvantage debtors. The study concludes that Indonesian contract law plays a strategic role in ensuring legitimacy, legal certainty, and balanced protection for both creditors and debtors, although continuous regulatory refinement and enforcement improvement are necessary to address existing challenges and align with socio-economic developments in the banking sector.

Abstract

Corruption has become an endemic problem in Indonesia. Numerous high-profile cases resulting in trillions of rupiah in losses have made the term familiar to the public. Despite clear legal definitions outlined in UU No. 31 of 1999, corruption persists, particularly in sectors like mining. The repercussions extend beyond financial losses, damaging social structures, and the environment. Just like cancer, corruption erodes the very foundations of the nation, threatening its economy and social justice. In an effort to foster social awareness, students from the Universitas Internasional Batam have conducted community service at the Al-Jufri Orphanage Sekupang, Batam City. The activity was held on April 28, 2024, involving 56 participants and included three main activities: anti-corruption education, educational games, and decorating a reading corner.. This activity aims to make positive contribution to the surrounding community, especially to the children. he students have implemented an anti-corruption education program for the orphans. Serving as both educators and observers, the students have noted a high level of enthusiasm and a growing understanding of the dangers of corruption among the children.
