Abstract

PT Asuransi BUMIDA merupakan sebuah perusahaan yang bergerak di bidang pengalihan risiko. Dalam hal ini PT Asuransi BUMIDA Kota Pontianak melakukan hubungan kerjasama MOU dengan pihak-pihak sekolah yang berada di Kota Pontianak khususnya adalah sekolah SMK Negeri 7 Pontianak. Salah satu produk yang dikeluarkan oleh PT Asuransi BUMIDA adalah  produk asuransi kecelakaan SiswaKoe, di mana asuransi ini khusus dibuat untuk menjamin keselamataan dan kesejahteraan siswa-siswi yang ada di kota Pontianak. Dengan hadirnya PT Asuransi BUMIDA di Kota Pontianak, kebutuhan sisiwa-siswi di bidang pengalihan risiko kecelakaan dapat terpenuhi melalui perjanjian asuransi kecelakaan siswa. Dalam pelaksanaan perjanjian siswa-siswi harus membayar premi asuransi dan dapat mengajukan klaim asuransi. Namun dalam proses perjanjian asuransi kecelakaan terdapat masalah di mana siswa-siswi tidak dapat mengklaim perjanjian asuransi kecelakaan siswa. Skripsi ini memuat rumusan masalah : “Faktor Apa Yang Menyebabkan Siswa Tidak Dapat Mengklaim Dalam Perjanjian Asuransi Kecelakaan Pada PT. Asuransi BUMIDA Pontianak?” Adapun metode penulisan skripsi ini menggunakan metode penelitian hukum empiris dengan pendekatan deskriptif analisis. Penelitian hukum empiris yaitu penelitian hukum yang berasal dari kesenjangan antara teori dengan kehidupan nyata yang menggunakan hipotesis, landasan teoritis, kerangka konsep, data sekunder dan data primer. Metode deskriptif yaitu suatu prosedur untuk memecahkan masalah yang dihadapi dengan menggambarkan keadaan pada saat sekarang, berdasarkan fakta yang ada sewaktu penelitian. Selanjutnya dalam perjanjian asuransi kecelakaan antara PT. Asuransi BUMIDA Pontianak sebagai pihak penanggung dengan siswa-siswi SMK Negeri 7  sebagai pihak tertanggung saling memiliki hak dan kewajiban. Salah satu hak pihak penanggung adalah mendapatkan pembayaran premi, sedangkan hak pihak tertanggung adalah mendapatkan pengalihan resiko atau dapat mengajukan klaim asuransi. Dalam pelaksanaan perjanjian asuransi kecelakaan siswa terdapat masalah siswa-siswi SMK Neegeri 7 Pontianak tidak dapat mengklaim perjanjian asuransi kepada PT Asuransi BUMIDA Pontianak. Adapun faktor penyebab siswa tidak dapat mengklaim perjanjian asuransi kecelakaan adalah jangka waktu periode polis belum jatuh tempo dan kadaluarsa, penyakit yang tidak dicover atau dikecualikan pihak asuransi, tidak memiliki SIM. Akibat hukum bagi  siswa-siswi yang ditolak klaimnya mendapatkan surat penolakan ganti rugi dari pihak asuransi. Upaya hukum yang dilakukan oleh siswa-siswa untuk dapat mengklaim perjanjian asuransi adalah memepelajari kembali isi polis perjanjian dan meminta penjelasan kembali kepada pihak asuransi mengenai isi yang tetera dalam polis perjanjian asuransi kecelakaan siswa. Abstract

One of the substance of Law Number 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition is the provision that regulates collusion in tenders. The provision is regulated in Article 22 which is a special provision with the aim of creating a conducive business climate to support and develop activities for the provision of quality goods and services and at competitive prices. Considering that the impact of the conspiracy in tenders is very significant for national economic development and a healthy competitive climate, the regulation regarding the prohibition of tender conspiracy can be applied both with a rule of reason approach and with a per se illegal approach, so that administrative sanctions and criminal sanctions as well as additional criminal sanctions that will be imposed on business actors can run as desired by Law Number 5 Year 1999. The impact of collusion actions in tenders is not just economic development National and unfair competition climate, but other impacts can be felt by consumers as tender givers who can experience material and immaterial losses. Consumer protection is needed as an effort made to safeguard consumer rights and develop behavior attitudes of responsible business actors.Salah satu substansi Undang - Undang Nomor 5 Tahun 1999 Tentang Larangan Praktik Monopoli Dan Persaingan Usaha Tidak Sehat adalah ketentuan yang mengatur persekongkolan dalam tender. Ketentuan tersebut diatur dalam Pasal 22 yang merupakan ketentuan khusus dengan tujuannya untuk menciptakan iklim usaha yang kondusif guna mendukung dan menumbuh kembangkan kegiatan penyediaan barang dan jasa yang berkualitas dan dengan harga yang bersaing. Mengingat dampak yang ditimbulkan dari tindakan persekongkolan dalam tender sangat signifikan bagi pembangunan ekonomi nasional dan iklim persaingan yang sehat, maka pengaturan mengenai larangan persekongkolan tender dapat diterapkan baik dengan pendekatan secara rule of reason maupun dengan pendekatan secara per se illegal, sehingga sanksi administratif dan sanksi pidana serta pidana tambahan yang akan dijatuhkan pada pelaku usaha dapat berjalan sebagaimana yang dikehendaki oleh Undang - Undang Nomor 5 Tahun 1999. Dampak yang ditimbulkan dari tindakan persekongkolan dalam tender bukan hanya kepada pembangunan ekonomi nasonal dan iklim persaingan tidak sehat, akan tetapi dampak lain dapat dirasakan oleh konsumen selaku pemberi tender yang dapat mengalami kerugian materiil maupun immaterial. Perlindungan konsumen diperlukan sebagai suatu upaya yang dilakukan untuk menjaga hak-hak konsumen dan menumbuh kembangkan sikap perilaku pelaku usaha yang bertanggung jawab.

Abstract

As the main staple, rice becomes a food that must have good quality and is safe for consumption. The Indonesian National Standard is a parameter used as a benchmark for the feasibility of a product being circulated, so that the application of the Indonesian National Standard on rice products is needed to protect the security and safety of consumers. The irony is that this has not yet become the awareness of the business actors. To protect consumers from loss requires legal measures that consumers can do in accordance with consumer protection laws. As for the problems are: the application of good Indonesian National Standards regulations on rice products circulating in traditional and modern markets in Indonesia, and legal remedies carried out by consumers who suffer losses on rice products circulating on the market in Indonesia. The results of the research show that the application of SNI regulations is good to be applied to rice products circulating in modern markets and traditional markets in Indonesia, through the application of SNI rice where the regulations are not in accordance with the principles contained in the UUPK. Good legal remedies to be carried out by consumers who suffer losses on rice products circulating in the Indonesian market are certainly through consumer dispute resolution outside the court, namely through the Consumer Dispute Resolution Agency which acts as an intermediary in resolving disputes.

Abstract

Penggunaan pakaian anak yang memenuhi Standar Nasional Indonesia (SNI) adalah hal yang pentinng untuk menjaga kesehatan dan keselamatan anak. Standar Nasional Indonesia merupakan parameter yang digunakan sebagai tolak ukur kelayakan suatu produk dapat beredar pada masyarakat, sehingga penerapan peraturan Standar Nasional Indonesia pada produk pakaian anak diperlukan untuk melindungi keamanan dan keselamatan konsumen. Ironisnya hal tersebut masih belum mejadi suatau kesadaran yang penting tehadap pihak pelaku usaha. Realitanya masih ditemukan peredaran pakaian anak yang tidak memenuhi Standar Nasional Indonesia sehingga timbul pertanyaan bagaimanakah pengawasan terhadap peredaran pakaian anak yang tidak memenuhi SNI ditinjau dari Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan sosiologis (social legal approach) melalui wawancara, dan diskusi dengan para pihak. Dinas Perindustrian Perdagangan Koperasi dan Usaha Kecil Menengah Kota Pontianak pihak yang bertanggung jawab dalam mengawasi peredaran produk yang dimasyarakat menjelaskan kurangnya pengetahuan konsumen maupun pelaku usaha serta faktor ekonomi konsumen yang termasuk dalam cluster menengah kebawah yang menjadi alasan utama masih beredarnya produk pakaian anak yang tidak memenuhi Standar Nasional Indonesia (SNI). The use of children's clothing that meets the Indonesian National Standard (SNI) is important to maintain children's health and safety. The Indonesian National Standard is a parameter used as a benchmark for the feasibility of a product to circulate to the public, so the application of Indonesian National Standard regulations on children's clothing products is needed to protect consumer security and safety. Ironically, this is still not an important awareness of business actors. The reality is that there is still the circulation of children's clothing that does not meet the Indonesian National Standard, so the question arises how to supervise the circulation of children's clothing that does not meet SNI in terms of Law Number 8 of 1999 concerning Consumer Protection. The method used in this study is qualitative with a sociological approach (social legal approach) through interviews and discussions with the parties. The Department of Industry, Trade, Cooperatives and Small and Medium Enterprises of Pontianak City, the party responsible for supervising the circulation of products in the community, explained the lack of knowledge of consumers and business actors as well as consumer economic factors included in the lower middle cluster, which is the main reason for the circulation of children's clothing products that do not meet the Indonesian National Standard (SNI) .

Abstract

Tax is a source of income for a country, the use of tax money to finance all state expenditures and financing state development projects. Tax collection is carried out by the state to taxpayers or tax bearers. The current monetary crisis makes many taxpayers who do not obey in paying taxes. So the government must create a new mechanism that aims to help forcibly for taxpayers who do not obey the law. One such mechanism is the forced institution of body (gijzeling). In establishing gijzeling institutions, there are things that must be considered and considered, namely the legal, justice and humanitarian needs (Human Rights), because basically these institutions contain elements of deprivation of liberty. This study aims to analyze how the institution of forced agency (gijzeling) is implemented and how the implementation of tax hostage policy (gijzeling) is seen from the perspective of Human Rights. From the results of the study, it is known that the enforced implementation of the body can be carried out if other administrative legal activities are proven and the tax guarantor has arrears a tax payment of Rp 100,000,000-, and viewed from the perspective of human rights taking a tax (gijzeling) is basically a deprivation of a person's right to independence, but related to the tax guarantor who has no good intention, gijzeling can be applied.

Abstract

The aim to be achieved in this research is to realize the achievement of a Legal Awareness Village by increasing the role of Family Welfare Empowerment (PKK) at the Village Level. The PKK, which recruits members down to the lower levels of society is expected to be able to bring about prosperous family conditions, namely families that can fulfill basic human needs both materially, socially, mentally, and spiritually, as well as empowered families, namely families that live prosperously, progressively and independently, including families who are obedient and adhere to the rules of law, so that fulfillment of the Legal Awareness Village achievement indicators can be achieved through the strategic role of the PKK Movement in the village. This research is socio-legal research with a qualitative approach. The data used in this research are secondary (literature, documents, laws, and regulations) and primary data (interviews, questionnaires, and focused discussions) with the focus of the research carried out in ArangLimbung Village, Sei Raya District, Kubu Raya Regency. The research results show the urgency of forming a Village PKK level group which can be a forum for achieving the fulfillment of the Law Awareness Village indicators.

Abstract

Dalam mendukung pencapaian kesejateraan masyarakat menuju desa sadar hukum, sangat perlu dilakukan sosisalisasi masyarakat. Sosialisasi masyarakat dilakukan dengan melalui metode penyuluhan hukum berupa pendampingan kepada oprganisasi kemasyarakatan yang ada. Berkaitan dengan pencapaian desar sadar hukum, maka diperlukan pembentukan kelompok keluarga sadar hukum (kadarkum) dengan pelibatan peran dari organiasi Pemberdayaan Kesejahteraan Keluarga (PKK). Salah satu bagian dimensi implementasi hukum untuk pemenuhan indeks pencapaian desa sadar hukum yang harus dicapai adalah tidak adanya angka perkawinan anak di desa, realitasnya masih adanya perkawianan anak yang terjadi di Desa Arang Limbung. Pengabdian ini berkerjasama dengan TP PKK Desa Arang Limbung yang berjumlah 30 orang. Hasil pengabdian ini menunjukan perlu dilakukan pendampingan terhadap anak dan orangtua di desa, selain itu terbentuknya kelompok kadarkum oleh PKK desa sebagai penyuluh desa untuk membantu pelaksanaan upaya pencapaian desa sadar hukum dalam memaksimalkan pencegahan perkawinan anak. Melalui pendampingan terhadap PKK Desa Arang limbung, maka diharapkan dapat melakukan komunikasi dan edukasi kepada masyarakat setempat mengenai Gerakan Cegah Perkawinan Anak (CEPAK).

Abstract

Conservatism, combined with a positivist view of the law, causes the law to become rigid and merely an artificial construct. Legal actors, who should be reformist agents of change, now focus solely on rules. The implications of this static application of the law by legal actors, particularly in relation to legal counselling methods, hinder legal counselling programs aimed at building public legal awareness. Based on this, it is necessary to find a legal counselling method that is more relevant to current times—one that aligns with public aspirations, is creative, innovative, and can be effectively implemented in the community. The problem formulation in this study is how to contextualize progressive law in designing a hybrid legal counselling method as an effort to build public legal awareness. The purpose of this study is to explore and contextualize progressive law in designing such a method. This study employs an empirical legal research method with a sociological-juridical approach. The research was conducted in West Kalimantan Province, focusing on Bengkayang Regency and Landak Regency. The conclusions of this study were drawn deductively. This study concludes that the contextualization of progressive law within the hybrid legal counselling method in West Kalimantan must be based on legal awareness and the needs of the community. This method aims to liberate society from conservative rules. Additionally, the effectiveness of this method is highly dependent on the ability of legal counsellors to continuously innovate and progress while upholding legal ethics.

Abstract

This article explores the utilization of digital technology to enhance public legal awareness from a comparative global perspective. In the digital era, technology has become a significant tool for expanding access to legal information and empowering individuals to understand their legal rights and obligations. This study analyzes various global practices, including digital initiatives such as law-based mobile applications, e-learning platforms, social media-based legal awareness campaigns, and online legal aid systems. Furthermore, the article evaluates the necessary legal reforms to effectively support the use of digital technology in legal contexts, with a focus on Indonesia. By comparing approaches in countries such as the United States, the United Kingdom, and Scandinavian nations, this research provides recommendations to strengthen inclusive and equitable digital legal awareness strategies. The article underscores the importance of technological innovation in fostering a legally informed society and supporting legal transformation in the digital age.

Abstract

Child marriage continues to be a significant issue in various Indonesian villages, including Lingkonong Village in Landak Regency. This issue has threatened children's education and health while obstructing the realization of their rights as the future generation of the nation. The Village Family Empowerment and Welfare Movement Team (TP-PKK) serves as an innovator by employing a community empowerment approach to address this issue. This community service initiative aims to enhance public legal awareness regarding the dangers of child marriage, while simultaneously equipping TP-PKK members with skills in utilizing digital media as a tool for prevention campaigns, particularly within the framework of the CEPAK (Child Marriage Prevention) Movement program. The Participatory Action Research (PAR) method is utilized, engaging TP-PKK members and residents in the design, implementation, and evaluation of educational programs. The primary activities encompass legal counseling, training in the utilization of digital platforms, the development of context-specific educational materials, and the dissemination of information via online media. The capacity of TP-PKK Lingkonong Village to manage digital campaigns promoting the CEPAK Movement has significantly increased. Their role as agents of change was effectively reinforced through the initiation of the campaign entitled "Lingkonong Village Towards a Generation Free of Child Marriage." This collaboration enables the community to comprehend the adverse effects of early marriage while also engaging in preventive initiatives. Digital media serves as an effective strategy for enhancing outreach, promoting collective awareness, and establishing a community environment that is more attuned to the safeguarding of children's rights
