Abstract

The embodiment of people's democracy, namely the regional head elections from 2017 to 2020, has revealed various problems, which can be considered to have reduced the quality of this political event. Debates continue to occur regarding regional head candidates, even DPR/DPRD member candidates who have committed corruption, and the low level of public trust in political parties. There appears to be a correlation with corruption due to the need for campaign funds related to the choice of regional heads. The scope of corruption in regional head candidates needs to be of concern to all parties, so that the prevalence of corruption in the implementation of regional elections actually increases, and undermines the goals of democracy as a means of realizing people's welfare. On the other hand, political parties as the first door to recruiting regional head candidates have an early detection role, in tracking the track record of the regional head candidates they will nominate. The formulation of the problem that will be studied is how the phenomenon/"shadow of corruption" in the 2024 Simultaneous Pilkada reflects the previous Pilkada, this political behavior is also similar to when there are legislative choices. The method used is normative juridical, then examines secondary data for the 2020 simultaneous regional elections, as a view of the potential that will occur in the 2024 simultaneous regional elections. Regional head candidates who commit corruption or are related to criminal acts of corruption do not have the legitimacy to nominate or be elected regional head.

Abstract

The decline in economic growth in Indonesia amidst the Covid-19 outbreak has resulted in a drop in income in various industrial, tourism and service sectors, resulting in layoffs. Apart from layoffs, the impact of Covid-19 also caused delays in several payment contracts, even ending in cancellation. Some of the contracts affected by Covid-19 are business contracts that are related to and depend on human movement, such as hospitality, transportation, tourism and manufacturing. Apart from that, there are also contracts in the financing sector such as leasing which are also affected by the downturn in the economy which results in delays in payments by debtors. One of the government's policies to save the national economy is by issuing a policy regarding the Designation of Non-Natural Disasters from the Spread of Covid-19 as National Disasters through Presidential Decree (Keppres) Number 12 of 2020.

Abstract

The purpose of this research is to find out cases of violations related to human rights in Papua and to find out the state's responsibility for violations of human rights in Paniai Regency, Papua Province. The formulation of the problem in this study is why the issue of human rights violations in Paniai District, Papua Province has occurred again and what is the role of the state in protecting human rights in Indonesia and what is the international view of the state's role in protecting human rights in Indonesia. The purpose of this study is to determine the role of the state in protecting human rights in Indonesia and to find out the legal view of the state's role in protecting human rights in Indonesia. The research method used in this study is a normative research method with primary data sources derived from library research. This research was conducted using a statutory approach in order to further study the legal basis by examining laws and regulations related to human rights violations that occurred in Paniai district, Papua. The findings in this study are that the role of the state in protecting human rights in Indonesia has been considered in such a way as can be seen from the many laws and regulations regarding human rights whose aim is to protect the rights of the humans themselves. However, the issue of resolving human rights cases must be carried out as fairly and transparently as possible in their settlement, considering the obligation of the state to carry out its role as a protector of human rights for all of its people, must be maximized and every right must be fulfilled. However, in practice discrimination against human rights is still widely encountered due to injustice that comes from the authorities themselves. Keyword : HAM, Paniai, Accountability and justice

Abstract

Abstract

The Indonesian state has a constitutional obligation to advance national culture, as mandated by Article 32 paragraph (1) of the 1945 Constitution, which guarantees the freedom of the people to preserve and develop cultural values. Indonesian culture, reflecting the nation's noble values, must be embraced by all citizens to strengthen national identity, enhance dignity, and reinforce unity to achieve the nation's future aspirations. Historical objects, structures, and buildings are crucial to preserve to provide an understanding of current social and physical realities. In Paser Regency, rapid development has negatively impacted efforts to protect and preserve historical traditions and culture. Cultural heritage, such as Cultural Heritage Objects, Cultural Heritage Buildings, and others, have not been officially recognized as cultural heritage by the local government. The management of valuable historical traces has not been comprehensive, with current management more oriented towards tourism and religious activities. An academic draft of a Regional Regulation on the Protection, Preservation, and Management of Cultural Heritage is needed to optimize the management and preservation of cultural heritage in Paser Regency. This would enable the community to better understand history and support overall community empowerment.

Abstract

Kata Kunci: Pemilihan Umum, Pengawasan, Teknologi Informasi AbstractThe most fundamental feature of a democracy is the existence of universally transparent and democratic suffrage. Over time, the conduct of elections should be monitored. It is necessary to discuss the issue of using information technology in conducting elections, because almost every modern country has used information technology in the conduct of elections to achieve quality elections. Therefore, information technology must be used to support supervisory functions in the holding of general elections. This research uses normative juridical methods by using secondary data collection techniques through literature searches, examining materials taken from literature, namely laws, journals, books and online news. The purpose of this study is to encourage the optimization of general election monitoring using information technology. The use of information technology in general elections is an important issue, especially related to supervision. The implementation of legislative elections in the era of advances in information technology that is developing today requires professional human resources in terms of facilitating the performance of general election organizers and minimizing data errors both at the regional and central levels. The election supervision process is currently running well, but due to limited human resources, the wide reach of election monitoring agencies, various fraud efforts, and the lack of optimal socialization in the use and monitoring of information technology, these are weaknesses in supervision. Keywords: Elections, Surveillance, Information Technology
