Abstract

Latar Belakang: Isu pemanasan global disikapi dengan berbagai cara oleh setiap negara, dengan tujuan utama adalah menurunkan tingkat emisi gas ke udara yang kemudian dapat mempengaruhi temperatur dunia. Penelitian ini disusun untuk mengkaji langkah Pemerintah Indonesia untuk mengatasi masalah tersebut, salah satunya melalui kebijakan yang dikeluarkannya. Metode: Metode penelitian adalah kualitatif dengan pendekatan desk study. Temuan: Hasil kajian menyimpulkan bahwa terdapat paling tidak 2 (dua) kebijakan penting yang terkait dengan langkah Pemerintah Indonesia untuk mengurangi tingkat emisi ke udara, yaitu Peraturan Presiden No. 79 Tahun 2023 yang memberikan kemudahan bagi para produsen otomotif yang mengembangkan sepeda motor dan kendaraan listrik di Indonesia. Kebijakan ini dapat dikatakan sebagai kelanjutan dari kemudahan berinvestasi yang dicita-citakan melalui UU Cipta Kerja, termasuk investasi di bidang pertambangan dan pengolahan mineral nikel. Nikel adalah salah satu bahan baku utama untuk pembuatan baterai kendaraan listrik. Kesimpulan: Kajian ini menyimpulkan bahwa terdapat beberapa tantangan yang harus dihadapi untuk mewujudkan kedua cita-cita peraturan tersebut. Di hulu, pada kegiatan pertambangan, sampai saat percepatan proses perizinan masih banyak kendala baik secara teknis maupun administrasi. Sedangkan di hilir, infrastruktur untuk mendukung ekosistem kendaraan listrik masih terbatas atau kurang memadai, seperti stasiun pengisian baterai (SPB) yang masih jarang dijumpai di jalan raya atau area parkir umum.

Abstract

Studi ini memeriksa bagaimana Undang-Undang Cipta Kerja berfungsi sebagai cara untuk menerapkan hukum dan kebijakan ekonomi yang selaras di era globalisasi. Namun, untuk mendorong investasi dan penciptaan lapangan kerja, kebijakan ekonomi Indonesia memerlukan kerangka hukum yang jelas dan konsisten. Untuk menyederhanakan aturan di berbagai industri, pemerintah mengeluarkan Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja. Meskipun demikian, meskipun Undang-Undang Cipta Kerja bertujuan untuk meningkatkan investasi dan lapangan kerja melalui penyederhanaan regulasi, penelitian ini menemukan bahwa pelaksanaannya masih menghadapi berbagai masalah dan hambatan, seperti ketidaksesuaian regulasi dan masalah implementasi di lapangan. Evaluasi dan penyesuaian perlu dilakukan untuk meningkatkan efektivitas Undang-Undang Cipta Kerja di masyarakat. Di era globalisasi, pemerintah harus terus memperbarui kebijakannya untuk menciptakan iklim investasi yang baik.

Abstract

Based on Law Number 17 of 2023 concerning Health, it is stated that a hospital is a health service facility that provides comprehensive individual health services through promotive, preventive, curative, rehabilitative, and/or palliative health services by providing inpatient, outpatient, and emergency services. Referring to the provisions contained in Law Number 17 of 2023 concerning Health, hospitals can be organized by the central government, regional governments, or the community. Hospitals organized by the central government or regional governments in providing health services can apply the financial management pattern of public service agencies in accordance with the provisions of laws and regulations. In contrast, hospitals established by the community must be in the form of a legal entity whose business activities are only engaged in health services, except for hospitals organized by non-profit legal entities.

Abstract

Maqashid Sharia, which is the purpose and basic principle of Sharia, serves as a moral and ethical foundation in the development of various economic activities. The method used is a qualitative approach to explore the relevance of Maqashid Syariah in Social Based Crowdfunding contracts. This method was chosen to obtain an in-depth understanding of the concept of Maqashid Syariah and its application in the context of Islamic economic law in Indonesia and Malaysia.  Based on the analysis conducted, it can be concluded that Maqashid Syariah has significant relevance as a foundation in Social Based Crowdfunding contracts in Indonesia and Malaysia. Maqashid Syariah, which focuses on achieving the goals and benefits of society, can ensure that every Crowdfunding transaction is not only financially beneficial, but also in accordance with sharia principles. Social Based Crowdfunding based on Maqashid Syariah is able to answer the needs of the community by providing access to financing for beneficial projects, such as social, education, and health. This approach also promotes justice and equality in resource distribution, reduces inequality, and supports small entrepreneurs who need support. Agreements structured based on Maqashid Syariah principles emphasise the importance of transparency and accountability, so that all parties involved can be held accountable for their roles and contributions

Abstract

Legal politics is an important element when creating a number of policies and regulations that will be enforced in society. Economic development is a process that is carried out on an ongoing basis to achieve prosperity and progress for the nation. In an effort to encourage economic growth and increase global competitiveness, the Indonesian government introduced the Job Creation Law (UU Job Creation). This research method is normative legal research, with data sourced from library research. This research can provide benefits in the form of input, especially in economic development and investment. The Job Creation Law also increases transparency in the licensing process by requiring all licensing information and requirements to be openly available and accessible online. However, in investment policy after the Job Creation Law, there is still legal uncertainty and the potential for overlapping regulations at the central and regional levels. The government needs to increase harmonization and synchronization between regional regulations and higher laws and regulations. Coordination is very important as an effort to harmonize regulations, because licensing issues are not only at the central and regional levels but cross-sectoral at a national level..

Abstract

Investment management by state-owned enterprises (BUMN) or entities related to state finances often raises legal issues, particularly when losses occur that impact state finances. PT Daya Anagata Nusantara (PT. DANANTARA) is an entity that has been in the spotlight due to allegations of state losses arising from its investment management activities and the status of those losses. However, the emergence of exceptions to these losses from the category of state financial losses has given rise to legal debate that requires in-depth analysis. The method used in this research is a descriptive analytical method by solving research problems on the object of study, namely regarding Legal Analysis of PT Danantara's Exclusion from State Finance in Investment. The results of the study concluded that the exclusion of PT Daya Anagata Nusantara's (PT Danantara) losses from the category of state losses is based on a strong legal basis, especially referring to the legal status of PT Danantara as a limited liability company subject to private law and the principle of separate legal entity as regulated in the Law on Limited Liability Companies. The legal consequences of the exclusion of Daya Anagata Nusantara's (PT. DANANTARA) losses from the category of state finances due to investment management from the perspective of statutory regulations have a strategic position as a state investment management body that is directly responsible to the President. As a limited liability company, PT Danantara is legally separated from state finances as regulated in the State Finance Law No. 17 of 2003, so that the losses it experiences are not automatically categorized as state losses.

Abstract

Di era digital, peran Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) sangat penting dalam mengatur e-commerce di Indonesia. Pertumbuhan e-commerce berdampak pada hak dan kesejahteraan konsumen melalui peningkatan kesadaran hukum, regulasi e-commerce, dan penekanan pada kualitas layanan dan produk. Keamanan dan privasi data menjadi perhatian utama dengan semakin diperkuatnya pertahanan terhadap kejahatan siber. Konsumen memiliki lebih banyak pilihan berkat kemajuan dalam metode pembayaran dan transaksi, seperti dompet digital, sementara teknologi keamanan yang melindungi transaksi mengurangi risiko penipuan. Untuk melindungi konsumen dan membantu mereka membuat keputusan yang lebih bijak, pemerintah harus meningkatkan literasi konsumen dan menyebarkan regulasi. UU ITE memperkuat penegakan hukum terhadap praktik pengumpulan, pengolahan, dan penggunaan data konsumen oleh penyedia layanan elektronik. Penerapan Undang-Undang Nomor 1 Tahun 2024, sebagai perubahan kedua atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, membantu harmonisasi antara hukum konvensional dan digital, dengan e-dokumentasi dianggap sebagai perluasan dari hukum acara yang berlaku di Indonesia. Untuk meningkatkan pemantauan dan penegakan hukum di era digital, diperlukan kerja sama antara pemerintah, lembaga penegak hukum, dan platform bisnis online.

Abstract

The success of a transaction often depends on the balance of information and fairness between consumers and business actors. Therefore, this research will examine the role of the Consumer Protection Law in guaranteeing consumer rights and providing a legal framework for effective dispute resolution. The research methodology used is normative legal research which involves collecting data through literature study, analysis of related legal documents, and field research to obtain a comprehensive picture of consumer dispute resolution practices. The research results highlight the need for improvements in e-commerce transaction dispute resolution regulations, especially in the cross-border context. The Consumer Protection Law in Indonesia provides a significant legal basis, but there are obstacles in resolving cross-border disputes. Online Dispute Resolution (ODR) as a potential solution is also not fully optimal. This legal vacuum creates legal uncertainty that can harm the parties, so more specific legal reform is needed. Increasing the role of ODR with the application of more sophisticated technology is the key to resolving e-commerce transaction disputes effectively, while ensuring that the rights of consumers and business actors are well protected.
