Abstract

The rapid growth of financial technology, especially cryptocurrencies, raises challenges and legal questions regarding their acceptance and use in economic transactions. This research aims to examine the legal aspects related to the use of cryptocurrency as a means of payment in Indonesia. This research uses a normative legal approach to laws and regulations relating to cryptocurrencies in Indonesia. The research results show that the use of cryptocurrency, especially Bitcoin, as a means of payment in Indonesia has not been officially recognized. Although regulations such as Bappebti Regulation 7/2020 allow trading of crypto assets on the physical market, cryptocurrency is not considered a legal currency for payment transactions within the country. There are administrative sanctions for Payment Service Providers who violate this provision, and individuals who do not use Rupiah in payment transactions may be punished. Research recommendations include the need for clearer regulations to regulate the legal status of cryptocurrencies, including supervision, taxation and implementation of blockchain in Indonesia. In conclusion, legal recognition and stricter regulations are needed to accommodate the development of cryptocurrencies by considering national economic and financial policies.

Abstract

Investment management by state-owned enterprises (BUMN) or entities related to state finances often raises legal issues, particularly when losses occur that impact state finances. PT Daya Anagata Nusantara (PT. DANANTARA) is an entity that has been in the spotlight due to allegations of state losses arising from its investment management activities and the status of those losses. However, the emergence of exceptions to these losses from the category of state financial losses has given rise to legal debate that requires in-depth analysis. The method used in this research is a descriptive analytical method by solving research problems on the object of study, namely regarding Legal Analysis of PT Danantara's Exclusion from State Finance in Investment. The results of the study concluded that the exclusion of PT Daya Anagata Nusantara's (PT Danantara) losses from the category of state losses is based on a strong legal basis, especially referring to the legal status of PT Danantara as a limited liability company subject to private law and the principle of separate legal entity as regulated in the Law on Limited Liability Companies. The legal consequences of the exclusion of Daya Anagata Nusantara's (PT. DANANTARA) losses from the category of state finances due to investment management from the perspective of statutory regulations have a strategic position as a state investment management body that is directly responsible to the President. As a limited liability company, PT Danantara is legally separated from state finances as regulated in the State Finance Law No. 17 of 2003, so that the losses it experiences are not automatically categorized as state losses.

Abstract

The family economy is one source that can increase the family's welfare. The crisis caused by the Covid- 19 pandemic has exacerbated life in the household, thus demanding a change in behavior in a family's life. Prosperous survival of the role of the wife as a housewife is required to participate in the struggle for survival, especially in increasing economic needs. Economic needs include developing skills in the field of business, to be able to generate income, namely making food production, including pizza type foods which are currently in vogue, especially as snacks and side dishes. The problems faced in product development include the need for skills in marketing, and having to know the market share of the products offered. Marketing and market share is an obstacle in charging these products, so it requires a study that can open up better opportunities. The purpose of community service is to increase the role of housewives in improving the economy, especially the family economy through businesses using digital applications. The implementation method offered in product development includes several things that must be done, namely determining a strategic place other than the house as a place of production, strengthening in the field of capital, status of business entities that can provide added value, for example small and medium & micro businesses in the form of business entities individual; the status of recognition from the public for the products produced and following current trends with an electronic innovation. Involving digital technology partners can help marketing and expand market share. Data analysis uses secondary data in the form of laws and regulations and primary data through interviews. Strengthening the empowerment of the role of housewives who have produced a product needs to be carried out with various supports to support the economic progress of the family and also contribute to the economic growth of the community. Through outreach, briefings that involve related fields, for example regarding forms of supporting business entities, utilization of intellectual property rights, and new innovations in the field of digital technology, as well as being able to join wider associations and have existing insights well.

Abstract

Undang-Undang Cipta Kerja diterbitkan untuk mempercepat investasi dan pertumbuhan ekonomi, namun menimbulkan disharmoni fundamental dengan prinsip keberlanjutan lingkungan yang diamanatkan konstitusi. Penelitian ini membahas dua isu utama: pelemahan instrumen perlindungan lingkungan akibat perubahan Izin Lingkungan menjadi Persetujuan Lingkungan, serta pembatasan partisipasi publik dalam proses AMDAL sebagai dampak sentralisasi kewenangan dari daerah ke pusat. Metode penelitian yang digunakan adalah yuridis normatif melalui pendekatan perundang-undangan dan konseptual, dengan data sekunder berupa bahan hukum primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa ketentuan baru dalam UU Cipta Kerja mengurangi kualitas perlindungan lingkungan dan partisipasi masyarakat serta berpotensi mengabaikan kearifan lokal. Selain itu, penelitian ini menyoroti bagaimana pergeseran regulasi tersebut memengaruhi jaminan konstitusional seperti hak atas lingkungan hidup yang sehat (Pasal 28H UUD 1945) dan mandat pembangunan berkelanjutan (Pasal 33). Pelemahan instrumen preventif dan penyempitan ruang partisipasi publik berpotensi menimbulkan ketidakadilan ekologis dan ketidakpastian hukum. Oleh karena itu, diperlukan harmonisasi regulasi untuk mengembalikan fungsi instrumen lingkungan secara preventif, memperluas partisipasi publik, dan memastikan kebijakan pembangunan selaras dengan keberlanjutan ekologis serta keadilan antar generasi.
