Abstract

Kebijakan atau usaha untuk menanggulangi kejahatan, pada intinya merupakan bagian integral dalam rangkan melindungi masyarakat (social defense) untuk mencapai kesejahteraan sosial. Oleh karena itu, tujuan utama kebijakan kriminal adalah perlindungan untuk mencapai kesejahteraan masyarakat. Hasil dari penelitian ilmiah, terkait dengan alasan efektivitas atas sanksi kejahatan, bisa menjadi aspek penting untuk mendukung tercapainya tujuan dari kebijakan kriminal tersebut

Abstract

Corruption causes financial losses to the state which results in crises in various fields. In order to suppress the growth of corruption in Indonesia, various efforts to prevent corruption are carried out. One of them is by providing an additional penalty in the form of payment of replacement money. In terms of convict does not have sufficient assets to pay replacement money, he will be punished with substitute prison whose length does not exceed a main penalty. The absence of guidelines regarding the length of substitute prison based on replacement money results in frequent disparities. This research uses empirical research methods with a non-doctrinal approach in the form of empirical studies to find theories regarding the process of occurrence and operation of law in society. The formulation of the problem in this research is how judges consider when imposing a prison sentence as a substitute for replacement money in cases of criminal acts of corruption and what policies can prevent disparity in decisions in imposing prison sentences as a substitute for Additional Crime of Substitute Money in Corruption Crime.  Based on the research results, it is known that there are no standard guidelines regarding determining the length of substitute imprisonment, while Article 8 of Perma Number 5 of 2014 concerning Additional Crime of Substitute Money in Corruption Crime only determines that the maximum imprisonment is 20 (twenty) years. So, in addition to imposing a decision, the judge must consider the juridical, philosophical and sociological aspects and be based on the judge's beliefs obtained from the beginning to the end of a case that occurred. Because there are no restrictions on the provision of imprisonment as a substitute for Additional Crime of Substitute Money, several policies are needed to reduce existing disparities.

Abstract

Pada masa kini, Jaminan Hari Tua sering menjadi perdebatan di kalangan pekerja karena banyak yang tidak mendukung keputusan pemerintah lewat Permenaker No. 2 Tahun 2022. Kami ingin mengeksplorasi topik ini, khususnya terkait bagaimana regulasi Jaminan Hari Tua berdasarkan Permenaker tersebut dan realisasinya dalam konteks kebutuhan mantan pekerja. Terutama, realitas di lapangan menunjukkan bahwa banyak pekerja yang pension, baik di usia 56 atau sebelumnya tidak merasa kebutuhannya terpenuhi. Kami menerapkan metode normatif sosiologis dalam studi kami, menilai bagaimana Jaminan Hari Tua dirumuskan dalam Undang-Undang Cipta Kerja dan realisasi dalam Permenaker No. 2 Tahun 2022, serta dampaknya terhadap kondisi sosial mantan pekerja. Hasil studi kami menunjukkan bahwa implementasi Permenaker No. 2 Tahun 2022 belum optimal, sehingga perlu evaluasi ulang mengingat banyak pekerja yang tidak setuju dengan isi regulasi tersebut.

Abstract

Penelitian ini membahas penerapan hukuman dalam sistem peradilan pidana serta relevansinya dengan nilai-nilai keadilan dan demokrasi. Sistem peradilan pidana memiliki peran ganda, yaitu memberikan sanksi kepada pelaku kejahatan serta mendidik masyarakat mengenai pentingnya kepatuhan terhadap hukum. Dalam perkembangannya, pemenjaraan menjadi bentuk hukuman yang paling umum digunakan, menggantikan hukuman fisik yang dianggap tidak manusiawi. Namun, implementasi hukuman pemenjaraan masih menghadapi berbagai tantangan, seperti ketidakadilan dalam proses hukum, perlakuan tidak manusiawi terhadap narapidana, serta kesulitan reintegrasi sosial setelah bebas dari penjara. Tujuan penelitian ini adalah untuk menganalisis efektivitas sistem peradilan pidana dalam memberikan hukuman yang adil serta mengevaluasi dampaknya terhadap individu yang dihukum dan masyarakat secara keseluruhan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Data yang digunakan merupakan data sekunder yang diperoleh melalui studi kepustakaan, termasuk peraturan perundang-undangan, putusan pengadilan, jurnal hukum, dan literatur akademik lainnya. Teknik analisis yang digunakan adalah deskriptif kualitatif dengan interpretasi hukum untuk memahami penerapan norma hukum dalam praktik peradilan. Hasil penelitian menunjukkan bahwa meskipun sistem hukuman bertujuan untuk memberikan efek jera dan edukasi hukum, masih terdapat berbagai hambatan dalam penerapannya, seperti disparitas dalam penjatuhan hukuman, ketidakseimbangan kekuasaan antara hakim dan jaksa, serta dampak sosial yang dialami oleh mantan narapidana. Oleh karena itu, diperlukan reformasi dalam sistem peradilan pidana yang lebih berfokus pada keseimbangan antara penghukuman dan rehabilitasi, sehingga dapat menciptakan keadilan yang lebih inklusif dan efektif dalam menegakkan hukum.

Abstract

Korupsi di Indonesia masih menjadi masalah kompleks yang menghambat pembangunan ekonomi, sosial, dan tata kelola pemerintahan. Fenomena ini meluas di berbagai sektor, termasuk lembaga peradilan, yang menimbulkan kerugian multidimensional dan menurunkan kepercayaan publik terhadap pemerintah. Penelitian ini menggunakan metode hukum normatif dengan pendekatan konseptual untuk menganalisis efektivitas sistem peradilan pidana dalam menangani tindak pidana korupsi serta strategi peningkatannya. Hasil kajian menunjukkan bahwa meskipun regulasi dan lembaga seperti KPK telah dibentuk, masih terdapat kendala seperti rendahnya independensi penegak hukum dan budaya korupsi yang mengakar. Oleh karena itu, reformasi sistem peradilan pidana menjadi urgensi untuk mewujudkan tata kelola pemerintahan yang bersih, transparan, dan berkeadilan. Penelitian ini merekomendasikan peningkatan pengawasan, edukasi etika, dan perbaikan sistem hukum sebagai langkah strategis pemberantasan korupsi.

Abstract

This study examines Indonesia’s historical relationship with Communism and Marxism-Leninism, ideologies linked to the Madiun Rebellion of 1948 and the 1965 attempted coup. Despite the collapse of the Soviet Union and the global decline of Communist influence, legal provisions criminalizing the dissemination of Communism under the Indonesian Penal Code remain, raising concerns about academic freedom. These laws potentially restrict scholarly discussions and research, particularly concerning the 1965 events, both in academic settings and digital platforms. Using doctrinal legal research and comparative insights from Germany and Hungary, this study concludes that criminalizing Communist dissemination is no longer appropriate in Indonesia's current socio-political context. Legal protections should instead focus on safeguarding public interest and the rights of those affected by the 1965 events. Moreover, the vague formulation of Articles 188 and 189 of the Indonesian Penal Code poses a threat to academic freedom. The research suggests that policymakers reconsider these legal provisions and develop a clearer, more precise definition of “clear and present danger” to balance national security concerns with academic freedom. This study contributes to the debate on legal reform, highlighting the need for an updated approach that allows open academic discourse while respecting the rights of those affected by historical events.

Abstract

The Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education through the Regulation of the Minister of Education, Culture, Research, and Technology of the Republic of Indonesia Number 30 of 2021 is a symbol of follow-up from the government to address the phenomenon of sexual violence in tertiary institutions in Indonesia. This study aims to analyze the challenges and expectations related to this policy. There are a number of qualitative and quantitative methods that are used in this study, which include interviews, questionnaires, and document analyses, and all are empirical research methods. There are several tertiary institutions in Indonesia, particularly those in Bengkulu City that have implemented Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education, according to the results of this study. It is also important to note that there are also tertiary institutions that have not implemented these policies, but instead have their own policies or rules in regards to dealing with incidents of sexual violence at their institutions. A number of tertiary institutions, including tertiary schools in Indonesia, follow up on the rules governing the prevention and handling of sexual violence, but they follow policies that are not in line with the Regulation of the Minister of Education, Culture, Research and Technology of the Republic of Indonesia Number 30 of 2021 on Government's Policies on Prevention and Repression against Sexual Voilance in Higher Education.

Abstract

Penelitian ini menganalisis pengaruh penerapan pendekatan restorative justice terhadap efisiensi penyelesaian perkara pidana di Indonesia. Melalui pendekatan yuridis normatif, penelitian ini mengkaji peraturan perundang-undangan yang relevan untuk menilai sejauh mana dasar hukum mendukung efisiensi dalam penyelesaian perkara melalui mekanisme restorative justice. Hasil penelitian menunjukkan bahwa restorative justice memiliki potensi untuk meningkatkan efisiensi sistem peradilan pidana dengan mengalihkan penanganan kasus-kasus ringan ke mekanisme restoratif, sehingga memungkinkan aparat penegak hukum untuk fokus pada kasus-kasus yang lebih serius.

Abstract

The rampant violations of the main rights of road users that need to be prioritized can cause material and immaterial losses for those who get the main priority for road use. These violations can occur while driving or when utilizing road functions, due to intent, negligence, or ignorance. As a result of a lack of legal understanding and awareness, there is still a tendency to use and use roads not according to their designation, such as disruption of traffic order, delays for users of priority rights to obtain road access, and the potential for legal problems. The priority rights of road users that must be preceded are not fully understood by the community, especially regarding actions, criminal sanctions, and the importance of community participation. With this activity, people can add insight and knowledge to prevent and anticipate violations of the main rights of road users that need to be prioritized. The community is moved to orderly traffic to create conditions of obeying and obeying the law. As well as being able to provide awareness and increase legal awareness to prevent traffic violations in the future.

Abstract

This study examines the effectiveness of non-custodial sanctions within Indonesia’s juvenile justice system, with a particular focus on the implementation of restorative justice in Bengkulu Province. Grounded in Law No. 11 of 2012 on the Juvenile Criminal Justice System (UU SPPA) and international instruments such as the CRC and Tokyo Rules, the research explores the normative, institutional, and empirical dimensions of diversion and community-based sanctions for children in conflict with the law. Adopting a socio-legal methodology, the study combines doctrinal analysis with qualitative fieldwork involving 25 semi-structured interviews with judges, prosecutors, police investigators, correctional officers, and community leaders, complemented by direct observations of diversion sessions and the analysis of court and institutional documents. The findings reveal a strong normative commitment to restorative principles but highlight significant gaps in practice due to limited institutional capacity, inconsistent inter-agency coordination, and persistent cultural stigmas. Diversion programs in Bengkulu have demonstrated positive impacts on rehabilitation and social reintegration, particularly when supported by families and local communities. However, the absence of standardized procedures, integrated data systems, and adequate professional training undermines long-term sustainability. The study concludes that meaningful juvenile justice reform requires not only legal and procedural refinement but also transformative engagement with societal attitudes and sustained investment in supportive infrastructure. It further offers concrete policy recommendations to strengthen the restorative justice ecosystem and promote a more humane, rights-based approach to juvenile justice in Indonesia.
