Abstract

Tulisan ini berjudul Dualisme Kompetensi Dalam Penyelesaian Sengketa Tanah Terhadap Sertifikat Hak Atas Tanah Berupa Sertifikat Hak Milik (SHM) Yang Diterbitkan Oleh Badan Pertanahan Nasional Dikaitkan Dengan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Karya tulis ini dilatarbelakangi oleh adanya permasalahan mengenai adanya dualisme kompetensi absolut antar peradilan terkait kewenangan mengadili penyelesaian sengketa tanah. Tulisan ini bertujuan untuk mengetahui sejauh mana masing-masing peradilan tersebut berwenang dalam mengadili adanya sengketa tanah, sehingga nantinya tidak merugikan pihak yang akan mempertahankan kepentingannya terhadap suatu hak atas tanah, yang dikaitkan dengan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Abstract

Tulisan ini dilatarbelakangi oleh permasalahan hukum pengaturan organisasi dan tata kerja dinas daerah Kota Denpasar setelah berlakunya Peraturan Pemerintah No 18 Tahun 2016 Tentang Perangkat Daerah. Tulisan ini bertujuan untuk mengetahui kedudukan hukum Peraturan Daerah Kota Denpasar Nomor 15 Tahun 2012 tentang Perubahan Ketiga Atas Peraturan Daerah Kota Denpasar Nomor 7 Tahun 2008 Tantang Organisasi dan Tata Kerja Dinas Daerah Kota Denpasar setelah diberlakukannya Peraturan Pemerintah Nomor 18 Tahun 2016 Tentang Perangkat Daerah, serta untuk mengetahui kedudukan Dinas Pendidikan, Pemuda dan Olahraga di Kota Denpasar berdasarkan Peraturan Pemerintah Nomor 18 Tahun 2016 Tentang Perangkat Daerah. Tulisan ini menggunakan metode penelitian hukum normatif atau penelitian hukum doktrinal, yaitu merupakan penelitian hukum yang dikonsepkan sebagai apa yang tertulis dalam peraturan perundang-undangan (law in books). Kedudukan hukum dari Peraturan Daerah Kota Denpasar Nomor 15 Tahun 2012 Tentang Perubahan Ketiga Atas Peraturan Daerah Kota Denpasar Nomor 7 Tahun 2008 Tentang Organisasi dan Tata Kerja Dinas Daerah Kota Denpasar setelah diberlakukannya Peraturan Pemerintah Nomor 18 Tahun 2016 Tentang Perangkat Daerah, seharusnya sudah tidak berlaku lagi. Hal tersebut dikarenakan berlakunya asas “Lex Posterior Derogat Legi Priori”, yaitu dimana hukum yang baru mengesampingkan hukum yang lama. Jadi, untuk mengisi kekosongan hukum, Pemerintah Daerah Kota Denpasar secara otomatis dalam menyelenggarakan organisasi dan tata kerja dinas daerah kota Denpasa, mendasarkan pada hukum yang ada diatasnya, yaitu Peraturan Pemerintah Nomor 18 Tahun 2016 Tentang Perangkat Daerah. Peraturan Pemerintah Nomor 41 Tahun 2007 Tentang Organisasi Perangkat Daerah, dalam pelaksanaannya hanya mengatur Besaran Organisasi Dan Perumpunan Perangkat Daerah. Sedangkan dalam Peraturan Pemerintah Nomor 18 Tahun 2016, membentuk tipelogi-tipelogi dari A,B,C yang dimana ditentukan dengan nilai variabel yang telah ditentukan dalam peraturan pemerintah tersebut. Dari hasil penghitungan nilai-nilai variabel umum dan teknis, maka kedudukan Dinas Pendidikan, Pemuda Dan Olahraga Kota Denpasar masuk dalam Tipelogi A, yang menentukan susunan organisasi dari dinas ini terdiri atas 1 (satu) sekretariat dan paling banyak memiliki 4 (empat) bidang. Untuk sekretariat yang dimaksud terdiri atas paling banyak 3 (tiga) sub bagian, sedangkan untuk bidang yang dimaksud terdiri atas paling banyak 3 (tiga) seksi.

Abstract

Human right is elementary rights which naturally attach at human it self, having the character as universal andhave to judicial protect. Therefore cannot lessen, to be hijacked and for this reason have to be defended.In Indonesia in Chapter of XA the changed of constitution 1945 determined about human right. But its bearingwith rights in economic section, social and culture, identify have not yet detail and clear. Because of rights relatedto rights in economic area, social and culture, still spread over the changed of constitution 1945.Impact to rights of economic, social and culture, happened when state fail to fulfill such basic rights wich meant.In this case individual or citizens have the right to claim accomplishment to rights of economic, social and culture,through advocatie.

Abstract

Bali's tourism plays a crucial role in Indonesia's economy but has negative environmental and socio-cultural impacts due to rapid growth. Law No. 15 of 2023 marks a significant step toward sustainable tourism governance by regulating natural, cultural, and social resource management. This study uses a qualitative descriptive approach, with literature reviews and interviews with policymakers, industry players, and local communities, to explore the strategy for transforming Bali's tourism governance under this law. Results show that the law strengthens community participation and conservation, yet challenges remain in implementation and the need for better collaboration among stakeholders. The study highlights the importance of consistent regulation and collaboration in achieving sustainable tourism in Bali.

Abstract

Pancasila, as the source of legal morality of Indonesia, is used as the primary benchmark by Judges of the Constitutional Court in providing decision. The paper at hand explains that the constitutional court decision Number 90/PUU-XXI/2023 has moral weaknesses related to legal behaviour derived from Pancasila, specifically, First: Constitutional Court Decision had led to conflict and arising different views that potentially might cause disruption to Indonesia nation entity. Second: Constitutional Court Decision does not fully align with the Wisdom in Deliberation principle contained in the Fourth Principle of Pancasila. Third: Constitutional Court Judgment does not satisfy the sense of justice for Indonesian People. This paper employs a normative research method with a conceptual approach and a value-based approach.

Abstract

The implementation of general elections is one of the characteristics of a democratic country as a form of people's sovereignty. There are various types of general election systems throughout the world, including open and closed proportional systems. The normative legal method is based on the absence of norms in Law of the Republic of Indonesia Number 7 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2022 concerning Amendments to Law Number 7 of 2017 concerning General Elections into Law, where this Law only regulates the open proportional general election system and there is no regulation on the closed proportional system. The problem discussed in this study is how is the analysis of the open and closed proportional general election system from a democratic perspective? and which general election system is better to use for Indonesia and other democratic countries?.

Abstract

Global developments attempt to rectify serious human rights breaches within the context of legal regulations, as well as to build human rights systems and institutions on a national and global scale. However, in Indonesia, the paradigm shift from authoritarianism to democracy leads human rights as one of most important issues faced by the Indonesia government. In the last two decades, the red record in resolving major human rights abuses has not been attained, necessitating a study to evaluate effective legal choices in settlement of the past human rights violations settlement. This paper employed a statutory method, legal concepts, legal cases, and citations. The comparison validates the direction of this paper's research on the dynamics of national legal concerns in the policy of resolving gross human rights abuses and the selection of law that may be employed in effectively resolving major human rights violations in favor of transitional justice. The obtained results and findings show that problems have emerged in policy orientation at the macro, mezzo, and micro policy strata, as well as the need for future direction in the substance of legislation and the enforcement system, both through judicial and extrajudicial channels, against serious human rights violations.
