Abstract

ABSTRAK Bentuk dari aspek hukum dalam pelaksanaan administrasi publik di Indonesia adalah kebijakan publik dapat ditinjau tidak hanya secara sosial, politik dan ekonomi tetapi juga yuridis (perundang-undangan). Tujuannya agar penyusunan kebijakan tidak sembarangan atau benar-benar mempertimbangkan dalam menyusun kebijakan akan tidak dianggap melakukan tindakan sewenang-wenang melanggar kewenangan atau mengacuhkan kepentingan publik. Fungsi pemerintah dalam membuat kebijakan dibidang hukum adminstrasi publik yaitu fungsi regeling, membuat produk hukum tertulis yang berisikan materi daya ikat terhadap sebagian atau seluruh penduduk wilayah Negara dan fungsi beschikking, produk hukum yang berupa penetapan yang dibuat oleh pejabat tata usaha Negara. Kata kunci: Aspek Hukum, Administrasi Publik, Pemerintahan. ABSTRACT The form of the legal aspect in the implementation of public administration in Indonesia is that public policy can be reviewed not only socially, politically and economically but also juridically (legislation). The aim is that the formulation of policies is not carelessly or truly considerate in formulating policies that will not be considered as having arbitrarily violated authority or ignored the public interest.The function of the government in making policies in the field of public administration law is the function of regeling, making written legal products containing material binding power to part or all of the population of the State territory and the beschikking function, legal products in the form of decisions made by state administrative officials.

Abstract

Abstrak Di Kota Manna Kabupaten Bengkulu Selatan sudah ada pelaksanaannya serta perencanaannya tetapi didalam pelaksanaan pengelolaan ruang terbuka hijau masih belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada. Ada dua permasalahan yang dikaji dalam skripsi ini mengkaji 1) Bagaimana implementasi Peraturan Daerah Nomor 8 Tahun 2011 Tentang Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan 2) Bagaimana Faktor Penghambat Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan. Jenis penelitian ini menggunakan metode penelitian hukum empiris yaitu penelitian dengan adanya data lapangan sebagai sumber utama seperti hasil wawancara dan observasi dengan menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakatan. Hasil penelitian dan pembahasan 1)pelaksanaan pengelolaan ruang terbuka hijau di Kota Manna Kabupaten Bengkulu Selatan yang belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada serta masih kurangnya kesadaran dari masyarakat dalam menjaga dan memelihara ruang terbuka hijau yang ada. 2) masih adanya faktor penghambat seperti faktor internal dan faktor eksternal dalam pengelolaan ruang terbuka hijau di kota Manna. Dapat disimpulkan bahwa pelaksanaan ruang terbuka hijau di kota manna sudah ada pelaksanaannya tetapi dalam pelaksanaannya belum berjalan sesuai dengan peraturan perundang-undangan yang ada serta maish banyaknya faktor-faktor penghambat dalam pelaksanaan ruang terbuka hijau itu sendiri. Kata kunci: Implementasi, Pelaksanaan, Pengelolaan, Faktor Abstract In Manna city, South Bengkulu Regency, the implementation and planning havebeen carried out, hut in the implementation of the management of green openspace has not been implemented in accordance with the existing legislation. Thereare two problems examined in this thesis reviewing I ) How is the implementationof Regional Regulation No. 8 of 2011 Regarding Spatial Planning in SouthBengkulu Regency 2) How are the Inhibiting Factors of Spatial Planning in SouthBengkulu Regency. This type of research uses empirical legal research methods,namely research in the presence of field data as the main source such asinterviews and observations by analyzing laws that are seen as communitybehavior that is patterned in people’s lives that always interact and relate tosocial aspects. Research and discussion results 1) the implementation of greenopen space management in Manna City, South Bengkulu Regency which has hotbeen implemented in accordance with the existing Laws and Regulations as wellas the lack of awareness from the communityi in maintaining the existence ofgreen open spaces. 2) there are still inhibiting factors such as internal factors andexternal factors in the management of green open space in Manna city. It can beconcluded that the implementation of green open space in Manna city has beencarried out but in its implementation it has not proceeded in accordance with theexisting laws and regulations and also the many inhibiting factors in theimplementation of green open space itself

Abstract

An autonomous regional government must necessarily have an independent and uninterruptible internal supervisory body, in order to a ggod governace government as mandated by Act No. 23 of 2014, which is accountability, transparency, effectiveness and transparency. This research aims to find out the position and function of the internal supervisory agency of the Regional Inspectorate. In discussions using an institutional reconstruction approach to the regulations of the laws governing the Regional Inspectorate. As for the obstacles, some things are institutional relations, supervisory officers and officers who are killed are appointed by the head of the district and they are accountable to the governor or the mayor. Of the District Inspectorate is the same district official as the supervised official, of the same structural office as the second esellon officer appointed by the head of the district, from the aspect of the authority of the District inspectorate not followed with sanctions so that the supervision is ineffective. For effective supervision, the District Inspectorate must be reconstructed or rearranged legally by changing the regulations of the separate legislation governing the internal supervisory agency, i.e. the District inspectorate, either by law or government regulation

Abstract

The purpose of this study is to provide an overview of how to execute the minutes of the peace agreement in restorative justice and what products are appropriate in the use of the term restorative justice. The analytical method used in this study is a normative juridical research method. The results of the study concluded that the minutes of the peace agreement issued by the police and the prosecutor's office in restorative justice cannot be executed because the product issued is not a determination but an agreement report, therefore the minutes of the agreement have executive rights if it has been registered or notified to the court and has been obtain a determination, so that the right legal product in the use of the term restorative justice is in the form of a determination without reducing the meaning of the minutes of the peace agreement made by the parties.

Abstract

This study examines the strategic role of the Pulau Harapan Village Government in increasing Village Original Income (PAD) through improving the quality of Micro, Small, and Medium Enterprises (MSMEs) with the aim of optimizing the role of village officials in increasing Village Original Income (PADes). MSMEs are an economic sector that plays a vital role in creating jobs, increasing community income, and driving village economic growth. This study uses descriptive qualitative methods through interviews, field observations, and documentation studies. The results show that the village government has implemented various programs such as capacity training, licensing facilitation, capital assistance, increased market access, and MSME digitalization. However, several obstacles such as budget limitations, lack of innovation among MSME actors, and minimal digital literacy are the main challenges. The results of the activities are expected to become a model of sustainable empowerment in increasing PADes based on local potential. This article provides recommendations for strengthening the village MSME ecosystem as a strategy for increasing PAD.

Abstract

Asymmetric autonomy is a phenomenon that gives rise to unique dynamics in the context of granting authority to autonomous regions. From a human rights perspective, this phenomenon raises deep questions about the balance between regional autonomy and the protection of individual rights. This research aims to explore the impact and implications of asymmetric autonomy on human rights. This research uses a document analysis approach and literature study to detail the mechanism of asymmetric autonomy and its impact on human rights. The results show that the implementation of asymmetric autonomy can provide significant benefits for local development, but also poses potential risks to individual rights. There is a tension between the regional autonomy granted and the need to protect basic rights. Furthermore, this research highlights the need for a clear regulatory framework and effective oversight mechanisms to maintain this balance. The discussion also includes efforts that can be taken by the government and stakeholders to mitigate the risk of human rights violations in the context of asymmetric autonomy. This research contributes to our understanding of the complexity of the relationship between asymmetric autonomy and human rights. The policy implications resulting from this research can help governments and policy makers in designing regulatory frameworks that support regional development without compromising individual rights.Keywords: Asymmetric Autonomy; Human Rights; Impact; Balance; Regulation

Abstract

Health is a fundamental aspect that supports the success of education. The Indonesian government, through the Healthy School Movement (Gerakan Sekolah Sehat/GSS), seeks to create school environments that are clean, safe, friendly, and foster healthy living habits. This study aims to evaluate the implementation of the GSS program at SMP Negeri 3 Arut Selatan, Kotawaringin Barat Regency, using the CIPP (Context, Input, Process, Product) evaluation model to examine program relevance, resource readiness, implementation quality, and achieved outcomes. This research employed a qualitative approach with an evaluative method. Data were collected through observation, interviews, and documentation involving the principal, GSS team, teachers, and students. The data were analyzed through reduction, presentation, and conclusion drawing to identify key patterns and meanings emerging from the field. The findings revealed that the implementation of the GSS program was categorized as good across all evaluation components. The context aspect showed alignment between school needs and program goals. The input aspect indicated readiness in terms of human resources, infrastructure, and funding. The process aspect demonstrated that activities, schedules, and monitoring were carried out effectively. Meanwhile, the product aspect showed that students’ understanding and application of healthy behaviors reached 80%. The study concludes that the GSS program at SMP Negeri 3 Arut Selatan has been effectively implemented, though improvements are needed in consistent monitoring and the provision of supporting facilities. Recommendations include strengthening collaboration with local health offices, enhancing learning media for health education, and reinforcing continuous evaluation to ensure the sustainability and impact of the program.
