Abstract

Konsep tentang pembagian wilayah menjadi dar al-Islam, dar al-harb dan dar al-shulh merupakan hasil ijtihad dari para fuqaha’ yang dipengaruhi oleh suasana politik. Yakni ketika kaum musyrikin Makkah, kaum musyrikin Jazirah Arab sampai pula kaum musyrikin Persia dan Romawi telah serentak memaklumkan perang terhadap Islam. Sedangkan orang Islam dalam keadaan selalu membela diri, sehingga ada dua kekuatan yang selalu berhadap-hadapan, yakni kekuatan Islam dan kekuatan musuh-musuhnya. Dalam realitanya, konsep tentang dar al-Islam dapat dilihat dalam kasus India dan Indonesia yang meskipun secara tegas menyatakan bahwa konstitusi negara tidak berdasarkan Islam, namun karena negara memberi kebebasan pada warganya untuk menjalankan ajaran agamanya, maka negara tersebut dapat dianggap sebagai dar al-Islam. Sedangkan untuk dar al-harb dapat dilihat pada kasus negara Persia dan Romawi pada masa awal perkembangan Islam. Dalam perspektif teori, konsep dar al-Islam, dar al-harb dan dar al-shulh dapat dibaca dengan “teori perang” dan “teori perdamaian”. The concept of the division of the area into dar al-Islam, dar al-harb and dar al-shulh is the result of ijtihad of the jurists’ who are affected by the political atmosphere. That is when the polytheists of Mecca, Arabian Peninsula until Persian and Roman have simultaneously proclaim a war to Islam again. While the Moslems in the state has always defended himself, so that there are two forces that are always face to face, namely Islamic strength and power of his enemies. In reality, the concept of dar al-Islam may be seen in the case of India and Indonesia that although expressly states that the state constitution is not based on Islam, but because the state gives freedom to its citizen to live the teaching of his religion, then the country can be considered as dar al-Islam. While for the dar al-harb can be seen in the case of the Persian and Roman state during the early development of Islam. In theory perspective, the concept of dar al-Islam, dar al-harb and dar al-shulh can be read with the “theory of war” and “peace theory”.

Abstract

This paper aims to examine the implementation, supervision and solutions of sharia-based regional regulations in Tulungagung and Blitar from the philosophical, juridical and sociological aspects. This study is an empirical juridical study. Data are obtained from Tulungagung and Blitar. While the analysis was carried out by using empirical qualitative data analysis methods. The results show that the implementation and supervision of sharia-based regional regulations, primarily related to worship services and respect in carrying out religious values in Tulungagung and Blitar, have been running effectively and efficiently. Abstract

Abstract: This study aims to dicribe the dilemma of the Indonesian government's policy regarding the prohibition of going home the fiqh wabah approach. The existence of this policy dilemma is caused by the many different perceptions and understanding about the pandemic amongst the community. The difference in people's perceptions and understandings led to controversy about the existence of the homecoming ban policy. Based on the problems above, this literature-based study aims to describe and answer the dilemma of the prohibition of going home through the fiqh wabah approach. The fikih wabah is a new fiqh design with dimensions on a mashlahah-based approach model. Through in-depth discussion and analysis, this study found that the policy for the prohibition of going home for Eid in 2021 is the actualization of the concept of fiqh wabah, because the policy is based on prioritizing mafsadat prevention and subsequently taking mashlahah.Keywords: Fikih Wabah; Government Policy; Prohibition of Homecoming for Eid.Abstrak: Kajian ini bertujuan untuk mendeskripsikan adanya dilema kebijakan pemerintah Indonesia tentang pelarangan mudik lebaran melalui pendekatan fikih wabah. Dilema kebijakan ini disebabkan oleh adanya persepsi dan pemahaman masyarakat yang berbeda-beda. Perbedaan persepsi dan pemahaman masyarakat tersebut menimbulkan kontroversi tentang adanya kebijakan pelarangan mudik lebaran. Berdasarkan problematika di atas, kajian berbasis pustaka ini ingin menguraikan dan menjawab dilema kebijakan pelarangan mudik lebaran melalui pendekatan fiqih wabah. Fikih wabah adalah sebuah desain fikih baru yang berdimensi pada model pendekatan berbasis mashlahah. Melalui diskusi dan analisa yang mendalam, kajian ini menemukan bahwa kebijakan larangan mudik lebaran tahun 2021 merupakan aktualisasi dari konsep fikih wabah, karena kebijakan tersebut didasarkan pada pengambilan prioritas pencegahan mafsadat dan selanjutnya pengambilan mashlahah.Kata Kunci: Fikih Wabah; Kebijakan Pemerintah; Hari Raya.

Abstract

Abstract Religious fundamentalism is understood as an answer of the socialist group and the political elite of the religious in a religious group. So religious fundamentalism is always evolving in the modern era. As a study-based literature, this study will highlight the historical roots of religious fundamentalism in the era of the classical, pre-modern, and contemporary implications in the discovery model the thinking of fundamentalism religious in the contemporary era. The findings in this study show that fundamentalism has a few basic principles. Principles basic principles: the first is oppositional (understand resistance), the second the rejection of hermeneutics, the third rejection of pluralism and relativism, and the fourth is the rejection of the historical development and sociological. By using basic principles such then the movement of the Kharijites, the Wahabi movement in the Arabian peninsula, the movement of Shaykh Uthman and Fodio in Northern Nigeria, the movement Padri in Minangkabau and Al-Ikhwan al-Muslim in Egypt can be categorized in the movement of Islamic fundamentalism. Abstrak Fundamentalisme agama difahami sebagai sebuah jawaban dari kelompok sosialis dan elit politik keagamaan dalam sebuah kelompok agama. Sehingga fundamentalisme agama ini selalu berkembang dalam era modern saat ini. Sebagai kajian berbasis pustaka, kajian ini akan menyorot akar sejarah fundamentalisme agama pada era klasik, pra-modern, dan kontemporer yang berimplikasi pada penemuan model pemikiran fundamentalisme keagamaan pada era kontemporer. Temuan dalam kajian ini menunjukkan bahwa fundamentalisme memiliki beberapa prinsip dasar. Prinsip-prinsip dasar tersebut: pertama adalah oppositionalism (paham perlawanan), kedua penolakan terhadap hermeneutika, ketiga penolakan terhadap pluralisme dan relativisme, dan keempat adalah penolakan terhadap perkembangan historis dan sosiologis. Dengan menggunakan prinsip-prinsip dasar tersebut maka gerakan kaum Khawarij, gerakan Wahabi di semenanjung Arabia, gerakan Syaikh Usman dan Fodio di Nigeria Utara, gerakan Padri di Minangkabau dan Al-Ikhwan al-Muslimun di Mesir dapat dikategorikan dalam gerakan fundamentalisme Islam. Kata Kunci : Fundamentalisme Islam, klasik, pra-modern, kontemporer.

Abstract

The use of social media by women is oftentimes understood as a detriment to family sustenance. As a result, the stigmatization of social media user and social media misuse aspects is often associated with women. In addition, in family structures, men hold a very strong position. The men’s authority then has implications for the control and intervention against their wives in the use of social media. Based on this phenomenon, this qualitative study with a case study on women's activities on social media in Tulungagung Regency aimed to formulate an ijtihad model of the fiqh of social media with maqashid sharia and social reality as the basis. The findings of this study show that: 1. The intensity of women’s activities in social media in Tulungagung Regency, in essence, is adjusted to the needs and goals in the use of social media, 2. Women’s activities in social media in Tulungagung Regency, in essence, has implication for creating harmony in the family, 3. Women’s activities in social media in Tulungagung, in essence, is an actualization of social media fiqh, and 4. The implications of women’s social media activities in Tulungagung are the embodiment of social media fiqh.

Abstract

As one group or individual who was given a special mandate by God to represent Him in the field of service to the interests of humanity, the government or the authorities certainly have a very heavy responsibility. On one side of God’s syari’ah and His provisions to create benefit for mankind and focus on the protection and special handling of the problems of the masses or problems of humanity. That is, the government as a representative of God, should have a policy that takes sides and prioritizes policies based on humanism. As a literature-based study and discussion of literature, this paper reveals a piece of ijtihad of a contemporary ulama’ Yusuf Qaradawi namely fiqh of priority. This study is very important for dissemination, looking at the problematics of government policy ideas that often override humanitarian problems, as well as the importance of using new analysis glasses in the form of studies based on Islamic law. So, this kind of study, can be used special considerations and add new treasures in contemporary Islamic legal thought.

Abstract

This study aims to formulate the jurisprudence of sexuality based on maqashid shari'ah in responding to the vaginismus problems experienced by women. This is because so far vaginism is a phenomenon that often occurs in women's lives and has not received a response in the aspect of Islamic law. Ignorance of Islamic law seems to give stigma and discrimination when women are faced with suffering from vaginismus. Whereas in the current contemporary era, maqashid shari'ah has a very strong position in formulating Islamic legal products based on humanity and justice. The study, which is based on this literature review, seeks to dialogue and re-actualize maqashid shari'ah as an effort to build Islamic law based on humanity and justice. Through a comprehensive study, this study finds that it is necessary to build Islamic jurisprudence based on maqashid shari'ah to respond to various problems related to the realm of sexuality. In actualization, vaginismus is a necessity that cannot be denied and can only be treated. So that the legal consequences that accompany it must have dimensions of humanity and justice.

Abstract

This study aims to revisit the priority aspects of the state's interests and protection of the soul from the mashlahah perspective. This is so urgent when recently shocked by the shooting of a member of the Islamic Defenders Front (FPI) laskar by a member of the Indonesian National Police. The result of this case was the emergence of various controversies from humanitarian activists, human rights, and moderate state defenders. This phenomenon is certainly something that needs to be resolved with a model approach in the Islamic legal discourse, namely the mashlahah concept. The concept of mashlahah is seen as a more adaptive concept in responding to various contemporary problems, including seeing the shooting case of a member of the Islamic Defenders Front (FPI) army. This literature-based study found that the shooting of members of the FPI paramilitary apparatus by the police was based on prioritizing the public interest of the state (mashlahah al-'ammah) rather than personal or group interests (mashlahah al-fardhiyyah). Meanwhile, the determination of mashlahah between the interests of the state (public) and private interests (groups) is based on taking less mafsadat.

Abstract

Zakat is the leading financial instrument among Muslims. Therefore, muzakki's trust in the Amil Zakat Institution must be encouraged to increase groups. Furthermore, this study aims to determine the LAZISMU strategy in Tulungagung Regency to increase muzakki confidence and determine the supporting and obstacles factors in increasing muzakki trust. This study used field research with a qualitative approach descriptively to get the information concerning an existing condition. As a zakat management institution, LAZISMU Tulungagung Regency uses various strategies to increase the trust of muzakki, including Distribution of trustworthy zakat infaq and shadaqah funds, transparency of fund management, improving service quality, and maintaining relationships with muzakki. This strategy aims to increase muzakki trust carried out by LAZISMU Tulungagung Regency. In addition, in 2021, around 90% of the Tulungagung Regency Muhammadiyah Association members will receive ZIS funds through LAZISMU Tulungagung Regency.
