Abstract

In national development, construction services have an important and strategic role in supporting the growth and development of the economic, social and cultural fields. Construction Work Contracts (Construction Services Procurement Contracts), in principle, are consensual (a reciprocal agreement), between the Employer (Project Owner) and the Service Provider (Contractor); Service Providers (Contractors) with Sub Service Providers (Sub Contractors). This research uses normative (doctrinal) legal research type. This research was conducted by examining all laws and regulations related to agreements that arise as well as the legal consequences in the form of financial penalties for breach of contract.

Abstract

Introduction: The practice of buying and selling online is part of the development of digitalization and technology. Regulation of fair online buying and selling practices by the state is important to protect the rights of the parties.Purpose of the Research: This research aims to analyze and compare online buying and selling arrangements implemented in Indonesia, Malaysia and Singapore.Method of Research: Normative legal research by prioritizing conceptual, statutory and conceptual approaches.Results of Research: Regulation of online buying and selling in Indonesia is viewed from the aspect of distributive justice because the practice of equal playing field, namely equalizing business actors from abroad and from within the country, has not been accompanied by empowerment efforts and special treatment for small, micro and medium businesses in Indonesia, despite its commutative justice aspect, has accommodated various efforts to protect sellers and buyers in online buying and selling transactions. Comparison of the legal regulations for online buying and selling between Indonesia and Malaysia and Singapore. In general, Malaysia and Singapore have provided special arrangements and appropriate and fast procedures regarding means of complaints and the process for complaints in online buying and selling transactions is carried out comprehensively to ensure that everyone or parties involved in online buying and selling transactions have their complaints heard and followed up. Therefore, Indonesia needs to improve regulations related to online buying and selling transactions, especially regarding optimizing complaint services as implemented in Malaysia and Singapore, which follow up on complaint services within a certain period of time and are processed to provide legal certainty and protection for the parties involved in the transaction. online buying and selling transactions.

Abstract

Perkawinan di bawah umur masih menjadi fenomena hukum dan sosial yang marak di Indonesia meskipun telah terjadi perubahan batas usia minimal melalui Undang-Undang No. 16 Tahun 2019. Penelitian ini bertujuan untuk menganalisis secara yuridis praktik perkawinan anak dalam perspektif hukum pidana Indonesia. Pendekatan yang digunakan adalah yuridis normatif dengan mengkaji regulasi seperti KUHP, UU Perlindungan Anak, dan UU Perkawinan. Hasil penelitian menunjukkan bahwa praktik dispensasi kawin yang longgar serta lemahnya penegakan hukum mengakibatkan hukum pidana belum berfungsi efektif sebagai instrumen perlindungan anak. Selain itu, pertanggungjawaban pidana terhadap pihak selain pelaku utama, seperti orang tua, penghulu, dan tokoh masyarakat, belum diterapkan secara konsisten meskipun memiliki dasar hukum yang jelas. Penelitian ini menekankan perlunya penafsiran progresif, penegakan hukum yang lebih tegas, dan sinergi antar lembaga guna mewujudkan perlindungan maksimal terhadap anak. Dengan demikian, hukum pidana tidak hanya sebagai alat represif, tetapi juga preventif dalam mencegah dan menindak praktik perkawinan anak.

Abstract

This study analyzes the legal position of the captain in the structure of maritime employment relations with a case study at PT. Kembang Mekar Indah, which highlights the gap between the normative provisions in the Commercial Code (KUHD), Law Number 17 of 2008 concerning Shipping, and the Maritime Labor Convention (MLC) 2006 with the implementation practices in the field. This study uses a normative-empirical legal method through literature studies and interviews with captains and company representatives, analyzed qualitatively-descriptively to compare legal norms and empirical reality. The results of the study indicate that maritime employment agreements still place captains on an equal footing with ordinary workers even though the legislation confirms their position as the highest leader on board and the legal representative of the ship owner. Empirical findings show that the fulfillment of the captain's rights to salary is 80%, work facilities 60%, legal protection 40%, and regulatory socialization only 20%, indicating an imbalance in legal protection and weaknesses in the substance of the employment contract. Therefore, it is necessary to reformulate the shipping legal system by improving maritime work agreements, strengthening the role of harbormasters, and harmonizing national regulations with the 2006 MLC standards in order to create maritime work relations that are professional, fair, and adaptive to international maritime law.

Abstract

Pengumpulan darah adalah prosedur medis yang memberikan darah kepada pasien dalam kantong plastik. Palang Merah Indonesia (PMI) melalui Unit Pengumpulan Darah (UTD) atau sekarang Unit Donor Darah (UDD) telah melakukan upaya untuk memenuhi ketersediaan darah untuk kebutuhan layanan kesehatan. Kegiatan bakti sosial pengumpulan darah yang dilakukan di Kota Parepare melibatkan partisipan dalam donasi darah, pendidikan, dan pemahaman yang lebih baik tentang donasi darah. Hasil kegiatan ini adalah meningkatkan kesadaran masyarakat tentang pentingnya donasi darah dan cara-cara yang efektif untuk meningkatkan kualitas hidup masyarakat

Abstract

A romance room is a special room or room provided by the state for inmates to channel their sexual desires. The provision of a romance room aims to provide a place for inmates to channel their sexual desires to their legal partners. In Indonesia, romance rooms are still limited and there are only three correctional institutions that have romance booths, namely Ciangir Class IIB Correctional Institution, Kendal Class IIB Open Correctional Institution, and Nusakambangan Class IIB Open Correctional Institution, while Parepare Class IIA Correctional Institution has not yet held a romance room. This study aims to find out the reality of inmates' sexual desire and the problems of procuring romance rooms in Class IIA Parepare Correctional Institution. This research is an empirical normative research that uses a statute appraoch, conceptual approach and social approach. The results of this study show that the reality of inmates' sexual desires in the Class IIA Parepare Correctional Institution requires a romance room as a legal mechanism to fulfill the inmates' sexual desires and to carry out the rights and obligations of the inmate's legal spouse in order to maintain marital harmony. Inmates of Class IIA Parepare Correctional Institution still have difficulty channeling their sexual desires because romance booths are not yet available, while CMK and extraordinary permits that are often used as a medium for channeling sexual desire require strict administrative requirements. The problems faced by the Parepare Class IIA Correctional Institution in the procurement of romance rooms are the absence of regulations that specifically regulate the requirements, implementation procedures, supervision, and technical matters related to the procurement of romance rooms. Another problem faced is the concern about the safety of the romance room and the impact caused if the inmate's wife or female inmate becomes pregnant and gives birth.

Abstract

This study aims to examine the role of Article 1367 of the Civil Code in determining the duties of Futures Brokers and Futures Broker Representatives in the context of Indonesian commodity futures trading, with a focus on the consequences for violations of these duties by Futures Broker Representatives. respond to it. This methodology is based on normative legal principles and is based on research into relevant literature and examination of BAKTI rulings in the field of commodity futures trading arbitration. Findings from this study highlight the importance of taking into account the Futures Broker Representative's level of professionalism as well as any applicable rules and regulations when determining the extent to which the Futures Broker is legally liable for the Futures Broker Representative's conduct. In order to provide fairness and clarity in commodity futures trading, this study's findings suggest that current rules need to be revised and adjusted. The study also suggests directions for future research on the dynamics of futures trading's legal aspects.
