Abstract

With the times, the modus operandi of crime has also evolved. It’s characterized by crime victims who are currently not only limited to adults, but children are also often victims. One of the crimes that often befall children is sexual abuse. Indonesia as a state of law has attempted to protect children from crime, for example by establishing laws and regulations. One form of protection is by providing rights for child victims of criminal acts, one of which is the right to restitution. However, in practice, the provision of restitution hasn’t t been optimally implemented. The purpose of this research is to find out the causes of the provision of restitution that hasn’t been optimally implemented, especially in the case of Decision Number 133/Pid.Sus/2023/PN. This research uses empirical legal research methods with interview data collection techniques. Based on the results of the research, there are two factors that become obstacles in providing restitution for child victims. First, internal factors in the form of the absence of coercive rules if the perpetrator doesn’t pay restitution, administrative requirements for submitting restitution requests that burden the victim, and there are no rules that guarantee restitution is immediately paid by the perpetrator. Second, external factors in the form of the victim's lack of legal awareness and still focusing on punishing the perpetrator.

Abstract

The creation of the internet, which is used to make human life easier, has become a new problem because it has given rise to cyber crime in cyberspace. One of the cyber crimes currently developing is cyber terrorism. This research examines the crime of cyber terrorism from the perspective of the perpetrator's criminal responsibility according to national laws in Indonesia. The method used in this research is a normative juridical legal research method that is perspective based on literature study. The legal materials used are primary and secondary legal materials. Data analysis techniques using deductive logical reasoning. The research results show that the term cyber terrorism crime has not been mentioned grammatically in national legislation. However, several articles in Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions contain the substance of cyber terrorism crimes, namely Article 28 paragraph (2), Article 28 paragraph (3), Article 31 and Article 33. The legal subject, namely the perpetrator in this article, is "Person" which means an individual or legal entity/corporation. All of these articles contain elements of "acts against the law" whose substance corresponds to the crime of cyber terrorism. So that a person or legal entity that commits acts in accordance with this article can be held criminally responsible. The legal sanction for this crime is imprisonment and/or a fine.

Abstract

The aim of writing this article is to analyze the suitability of the imposition of fines by the panel of judges on children for the crime of sexual intercourse in the Karanganyar District Court decision Number 4/Pid.Sus-Anak/2023/PN.Krg with the Juvenile Criminal Justice System Law, especially in article 71 Paragraph (3) . The type of research used is normative with the nature of perspective research, while the approaches used are a case approach and a statutory approach. The results of this research are that the imposition of fines by judges is not in accordance with the Juvenile Criminal Justice System Law which clearly states that fines are replaced with job training.

Abstract

Artikel ini mengkaji urgensi peningkatan kesadaran hukum dan literasi digital dalam penggunaan media sosial guna mencegah kejahatan siber seperti kontaminasi nama baik, hoaks, pelanggaran privasi, dan kebencian kebencian. Fokus utama yang akan dibahas dalam tulisan ini adalah meningkatnya jumlah kasus hukum terkait media sosial di Indonesia, yang sering kali disebabkan oleh rendahnya pemahaman masyarakat terhadap penerapan hukum dari perilaku berani. Artikel ini mencoba melakukan pendekatan yuridis normatif, yaitu pendekatan peraturan-undangan dan konteks untuk menganalisis bagaimana norma hukum berinteraksi dengan praktik digital. Indonesia telah memiliki Undang-Undang Informasi dan Transaksi Elektronik serta perlindungan konstitusional dalam Pasal 28E dan 28J Undang-Undang Dasar Negara Kesatuan Republik Indonesia Tahun 1945, meskipun demikian kesadaran masyarakat terhadap regulasi tersebut masih kurang. Akibatnya, media sosial sering disalahgunakan untuk tujuan penyebaran hukum seperti penyebaran informasi palsu atau kontaminasi nama baik secara berani. Artikel ini menekankan pentingnya peningkatan literasi hukum, pembaruan regulasi yang adaptif terhadap perkembangan digital, serta kolaborasi antara pemerintah, platform digital, dan dalam mendorong perilaku berani yang bertanggung jawab.

Abstract

This study is motivated by the issue of criminalizing drug couriers, who in judicial practice are often equated with the main perpetrators, even though in reality they occupy a subordinate position in the drug distribution network. The lack of clarity in the differentiation of roles in Law No. 35 of 2009 on Narcotics has led to the application of criminal liability that tends to be formalistic and has the potential to disregard substantive justice. This study aims to analyze the form of criminal liability of Class I drug couriers and assess whether the Pekanbaru District Court Decision Number 119/Pid.Sus/2025/PN Pbr has reflected justice in the imposition of criminal penalties. The research method used is normative juridical with a legislative approach, case approach, and conceptual approach. The results of the study show that the criminal liability imposed on couriers in the verdict is direct as the main perpetrator, without considering the theory of the perpetrator's role, degree of fault, and the defendant's capacity to be held responsible. The judge emphasized the fulfillment of the elements of the act as formulated in Article 114 of Law Number 35 of 2009 concerning Narcotics, without adequate analysis of the mens rea and the factual contribution of the courier in the structure of the crime. Justice in this study is understood as substantive justice, which requires consistency between the punishment, role, and degree of fault of the perpetrator. Proportional punishment is interpreted as the imposition of sanctions that clearly distinguish between couriers as subordinate actors and the main actors who control the narcotics network. This study concludes that the criminal liability of narcotics couriers must be based on individualization of punishment and proportionality so that law enforcement not only fulfills legal certainty but also reflects substantive justice.

Abstract

This research aims to analyze the criminal liability of perpetrators of arson and destruction of public facilities during demonstrations in Indonesia, as well as to examine the enforcement of criminal law against these crimes based on applicable positive law. However, in practice, demonstrations are often accompanied by anarchic actions in the form of arson and destruction of public facilities that harm the public interest and disrupt public order. The urgency of this research lies in the need to ensure that criminal liability and criminal law enforcement for acts of arson and destruction of public facilities are carried out individually and proportionally in accordance with the provisions of the old Criminal Code and the National Criminal Code, in order to prevent the general application of criminal law to participants in demonstrations. The results of the first study indicate that criminal liability for perpetrators of arson and destruction of public facilities during demonstrations has basically been regulated in the old Criminal Code and then updated in the National Criminal Code, especially regarding the crimes of arson and destruction of property. While the second enforcement of criminal law against these acts requires proportional and individual application, even though it is carried out in the context of collective mass action.

Abstract

The juridical issues concern the limits of military criminal jurisdiction, patterns of sentencing for soldiers, command responsibility, and their implications for the principles of civilian supremacy and equality before the law. This study aims to analyze the implications and provide a comparative assessment of the expansion of the Indonesian National Armed Forces’ (TNI) authority following Law Number 3 of 2025 concerning the Amendment to Law Number 34 of 2004, particularly in relation to the addition of civilian positions that may be occupied by active-duty soldiers and the expansion of Military Operations Other Than War (OMSP). This research employs a normative juridical method with statutory, conceptual, and comparative approaches, using data sources in the form of legislation as well as national and international legal literature, which are analyzed qualitatively with deductive reasoning in drawing conclusions. The results of the study indicate that, first, the criminal law implications of the post-expansion of the TNI’s authority and roles give rise to the potential emergence of official offenses (delicta propria), particularly in the implementation of OMSP and the assignment of active-duty soldiers to civilian positions, which may generate ambiguity in judicial forums and criminal accountability; and second, a comparison with the military sentencing systems in the Netherlands and the United States demonstrates the importance of clear classification of offenses, a clearer separation between military jurisdiction and civilian courts, and the strengthening of due process of law, as well as effective civilian oversight to ensure the professionalism and legal certainty of the TNI.
