Abstract

This qualitative study explores the role of Village Councils in preventing child marriage on Lombok Island, focusing specifically on policy synergy and local governance. This research uses Lawrence M. Friedman's legal system theory to analyze the impact of regional regulations and community-based initiatives in addressing child marriage in North Lombok Regency, West Nusa Tenggara Province, Indonesia. This study adopts an empirical juridical approach, with primary data from North Lombok Regent Regulation No. 20/2017 on Village Council Guidelines and secondary data from relevant literature. Despite significant efforts, child marriage remains a widespread issue on the island. The North Lombok Regency Government, through the empowerment of Village Krama Councils, has made substantial progress in addressing this issue. However, challenges persist, including unclear regulatory provisions and inconsistent application of Village Council functions across the region. The strong legal culture and the tradition of deliberation for consensus within the local community play a crucial role in the success of these initiatives. This study emphasizes the importance of empowering Village Councils to enhance the effectiveness of policies and further reduce child marriage practices in Lombok.

Abstract

This article aims to comprehensively examine polygamy from various perspectives, with a particular focus on the legal protection afforded to second wives within polygamous practices in Indonesia. It explores the complex dynamics experienced by women who occupy the position of a second wife, including their roles, rights, and social perceptions. Furthermore, this study seeks to deconstruct the existence and identity of women in polygamous marriages by critically assessing the challenges they face and the efforts made to safeguard their legal and social well-being. Employing a qualitative research approach, this study utilizes Simone de Beauvoir’s existentialist feminism theory as an analytical framework to understand how women’s roles in polygamy are constructed and contested within patriarchal legal and social systems. The findings reveal that, although polygamy is permitted under Indonesian law, its practical implementation often leads to various injustices, particularly in the form of legal uncertainty and limited protection for second wives. These women frequently encounter stereotyping, social stigma, discrimination, and even the threat of criminal consequences when the polygamous marriage is carried out without the consent of the first wife. This article advocates for the reconstruction of the identity and social role of second wives, emphasizing the need for comprehensive legal reforms, increased public awareness, and the promotion of marriage registration to ensure the fulfillment of women’s rights and the creation of a more equitable marital framework in polygamous settings.

Abstract

This article is a library research from textual analysis related to child protection from the perspective of Islamic regulation and Covid-19. The data analysis method is qualitative-descriptive analysis method. The description of the data is divided into several stages, namely: Islam and the Covid-19 in Indonesia, Children in Islamic point of view, National Movement for Foster Parents or Gerakan Nasional Orang Tua Asuh (GNOTA), and Child Protection Affected by the Covid-19 from Islamic Perspective. The study shows children as one of the groups who are vulnerable to get their rights lost due to the Covid-19 pandemic, such as the right to life, economy, education and others. In Islamic regulation, children’s rights (ri'ayah) are contained in maqāshid sharia, namely maintaining children (hifż al-nasl). Responding to the absence of regulatory certainty in Indonesia that protects the rights of children affected by the Covid-19 pandemic, even though Islam protects children through the value of hifż al-nasl, the presence of the Gerakan Nasional Orang Tua Asuh is expected to be an alternative solution to protect children affected by the Covid-19 pandemic in Indonesia.Artikel ini merupakan penelitian kepustakaan dengan sumber data penelitian bersumber dari literatur terkait perlindungan anak perspektif hukum Islam dan Covid-19. Metode analisis data yang digunakan yaitu metode analisis kualitatif-deskriptif. Deskripsi data terbagi ke dalam beberapa tahapan, yaitu: Islam dan Pandemi Covid-19 di Indonesia, Anak dalam pandangan hukum Islam, Mengenal Gerakan Nasional Orang Tua Asuh (GNOTA), dan Perlindungan Anak Terdampak Pandemi Covid-19 Perspektif Hukum Islam. Hasil penelitian ini adalah bahwa anak menjadi salah satu kelompok yang rentan terenggut hak-haknya akibat pandemi Covid-19, seperti hakhidup, ekonomi, pendidikan dan lainnya. Di dalam hukum Islam, merawat dan memenuhi hak-hak anak (ri’ayah) merupakan salah satu makna yang juga terkandung dalam maqāshid syariah, yakni menjaga keturunan (ḥifż al-nasl). Menyikapi belum adanya kepastian regulasi di Indonesia yang melindungi hak-hak anak terdampak pandemi Covid-19, padahal Islam melindungi anak melalui nilai ḥifż al-nasl, maka kehadiran Gerakan Nasional Orang Tua Asuh (GNOTA) diharapkan dapat menjadi solusi alternatif untuk melindungi anak-anak terdampak Pandemi Covid-19 di Indonesia.

Abstract

The Indonesian juvenile justice system, regulated under Law No. 11 of 2012 on the Juvenile Criminal Justice System, fails to establish parental criminal liability for offenses committed by minors. This legal vacuum has resulted in high recidivism rates and undermines the rehabilitative goals of juvenile justice. This study aims to analyze the necessity of establishing parental criminal liability in Indonesia's juvenile justice system, examine comparative models from Japan, Germany, and Canada, and propose a comprehensive framework for shared accountability between juveniles and their parents. Using qualitative normative-comparative legal research, this study develops the Theory of Dual Accountability in Juvenile Justice, which posits that criminal liability should be shared between the juvenile offender and negligent parents through proportional criminal sanctions, administrative penalties, and rehabilitative interventions. The findings demonstrate that Japan's Family Court system, Germany's parental responsibility model, and Canada's restorative justice approach all incorporate mechanisms that hold parents accountable for supervisory negligence. This study proposes amendments to Indonesia's Juvenile Justice Law to introduce three tiers of parental criminal liability: (1) criminal sanctions for gross negligence resulting in serious juvenile crimes, (2) administrative penalties for moderate supervisory failures, and (3) mandatory rehabilitative programs for minor cases. The proposed framework balances punitive measures with family rehabilitation, ensuring that both juveniles and parents bear proportional responsibility for criminal conduct. This paradigm shift toward shared accountability represents a fundamental reform in Indonesian criminal law, recognizing that effective juvenile crime prevention requires legal mechanisms that compel parental responsibility alongside juvenile rehabilitation.

Abstract

Penelitian ini bertujuan untuk menganalisis upaya mewujudkan ketahanan keluarga pada pasangan long distance marriage (LDM) melalui perspektif mubādalah yang dikembangkan oleh Faqihuddin Abdul Qadir. Penelitian ini menggunakan metode kepustakaan (library research) dengan pendekatan kualitatif-deskriptif. Sumber data utama berasal dari karya Qirā’ah Mubādalah serta literatur hukum keluarga Islam, tafsir, dan psikologi keluarga yang relevan. Hasil penelitian menunjukkan bahwa ketahanan keluarga dalam konteks LDM dapat diwujudkan melalui penerapan lima pilar mubādalah, yaitu: komitmen pada ikatan janji yang kokoh (mitsāqan ghalīzhan), prinsip berpasangan dan berkesalingan (zawaj), sikap saling memberi kenyamanan (tarādhin), saling memperlakukan dengan baik (mu’āsyarah bil ma’ruf), dan musyawarah dalam pengambilan keputusan keluarga (musyawarah). Implementasi prinsip tersebut memperkuat ketahanan emosional, komunikasi, serta keseimbangan peran antara suami dan istri dalam menghadapi tantangan keterpisahan fisik. Perspektif mubādalah tidak hanya menekankan kesetaraan dan keadilan gender, tetapi juga menghadirkan solusi teologis, yuridis, dan praktis bagi keluarga LDM dalam menjaga keharmonisan rumah tangga. Temuan ini menegaskan bahwa penerapan prinsip kesalingan dan keadilan menjadi dasar penting dalam membangun keluarga yang sakinah, mawaddah, dan rahmah.

Abstract

Sexual violence is a systemic problem rooted in patriarchal structures and gender bias in society, including in Lombok. Emerging cases, such as those involving religious education figures, show the need for a preventive approach based on collective awareness. This service activity aims to strengthen anti-sexual violence awareness among the younger generation through participatory public dialogue. Taking place at Kedai It's Milk in Mataram City, this activity involved youth, students, law enforcement officials, child protection agencies, and academics. The fishbowl discussion method was used to encourage equal and open participation. As a result, the dialogue raised critical awareness, formed a community action network, and initiated a digital platform as a safe space for sharing and education. This activity confirms the importance of an inclusive dialogical space to dismantle the culture of silence, and encourage social change through multi-stakeholder collaboration and intersectional approaches that are relevant to local conditions.

Abstract

The Indonesian legal system still contains gender bias embedded in the substance, structure, and culture of law. This community service activity aims to: (1) enhance gender legal literacy among academics, legal practitioners, and the general public through a book review; (2) disseminate empirical findings on gender injustice in the Indonesian legal system; and (3) promote the Mubadalah perspective as an alternative framework in Islamic family law reform. The book review activity of "Mata Hukum, Mata Perempuan" was conducted on November 9, 2025, in North Lombok, involving keynote speakers, the author, and three reviewers from various disciplines. This book integrates legal feminism with the Mubadalah perspective to analyze gender bias in marriage law, the juvenile criminal justice system, child marriage prevention, and women's participation in state administration. The activity results showed high enthusiasm among participants in understanding structural gender injustice in Indonesian law. Discussions generated concrete recommendations for more gender-responsive legal reform, including revision of the Marriage Law, strengthening dual accountability mechanisms in the juvenile justice system, and empowering local customary institutions in preventing child marriage. The Mubadalah perspective proved effective as a bridge for dialogue between feminism and Islam in the context of Indonesian Muslim society.

Abstract

This study examines the legal protection framework for consumers facing price fluctuations of staple goods in West Nusa Tenggara Province (NTB), Indonesia. Using a mixed-method approach combining quantitative price data analysis from BPS NTB 2024 and qualitative legal document review, this research evaluates the implementation of Law No. 8 of 1999 on Consumer Protection and Law No. 7 of 2014 on Trade. The findings reveal that while Indonesia possesses a robust normative legal framework for consumer protection, implementation at the regional level remains inadequate. Analysis of 2024 price data demonstrates significant fluctuations in strategic commodities: rice prices increased by 14% in March 2024, while shallot prices fluctuated up to 120% throughout the year. These variations indicate weak enforcement of price control mechanisms and insufficient application of fairness, balance, and legal certainty principles. The study concludes that strengthening regional regulations, enhanced inter-agency coordination, and improved market surveillance mechanisms are essential to ensure price affordability and protect consumers from predatory economic practices.
