Abstract

This study aims to explain the development of understanding of child custody after divorce, describe an overview of the provisions of child custody after divorce in Indonesia and Tunisia, explain the importance of applying the best interest of the child in post-divorce child custody decisions, and finally assess the responsiveness of child custody provisions after divorce in Indonesia and Tunisia. This research is a qualitative research, with a normative juridical approach. The main sources of data for this research are Law Number 1 of 1974 concerning Marriage jo. Law Number 16 of 2019, Compilation of Islamic Law and Code of Personal Status (CPS).  Family law reform in Tunisia is more progressive in ensuring the law is responsive to social change and children's needs. On the other hand, Indonesia still faces challenges in integrating traditional values with modern legal principles. Both countries have the potential to learn from each other, especially in creating a more equitable and child-oriented legal system after divorce. Both countries offer flexibility in addressing social contexts, relationships between children and parents, and emotional needs. However, implementation varies between the two countries. Islamic law in Indonesia strongly influences child protection, while Tunisia's CPS reforms in the year focused on gender equality.

Abstract

This study examines the Nyongkolan tradition of Sasak society in Lombok through the lens of Robert Redfield's cultural acculturation theory, employing a multidisciplinary approach that integrates legal and inclusive perspectives. Nyongkolan, a ceremonial wedding procession characterized by mass participation and festive atmosphere, represents a complex intersection of traditional values and modern influences. Using a literature review methodology, this research analyzes how Nyongkolan demonstrates cultural transformation while maintaining its essential identity, explores the legal frameworks governing this tradition in contemporary Indonesia, and evaluates its role in promoting social inclusion across diverse community segments. Findings reveal that Nyongkolan exemplifies Redfield's concept of the folk-urban continuum, where traditional practices adapt to urban modernity without losing core cultural significance. The tradition simultaneously faces challenges from modernization pressures and legal regulations while demonstrating remarkable resilience through adaptive strategies. From an inclusive perspective, Nyongkolan functions as a social leveler that transcends economic and social boundaries, though gender dynamics and accessibility issues require ongoing attention. This study contributes to understanding how indigenous traditions negotiate modernity while preserving cultural authenticity and promoting social cohesion in Indonesia's pluralistic society.

Abstract

Traditional weaving from North Lombok represents intangible cultural heritage with significant economic and cultural value, yet faces threats of extinction and commercial exploitation without fair compensation. This research examines legal protection of traditional weaving through Intellectual Property Rights and communal protection regimes based on Law Number 28 of 2014 on Copyright and Government Regulation Number 56 of 2022 on Communal Intellectual Property. The research employs a normative juridical approach with analysis of laws and regulations and case studies in North Lombok. Findings reveal a dual protection system where the state holds copyright over traditional cultural expressions but has not optimally conducted inventory and economic benefit distribution to weaving communities. Main constraints include minimal documentation of weaving motifs, limited legal awareness among communities, and absence of clear benefit-sharing mechanisms. The research recommends accelerating inventory of North Lombok traditional weaving, strengthening weaving community institutions, and establishing specific regional regulations governing protection and economic utilization of weaving based on communal justice principles.
