Abstract

PurposeThe aim of this research is to analyze the urgency of establishing the LPPDP in strengthening personal data protection laws in Indonesia through a comparison of laws and practices in Hong Kong and Singapore and to determine the opportunities and challenges of establishing the LPPDP in Indonesia. MethodologyThe research uses normative legal research methods with a statutory approach, a conceptual approach and a comparative approach. ResultThe results show that the existence of an independent LPPDP will strengthen the personal data protection law effectively and comply the adequate level of protection with other developed countries. Thus, the President must immediately establish LPPDP regarding the minimum requirements for the DPA's establishment in international practice. ContributionLaw Number 27 of 2022 concerning Personal Data Protection (UU PDP) has directly mandated the establishment of a data protection authority which determined by the President. The LPPDP has projected to become an authority that acts as a supervisor and law enforcer for personal data protection in Indonesia, the LPPDP must be able to perform its functions, duties, and authorities independently. LimitationHowever, instead of achieving this noble goal, there are several recommendations that can be applied in establishing the formation of LPPDP, whether in the form single supervisory authority or ministry based-models.

Abstract

This research aimed to examine and analyze the distribution of inheritance within the Minangkabau ethnic community, focusing on the application of customary law. Due to a lack of understanding regarding the proper division of customary inheritance, discrepancies and conflicts frequently arose during the process. This qualitative research employed an empirical descriptive approach and was conducted in Bandar Jaya Barat Village, Central Lampung Regency. The research utilized both primary and secondary data, collected through fieldwork and literature review. The findings revealed that inheritance distribution in the Minangkabau community of Bandar Jaya Barat followed two systems: the matrilineal collective inheritance system and the bilateral individual inheritance system. High inheritance was distributed using the matrilineal collective system, while low inheritance, particularly in Bandar Jaya Barat, was distributed through the bilateral individual system, which did not require approval from Minangkabau customary leaders.

Abstract

Struktur pasar yang kompetitif merupakan fondasi penting bagi terciptanya efisiensi ekonomi dan perlindungan konsumen. Namun, praktik monopoli yang dilakukan oleh pelaku usaha dominan sering kali menciptakan ketimpangan dalam akses pasar dan harga yang merugikan konsumen. Penelitian ini bertujuan untuk menganalisis praktik monopoli perdagangan di Indonesia dari perspektif hukum serta mengevaluasi efektivitas Undang-Undang Nomor 5 Tahun 1999 dalam menciptakan iklim usaha yang sehat. Pendekatan yang digunakan adalah yuridis normatif dengan metode deskriptif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa praktik monopoli di Indonesia terjadi melalui merger, integrasi vertikal, dan penyalahgunaan dominasi pasar yang berdampak pada harga tinggi, rendahnya inovasi, serta terbatasnya peluang bagi UMKM. Keberadaan Komisi Pengawas Persaingan Usaha (KPPU) menjadi instrumen penting dalam menegakkan keadilan ekonomi, meskipun masih terdapat tantangan dalam hal efektivitas implementasi dan adaptasi terhadap praktik monopoli di era digital. Diperlukan reformasi regulasi dan penguatan kelembagaan agar pasar yang adil dan inklusif dapat terwujud secara berkelanjutan

Abstract

Bankruptcy law exists as a debt settlement mechanism for debtors who are no longer able to fulfill their obligations, with the main objective of creating certainty and justice in the distribution of bankruptcy assets to Creditors. However, in practice, problems often occur when money or assets belonging to the Debtor are physically controlled by one of the Creditors before or during the bankruptcy process. This research aims to analyze the legal aspects related to the control of the Debtor's money by Creditors in the bankruptcy process, by examining the principles of bankruptcy and legal protection for the parties. The method used is normative juridical legal research with a descriptive approach. The results of the study show that the actions of Creditors who hold money belonging to Debtors have the potential to violate the principle of equal treatment of creditors and the principle of general confiscation in bankruptcy law, and can interfere with the process of administering bankruptcy assets fairly and proportionally. Therefore, it is important that there is legal affirmation that protects the rights of debtors while upholding the principle of equal distribution for all creditors in the bankruptcy process
