Abstract

The Governor of Bali Province Regulation Number 46 of 2020 was formed on a delegation owned by the Governor of Bali. However, thus Governor Regulation includes fines and their application on the spot. The authority of the Governor Bali to include fines in the form of money is a polemic in the community and at the same time a legal problem because it is related to the legal norms set forth in the governor's regulation. The purpose of this research is to analyze the authority of the Governor of Bali in regulating the control of Corona Virus Disease 19 and to analyze the form of control of the Corona Virus Disease 19 in the Province of Bali. This research uses normative legal research. The results of this study indicate that the authority of the Governor Bali in regulating the control of Corona Virus Disease 19 only regulates the control of Corona Virus Disease 2019 in Bali. The authority to control Corona Virus Disease 2019 in Bali remains with the Central Government, while the Governor of Bali is only given assistance tasks. Controlling the Corona Virus Disease 2019 in Bali is a concurrent business of the Central Government. Therefore, the authority remains with the Central Government, not the Bali Provincial Government. The form of controlling the Corona Virus Disease 19 in the Province of Bali is carried out based on the principle of deconcentration. The implementation of the principle of deconcentration is carried out by delegating co-administration tasks to the Governor of Bali.

Abstract

Examining a number of issues of violence against women in Indonesialately, has placed women as victims for a very long period of time. This can be seen bythe variation in a number of cases of violence that have implications for all forms ofviolence ranging from physical to intimidation, harassment, humiliation and restrictionof rights as social beings even more visible and organized, namely in the form oftrafficking in women or the coercion of selling themselves. So that women in Indonesiaas a weak group must receive protection. Based on the background of the problemoutlined above, there are several important issues to be discussed further. The problemsare as follows: How is multicomplex legal protection for women as victims of violenceand discrimination, What are the obstacles faced in providing legal protection againstwomen as victims of violence and discrimination. Legal Use Theory. This type ofresearch used in this research is normative legal research which is a scientific researchprocedure to find the truth based on legal scientific logic from the normative side.Violence against women is any action that violates, inhibits, negates the enjoyment andneglect of women's human rights. Based on Komnas Perempuan data, the number ofreported cases of sexual violence in 2017 increased by 74% from 2016. Even in 2019cases of violence against women increased by 14% with a number of 406,178 cases. Theneed for guarantees of protection for women comes along with the awareness to providespecial protection because of the many problems faced by women such as physical andpsychological violence, discrimination, underdevelopment in various fields, and so on.Legal protection for women as victims of violence and discrimination is currentlyregulated in Indonesian law, namely the Criminal Code, Law Number 23 of 2004concerning the Elimination of Domestic Violence, Law Number 21 of 2007 concerningEradication Criminal Acts on Trafficking in Persons, Law Number 39 Year 1999Concerning Human Rights, Presidential Instruction Number 9 Year 2000 concerning Gender Mainstreaming (PUG), Presidential Decree Number 181 Year 1998 concerningthe Formation of the National Commission on Violence against Women or KomnasPerempuan, which was amended by Perpres Number 65 of 2005. Besides that, severalother forms of direct efforts made in providing legal protection for women are throughexisting institutions such as, Integrated Service Centers, and Legal Aid Institutions.There are several obstacles encountered in implementing legal protection againstwomen victims of violence and disks elimination which is caused by several factorsincluding, the substance of the law, law enforcement, culture, facilities and facilities. Forthis reason, there needs to be a number of improvements to a number of components thataffect law enforcement for violence experienced by women, both from human resourceslaw enforcement officers, the establishment of legislation that specifically regulateswomen, and maximizes a number of facilities related to the interests of victims of violenceso that implementation in providing legal protection to women can be properlyaccommodated.

Abstract

Land for humans has a very important meaning for life itself and together with the community.The importance of land can be seen from the function of the land, namely as a place to stand, for houses,a place to make a living, as a place to worship the Creator and also a place to bury those who havedied. By paying attention to the function of such a large land, the longer it feels as if the land becomesnarrow, while the demand always increases, it is not surprising that the value of the land becomes high.From the importance of the land, it is very necessary to do a study of what is meant by the sale andpurchase agreement of land rights that contain legal defects? What efforts can be taken in resolvingthe sale and purchase of land rights that contain legal defects? This type of research uses legal researchin normative legal aspects that reviews current legislation in Indonesia in relation to the legalconsequences of land purchase and sale agreements that contain legal defects. For the answer all theseproblems, article 1425 of the Civil Code regulates the occurrence of buying and selling and the articlestates that the sale and purchase is deemed to have occurred between the two parties, immediatelyafterwards these people agreed on the material even though the price of the material had not beendelivered or the price not yet paid. With the sale and purchase of the land, it does not mean that the ownership rights in this case the ownership rights to the land have changed. Because the transfer ofownership rights to land needs to be followed by legal actions in the form of Yuridische levering so thatit does not cause legal defects. The legal effect of the land purchase agreement that contains legaldefects is that the seller returns the money from the sale of land to the buyer and the buyer returns thecertificate of land rights to the seller so that it can be canceled due to the seller's fault. Efforts that canbe taken in resolving the sale and purchase agreement on land containing legal defects can be resolvedeither by deliberation, peace or family and if this fails, the solution is through mediation, if it is notfinished, the legal remedies are the last resort.

Abstract

Besides being known for its tourist destinations, Bali also has traditional institutions full of local wisdom known as subak. In the era of globalization triggered by advances in science and technology as well as rapid progress in the field of tourism, this has created problems for the existence of subak itself, both in terms of socio-religious aspects as well as its physical condition. The aim of this research is not only to understand the wisdom of subak but also to know the challenges experienced by subak in the era of globalization. The method used in this research is an exploratory method to reveal phenomena that are fundamentally related to the focus of the problem   or   object   of   study.   In   addition,   this   research   was   conducted   through   a   critical ethnographic approach based on a qualitative research paradigm. Subak is a traditional institution that is socio-religious and plays a very important role in distributing water to rice fields in Bali. In carrying out its activities, subak is based on the harmonization philosophy of Tri Hita Karana or the three causes that can give happiness to humans, consisting of parhyangan or human relations with the Creator, pawongan or human relationships with each other and palemahan or relationships between humans and their natural environment. In this era of globalization, which has entered through the rapid development of tourism, it has resulted in many subaks whose functions have begun to be eroded, starting from the decreasing number of subaks caused by the transfer of functions from existing subak lands, to the decreasing desire of the younger generation who pursue the profession of farmers as their livelihood. In addition, the entry of modern culture with the use of chemicals in pest control, has made several species of rice fields disappear. Rituals in subak culture have also begun to be simplified even though in practice it does not reduce the meaning of the ritual itself. Government intervention is needed to save the existence of subak in Bali through improving irrigation, increasing dams that can accommodate water for agricultural irrigation, exemption from rice fields tax, fertilizer assistance or other assistance needed by farmers.

Abstract

Prestasi belajar siswa terkait mata pelajaran Pendidikan Pancasila dan Kewarganegaraantidak dapat dinilai dari aspek cognitif ansich, melainkan harus juga dinilai dari aspekaffektif, dan psikomotor. Implikasi demikian, pembelajaran Pendidikan Pancasila danKewarganegaraan tidak semata-mata dituntut oleh besarnya bahan pembelajaran saja,akan tetapi harus mampu memenuhi ketiga tuntutan di atas beserta dengan faktor-faktoryang mempengaruhi proses belajar siswa. Tujuan penelitian ini adalah untuk mengetahuipengaruh pelaksanaan program perbaikan dan pengayaan terhadap prestasi PKn siswaKelas IX semester genap SMP 2 Petang tahun pelajaran 2018/2019. Dalam penelitian iniyang menjadi subjek penelitian adalah seluruh siswa kelas IX yang memproleh nilai PKnpada rapot lebih kecil atau sama dengan 7,0 pada semester ganjil SMPN 2 Petang TahunPembelajaran 2018/2019. Dari populasi sebanyak 62 orang dengan menggunakan metodeproporsional random sampling, maka yang memenuhi syarat sebagai sampel adalah 62orang. Dari 62 orang sampel tersebut dibagi menjadi 2 kelompok, yaitu 31 orang sebagaikelompok eksperimen dan 31 orang sebagai kelompok kontrol. Untuk memperoleh data,baik kelompok eksperimen maupun kelompok kontrol mengikuti tes. Kemudian hasilyang diperoleh masing-masing kelompok diolah dan diuji dengan menggunakan analisist-test. Dari hasil pengolahan data dengan rumus t-test, nilai t hitung 3,324. Berdasarkantabel dengan taraf signifikan 5% dengan derajat kebebasan 60, maka besarnya nilai tdalam tabel 2,000. Ternyata nilai t dalam perhitungan lebih besar dari nilai t dalam table.Artinya, hipotesis nol (Ho) ditolak dan hipotesis alternatif diterima. Dengan demikianmenunjukkan ada pengaruh pelaksanaan program perbaikan dan pengayaan tehadapprestasi belajar PKn siswa kelas IX semester genap SMP Negeri 2 Petang tahun pelajaran2018/2019.

Abstract

This study aims to analyze how cultural identity influences the spatial dynamics of traditional houses. In Indonesia, diverse local traditions are passed down through generations, shaping the identity of a region. These traditions affect the functions of living spaces, which evolve due to various factors, including social, economic, and environmental changes. If not addressed, this phenomenon could lead to the loss of cultural identity. The study focuses on the Tengger and Bali Aga tribes, using a qualitative comparative approach to analyze and compare their traditional spatial dynamics. The findings suggest that local customs, social activities, and the specific functions of these spaces significantly shape their transformation. The comparison reveals that while Tengger houses adapt to modern influences, Bali Aga houses adhere strongly to traditional spatial configurations. The study highlights the importance of preserving traditional elements and spatial configurations to maintain the cultural identity of these tribes. Furthermore, this study contributes to a deeper understanding of the relationship between spatial dynamics and cultural heritage.

Abstract

Pada era modern ini, perpustakaan bukan lagi hanya tempat untuk meminjam dan membaca buku, tetapi juga merupakan pusat komunitas yang berfungsi sebagai ruang untuk belajar, berdiskusi, dan berinovasi. Penelitian ini bertujuan untuk mengeksplorasi implementasi program inklusi sosial di Perpustakaan Wigati Desa Glinggang sebagai sarana untuk mempromosikan literasi moderasi beragama dan memperkuat kerukunan sosial di masyarakat. Program-program ini meliputi kegiatan-kegiatan seperti "Baca Sama-sama", lokakarya literasi, dan pameran buku yang menampilkan keberagaman agama dan budaya. Menggunakan pendekatan kualitatif, data dikumpulkan melalui observasi dan wawancara mendalam dengan pengelola perpustakaan, partisipan program, dan pemangku kepentingan terkait. Analisis data menunjukkan bahwa program inklusi sosial telah berhasil menciptakan lingkungan inklusif yang mendukung dialog antaragama dan antarbudaya, meskipun menghadapi tantangan seperti tantangan dalam mengatasi prasangka dan stereotip, ketersediaan tenaga ahli dan relawan, kesadaran penuh masyarakat, dan kesulitan dalam mempertahankan keterlibatan masyarakat. Hasil penelitian menunjukkan bahwa program ini memberikan dampak positif termasuk peningkatan pemahaman antaragama, penguatan jaringan sosial, dan peningkatan partisipasi masyarakat dalam kegiatan literasi. Untuk meningkatkan efektivitasnya di masa depan, disarankan agar pemerintah daerah meningkatkan pendanaan untuk perpustakaan, melanjutkan edukasi dan pelatihan masyarakat tentang literasi moderasi beragama, dan memperkuat kolaborasi antar stakeholder. Dengan langkah-langkah ini, program inklusi sosial di Perpustakaan Wigati Desa Glinggang dapat terus menjadi model berkelanjutan dalam mendukung literasi moderasi beragama dan mempromosikan inklusi sosial di masyarakat.

Abstract

Regional Head Elections (Pilkada) are a real manifestation of democracy and are a means for the people to declare sovereignty. Pilkada organizers, especially in Bali Province, must work together to face the challenges and risks of the 2020 Pilkada on December 9. Both Bawaslu and the Bali Provincial KPU have to work hard considering that the democracy party this time was held during the Covid-19 pandemic. The purpose of this study is to determine the role of the Bali election supervisory agency (Bawaslu) in the 2020 simultaneous regional elections. The aim of the research is to build a strong, independent, solid election monitoring apparatus and institution in Bali. Develop effective and efficient monitoring patterns and methods in Bali. The research method uses interview, observation and data collection methods with non-participatory observation, namely a type of observation where the researcher is not directly involved in any activity of the research subject. The results of this research showed that Bawaslu's role is an independent election monitor tasked with overseeing and guarding the Bali regional elections. Bawaslu supervises the implementation of elections by receiving complaints, handling cases of election administrative violations and election criminal violations. Bawaslu has the authority over reports relating to alleged violations of the implementation of laws and regulations concerning elections. Either election administration violations, money politics violations, or disputes over the election process.

Abstract

This article explores the multifaceted role of law as a catalyst for social change, integrating theoretical insights with comparative empirical analysis. Drawing from classical sociological perspectives, critical legal studies, and interdisciplinary approaches, the paper examines how legal systems both reflect and shape evolving societal norms, values, and power dynamics. Through selected case studies—including civil rights reforms, environmental legislation, gender equality policies, and digital privacy laws—it highlights the conditions under which legal reforms succeed or fail in producing meaningful social transformation. The findings reveal that while law can institutionalize progressive change, its effectiveness depends on a range of factors, including political will, enforcement mechanisms, legal culture, and public legitimacy. The article argues that law functions most effectively as an instrument of social change when integrated with broader strategies of civic engagement, structural reform, and inclusive governance. Ultimately, the study underscores the necessity of a critical, context-sensitive, and future-oriented legal framework capable of addressing the complexities of contemporary social challenges.

Abstract

Penelitian ini bertujuan untuk menganalisa kepastian hukum bagi konsumen yang terdampak oleh wanprestasi pihak promotor dalam konser musik Blackpink World Tour (BORNPINK) Jakarta. Penulisan ini dilakukan dengan menerapkan metode hukum empris dan pendekatan undang-undang dalam penulisannya. Penelitian dianalisis dengan metode deskriptif kualitatif, dengan menelaah sumber hukum primer, sekunder, dan tersier. Penelitian ini menghasilkan temuan bahwa dalam Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen dan Kitab Undang-Undang Hukum Perdata menjamin kepastian hukum bagi konsumen dan pelaku usaha. Meskipun ketentuan tersebut menetapkan dengan tegas mengenai hak konsumen serta kewajiban dan tanggung jawab pelaku usaha, namun pada kenyataannya masih sering terjadi pelanggaran oleh pelaku usaha yang tidak memenuhi kewajibannya yang kemudian mengakibatkan kerugian bagi konsumen. Konsumen yang dirugikan berhak mendapatkan perlindungan hukum konsumen dalam bentuk ganti rugi dari pelaku usaha. Adapun kewajiban  pelaku usaha adalah mengganti kerugian dengan cara memberikan pengembalian uang atau pengembalian jasa yang bernilai sama dengan kerugian yang dialami oleh pelanggan.
