Abstract

AbstractThe urgency of land registration for the first time on land that has not been certified is intended to realize the orderly administration and legal certainty for landowners. This is because the implementation of land registration will produce a final product that is a certificate as a proof of ownership of land rights. This research aims to determine how the first land registration on land that has not been certified and how obstacles in the first Land registry. This research is expected to make a meaningful contribution. Theoretically, this research is beneficial for the development of legal sciences, especially regarding agrarian law. Keynote: Agrarian, Land Registration, Certified Land. AbstrakUrgensi Pendaftaran Tanah untuk Pertama Kali pada Tanah yang belum Bersertifikat dimaksudkan untuk mewujudkan tertib administrasi dan kepastian hukum bagi pemilik tanah. Hal ini karena penyelenggaraan pendaftaran tanah akan menghasilkan suatu produk akhir yaitu berupa sertifikat sebagai tanda bukti kepemilikan hak atas tanah. Penelitian ini bertujuan untuk mengetahui bagaimana pendaftaran tanah yang pertama kali pada tanah yang belum bersertifikat dan bagaimana kendala – kendala dalam Pendaftaran tanah yang pertama kali. Penelitian ini diharapkan dapat memberikan kontribusi yang sangat berarti. Secara teoritis penelitian ini bermanfaat untuk kepentingan pengembangan Ilmu hukum, khususnya mengenai Hukum Agraria. Kata Kunci: Agraria, Pendaftaran Tanah, Sertifikat Tanah

Abstract

AbstractCase of the theft crime by the child is a law crime that should be examined wisely, in other side that action is a criminal crime that should be punished, but in another side, Child Juvenile Justice Law no. 3 Year 1997 about Juvenile Justice said that when the crime was done by the kid so Child Juvenile Justice Law no. 3 Year 1997 on Juvenile Justice become Lex Specialist against the procedural law applicable at all of justice levels, however this provision face symmetrically with the Supreme Court Regulation no. 2 of 2012 Concerning Adjustment of Limit Crime and Number of Penalties in the criminal code which become the guidance for the judges in deciding cases of light criminal hearing so that such matter will bring legal problem in court for judges to decide criminal case of theft as criminal acts (Tipiring) where the perpetrators are children.Keywords: Theft Crime, Adjustment of the Criminal Act and Theft Crime Limit by the Child.

Abstract

Budaya masyarakat tepi sungai yang lebih suka membuang air besar (BAB) di sungai, membuat mereka enggan membuat jamban di rumah masing-masing. Berdasarkan studi awal menunjukkan sebagian besar masyarakat di RT 01 kelurahan Alalak Utara masih menggunakan jamban cemplung untuk buang air besar/kecil dan limbah rumah tangganya langsung dialirkan ke sungai. Data Puskesmas Alalak Tengah tahun 2017 di kelurahan Alalak Utara menunjukkan jamban keluarga yang terinspeksi sebanyak 626 buah dan hanya 587 buah yang memenuhi syarat atau 14,1%. Tujuan penelitian ini untuk menganalisis kepemilikan jamban sehat pada masyarakat pinggiran sungai di RT 01 kelurahan Alalak Utara wilayah kerja Puskesmas Alalak Tengah kota Banjarmasin. Metode penelitian dalam penelitian ini yaitu survei analitik dengan pendekatan  cross sectional study. Populasi adalah seluruh kepala keluarga di RT 01 kelurahan Alalak Utara, yaitu sebanyak 187 kepala keluarga. Sampel penelitian menggunakan teknik simple random sampling, berjumlah 65 responden. Analisis data menggunakan uji chi-square dengan tingkat kepercayaan sebesar 95%. Hasil penelitian menunjukkan bahwa ada hubungan yang signifikan antara pengetahuan (p value 0,001), sikap (p value 0,000), tingkat pendidikan (p value 0,000), status ekonomi (p value 0,000) dengan kepemilikan jamban sehat, tidak ada hubungan antara peran petugas (p value 0,07) dengan kepemilikan jamban sehat. Disarankan agar masyarakat bersama-sama petugas kesehatan lebih berperan aktif dalam menjaga kesehatan lingkungan yaitu dengan cara membangun jamban sehat dan meningkatkan kesadaran akan pentingnya memiliki jamban sehat.

Abstract

Sebagaimana yang diatur dalam PERMA Nomor 1 Tahun 2016. Peraturan yang mengatur mediasi ini juga terdapat pada Undang-undang Nomor 30 Tahun 1999 dan PP Nomor 54 Tahun 2000 yang mana merupakan landasan yuridis bagi penyelenggaraan mediasi di luar pengadilan. Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2002 tentang kesungguhan semua hakim untuk mengusahakan perdamaian. Dan juga terdapat dalam PERMA yang mengatur yaitu PERMA Nomor 2 Tahun 2003, PERMA Nomor 1 Tahun 2008, dan yang terbaru PERMA Nomor 1 Tahun 2016. Dimana PERMA tersebut semuanya mengatur tentang Prosedur Mediasi di Pengadilan, bahwa dalam proses penerapannya mediasi di Pengadilan Agama Banjarbaru belum sesuai dengan PERMA Nomor 1 Tahun 2016. Sehingga, apa yang diharapkan dari terbitnya PERMA ini belum tercapai secara maksimal. Karena nyatanya angka perceraian di Pengadilan Agama Banjarbaru masih sangat tinggi. Sehingga efektifitas PERMA dan optimalisasi peran Mediator dalam meminimalisir angka perkara perceraian belum tercapai, dikarenakan oleh beberapa faktor yaitu. Kepatuhan terhadap PERMA, waktu proses mediasi, budaya masyarakat Indonesia, pola berfikir masyarakat Indonesia, tenaga ahli, data terkait mediasi, dan pembekalan ilmu sebelum menikah (pra nikah).

Abstract

With the principle of benefit in mind, the law will be dynamic in responding to the dynamics of human life, thus not detached from human life. There is an interconnection between the normativity of law and the historicity of humanity. The method used in this research is the normative research method, which examines the history of law in its development based on the thoughts of Hasbi Ash-Shiddieqy. From this research, it can be concluded that Hasbi, in the field of Islamic Law, introduces the concept of the benefits of Islamic law to the Indonesian public in a balanced manner. Hasbi's thought constructs in the field of benefits are based on: Istihsan, Saddudz Dzari’ah, and Maslahah.

Abstract

Saat ini kompetensi kewirausahaan dan sosial merupakan suplemen baru dari tugas seorang kepala madrasah, dibanding dengan kompetensi kepribadian, manajerial, dan supervisi yang sudah lebih dulu menjadi tanggungjawab kepala madrasah. Kompetensi kewirausahaan secara filosofis menghendaki seorang kepala madrasah harus mampu berfikir kreatif dan inovatif untuk pengembangan madrasah yang dipimpinnya. Madrasah harus maju dan mampu berdiri sendiri dengan mengoptimalkan segala potensi sumber daya madrasah salah satunya melalui potensi kewirausahaan. Tetapi ada madrasah yang kesulitan untuk menggali potensi kewirausahaan tersebut, sehingga perlu mendapatkan bantuan dan solusi dari semua pihak. Dari permasalahan tersebut maka mendorong kami untuk menemukan jalan keluarnya melalui sebuah kegiatan pengabdian kepada masyarakat dalam bentuk pelatihan pembuatan kain sasirangan sebagai upaya pengembangan potensi kewirausahaan di Madarasah Aliyah Darul Mukarram Kabupaten Barito Kuala. Hal ini bertujuan agar adanya pengetahuan keterampilan pembuatan kain sasirangan dan pengembangan potensi kewirausahaan di Madrasah Aliyah Darul Mukarram Kabupaten Barito Kuala. Metode dalam program pengabdian ini dibagi menjadi dua tahapan, yaitu pertama memberikan sosialisasi terlebih dahulu berupa penyampaian materi terkait tentang tata cara pembuatan kain sasirangan. Kemudian yang kedua melaksanakan pelatihan dengan praktik secara langsung pembuatan kain sasirangan dengan dibagi menjadi beberapa kali pertemuan. Hasil dan kesimpulan dari dilakukannya kegiatan ini menunjukkan bahwa telah meningkatnya pengetahuan keterampilan para peserta dalam pembuatan kain sasirangan dan mampu mengembangkan potensi kewirausahaan di Madrasah Aliyah Darul Mukarram Kabupaten Barito Kuala.

Abstract

The use of Memorandums of Understanding (MoUs) as initial agreements or contractual stages is growing in Indonesia, but their legal status remains valid. This research aims to examine the position of MoUs in Indonesian contract law, focusing on several valid agreement requirements as stated in Article 1320 of the Civil Code and the court's interpretation of MoUs in law enforcement. This research applies a normative approach in legal studies and case studies. The results show that an MoU can be legally binding if it meets the valid requirements of an agreement, namely agreement, the capacity of the parties, a clear object, and a legitimate cause. Several court decisions, such as Denpasar District Court Decision No. 419/PDT.G/2012/PN.DPS, recognize MoUs as preliminary agreements that give rise to legal obligations. However, if an MoU only contains a general understanding without clear obligations, then the MoU is considered merely a moral agreement without legal consequences. This research emphasizes the importance of clarity in establishing an MoU to provide legal certainty.

Abstract

Health development in Indonesia continues to face major challenges, particularly in fulfilling community nutrition needs, as reflected in the high prevalence of stunting, wasting, and malnutrition. From a human rights perspective, the rights to health and food are interrelated and require integrated policy implementation. Through the Free Nutritious Meal Program (MBG), the government seeks to fulfill nutritional needs while carrying out its responsibility to guarantee the rights to health and food. This study aims to analyze the regulation of the rights to health and food within the Indonesian legal system and examine the integration of both rights into the Free Nutritious Meal Program as a human rights–based policy using normative legal research methods with statutory, conceptual, and human rights approaches. The findings show that the rights to health and food already have a strong normative basis in the 1945 Constitution and related legislation; however, existing regulations remain sectoral and lack an integrated framework. The study also identifies potential conflicts between fulfilling the rights to health and food and the right to education, particularly regarding state budget allocation, as the Free Nutritious Meal Program may create budgetary pressure on the education sector, thereby requiring regulatory harmonization to ensure balanced fulfillment of all human rights.
