Abstract

Negara demokrasi dikonotasikan sebagai suatu cara pandang yang memberikan kebebasan kepada setiap orang untuk berpendapat, berpikir, berkarya hatta kebebasan dalam memeluk suatu agama dan ajaran tertentu menurut keyakinan mereka masing-masing. Indonesia dalam hal ini di sebut-sebut sebagai negara yang mengadopsi paham demokrasi dalam sistem pemerintahan yang dilakoninya, sehingga berimbas pada pola, sistem dan ketetapan yang mampu merangkul setiap etnis, budaya, suku, agama dan kepercayaan setiap warga negaranya, sebagaiman yang diamanatkan oleh UUD 45 dan pancasila sebagai dasar Negara. Kebebasan dalam beragama berimplikasi pada ‚agama minoritas dan agama mayoritas?. Agama ‘Islam’ merupakan salah satu agama yang‚ digandrungidi Indonesia; ajaran baku (syariat Islam) sering kali tidak sejalan (baca: berbenturan) dengan idelogi Negara. Para ‘abdi agama menghendaki syariat Islam sebagai rujukan dalam melaksanakan sistem pemerintahan, terutama dalam penetapan hukum sebagaimana yang dikumandangkan, bahwa Islam adalah agama rahmatanlil alamiin. Demokrasi pancasila pada dasarnya sama atau sinoninm dengan demokrasi lokal seperti yang yang telah dipraktekkan selama beberapa abad oleh suku-suku bangsa Indonesia, yang sekarang masih dapat dijumpai dalam masyarakat yang menggunakan sistem adat, budaya, agama dan demokrasi sehingga terlihat memiliki dialektikanya sendiri dalam bagan yang utuh perbedaan basis empirik itu tidak akan menghalangi bertemunya dua konsep, antara yang non empirik dengan yang empirik bahkan akan bertemu pada satu titik. Sebab, meski agama berdasarkan wahyu tetapi ia diterima berdasarkan penalaran manusia. Lebih-lebih karena wahyu mengandung nilai-nilai yang mendorong demokrasi.

Abstract

Having a happy and harmonious home life is certainly everyone's dream. However, the course of married life is not always smooth and without obstacles. Married life is sometimes complicated and full of sharp stones or not always happy. So many have to stop in the middle of the road, but many are also able to make it to the end. This happened to the WBP Mataram Women's Prison where out of 203 prisoners there were 152 prisoners who were unable to maintain their married life. The reasons are different. For this reason, it is necessary to understand and know about the factors that influence divorce and the factors that influence household resilience, which can be used as a guide in carrying out domestic and marital life after serving a sentence. The concept of family resilience is very relevant because the concept of family resilience is in accordance with Islamic teachings and can be applied in efforts to realize family resilience. In order to be able to produce a generation of quality and of course useful for the nation and religion.

Abstract

The current of modernism that was carried by Europe with its characteristic ―rationalistic-empirical‖ exerted a very striking influence in the midst of Islamic society. The spread of modernism became more prominent when this concept of thought found its place among Islamic thinkers—as if it were a new school in the dynamics of Islamic thought. One concrete form of the impact of this current of modernist thought in Islam is the birth of one of the reformist-modernist schools; requires every Islamic society to study, understand, reconstruct and create a new format that is able to answer every problem of the Ummah from every line of life. The moderism of Islamic thought underwent significant changes and gained a new world when Islamic thinkers used this model of thought in fulfilling religious guidance to the need for religion in solving various problems that began to surface, necessitating a new formula to fix the socio-politics of the Islamic community which in fact was becoming obsolete and outdated, as proclaimed by Jamaludin al-Afghani. The implication of al-Afghani's modernism is that of the Pan-Islamic concept of carrying a centralized form of government led by a caliph, but still incorporating contemporary ideas. Afghani offers a democratic system as the right way out as the ideal form of an Islamic state. More concretely, Afghani even gave consideration to using a republican system of government.

Abstract

This study explores the perspectives of religious figures regarding joint property division in East Lombok, aiming to elucidate the role of education as a potential solution in addressing related challenges. Employing a qualitative research approach, data was collected through semi-structured interviews with key religious figures in the region. These interviews were transcribed and analyzed thematically to identify recurring patterns and themes. The findings reveal a nuanced understanding among religious figures regarding joint property division, influenced by cultural, social, and religious factors. Education emerged as a central theme in their perspectives, highlighting its potential to foster understanding, tolerance, and equitable solutions. The implications of these findings underscore the importance of integrating educational initiatives into discussions and practices related to joint property division in East Lombok, thereby promoting social cohesion and conflict resolution.

Abstract

This case study research aims to examine and analyze the condition of information and communication technology facilities for implementing Computer Based Testing School Assessment exams, school principal strategies in implementing Computer Based Testing School Assessments, as well as obstacles in implementing School Assessments Computer Based Testing in one of the junior high schools in Mataram City, Nusa Tenggara Barat, Indonesia. Data was collected through interviews, observation and documentation. The results of data analysis show that the condition of computer facilities for implementing Computer-based National Exam in schools is inadequate. The principal's strategy in implementing the Computer Based Testing School Assessment includes strategies in the areas of facilities and infrastructure, human resources and student affairs. There are two obstacles in implementing the Computer Based Testing School Assessment that have emerged, namely technical and non-technical obstacles. This highlights the importance of the principal's strategy in ensuring the successful implementation of Computer Based Testing-Based School Assessment.

Abstract

The hijrah of the Prophet Muhammad PBUH to Medina marked the birth of the initial concept of the Islamic political order by forming a plural Medina society, based on the values of justice, sovereignty, and shura. This research discusses the relationship between religion and the state in Islam, which is theoretically formulated in three main paradigms: integralistic, symbiotic, and secularistic. In addition, this article examines the basic principles of Islamic rule, such as Allah's absolute sovereignty, justice, and community participation through deliberation. The research also explores the concept of power division in Islam which includes the legislative, executive, and judiciary, as well as the typology of power between the organic approach that unites religion and the state, and the secular approach that separates them. The conclusion highlights the relevance of the Medina Charter as a reference for Islamic political principles, although it does not explicitly describe the ideals of the Islamic political order. This study identifies contemporary challenges in applying Islamic political principles amid increasingly complex global social dynamics.

Abstract

Di era digital, teknologi telah membawa manfaat signifikan tetapi juga menimbulkan tantangan terkait perlindungan privasi. Kajian ini fokus pada relevansi nilai-nilai Al-Qur'an, prinsip-prinsip hak asasi manusia (HAM), dan perspektif gender dalam melindungi hak privasi di era digital. Metode yang digunakan adalah pendekatan kualitatif dengan kajian literatur dan analisis konseptual, menggunakan data primer dari Al-Qur'an dan tafsir, serta data sekunder dari literatur HAM dan studi gender. Pengumpulan data dilakukan melalui seleksi teks dan studi relevan, sementara analisis data menggunakan analisis tematik dan komparatif. Hasil kajian menunjukkan bahwa Al-Qur'an menekankan pentingnya menjaga martabat dan privasi individu, seperti dalam Surah Al-Hujurat ayat 11-12 dan Surah An-Nur ayat 27-28 serta 30-31, sejalan dengan prinsip HAM yang menekankan non-diskriminasi dan kesetaraan. Tantangan khusus seperti kekerasan berbasis gender dan pelecehan online menunjukkan perlunya kebijakan yang inklusif dan adil untuk melindungi perempuan dan kelompok marginal. Integrasi nilai-nilai Al-Qur'an dengan prinsip-prinsip HAM dan perspektif gender dapat menciptakan lingkungan digital yang lebih manusiawi dan adil. Rekomendasi kajian ini mencakup penguatan kerangka hukum nasional dan internasional, pengembangan kebijakan digital yang inklusif dan transparan, serta peningkatan edukasi digital yang menekankan pentingnya menjaga kehormatan pribadi. Artikel ini berkontribusi sebagai panduan bagi pembuat kebijakan, peneliti, dan masyarakat umum dalam memahami dan mengatasi tantangan perlindungan privasi di era digital, dengan menggunakan pendekatan holistik yang menggabungkan perspektif agama, HAM, dan gender.

Abstract

A harmonious marriage, apart from being based on compatibility and harmony, must also be based on aspects of equality or equality between the two partners. Not only in material aspects but also immaterial aspects such as lineage and nobility. Apart from that, the Sasak tribe also still adheres to patrilineal principles in the aspect of marriage. This is illustrated in the dichotomization of wedding processions between each level of society based on their background, such as menak and coral rows which are differentiated in the traditional procession. Because in every traditional process of merarik in the Sasak tribal community there are certain meanings in it, however, this has experienced shifts and changes in some villages in the Sasak tribe. Therefore, this merarik tradition deserves to be raised as a research subject, especially in its unique aspect, why the merarik tradition is used as a ritual that must be fulfilled. This research was carried out in Lendang Nangka village, Masbagik sub-district, East Lombok district. This research is also included in qualitative research, the research subjects of which consist of village heads, traditional heads, religious leaders and community leaders. The research results include: First, the process of attracting noble people and ordinary people before and after the marriage contract in Lendang Nangka Village is basically all almost the same, only it can be differentiated by the size of the existing aji krame. Then, most of the people of Lendang Nangka village have been able to accept changes, where the keskufu'an of the noble lineage can be compared with other material aspects.

Abstract

In the idiom of the Islamic legal tradition, gender equality is a new problem (masā'ilmustahdatha). Gender equality is an issue that was not found in Islamic law until the 20th century. By the middle of the century, through the CEDAW convention, gender equality gained a clear international mandate. Many Muslim countries ratify CEDAW (except Iran, Somalia and Sudan). Although in fact, the ratification was accompanied by a reservation that spoke of tensions that have not been resolved until now, therefore the United Nations by echoing freedoms based on human rights and UNICEP echoing about the protection of children so that children get their rights in living life so that later they will not be marginalized, in Indonesia itself a law on child protection was formed that gives children legal power in all forms discrimination both in the family environment and in the community itself and in the end children are free to create without any bullying against them. In CEDAW, article 5 emphasizes eliminating all forms of discriminatory treatment in the private sphere, namely the family, which according to CEDAW is the most important and frequent place of injustice against women's human rights. Human rights (HAM) and Islamic family law have the same goal in protecting and guaranteeing the welfare of individuals and families. However, the way they are applied and interpreted can be different. The integration of human rights in Islamic family law includes the understanding that human rights principles, such as equality, freedom, and protection from discrimination, must be applied in the context of Islamic law. This understanding requires a balance between traditional norms and the demands of modern human rights.
