Abstract

This article describes Imam al-Shāfi'i thought in building istinbath Islamic law method and its decition's which evolved from qawl qadīm to qawl jadīd. He is known as the founder of uṣūl al-fiqh science which is arranged systematically-logically and critically. He tried to combine the two schools of thought, those are: Maliki, known as ahl al-ḥadīth that thrives in the Hijaz, and the Hanafi, known as ahl al-ra'y that is entrenched in Iraq. He managed to combine the two schools by taking method good ahl al-ḥadīth and leaving the less ones successfully. Reciprocally, he took the good ahl al-ra’y method and left the poor. It was done for the reason that he had studied with Imam Malik and Muḥammad ibn Ḥasan al-Shaibani, the adherents of the Hanafi schools. The fatwa which he formulated at his living in Iraq is known as qawl qadīm. After he reviewed the fatwa built in Iraq and found the fragility of the arguments as a fundamental, finally, he triggered a new law, namely qawl jadīd which was based on the strong arguments.

Abstract

Al Quran is the first and primary reference for any problems Muslims faced. This holy book becomes guidelines and directions of Muslim’s life throughout the ages. In line with the changes and development of times, there are various problems in law, social, cultural and others emerging in the middle of life. Among them is the issue of gender which is also reflected in the Quran. Quran contains universal values as the guide for human life at all times. The values are always relevant to be implemented in every place, day and time, among others are humanities, justice, freedom, and equality values. Related to the values of justice and equality, Quran never tolerates differences and subordinated treatment or even discrimination among human beings. Quran explains the sameness and equality between men and women. Therefore, they have the same duties and responsibilities as abdullah and caliph in the earth. Human capacity as caliph serves to preserve, manage and prosper the earth. Achieving prosperity is done in various aspects of life, in the fields of economics, culture, science and so on.

Abstract

Gender justice and gender equality are complex topics and drew the attention of many people. A number of Muslim jurists have studied it from various perspectives in order to understand and find a fair solution to the problem. However, most of them are rare to study it from the lens of maqāṣid al-Qur’ān, the purpose of al-Qur’an was revealed to the earth. Incorporating gender justice and gender equality in maqāṣid al-Qur’ān is considered urgent with the intent that people will really pay attention, watch, and put male and female proportionally. This paper focuses on analyzing Yūsuf al-Qarḍāwī's thought about gender equality and justice as part of maqāṣid al-Qur’ān. This article includes library research, whose datas are sourced from the literature. The results of this study revealed that men and women have equal rights in every aspect of life; education; economics, social, political, and law. They are also given equal rights in participating to be public leaders. Besides that, they have equal rights in selecting their belief (religion) based on their strong desire and their own belief and they have rights to get heritance as well as having rights to the goods they have. On the contrary, any kinds of discriminations, subordination, stereotyping, violence, and all forms of deviation inequality of gender bias, contradict and contrasted with maqāṣid al-Qur’ān.

Abstract

The existence of renewal in Islamic religious thought is a necessity because there are new different challenges and problems in each era. Islam as a religion of rahmat lil’ālamīn (a mercy to all creation) advocates and asks Muslims to optimize their logical reasoning in responding to every phenomenon. The existence of Arkoun as a contemporary Muslim thinker makes serious effort in reading, studying and investigating Islamic turath (heritage) with all his teachings in order to deconstruct then reconstruct the epistemology of Islam so that he can move forward in the current era. Arkoun's thought was very intent to dismantle the standard and well-established understandings among Muslims and also dared to counteract “the big waves” in revising and rearranging Islamic scientific construction. For Arkoun, all kinds of knowledge, as well as Islamic religious sciences are linked to the historicity that surrounds them, it cannot be denied that those are a product of history. Therefore, his scientific epistemology is also the product of history and the results of the reasoning creativity of those who lived in a certain era. He proclaims to understand, to examine, to study, to examine and to criticize Islamic religious thought (al-afkār al-dīniyah al-islāmiyah) which is summarized in a number of turath (heritage) using various methods and findings of humaniora (humanistic studies) and social sciences developed since the 19th century, its development was even faster in the 20thcentury.

Abstract

This paper described the formulation of Yūsuf al-Qarḍāwī's isntinbāṭ method towards moderate fiqh. The choice of this theme was based on the existence of two demeanours in religion, between permissive and inclusive. Two main questions in this research were, first, how did Yūsuf al-Qarḍāwī formulate the istinbāṭ method for moderate fiqh? Second, how is the implementation of this method in formulating Islamic law? This paper concluded two things through a literature study with the descriptive-analytic method. First, there were six formulations of the istinbāṭ method for the moderation of Islamic law. a. Examining the maqāṣid contained in the text before determining Islamic law, b. Linking texts and Islamic law with texts and other Islamic laws. c. Understanding texts in the frame of asbāb (al-nuzūl or al-wurūd), both micro and macro. d. Distinguishing between constant maqāṣids and changing instruments. e. Adjusting between al-thawābit and al-mutaghayyirāt. f. Observing the difference between worship and mu’āmalah in terms of wisdom, ‘illah and maqāṣid. Second, this method of istinbāṭ could produce fiqh with a flexible, elastic, dynamic, adaptive, and easy-to-practice.

Abstract

In one of the efforts to increase the economic progress of the pesantren and also to eat for the students, especially at the Nurul Jadid Boarding School, Probolinggo, it is very necessary to have a centralized program for paying the cost of paying for the cost of the students’ meals so that each student’s meal is regelated and even becomas a way of saving the cost of living for the students. For decades, the Nurul Jadid Islamic Boarding School has not been able and succeeded ini centralizing the cost of food for students and processed food products for students at one door. The centralization of the santri staple food business is believed by the pesantren. The fear of pesantren in managing this business is quite an obstacle, but by providing location, technology and human resources, pessntren is expected to be able to maintain and preserve Costmara’s business. Our service uses a Consultation approach, where wa several individuals at the same time assist, guide and direct policy makers, employees and servants at Nurul Jadid Cost of Eating student to make this businenss lively and comfartable, especially able to nourish the economy of the Pesantren and serve the needs of the santri so that the pesantren achieves the peak of independence and economic sovereignty. Centralization of the cost of meals for studentswas initiated by Pesantren bereau and ini teh end it was acquired by the business bereua, Centralized peyments at the santri supplies simpab office and food management in public kitchens with a sufficient number of employess, centralization of santri food and payments were able to mave the pesantren economy for more beneficial interests including religious agends, education, health, equipment and others within the Nuru Jadid Islamci Boarding School. Economics is the foundation of every pesantren agenda. So Cost Mara contributes a lot the economic pace of Islamic Boarding Schools. Santru obtain sufficient benefits, including low prices, healthy composition and savings for santri and the ecomic flow santri guardiens.

Abstract

Desa Sumber Secang sendiri telah memiliki perpustakaan akan tetapi secara fungsional kini telah tak berjalan. Diharapkan diadakannya perpustakaan digital ini bisa memberi kemudahan bagi para penggunanya untuk mengakses sumber informasi elektronik dengan alat yang menyenangkan serta bisa diakses kapan saja dan dimana saja. Penelitian ini menggunakan pendekatan ABCD (Asset Based Community Development). penelitian yang dilaksanakan adalah field research yaitu penelitian yang diperoleh berdasarkan data lapangan dan pengamatan langsung. Diadakannya perpustakaan digital membawa dampak positif bagi masyarakat desa Sumber Secang Karena bisa mengakses buku dimana saja dan kapan saja.

Abstract

The latest law on marriage No. 16 of 2019 confirms that marriage can be legalized if the man and woman have reached the age of 19. However, this new regulation is still not widely known by the public, especially teenagers. This article is the result of community service activity in the form of outreach. The purpose of this community service is to provide understanding to students regarding the age limit for marriage and mental preparation in facing marriage, as well as preventing early marriage for teenagers at Daarul Lughoh Islamic Boarding School, Akkor Village, Palengaan Sub-District. This event has great benefits in increasing students' understanding of the importance of physical and mental preparation before going into a marriage, because a marriage is not only based on the principle of liking each other and consensual. Instead, a married life will definitely deal with many challenges and problems. Therefore, then it takes a mature personality and mentality to manage household life within the framework of sakinah mawaddah wa rahmah. (Undang-undang terbaru tentang perkawinan no 16 tahun 2019 menegaskan bahwa perkawinan dapat diizinkan apabila laki-laki dan wanita sebagai calon mempelai telah mencapai usia 19 tahun. Namun, peraturan baru ini masih belum banyak diketahui oleh masyarakat, khususnya para remaja. Artikel ini merupakan hasil dari kegiatan pengabdian kepada masyarakat dalam bentuk sosialisasi. Adapun tujuan dari pengabdian masyarakat ini adalah memberikan pemahaman kepada santri terkait batas usia perkawinan dan persiapan mental dalam menghadapi perkawinan, serta mencegah adanya pernikahan dini dari para remaja di pondok pesantren Daarul Lughoh Desa Akkor Kecamatan Palengaan. Acara ini dinilai mempunyai manfaat yang besar dalam meningkatkan pemahaman para santri akan pentingnya persiapan fisik dan mental sebelum melangsungkan pernikahan, karena sebuah pernikahan bukan hanya didasari atas prinsip suka sama suka saja. Akan tetapi, perlu disadari bahwa kehidupan pernikahan akan mengalami banyak tantangan dan masalah dalam bahtera rumah tangga sehingga dibutuhkan kepribadian dan mental yang dewasa untuk mengatur kehidupan rumah tangga dalam bingkai sakinah mawaddah wa rahmah.)

Abstract

Laporan ini membahas tentang pendampingan Usaha Mikro, Kecil, dan Menengah (UMKM) Kue Bilza Cake di Desa Pesisir, Kecamatan Paiton, Kabupaten Probolinggo, Jawa Timur, dalam meningkatkan volume penjualan melalui platform e-commerce. Pendampingan ini bertujuan untuk meningkatkan pengetahuan dan keterampilan pemilik UMKM dalam mengelola toko online, strategi pemasaran digital, dan optimasi penjualan online. Metode pendampingan yang digunakan adalah pelatihan, konsultasi, dan pendampingan langsung dalam mengelola toko online dan strategi pemasaran digital. Hasil pendampingan menunjukkan peningkatan signifikan dalam volume penjualan Kue Bilza Cake setelah mengikuti program pendampingan. Peningkatan ini dikaitkan dengan peningkatan pengetahuan dan keterampilan pemilik UMKM dalam mengelola toko online, strategi pemasaran digital, dan optimasi penjualan online. Laporan ini merekomendasikan replikasi program pendampingan UMKM serupa di daerah lain untuk membantu UMKM meningkatkan daya saing mereka di era digital.

Abstract

Peneliti menemukan bahwa penerapan budaya kerja (corporate culture) dalam proses kegiatan kerja di Bank Jatim Syariah Capem Sampang melalui penekanan dan efektifitas dalam penerapannya. Sehingga menciptakan sumber daya manusia yang terlatih dan terbentuk dalam mengejar kinerja Bank Jatim Syariah, serta mampu bersaing dan menciptakan lembaga keuangan syariah yang dapat go public dan dapat dikenal oleh lebih banyak orang. Dalam upaya membangun sumber daya manusia, proses kerja dan hasil kerja yang lebih baik diharapkan bersumber dari perilaku masing-masing individu, artinya pembentukan budaya kerja dari karyawan dan pimpinan merupakan kerangka dasar manajemen dari sebuah organisasi, yang dilakukan secara terus menerus tidak lepas dari kerja keras pemimpin. Hal inilah yang akan menghasilkan dampak yang signifikan bagi organisasi dan lembaga. Dalam penelitian ini, peneliti menggunakan metode penelitian deskriptif kualitatif. Fokus penelitian yang akan ditelaah dalam penelitian ini adalah terkait penerapan budaya perusahaan yang dalam hal ini diimplementasikan dalam beberapa referensi, sehari-hari adalah selasa, ‎Iman, OK BRO, SICOMO, dan singkatan dari kata EXPRESI. Sehubungan dengan hasil penelitian ini, disarankan kepada staf pimpinan BANK JATIM SYARIAH CAPEM SAMPANG untuk mempertahankan dan meningkatkan budaya kerja pegawainya, terlebih dahulu alangkah baiknya mengendalikan dan menerapkan budaya kerja tersebut pada diperhatikan dan dipertahankan dalam rangka meningkatkan budaya kerja yang profesional sesuai dengan visi dan misi bank Jatim itu sendiri.
