Abstract

Masalah yang diangkat dalam penelitian ini adalah untuk menggali dan menganalisa pandangan tokoh masyarakat NU dan Muhammadiyah terhadap perempuan yang bekerja mencari nafkah keluarga. Penelitian ini menggunakan jenis penelitian lapangan. Pendekatan yang digunakan adalah pendekatan kualitatif. Sumber datanya berupa sumber data primer dan sekunder. Teknik pengumpulan datanya adalah observasi, wawancara, dokumentasi dan triangulasi. Analisis data dalam penelitian ini menggunakan teknik analisis interaktif. Hasil penelitian menunjukkan bahwa kelemahan seorang suami dalam mencari nafkah dapat diatasi dengan kerelaan istri membantu pekerjaan suami dan Hasil penelitian ini mengemukakan bahwa tidak ada larangan bagi perempuan untuk tetap bekerja sesuai yang diinginkan dengan syarat kedudukannya sebagai istri dan ibu dalam rumah tangga tidak terlupakan, karena ibu adalah sekolah pertama bagi generasi-generasinya, pendapat ini berdasar dari al-Qur’an dan hadis sesuai dengan perkembangan zaman, meskipun ada yang tidak membolehkan bekerja karena melihat bahwa wanita yang sibuk di luar lebih banyak mudaratnya dibanding yang tinggal di rumah, namun semuanya dapat teratasi jika ada komunikasi harmonis.

Abstract

The background of the article is the contents of Article 59 paragraph (3) and explanation of paragraph (1) of the Law on Judicial Power. The article authorizes the District Court to implement the decision of the Sharia arbitration body on the resolution of Islamic economic disputes. The article and explanation of the verse contradicts the absolute authority of the Religious Courts regulated in Article 49 letter (i) of the Law on Religious Courts. This shows that, the legislators are not consistent in making laws and regulations, so that it creates legal uncertainty. By applying the normative legal research method to the statute approach and case approach, this article seeks to describe the phenomenon of legal conflicts that occur. From the in-depth analysis it can be concluded that the legal provisions regarding the implementation of the decision of the National Sharia Arbitration Board are regulated in the Arbitration Law, the Judicial Power Act and the Religious Courts Act. Abstract

Religious courts have a function as actors of independent judicial power at the first level to administer justice to uphold law and justice. To carry out their functions, religious courts are given the duty and authority to examines, decide and resolve cases at the first instance between people of the Islamic faith, one of which is in the field of sharia economics. The urgency of this research is to explain and analyse the implementation of Radbruch's legal objectives in the trial process, so as to produce a fair and certain court decision. Therefore, this research aims to examine the regulation and significance of the settlement of sharia economic disputes in the Religious Courts. This research is a doctrinal research that examines the law conceptualised as a rule, using conceptual approaches and legislation. The results of the study found that: 1) the regulation of economic dispute resolution comes from legislation, customs, and jurisprudence; and 2) the significance of sharia economic dispute resolution in the Religious Courts, namely the obtaining of justice, finality / usefulness, and legal certainty for the justice-seeking community.

Abstract

Economic transactions are carried out by humans in order to fulfill their needs, one of which is a land lease agreement as carried out by PT. KAI with PT. Herona Express Pekalongan. What's interesting about this case, one of the parties changed the contents of the lease agreement, and the change in the agreement was in the lease period that had not yet expired. So it is interesting to study using ijarah contract analysis, is there a unilateral change in an agreement whether it is in accordance with the concept of ijarah contract. This research is a field research with a qualitative approach. The results of the study show that based on the results of the analysis, in general the land lease agreement has fulfilled its pillars and conditions. The change in the agreement does not damage the pillars and terms of the agreement because the change in agreement is based on the approval of the related parties, besides that the party that changed the agreement (PT. KAI Express) also provides compensation in the form of relocation. Meanwhile, when viewed from the reasons for changing the agreement which prioritizes the public interest, it is in line with the concept of maslahah 'ammah.

Abstract

The presence of a Sharia fintech lending service platform provides various benefits to the community, with multiple conveniences offered. However, operationally, the implementation of Sharia fintech lending services can pose risks, leaks, or misuse of the personal data of service users. This is because the implementation of Sharia fintech lending cannot be separated from the activities of collecting, processing, using, and disclosing personal data of service users. This study analyzes the law on personal data protection in the implementation of Sharia fintech lending and its relevance to Jasser Auda's thoughts on the theory of systems in Maqashid Sharia. The research method uses normative law, which is prescriptive with a statute approach and conceptual. Primary and secondary legal sources are traced using document studies. The study results show that Sharia fintech lending organizers must protect the confidentiality of the personal data of service users and ensure the fulfillment of the rights of personal data owners. Personal data protection in Sharia fintech lending services is relevant to Auda's maqosid sharia system theory, especially the features of cognition, openness, interrelated hierarchy, and intentionality with the ultimate goal of fulfilling the principles of justice and the glorification of human rights. This study contributes to policy revisions to address the risks of implementing Sharia fintech lending more humanistic and equitable.

Abstract

The existence of people's need for financing is fast, easy, safe and certainly in accordance with the principles of sharia, triggering sharia banking to innovate. One form of innovation issued by sharia banks to support the needs of the community is the product of pawn gold sharia. On the other hand, concerns arise about the product of rahn (sharia pawn), because the rahn product (gold pawn) is not a productive asset in the profit. Considerations arise when the profits are derived from the percentage of the loan amounts given by the bank to customers, as is the practice in conventional banking. Based on the problems that will be examined by the author above, then the method used in the research is normative legal research method. The results of the research are: 1) gold pawning products performed by sharia banks using three contracts, namely contracts qardh, rahn, and ijarah; 2) the amount or amount of the place rental charge shall not be calculated from the percentage of the loan or the loan granted by the bank to the customer, but the amount of the fee is taken from the expenses that are clearly required; And 3) when payment is due, then the customer could not repay the debt, it shall be returned to the agreement which has been made and agreed by the parties.

Abstract

Penelitian ini mengkaji putusan atas perkara penyalahgunaan keadaan (misbruik van omstandigheden) dalam perjanjian kredit, adendum, dan restrukturisasinya. Penyalahgunaan keadaan dilakukan dengan cara memberikan bunga kredit yang tinggi, padahal tergugat mengetahui kondisi para penggugat sedang dalam kesulitan finansial akibat gagalnya rencana ekspansi bisnis. Berdasarkan gugatan tersebut, pengadilan tingkat pertama mengabulkan gugatan para penggugat, dan kemudian dikuatkan oleh pengadilan tingkat banding. Namun, putusan pengadilan tingkat banding dibatalkan di tingkat kasasi oleh Mahkamah Agung. Berdasarkan latar belakang, masalah yang diangkat adalah bagaimana pertimbangan hakim dalam putusan pengadilan tingkat pertama, banding, dan kasasi? dan bagaimana unsur-unsur penyalahgunaan keadaan dalam putusan kasasi. Jenis penelitian ini merupakan penelitian hukum normatif. Objek kajiannya berupa penemuan hukum pada putusan pengadilan. Pendekatan penelitian yang digunakan, yaitu pendekatan kasus, konseptual, dan peraturan perundang-undangan. Analisis bahan hukum menggunakan metode content analysis dengan cara melakukan pengkajian dan penafsiran terhadap fakta hukum, pertimbangan hukum, dan amar putusan. Penelitian ini menyimpulkan bahwa pertimbangan majelis hakim tingkat pertama dan tingkat banding tidak memperhatikan unsur-unsur penyalahgunaan keadaan sebagai dalil hukum dalam gugatan para penggugat, sehingga terdapat kekeliruan dalam menerapkan dalil hukum terhadap peristiwa dan fakta hukum di persidangan; terdapat dua unsur perbuatan penyalahgunaan keadaan, yaitu penyalahgunaan keadaan karena keunggulan ekonomi; dan keunggulan psikologis. Suatu perbuatan dikatakan sebagai penyalahgunaan keadaan, apabila dilakukan pada saat sebelum dan saat penutupan perjanjian.

Abstract

Post-pandemic COVID-19 still leaves Non-Performing Financing (NPF), especially financing with fiduciary guarantees in Sharia finance companies. The Otoritas Jasa Keuangan's Relaxation Policy, which ended in April 2023, has not been effective and has fulfilled a sense of justice for debtors. This research discusses the causes of the ineffective implementation of the Relaxation policy in Sharia Financing Companies so that there is still NPF post the Covid-19 pandemic. Furthermore, it discusses the settlement model of NPF as an offer so that is more effective and fulfils a sense of justice for the parties. This empirical juridical research uses a qualitative approach in collaboration with statutory and conceptual approaches. The research locations were nineteen financing companies in Pekalongan ex-Residency with fiduciary financing objects. Data collection uses focus group discussions, interviews and document studies. The results show that inconsistent norms, negative legal culture, misperceptions of restructuring diction as the write-off of debt and the debtor's objection in the settlement of NPF are the causes of the ineffective implementation of the Relaxation policy. The settlement of NPF should be carried out based on sharia principles, the principle of prudence and good faith which prioritizes the needs of the debtor. Determining the rescheduling period should be carried out using a tri-semester tiered model so that effectivity, justice and benefits (reciprocal benefits) will be realized between the two parties.

Abstract

Islamic financial inclusion in Indonesia remains relatively low among the unbanked and underbanked populations, who have limited access to formal banking services. This condition necessitated Bank Syariah Indonesia to introduce a branchless banking initiative, known as BSI Smart, which is integrated with mosques to expand equitable access to Islamic financial services. Therefore, this study aimed to analyze the effectiveness of implementing a branchless banking policy integrated with mosques to increase Islamic financial inclusion. The analysis adopted qualitative methods, collecting data through interviews and questionnaires. Interviews were conducted with 10 informants selected purposively. Questionnaires were further administered to 100 respondents in rural areas and 100 in urban areas who were randomly selected. Correlating with the theories of Edwards and Metter-Horn, this study showed that implementing branchless banking policy through mosques remained ineffective due to inaccurate targeting, limited facilities and infrastructure, suboptimal communication, and the community's socio-economic conditions, which tended to favor informal financial institutions. The novelty of the analysis lay in the integration of mosques as centers for Islamic financial literacy and education, directly connected to BSI Smart agents. This allowed mosques to serve as places of worship and centers of economic empower­ment for the community. Additionally, the model had the potential to become a new strategy in expanding the reach of Islamic banking that was more inclusive, sustainable, and in accordance with Islamic principles.

Abstract

A halal product guarantee is a legal certainty regarding the halal status of a product produced by a business entity, which is evidenced by the issuance of a halal certificate by the government. The focus of the research examines the changes in halal product guarantee regulations within the Omnibus Law using a legal politics and consumer legal protection approach. This research is normative legal research whose object of study is the history of changes to halal product guarantee regulations in the Job Creation Act and its implications for consumer legal protection. Legal and non-legal materials were obtained from document studies and literature studies in the form of academic texts, draft laws, problem inventory lists, laws and regulations related to halal product guarantees and consumer protection, journals, and other documents relevant to the research issue. Changes in halal product guarantee regulations are a strategic step to strengthen the national halal industry and increase the competitiveness of Indonesian halal products in the global market. Changes in regulations prioritizing business actors' statements as the basis for halal certification can overcome the low awareness of business actors regarding halal certification obligations. In addition, changes to halal product guarantee regulations provide legal protection for consumers through guarantees of legal certainty, both preventively and repressively through self-declaration policies by implementing special limitations, conditions, and criteria for halal certification obligations for micro and small businesses, as well as administrative sanctions. and criminal penalties for business actors who commit acts or violations that can harm consumers.
