Abstract

In the verdict of a narcotics case, the destruction of confiscated narcotics is usually one of the rulings that must be implemented. In Indonesia, the method of destroying confiscated narcotics goods that is commonly used in the execution of decisions in the form of destroying confiscated narcotics goods is by using the open burning method. However, this method of burning confiscated goods is considered to potentially violate human rights because it affects the environment and public health. This research aims to find out how human rights views on the open burning of confiscated narcotics and to determine the destruction procedure that is in accordance with human rights standards in Indonesia. The research method used in this research is socio-legal by using descriptive analytical research specifications. The research stages were carried out with secondary data library research and field research in the form of interviews with the National Narcotics Agency. Based on the results of the research, it can be concluded that the method of burning confiscated narcotics in open spaces can violate human rights. This is because the smoke from the combustion still contains high levels of dangerous narcotic substances, thus violating the right to a clean, healthy and sustainable environment. Furthermore, regarding the method of destroying confiscated narcotics that is safe for the environment and the surrounding community, namely using an incinerator. This is because incinerators do not produce smoke from combustion, so they do not pollute the environment and are not harmful to the surrounding community

Abstract

The functions of forensic autopsy in murder investigation process is to examine the victim’s body and provide definite informations about the victim’s death.  Forensic autopsy results will be used by Investigators as an evidence that can prove causal verband between the actions of the suspect and the death of the victim. But there are problems, incomplete autopsy regulation which results in uncertainty along with irregularities in the autopsy process in practice and the second problem is the autopsy function in the process of investigating the crime of murder in an effort to find and achieve material truth. Unclear and incomplete regulations related to autopsy caused unclear interpretation of the regulations regarding autopsy also differences in relation to application in investigation practice. The rule of forensic autopsy will affect the function of autopsy as the main examination standard to examines cause of death to achieve the truth of victim’s death. The renewal rule of forensic will be first step to optimize the development of forensic autopsy according to field requirements and to optimize the function of autopsy, so it will have the effect of reducing doubts on the disclosure of murder cases.

Abstract

Perkembangan teknologi di era digital telah memunculkan platform marketplace yang memberikan kemudahan dalam melakukan transaksi jual beli secara online. Keberadaan promo dalam platform marketplace memunculkan daya tarik tersendiri bagi masyarakat. Dalam praktiknya terdapat oknum yang melakukan transaksi elektronik fiktif untuk mendapatkan jumlah promo yang banyak. Kurir marketplace pengantar barang memiliki peran yang penting dalam terselesaikannya order transaksi elektronik fiktif. Perbuatan transaksi elektronik fiktif merupakan tindak pidana sebagaimana Pasal 378 KUHP dan Pasal 35 UU ITE jo. Pasal 51 Ayat (1) UU ITE. Meskipun terlibat dalam suatu tindak pidana, kenyataannya terhadap kurir tersebut tidak dilakukan penegakan hukum pidana. Penelitian ini bertujuan untuk mengkaji penegakan hukum pidana terhadap kurir marketplace pengantar barang. Penelitian ini menggunakan metode penelitian hukum untuk menjawab permasalahan. Hasil penelitian menunjukkan bahwa terdapat beberapa faktor dan hambatan yang membuat penegakan hukum pidana terhadap kurir marketplace pengantar barang yang menyelesaikan order transaksi elektronik fiktif pada akhirnya tidak dilakukan.

Abstract

Memperoleh pendampingan hukum merupakan salah satu hak yang dimiliki oleh seorang terdakwa ketika menjalani proses peradilan. Pemberian bantuan hukum kepada terdakwa selama masa pandemi Covid-19 sedikit banyak mengalami kendala. Beralihnya mekanisme pendampingan hukum selama masa Pandemi Covid-19 yang dahulu dilaksanakan tatap muka secara langsung menjadi daring menggunakan perantara alat elektronik dianggap memicu munculnya hambatan dan kendala bagi Posbakum untuk melakukan pendampingan hukum secara optimal kepada terdakwa. Berdasarkan hal tersebut, Penelitian ini dilakukan untuk mencari tahu sejauh mana peran Posbakum sebagai penyedia layanan hukum cuma-cuma di pengadilan dan efektivitas pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum kepada terdakwa selama masa Pandemi Covid-19. Penelitian dilakukan menggunakan metode yuridis empiris, sehingga permasalahan tidak hanya dilihat secara normatif, tetapi juga melihat bagaimana kenyataan yang terjadi di lapangan secara langsung. Data lapangan didapatkan melalui hasil observasi dan wawancara dengan beberapa narasumber yang memiliki keterlibatan dengan proses pemberian bantuan hukum. Hasil penelitian menunjukkan bahwa pelaksanaan pemberian bantuan hukum yang dilakukan oleh Posbakum Pengadilan Cibinong selama masa Pandemi Covid-19 belum sepenuhnya efektif karena dalam pelaksanaannya masih menemukan kendala-kendala yang menjadikan pendampingan hukum tidak dapat diberikan secara optimal, sebagai akibat dari keterbatasan interaksi dan komunikasi antara penasihat hukum dengan terdakwa dan ketiadaan sarana atau prasarana yang kurang mumpuni.

Abstract

Putusan MK No. 33/PUU-XIV/2016 menyatakan bahwa Pasal 263 ayat (1) KUHAP secara bersyarat bertentangan dengan UUD 1945 sepanjang dimaknai lain selain yang secara eksplisit tersurat dalam norma a quo. Oleh karena itu yang berhak melakukan peninjauan kembali adalah terpidana dan ahli warisnya. Jaksa Penuntut Umum tidak berwenang melakukan Peninjauan Kembali. Hal ini menimbulkan permasalahan baru bagi Jaksa Penuntut Umum yang mewakili negara dan juga korban. Penulis menganalisa Perlindungan Korban Kejahatan Untuk Mengajukan Peninjauan Kembali Pasca Putusan MK tersebut. Dalam praktik Putusan Peninjauan Kembali Nomor: 55 K/Pid/1996 yang menjadi yurisprudensi Mahkamah Agung merupakan pembaharuan hukum. Dengan adanya Putusan MK No. 33/PUU-XIV/2016 telah mengesampingkan yurisprudensi yang merupakan pembaharuan hukum dan tentunya tidak menjamin hak korban kejahatan dalam mengajukan Peninjauan Kembali yang diwakili oleh Jaksa Penuntut Umum.

Abstract

Pregnancy can be good or bad depending on the condition of the mother. Some mothers who do not want their babies choose to have illegal abortions. This has led to the proliferation of illegal abortion clinics that perform abortions not in accordance with the law. Although the law provides for some justifiable cases of abortion, there is debate about the consequences of punishing abortionists. Judges' verdicts in abortion cases often do not fulfil the purpose of punishment to provide a deterrent and corrective effect. The purpose of this research is to analyse the Case Study of Central Jakarta District Court Decision Number 1140/pid.sus/2020/Pn Jkt Pst on the act of carrying out illegal abortion in accordance with Article 75 of Law Number 36 of 2009 concerning health in relation to the purpose of punishment. This research method is a normative juridical approach. The research specifications used are descriptive analysis. The result of this research is that the Panel of Judges in this case can be considered lacking in considering the mitigating or aggravating circumstances of the defendant when compared to other cases. Consideration of judges who are less mature can lead to unclear objectives of punishment in cases of abortion. The clarity of the human rights of a foetus is questionable in this abortion case. More research and careful consideration by judges is needed to ensure fair and balanced sentencing in abortion cases.

Abstract

ABSTRAKPenolakan pengesahan RKUHP yang diangkat dalam tulisan ini terjadi karena petunjuk yang diberikan oleh Putusan Mahkamah Kostitusi Nomor 013-022/PUU-IV/2006 tidak dilaksanakan oleh DPR dan pemerintah. Permasalahan penelitian ini adalah bagaimanakah delik penghinaan presiden/wakil presiden dalam RKUHP tahun 2019 dikaitkan dengan teori kebijakan hukum pidana? Kemudian, apakah pemerintah dan DPR mempunyai argumentasi hukum yang kuat untuk melegislasikan kembali delik penghinaan presiden/wakil presiden dalam RKUHP tahun 2019, dikaitkan dengan putusan Mahkamah Konstitusi dan hak asasi manusia dalam menyampaikan pendapat. Penelitian hukum ini merupakan penelitian hukum normatif, yaitu penelitian yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Penelitian menyimpulkan bahwa pengaturan substansi yang sama dalam RKUHP dengan putusan Mahkamah Konstitusi sebelumnya yang telah menyatakan Pasal 134, Pasal 136 bis, dan Pasal 137 KUHP tidak mempunyai kekuatan hukum mengikat, dan memerintahkan untuk tidak mengatur kembali delik penghinaan terhadap presiden/wakil presiden dalam RKUHP. Pemerintah dan DPR tidak mempunyai argumentasi hukum yang kuat untuk menghidupkan kembali delik penghinaan terhadap presiden/wakil presiden. Menurut putusan Mahkamah Konstitusi, presiden dan wakil presiden tidak boleh mendapatkan perlakuan privilege hukum secara diskriminatif berbeda dengan kedudukan rakyat. Pembatasan yang dilakukan oleh negara kepada warga negaranya dalam menyampaikan pendapat harus sangat hati-hati, karena hal itu berarti negara telah membatasi hak asasi manusia dalam menyampaikan pendapat.Kata kunci: Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP); delik penghinaan presiden/wakil presiden; kritik; kontroversi.  ABSTRACT Rejection of the RKUHP rati cation raised in this paper occurred because the instructions provided by the Constitutional Court Decision Number 013-022/PUU-IV/2006 were not implemented by the DPR and the government. The problem of this research is: how is the offense of insulting the president/vice president in the 2019 RKUHP related to the theory of criminal law policy? Then, do the government and the DPR have strong legal arguments to re-legitimize the offense of insulting the president/vice president in the 2019 RKUHP, related to the Constitutional Court decision and human rights in expressing opinions. This legal research is a normative legal research, namely research conducted by examining library materials or secondary data. The research concludes that the same substance arrangement in the RKUHP with the previous Constitutional Court decisions which stated that Article 134, Article 136 bis, and Article 137 of the Criminal Code have no binding legal force, and ordered not to rearrange offenses against the president/vice president in the RKUHP. The government and the DPR do not have solid legal arguments to revive the offense against the president/vice president. According to the Constitutional Court decision, the president and vice president may not receive legitimate privilege treatment in a discriminatory way from the position of the people. The restrictions levied by the state on its citizens in expressing opinions must be very careful, because this means that the state has limited human rights in expressing opinions.Keywords: Draft of Criminal Code (RKUHP); the offense of insulting the president/vice president; criticism; controversy.

Abstract

Article 5 Paragraph (1) of Perja 15/2020 is a cumulative principle requirement. However, in certain criminal acts the three principle conditions can be distorted as in Article 5 Paragraph (2), Paragraph (3), and Paragraph (4). This study examines the current regulation of the implementation of deviations from Article 5 Paragraph (1) letter b and c of Perja 15/2020 and the enforcement of law deviations from Article 5 Paragraph (1) Letter b and c of Perja 15/2020 by the public prosecutor. The research method used is juridical normative in the form of an assessment of literature materials or secondary data. The statute approach and the case approach are the two approaches used in this study. To obtain information that supports this study, data collection techniques in the form of interviews were also used. The results showed that currently the implementation of the termination of prosecution deviates from Article 5 Paragraph (1) Letters b and c referring to Perja 15/2020.
