Abstract

Capital punishment is still exist as one of kind punishments in Indonesia. The existence of capital punishment is based on the Penal Code and other laws. On the other hand, however, according to Constitution 1945, MPR Decree Number XVII/MPR/1988 on Human Rights and Law Number 39 / 1999 on Human Rights, the right to live cannot be limited under any circumstances (non derogable). Capital punishment and the right to live as the right that cannot be limited under any circumstances (non derogable) are contradictive. This contradiction results a conflict of norm between legislations that legalize the existence of capital punishment and legislations that legalize the existence of the right to live.  Solutions should be resulted to solve the conflict of norms.

Abstract

Article 64 paragraph (1) and paragraph (2) of Law no. 1 of 2004 concerning the State Treasury, states firmly that the Treasurer and other officials who have been determined to compensate the state/regional losses in settlements with the dimensions of State Administrative Law may still be subject to administrative sanctions and/or criminal sanctions. And if the treasurer and other officials are processed under criminal law, the criminal decision does not relieve the claim for compensation that has been determined through a settlement with the dimensions of State Administrative Law. Such norms are regulated in Article 64 paragraph (1) and paragraph (2) of Law no. 1 of 2004 concerning the State Treasury, of course, has the purpose and intent (ratio legis) of the legislators. Based on research on the minutes of the discussion of the Draft Law no. 1 of 2004 concerning the State Treasury, the legislative ratio of Article 64 paragraph (1) and paragraph (2) in general is 3 (three), namely: as a form of official accountability in carrying out office functions, punishment for Treasurers and Other Officials who are detrimental to State/Regional finances, and realizing the principle of returning State/Regional losses.

Abstract

Abstract This research studies the case of unauthorized persecution done jointly and causing the death of a person in the Regency of Malang, Tumpukrenteng village, Turen. This research topic departed from the highest cases of unauthorized persecution in the area. The proscription of unauthorized persecution, however, is specified in Article 170 of the Criminal Code, while the case causing the death of a person is in Article 170 paragraph 2 of the Criminal Code. Furthermore, police have introduced the stages of the report and the report-making in case of criminal conduct or violations. This indicates that some articles governing violations of social orders and the incidence of criminal cases are irrelevant in the case of unauthorized persecution collectively done by people and causing death. This research employed empirical-juridical methods and criminological-juridical approaches. Data involved primary and secondary materials, garnered from interviews and library research, and analyzed based on descriptive-qualitative methods explaining that the data were analyzed based on the contextual theory. Keywords: Death, Jointly, Unauthorized Persecution   Abstrak Pada penelitian ini penulis akan mengangkat permasalahan terkait tindakan main hakim sendiri yang dilakukan bersama-sama dan mengakibatkan hilangnya nyawa seseorang di daerah Kabupaten Malang. Penelitian ini berfokus pada kasus main hakim sendiri yang dilakukan bersama-sama dan mengakibatkan hilangnya nyawa seseorang di desa Tumpukrenteng, Turen, Kabupaten Malang. Pilihan tema tersebut dilandasi oleh Kabupaten Malang dinobatkan sebagai provinsi dengan jumlah tertinggi atas tindakan main hakim sendiri yang mengakibatkan hilangnya nyawa seseorang diantara Provinsi Malang Raya lainnya. Aturan tentang larangan Tindakan main hakim sendiri secara tidak langsung telah diejawantahkan dalam pasal 170 KUHP, dan yang mengakibatkan hilangnya nyawa seseorang diatur dalam pasal 170 ayat 2 KUHP. Terlepas dari itu kepolisian sendiri telah melakukan sosialisasi mengenai tahap-tahap pelaporan serta pembuatan laporan apabila terjadi kejatan atau penggaran. Maka dari itu terdapat ketimpangan pasal yang sudah mengatur mengenai kejahatan terhadap ketertiban umum dengan tingginya angka kejahatan terhadap ketertiban umum yakni tindakan main hakim sendiri yang dilakukan secara bersama- sama dan sampai menghilangkan nyawa seseorang. Jenis penelitian ini adalah penelitian yuridis empiris dengan pendekatan yuridis kriminologis. Sumber data yang digunakan yaitu data primer yang didukung oleh data sekunder. Teknik pengumpulan data dilakukan dengan wawancara dan studi kepustakaan. Teknik analisis data melalui deskriptif kualitatif dengan menjelaskaskan data primer yang didapat serta dianalis menggunakan teori yang berkaitan dengan permasalahan tersebut. Abstract

This study aimed to analyze the guidelines for implementing Article 27 paragraph (3) of Electronic Transaction and Information Law and the joint decree's legal standing as guidelines for implementing the law on information and electronic transactions. This study utilized a normative juridical method with a historical approach, a conceptual approach, and a statutory approach. The implementation of Article 27 paragraph (3) of Law Number 11 of 2008 in conjunction with Law Number 19 of 2016 was based on the Decision of the Constitutional Court Number 50/PUU-VI/2008 that referred to Article 310, Article 311, and Article 315 of the Indonesian Criminal Act. Although it was not explicitly stated in Article 7 paragraph (1) of Law Number 12 of 2011 concerning the Establishment of Legislation, the joint decree as guidelines for implementing the law on information and electronic transactions had the same position and binding legal force as the laws and regulations.

Abstract

Land Deed Officials (PPATs) have an important role in ensuring the legality of land transactions, which demands high standards of integrity and public trust. However, Article 10 paragraphs (3) and (4) of Government Regulation Number 24 Year 2016 only regulates sanctions for PPATs who are sentenced to five years or more, while there is no clear regulation regarding sanctions for PPATs who are sentenced to minor criminal penalties under five years. This creates a legal vacuum that has the potential to undermine public confidence in the PPAT profession and the land law system in Indonesia. This study aims to analyze the feasibility of PPATs who are sentenced to minor criminal penalties to return to office, as well as recommend revisions to regulations to fill the legal vacuum. The research method used is normative juridical with a statutory and conceptual approach, and uses primary and secondary legal materials. The results show that PPATs who have criminal records, even if they are minor, find it difficult to regain public trust and potentially tarnish the integrity of the profession. Therefore, a revision of regulations is needed to establish strict sanctions and maintain morality standards and public trust in the PPAT profession.

Abstract

This study aims to discuss the urgency of regulating euthanasia in Indonesia. This study uses a type of normative legal research using research methods on laws and regulations, conceptual approaches and comparative legal approaches. The results of this study show that various arrangements for euthanasia in Indonesia are very embraced, to realize laws and regulations, not only in the field of criminal law, but also regulated in health law about euthanasia in accordance with the circumstances and situations that will occur in the future

Abstract

Appraisal service companies are entities tasked with determining the true value of wealth or property for various trade transaction purposes, but they currently face a range of economic and legal challenges. This study analyses the appraisal team's principles of justice and legal responsibility in setting the minimum bid value for auctioned collateral. Employing a normative legal research method, this research draws on statutory, conceptual and case approaches supported by primary legal material. The findings show that the appraisal team is legally responsible for the values they determine for collateral auctions, with the liability encompassing three main areas, including civil liability. If the team is proven to have violated the provisions of the auction as mentioned in PMK Number 228 / PMK.01 / 2019 concerning Public Appraisers, they may face administrative sanctions, such as written warnings, restrictions on certain appraisal services, suspension of permits, or permit revocation. Furthermore, the Government has provided legal protection to auction buyers with good faith who participate in auctions in compliance with applicable regulations. Fairness must be achieved and upheld through just procedures to ensure fair results, giving all parties equal standing and rights in the auction process.

Abstract

State losses due to corruption are certainly detrimental to the country's economy. However, law enforcement against corruption crimes must still go through applicable legal procedures. Prosecutors do not have rules that specifically allow them to calculate and determine state losses. The research used is normative juridical. The research approach used is through legislation and cases. Based on Decision Number: 69 K/Pid-Sus/2013, it shows that the legal consequences of the calculation of state losses carried out by the prosecutor are the non-fulfillment of the element of harm to state finances or the non-fulfillment of formal requirements in terms of calculating state losses because it is not based on the calculation of institutions that have the authority and competence related to this matter, namely BPK or BPKP. The prosecutor in this case has violated the principle of legal certainty because it is out of the corridor of the applicable positive law.

Abstract

General Background: Corruption is an extraordinary crime requiring effective legal measures. Specific Background: In Indonesia, accomplices in corruption crimes receive the same punishment as principal offenders, raising concerns about fairness. Knowledge Gap: Current laws do not differentiate culpability levels, leading to potential injustices. Aims: This study examines the proportionality of sentencing norms for accomplices in corruption cases. Results: Findings show that equal sentencing contradicts proportional justice and creates legal inconsistencies. Novelty: The study highlights conflicts between the Anti-Corruption Law and the Criminal Code, advocating for reform. Implications: Policy adjustments are needed to align sentencing with justice principles, ensuring fairness in anti-corruption enforcement. Highlights: Unequal Punishment: Accomplices receive the same sentence as principal offenders, raising fairness concerns. Legal Inconsistency: The Anti-Corruption Law conflicts with the Indonesian Criminal Code on culpability. Abstract

This study aims to analyze the formulation of legal regulation for the criminalization of LGBT sexual behaviour in Indonesia through the perspectives of Maqashid Syari'ah and Utilitarianism. In a country with a Muslim-majority population, the LGBT phenomenon frequently raises a conflict between human rights protection and religious values. Using a normative juridical approach, this study examines legislation, legal theories, and relevant secondary data. Findings indicate that there is no explicit national regulation criminalizing LGBT behaviour. The Maqashid Syari'ah perspective emphasizes the protection of five fundamental principles: religion, life, intellect, lineage, and property. Meanwhile, Jeremy Bentham's Utilitarianism asserts that legal policy should maximize societal benefit. The study concludes that integrating these two approaches provides a balanced foundation for criminal policy formulation that upholds moral values and public interest without compromising justice and human rights.
