Abstract

Currently the country is trying to improve Human Resources (HR) on a large scale, especially in Indonesia to advance the nation, but the high rate of early marriage has an impact on the progress of the younger generation where marriages that are held without careful preparation both from the economy, education, psychology and sociology also have an impact on the next generation born and personal and social development in society also occurs unprepared. Law No. 1 of 1974 Jo Law No. 16 of 2019 About was passed by the government as an effort to prevent early marriage by limiting the minimum age of 19 years for men and women. The purpose of this research is to find out what factors cause the application for marriage dispensation and obstacles in the application for marriage dispensation in religious courts and what steps are used in the event of rejection of the application. The method used The data collection method used in this research is an empirical juridical review by conducting observations, comparisons and interviews with sources from the Religious Court and informants who apply for marriage dispensation. Causes for advocating marriage dispensation include religious reasons, special circumstances, parental/guardian consent, legal considerations. In the implementation of the application for marriage dispensation, there are also obstacles, namely the difficulty of completing data. In the event of rejection of the application for marriage dispensation, the applicant can make cassation.

Abstract

This study aimed to determine the right fulfillment of non-Muslim residents regarding the implementation of Islamic Sharia in Aceh Province, Indonesia. It was a non-doctrinal legal study conducted in Banda Aceh City, Singkil, and Takengon. The primary data was obtained from the completion of questionnaires and interviews with non-Muslim religious leaders to supplement the required information, as well as secondary data, which consisted of various legal materials. The sample was selectedusing non-random purposive sampling, while data analysis was conducted quantitatively and qualitatively. The results based on the analysis of 244 questionnaires showed that the perception of non-Muslim residents regarding the implementation of Islamic Sharia in Aceh tends to be positive. Furthermore, the number of residents who were worried before and after the implementation of Islamic Sharia in Aceh decreased significantly from 29.5% to 9.4%. The guarantee of fulfilling the rights of non-Muslim residents can be compared to zimmi, as recognized in Islamic terminology. This comparison assumed that non-Muslim residents were within a jurisdiction and did not oppose the Islamic principles applied by a governance system.

Abstract

This article aimed to observe the criminal provisions both in the Formulation of the EIT ACT 2008 along with the verdict of the judicial review of the Constitutional Court Number 50/PUU-VI/2008 as well as the EIT ACT  2016 especially in strictly contained in article 27 along with the norm of the criminal sanctions contained in Article 45 can still be said to be a ”Rubber Articles”, so it requires linguist and religious leaders in order to get a description or explanation of a remark or action in conflict with religious values and modesty as well as decency in public life. The Guarantee Of Freedom Of Speech. Then when viewed from the highest norm of the 1945 Constitution to the level of the law that is Article "Number 9 of 1998 and Article Number 39 of 1999 there is a harmony of norms and limits of freedom of speech that is the norms and values of religion, morality, public order, public interest and the integrity of the State, the concept of punishment against the actions of cyberbullying in social media in the future require an integral approach and the concept approach is criminal on parole and penal mediation with the terms limitedly and imperative.

Abstract

The purpose of this study is to determine whether there are implications of expanding the authority of the pretrial post-verdict judicial review of Constitutional Court in deciding whether it is a valid determination of the suspect against law enforcement and the protection of the rights of the suspect. This research belongs to normative research. The results of this study explain that the interpretation method used in pretrial decision  No:04/Pid.Prap/2015/PN.Jak.Sel is the method of discovery of analogy interpretation law (argumentum per analogiam) is wrong, while the legal interpretation method used in the judicial review judgment of the Constitutional Court of the Republic of Indonesia Number 21 / PUU-XII / 2014 is the historical interpretation method (historiche intepretatie) the problem namely, the Constitutional Court has exceeded its original function that is negative legislator became positive legislators form or add a new norm. So that raises the problem that is contrary to the principles of the criminal justice system that is the principle of quick and simple and low budget justice and the principle of litis finiri oportet also inhibits the process of law enforcement settlement.

Abstract

AbstractThe purpose of this scientific writing was to determine and analyze the model of settlement of divorce cases through ishlah in the Religious Courts and to determine the level of success and failure of the settlement of divorce cases through ishlah in the Religious Courts. The research method includes the type of empirical research/socio legal research, while the approach used is a socio legal approach (socio legal approach). The results of this study are that there are several models of settlement of divorce cases through ishlah in the Religious Courts such as; Settlement Mediation, Facilitative Mediation, Evaluative Mediation and Transformative Mediation and also related to the success rate of mediation for divorce cases at the Selong Religious Court and the Taliwang Religious Court is still very low because there are still many mediator judges in the Religious Courts who are not certified so they do not have skills in in seeking peace for the parties, in addition to the inadequate facilities and infrastructure and not having long-distance audiovisual equipment.AbstrakTujuan penulisan ilmiah ini adalah untuk mengetahui dan menganalisis model penyelesaian perkara perceraian melalui ishlah di Pengadilan Agama dan untuk mengetahui tingkat keberhasilan dan kegagalan penyelesaian perkara perceraian melalui ishlah di Pengadilan Agama. Metode penelitian meliputi tipe penelitian empiris/socio legal research,sedangkan pendekatan yang digunakan adalah pendekatan socio legal (socio legal approach). Hasil dari penelitian ini adalah bahwa ada beberapa model penyelesaian perkara perceraian melalui ishlah di Pengadilan Agama seperti; Settlement Mediation, Facilitative Mediation, Evaluative Mediation dan Transformative Mediation dan juga terkait dengan tingkat keberhasilan mediasi perkara perceraian di Pengadilan Agama Selong dan Pengadilan Agama Taliwang masih rendah sekali karena masih banyak hakim mediator yang ada di Pengadilan Agama tersebut yang belum bersertifikat sehingga tidak memiliki skill di dalam mengupayakan perdamaian bagi para pihak, disamping faktor sarana dan prasarananya yang belum memadai serta tidak memiliki audio visual jarak jauh.
