Abstract

Dalam pelaksanaan tanggung jawab sosial perusahaan di Kota Bima, tujuan penelitian adalah untuk mengetahui tanggungjawab sosial perusahaan di Kota Bima. Jenis penelitian adalah Penelitian hukum empiris, dengan pendekatan yang digunakan, yakni pendekatan perundang-undangan, pendekatan sosiologi, dan pendekatan perbandingan. Hasil penelitian ini menunjukan bahwa BUMN/BUMD untuk melaksanakan kegiatan tanggung jawab sosial perusahaan dalam berbagai bentuk yang ada. Saat ini tanggung jawab sosial perusahaan di Kota Bima telah memiliki instrumen hukum yang kuat dalam bentuk Peraturan Daerah yang mengatur mengenai Tanggung Jawab Sosial Perusahaan sebagai sebuah acuan untuk menjawab semua permasalahan, perkembangan, dan kebutuhan hukum terkait pelaksanaan tanggung jawab sosial perusahaan di Kota Bima

Abstract

Progam Pengabdian kepada masyarakat ini yakni Pemberdayaan Kemitraan Masyarakat (PKM) : Pengelolaan Sampah Berkelanjutan Dalam Mendukung Sustainable Development Goals (SDGs) bertujuan untuk menerapkan sistem pengelolaan dan manajemen sampah berkelanjutan berbasis teknologi tepat guna di Desa Kaboro, Kecamatan Lambitu, Kota Bima. Melalui pendekatan partisipatif, kegiatan ini melibatkan mitra sasaran yang terdiri atas Badan usaha Milik Desa (BUMDES) dan Pemerintahan Desa Kaboro dalam proses edukasi, perancangan, dan implementasi alat pengelola sampah, seperti mesin pencacah dan tungku pemanas plastik sebagai bentuk pengelolaan sampah berkelanjutan. Hasil kegiatan menunjukkan peningkatan kesadaran masyarakat terhadap pentingnya pengelolaan sampah, serta kemampuan warga dalam mengoperasikan alat secara mandiri setelah pelatihan. Program ini berkontribusi pada pemberdayaan komunitas, dan pencapaian Tujuan Pembangunan Berkelanjutan (TPB/SDGs) di tingkat lokal. Kegiatan ini juga menunjukkan bahwa integrasi teknologi sederhana dengan kearifan lokal dapat menjadi solusi nyata dalam pengelolaan sampah plastik.

Abstract

This study examines the legal construction of employment agreements between security service provider companies and commercial banks within the framework of Indonesian labor law and banking law. The complexity of this legal relationship stems from the fact that security personnel assigned to bank premises are administratively bound to the provider company, yet operationally supervised by and directly serving the interests of the bank, thereby generating a triangular employment pattern that risks blurring the boundaries of legal responsibility among the three parties involved. Employing normative legal research through statutory, conceptual, and case approaches, this study systematically analyzes the validity of outsourcing employment agreements, the mechanisms of legal protection afforded to security workers, the prudential principles mandated for banks under Financial Services Authority Regulation Number 9/POJK.03/2016, and the institutional implications arising from cross-sectoral supervision involving the Ministry of Manpower, the Financial Services Authority, and the Indonesian National Police as the technical supervisor of security service business entities. The findings indicate that although Law Number 11 of 2020 concerning Job Creation and Government Regulation Number 35 of 2021 have clarified the responsibilities of outsourcing companies, these provisions have not fully accommodated the distinctive characteristics of the banking sector, which demands heightened security standards and layered supervision, leaving normative gaps that permit overlapping accountability and inadequate protection of security workers' rights. The novelty of this research lies in its simultaneous integration of labor law, banking law, and police regulatory law, a cross-regime approach seldom found in prior literature that has generally addressed outsourcing issues in a partial manner confined to labor law alone. The study concludes by recommending strengthened technical regulation through standardized tripartite cooperation agreement guidelines, harmonized cross-institutional supervision, and an explicit assertion of joint liability on the part of banks as the ultimate users of security services to close the persisting protection gap experienced by banking security personnel.

Abstract

This study examines the legal protection of inheritance rights for childless wives whose husbands have passed away in Lambu Subdistrict. This study was conducted because there remains a discrepancy between the provisions of Islamic inheritance law and the actual practice of inheritance distribution in the community. The methods used were empirical legal research with a sociological approach and a case study approach. The results of the study indicate that the distribution of inheritance is still influenced by customs, family traditions and the dominance of the husband’s family, resulting in the wife’s rights often not being fulfilled fairly. Legal protection for the wife has not been optimally implemented due to the community’s limited understanding of the law and the weak enforcement of legal provisions in the practice of inheritance distribution within the community.

Abstract

The purpose of this research is first to describe the arrangement of criminal liability for business actors for iron sand mining activities which result in environmental damage; second, to describe the form of criminal responsibility of business actors for iron sand mining activities which result in environmental damage. Empirical legal research methods (non-doctrinal), case and policy approaches, using data collection, documentation, observation, and interviews and integrating with literature review of legal documents relevant to the object under study, and analyzed descriptively. The results of the study show, First, legal arrangements for criminal acts of environmental pollution committed by business actors, can be seen in Article 98, Article 99, Article 100, Article 101, Article 104, Article 105, and Article 112 of Law Number 32 of 2009 concerning Protection and Management of the Environment (UUPPLH) can be imposed on individuals, corporations, and authorized officials. Furthermore, accountability for criminal acts of environmental pollution as ultimum remedium is the last legal remedy where the goal is to punish the perpetrators in the form of imprisonment. In enforcing environmental criminal law through four stages namely investigation, prosecution, examination, and execution. In article 94 of the UUPPLH the investigators are Republic of Indonesia Police Officers and Civil Servant Officials, in article 96 evidence, the validity of evidence is witness testimony, expert testimony, letters, certain instructions, statements from the accused, as well as other evidence including evidence which is regulated in laws and regulations. Second, Forms of Corporate Criminal Liability Against Iron Sand Mining Activities Causing Environmental Damage. In the form of absolute liability (strict liability), however, based on Article 88 of the Law, absolute liability or (strict liability) is only limited to the obligation to pay compensation in the event of a civil lawsuit, on the other hand, criminal liability adhered to by the Law Number 32 of 2009 concerning Environmental Protection and Management still adheres to the principle of error.
