Abstract

The Democratic Rule of Law adopted by Indonesia manifests Article 1 paragraph (2) and Article 1 paragraph (3) of the 1945 Constitution. This requires the public's role as the holder of supreme sovereignty in national and state life in various fields. Public participation has been practically implemented and guaranteed in statutory regulations. However, public participation is still interpreted as just a formality by stakeholders, so this causes harm to the policies implemented for the public and weakens the legitimacy of the owner of the highest sovereignty, namely the people. Constitutional Court Decision Number 91/PUU-XVIII/2020 is considered a landmark decision in strengthening people's sovereignty by encouraging meaningful participation in forming statutory regulations. This decision also triggers meaningful public participation in various areas of national life and patriotism. Through a doctrinal approach, this study intends to elucidate the relationship between Meaningful Participation and the concept of a Democratic Rule of Law, as well as efforts to implement and protect meaningful public participation in state practice. The research results concludes that meaningful participation is a form of popular sovereignty to realize a substantive democratic rule of law. Public participation is important for formulating, implementing, and evaluating policies formed together with the state. Soon, Formal guidelines are needed to realize Meaningful Participation as a follow-up to Constitutional Court Decision No. 91/PUU-XVIII/2020.Keywords: Democracy, People's Sovereignty, Public Participation, Rule of Law. AbstrakNegara Hukum berbasis Demokrasi yang dianut Indonesia terwujud dalam Pasal 1 ayat (2) dan Pasal 1 ayat (3) UUD 1945. Hal ini mensyaratkan peran serta masyarakat sebagai pemegang kedaulatan tertinggi dalam kehidupan berbangsa dan bernegara di berbagai bidang. Partisipasi masyarakat secara praktis telah terimplementasi dan terjamin dalam peraturan perundang-undangan. Akan tetapi, partisipasi masyarakat masih dimaknai hanya sebagai formalitas belaka oleh para pemangku kepentingan, sehingga hal ini menimbulkan kerugian bagi kebijakan yang dijalankan untuk masyarakat dan melemahkan legitimasi pemilik kedaulatan tertinggi, yaitu rakyat. Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 dinilai sebagai keputusan penting dalam memperkuat kedaulatan rakyat dengan mendorong partisipasi yang bermakna dalam pembentukan peraturan perundang-undangan. Putusan ini juga memicu partisipasi masyarakat yang bermakna dalam berbagai bidang kehidupan berbangsa dan bernegara serta menumbuhkan rasa cinta tanah air. Dengan menggunakan pendekatan doktrinal, penelitian ini bermaksud menguraikan hubungan antara Partisipasi yang Bermakna dengan konsep Negara Hukum berbasis Demokrasi, serta upaya penerapan dan perlindungan partisipasi masyarakat yang bermakna dalam praktik bernegara. Hasil penelitian menyimpulkan bahwa partisipasi yang bermakna merupakan salah satu bentuk kedaulatan rakyat untuk mewujudkan negara hukum yang demokratis dan substantif. Partisipasi publik penting untuk merumuskan, melaksanakan, dan mengevaluasi kebijakan yang dibentuk bersama negara. Dalam waktu dekat, diperlukan pedoman formal untuk mewujudkan Partisipasi yang Bermakna sebagai tindak lanjut Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020.Kata kunci: Demokrasi, Kedaulatan Rakyat, Negara Hukum, Partisipasi Masyarakat.

Abstract

Abstract: Political education plays a crucial role in strengthening the quality of democracy and increasing public participation in Indonesia’s 2024 Simultaneous Regional Elections. Through political education, citizens can gain a comprehensive understanding of their rights and obligations, enabling them to exercise their voting rights wisely, rationally, and responsibly. This study employs a normative legal research method using statutory, conceptual, and historical approaches to examine the importance of political education and the role of political parties in promoting political awareness among citizens. The findings indicate that political education significantly helps prevent money politics, reduce social conflict, and strengthen the legitimacy of election results. Moreover, continuous political education contributes to producing regional leaders with integrity and fostering democratic, transparent, and accountable governance.Keywords: Political Education, Public Participation, Regional Elections 2024.

Abstract

In a democratic system, opposition plays a vital role in providing checks and ensuring that the government operates in alignment with the public interest. However, within the context of Indonesia, opposition is often viewed as a taboo, seen as conflicting with the values of Pancasila and the familial principles that define Indonesian society. This article explores the historical development of opposition in Indonesian democracy and the role of checks and balances within the framework of the trias politica, as part of the broader effort to advance democratization in Indonesia. Employing a socio-legal approach, the study examines Indonesian democracy from theoretical, historical, and practical perspectives. It concludes that the evolution of Indonesian democracy cannot be separated from the post-independence ideological debate between proponents of integralism and those advocating for social democracy. This debate ultimately gave rise to the concept of a “family state,” where the state acts as a father figure and the citizens as children. The Reformasi era marked a transitional phase toward democratization, introducing constitutional liberalism alongside the principles of checks and balances and the trias politica. However, these democratic instruments have not been effectively implemented. Indonesia remains entangled in political party cartelization, reinforced by a system of coalition presidentialism and supported by Constitutional Court decisions that emphasize strengthening the presidential system and simplifying the party structure. As a result, political parties in the legislature tend to focus more on positioning themselves for the next presidential election and securing roles within the governing coalition, rather than engaging in meaningful oversight of government actions.

Abstract

Elections are a fundamental instrument for realizing popular sovereignty and represent a central pillar of democracy in Indonesia. As a mechanism that ensures the peaceful transfer of power, elections play a crucial role in strengthening governmental legitimacy, promoting accountability, and providing equal political participation opportunities for all citizens. However, the electoral process continues to face significant challenges, including widespread vote-buying, digital disinformation, low voter literacy, and weak law enforcement against electoral violations. These issues highlight the urgency of evaluating the effectiveness of elections as the foundation of Indonesian democracy. This study employs a normative legal research method using statutory, conceptual, and doctrinal approaches to examine the legal framework, principles, and practices governing elections. The results indicate that although Indonesia’s electoral regulations are relatively comprehensive, their implementation faces structural, technical, and cultural obstacles that undermine democratic quality. Strengthening electoral institutions, improving civic political education, and reforming the enforcement of electoral law are essential to ensuring that elections truly function as a cornerstone of democracy.Keywords: Election, Democracy, Law Enforcement

Abstract

Konstitusionalitas kesatuan pemilu diatur dengan berbagai regulasi yang berbeda antara pemilu dan pemilihan. Implikasinya terhadap sistem penegakan hukum, tidak sebatas tataran teknis saja, namun juga substantif seperti perbedaan norma formil dan materilnya, tata acara dan jenjang upaya hukumnya, dan kelembagaan penegak hukumnya. Menggunakan metodologi penelitian hukum normatif, artikel ini menelaah efektivitas penegakan hukum pemilu eksisting terhadap beberapa preseden kasus, melalui pendekatan regulasi, konseptual, dan putusan. Hasil telaah menyimpulkan perlu dilakukan penataan terhadap sistem penegakan hukum pemilu. Keragaman regulasi yang tidak spesifik membatasi norma dan kompetensi antarlembaga, berdampak kepada inkonsistensi penafsiran dan penerapan regulasi oleh lembaga penegak hukum pemilu. Akibatnya, sistem penegakan hukum pemilu dan pemilihan tidak berjalan secara efektif. Sehingga perlu dilakukan penataan yang sejalan dengan konstitusionalitas kesatuan pemilu: penyatuan sistem penegakan hukum pemilu dengan penyamaan terhadap norma dan kelembagaan.
