Abstract

Hukum Islam di Indonesia terus mengalami perkembangan yang dinamis sebagai respons terhadap perubahan sosial, budaya, politik, dan teknologi dalam masyarakat. Penelitian ini bertujuan untuk mengkaji perkembangan dan pembaruan hukum Islam di Indonesia dengan fokus pada sejarah perkembangannya, bentuk-bentuk pembaruan, serta faktor-faktor yang mendorong terjadinya transformasi tersebut. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan melalui analisis berbagai sumber ilmiah seperti buku, jurnal, dan dokumen hukum yang relevan. Analisis data dilakukan dengan teknik deskriptif-analitis untuk mengidentifikasi pola perkembangan hukum serta adaptasi kontekstual hukum Islam di Indonesia. Hasil penelitian menunjukkan bahwa pembaruan hukum Islam terjadi melalui kodifikasi, lembaga fatwa, ijtihad kolektif, serta pendekatan maqashid al-syariah yang menekankan kemaslahatan umat. Selain itu, perkembangan hukum Islam dipengaruhi oleh perubahan sosial, kemajuan teknologi, globalisasi, pluralisme hukum, dan kebutuhan kepastian hukum bagi umat Islam. Penelitian ini menyimpulkan bahwa hukum Islam di Indonesia bersifat dinamis dan terus berkembang untuk tetap relevan dalam menjawab persoalan kontemporer tanpa meninggalkan prinsip dasar ajaran Islam.

Abstract

Halal food and beverages constitute a central element of Muslim life, yet contemporary discussion often separates Qur'anic norms, the tayyib principle, health and safety considerations, and modern halal assurance. This study aimed to integrate these dimensions and clarify their practical relevance. A qualitative library-research design was employed using a normative-theological perspective and thematic content analysis. Primary textual data were drawn from Q.S. Al-Ma'idah 5:3-4 and Q.S. Al-Baqarah 2:168, while supporting materials comprised peer-reviewed studies and Indonesian halal regulations published mainly within the last decade. The analysis generated four interrelated dimensions: normative lawfulness, tayyib quality, process integrity, and ethical-spiritual orientation. The findings showed that halal consumption could not be reduced to the absence of prohibited ingredients; it also required attention to lawful acquisition, cleanliness, safety, quality, traceability, and responsible consumption. Contemporary certification and supply-chain assurance therefore functioned as institutional mechanisms for translating Qur'anic norms into complex food systems. The study concluded that an integrated halal-tayyib framework provided a more comprehensive basis for Muslim consumption than a purely label-based approach

Abstract

Hajj and Umrah were examined as forms of Islamic worship in which legal, spiritual, social, and contemporary institutional dimensions intersected. This study investigated their legal foundations, conditions of obligation, pillars, essential duties, procedures, and selected contemporary issues from an Islamic jurisprudential perspective. A qualitative library-research design with descriptive, analytical, and comparative approaches was employed. The analysis drew on the Qur'an, hadith, authoritative fiqh works, official pilgrimage guidance, Indonesian regulations, and traceable peer-reviewed studies, particularly recent literature on pilgrimage management and health-related istitha'ah. The findings showed that the obligation of Hajj for Muslims possessing istitha'ah was established by consensus, whereas the legal status of Umrah remained subject to recognized juristic disagreement. Contemporary issues involving proxy Hajj, women's travel without a mahram, health eligibility, and pilgrimage governance required an integration of classical legal reasoning, considerations of safety and welfare, and modern institutional evidence. The study demonstrated that combining doctrinal fiqh, cross-madhhab comparison, and verifiable contemporary sources produced a more precise and context-sensitive account of Hajj and Umrah
